Section 42

The Sikkim Anti Drugs Act,2006State Act of Sikkim · Act 2 of 2006

(1) Subject to the other provisions of this Act, the Government may, by notification in the Official Gazette, make rules for carrying out the purposes of this Act.

(2) In particular and without prejudice to the generality of foregoing power, such rules may provide for the matters for effective implementation of the provisions of this Act wherever necessary.

(3) Every rule made by the Government under this Act shall be laid, as soon as may be after it is made, before the Legislature of the State.

(4) *19 The State Government may also make such other rules for the purpose of carrying out such other activities which are ancillary to and related to the object of this Act.

*20 Power to Make regulation 42A Subject to the provisions of this Act and the rules made thereunder, the State Government, may by notification, make regulation prescribing the constitution of organization or authority or body, as the case may be, for dealing with and carrying such activities which are ancillary to and or related to the object of the Act.

Power to remove difficulties

43. If any difficulty arises in giving effect to the purposes of this Act, the State Government may take steps or issue such orders not inconsistent with the provisions of this Act as may appear to it to be necessary or expedient for the purpose of removing such difficulty:

Provided that no such order shall be made after the expiry of a period of two years form the date of commencement of this Act.

Saving of other laws 44 .

The provisions of this Act shall be in addition to, and not in derogation of, any other law for the time being in force regulating any of the matters dealt with in this Act.
