SIKKIM GOVERNMENT GAZETTE EXTRAORDINARY PUBLISHED BY AUTHORITY Gangtok Thursday T" September, 2017 No. 402 LOKAYUKTA SIKKIM GANGTOK No: 07/LOK/2017 Dated: 25/04/2017 NOTIFICATION in exercise of the powers conferred by sub-section (i) of Section 43 of the Sikkim Lokayukta Act, 2014, the Lokayukta of Sikkim hereby makes the following conditions of service of staff and oificers of the Lokayukta, namely:- Short title and commencement
1. (1) These rules may be called the Sikkim Lokayukta Employees Conditions of Service Rules, 2017,
(2) It shall be deemed to have come into force with effect from 27'h February, 2014, Conditions of service 2. (1) The employee, l.e. stati and officers, posted with the Lokayukta Sikkim on being transferred from the State Government to the L.okayukta Sikkim, will continue to be dealt as per the service rules governing their conditions of service and other entitlement, as was applicable, prior to their transfer to l.okayukta.
(2) The employees i.e. staff and officers, appointed in the Lokayukta who are retired/re-employed shall not hold the ornce beyond the age of 70 years. '
(3) The conditions of service of employees in the Lokayukta shall not be varied to their disadvantage during the period of their service.
(4) Where an otficer' of the Lokayukta was performing or performs any functions or duties under the State Government, the concurrence of the Lokayukta shall always be deemed to exist until further order.
(5) These conditions of service would be supplemented or amended as may be necessary through issue of notifications from time to time it so required.

Power of th9 3. (1 ) The Chairperson of the Lokayukta Sikkim, shall be the final authority Chairperson in theLokayukta to take any decision or pass such order as may be considerea appropriate in respect of any disciplinary matter of the employees in the Lokayukta.
(2) The Chairperson of the Lokayukta shall bo the final authority to deal with all the question involving any grievance of any employee of the Lokayukta.
(3) The Chairperson of the Lokayukta may pass such order as may be deemed tit in respect of service of any employee of the Lokayukta.
(4) The Chairperson of the Lokayukta may direct any senior onicers of the Lokayukia to do or perform such duties as may be considered appropriate.
Power to relax 4. (1 ) The Chairperson of the Lokayukta Sikkim, may in deserving cases relax any of the Conditions of Service.

SIKKIM GOVERNMENT GAZETTE EXTRAORDINARY PUBLISHED BY AUTHORITY Gangtok Tuesday 28th August, 2018 No. 445 LOKAYUKTA SIKKIM GANGTOK No: 73/LOKISKM/2018 Dated:- 06.08.2018 NOTIFICATION In exercise of the powers conferred by sub-section (i) of Section 43 of the Sikkim Lokayukta Act, 2014 (6 of 2014), the Lokayukta of Sikkim hereby makes the following rules to amend the Sikkim Lokayukta Employees Conditions of Service Rules, 2017, namely:- Short title and 1. (1) These rules may be called the Sikkim Lokayukta Employees commencement Conditions of Service (Amendment) Rules, 2018.
(2) They shall be deemed to have come into force on the 27th day of February, 2014.
Amendment In the Sikkim Lokayukta Employees Conditions of Service Rules, ofrule 2 2017, in rule 2, after sub-rule (5), the following sub-rules shall be inserted, namely:- "(6) The staff and officers working in the Lokayukta, Sikkim shall be eligible to receive the same salary, allowances and other entitlements as are applicable to equivalent staff and officers working in the State Government.
(7) The retired/re-employed staff and officers shall also be eligible to receive the same salary allowances and other entitlements as are applicable to the equivalent staff and officers working in the State Government, minus the pension, subject to pay revision from time to time."
