Whereas it is expedient to make provisions 1or lncenlives iortiny, small scale, m€dium scale and large scale lndustries set up within the stale ol Sikkim.

Be it enacted by the LeOislature of Sikkirn in the Fifty'first Year of the Repubiic oi india as

1. {1) This Act ma, be called The Sikkim lnCustrial Promotion and lncentive Act, 2000.

(2) ltshal. cone i'llo force al o1ce.

2. This Act shall be applicable 10 all industrial units exisling on the date oi commencement of this Act and also the industrial unit as may be set up alter the commencement of this A.t. Notwithstanding anything contained herein the lnduslries set up prior to commencement of lhis Act and enjoyed banefils, concessions, incer',lives or some other package of subsidies etc.

for a period of Jive years under any NotiJicalion or Rules or Orders or Schemes etc. sha I noi be eLigibLe for any benefits under this Act.

3. ln th's Act unress l1e conlext otherw'se requ res :'

(a) 'Artisan and tiny units, Smallscale Units and Mediulm/Larde scale Units" mean an lndustrial Unit as defined by the Government oi lndia from time to tlme and includes co_operative industl'ial units;

(b) "Capital" means the tolal investment of money on tangible assets like building, etc. and intangible assots like good Wlli

(e) "Company" means a unil registerec un0er the provrsron of the law relating to regiskaljon oi Compan es lor the lime being in force n tho State:

'Co"operative Society" rneans any Co-operative industflal unit registered under the Sikkim Co"operative Socieiy Act, 1978;

pLant and machineries and other capitaL goods;

"Partnership Firm" rheans a unit tormed by two or more persons;

"Proprietorship" means a uoit owned by a single person;

"Small Scale lnduslry" rneans !vhere the lnvestmenl in fixed assets in plant and machineries, (i.e. excluding the cosl ol land, building, etc.) whether heLd on ownership terms or on lease or on hire purchase, not exceeding 1OO lakhs;

"Working Capital" means that componenl of lund loan which is required for meetjng up the expenditLrre on day-lp-day operat on ot a unit including cosl of inventories, raw rnateria s, componenl works in progress and operative expenses like wages, sa aries, po!!er cl'aroes ald olner re,:.rr11g expeTses:

'Working Capaital Loan" rneons a loan required for acouis tion ' cu rrent assets for nreeting day to day requirements oi an ndusl.ial unit lor con'rpleling lhe operatton cyc e and include cash creditand over drafi facilities and any ottter sho.t lerm loan reqduired by the induslrial unit;

7. lndLrstiral units eiiher small or large set up within the territory of State oi Sikkim shall enjoy a price prelerence to the extent oi '15o/o over the rates of price quoted for same product having same or equrvalent quality broughl from outside the slaie.

9. lndustrial!nit shall be exempted irom payment of securiiy deposit and or earnest monoy in respect ol tenders or quotations for pur;hase of stores by Government Department,

10. The industrial unit shall obtain lndian Standard lnslitule/lnternational Stanoard Organisatio4 Cenil;caLe in resDect of il'e;r orodlrcts to compele al the state and national level and to ensure product quality and for such the State Government shall reimburse 100% ot the expenditure incurred on the !'egistration fees, testing fees, annual license fees, purchase of lestlng equipment provided the maximum amount payabl€ by way ol reimbursemeni shall nol exc€ed Rs.25,000.00 1 1 . The amount spent by hn industrial unit ln obtaining a .egistraiion with Promotion Council, lndian Slandald lnstitution, Commodity Board, Chamber of Commeice, etc. shali be.eimbursed to the unit,6Llbjeotto a maximum of Rs. 1O,OOO.Oo (Rupees ten thousand) or the actual registration iee, whichever is less.

12. Exemption under Notification No. 2/TlC dated the 1 6th February, 1 974 wi'. cortinLe, '13 (11 Tre oe lelils, concess,ons or exeoplions as conlerreo bnder this Acr ;hall oe ior sucn period as may be noti{,ed oy lhe sanctloning aulhorrty.

(2) The sanctioning authority may with the approval ol the Government irom lime to time, nouiy such addilional beneiils. concessions or exernptions apPlicable to indushialunits as may be considered desirable

14. li any dilficulty arises in giving eftect to the provisions of lhis Act the Government may by order not in consistent with the provisions of thls Aci, remove sLcl^ d ii'c,lll es.

AIlthe notifications, orders, lnskuctions, circulars, schemes etc issued irorn time to time for the purpose of extending beneiits/ihcentives/concessions to induslry both tiny, small scale or medium/large scale industry are hereby repealed.

1 . (1) This Act may be called ih6 Sikkim tndlsklal promotion a.d lnconlive (Amendment) Act, 2003.

(2) lt saall come into torce at once.

2. ln the Sikkim lndustrial Promotion and lncentive Aci,2OOO, {horeinafter referred to as th€ said Act), section 2 shalt bo ronuhborod as sub-section (1) oj that seclion and in sub.sectlon (1) as so r6number€d, tor the word ,Uve,, lhe word s'len" shallb6 sub6titutedand atle I s ub-s€cijon (1) as so r6numb6red, tho folowing sub-sections shall be.inssrtod, namely:- "(2) Tho Scheme will also be appticable to existing unils in cas€ o, div6rsification,' modernization and expansion."

The units whioh have taken up expansion/divorsification/modernization plan prior to comang inio torce ol th s poiicy should intimate lhe concerned agency within three monlhs from lho dale ol implementation ol the poLicy".

(5) Thors shall be a Committee constituted under lhe Sch€me conslsting oi the Minister InduslrieE with secrotary, lndustries, Secretary, Finance and Direclor, lndustries as m€mbers who shall sanction subsrdies inconlive between Rs.
