(3) Cbilstitki:ion.—A fund shall be creattd called "The Small Industries Development Bank of India Employees Provident Fund'.

(4) Administration.—The Fund shidl be held to the Small Industries Bank and shall be administenn:1 by a committee of Adminisrators consistiag of the Managing Director, two other Dir, cior• nominate:I by the Board, on Executive Director or Getrra Manager ar,d three persons, one of whom shall represent the officers, the second:the clerical staff and the third the staff in th2 subordinate r.en ues. all the four te be nominated by • the Manar.ine Director.

Without prejudice to the specific pe,wers crafetrtd on them under the varinus Regtilation?„ the Administrators of the Fund shall be entitled to exercise all flowers and cm do all acts- and things on behalf or tbe Fund under these Regulat1011- .1 ;.;$1.7:1 '«eibr,s. 13

(5) Meeting of Administrators --At every meeting of the Aumiai:nutors, (lit Managim. Dimon- in, in his absenee the Executive Director or one 1)1 the nominated r shall preside. (iii) (a) a temporary employee, other than nu employee who is already contributing to seme other provident fund, may subscribe to the fund, if so permitted by the Administrators.

(b) Any other r erson in receipt of remuneration, other than rasual remuneration, from the Small Industries Bank may also subscribe to the Fund, if so permitted by the Administrators. •

Provided that where any stint' ,is standing. to the credit of such person in the Fund and has become payable to him by reason of the provisions of Regulation 19, such sum may, in exceptional eases, if so permitted by the adminisarators, continue to stand to his Credit in the Fund for such time as he is in receipt cf remuneration other than casual remuneration from the Small Industrie.; Bank and interest shall. notwithstanding anything contained in Regulation 18, accrue on such sum.

(iv) On the creatien of the Fund under Regulution

The Small Industries Bank shall not be required to make any contribution in respect oi any amount paid into the Fund 'under this Regulation.

In case any arrears pay or allowances beetine payable to any category ot employees of the Small indus.ries Bank and a decision is taken by the Small Ineit.o.iries Bank that such arrears or part thereof, as the ease may be, shall not be disbursed in cash but should be credited to the Provident Fund Accounts of the employees concerned, the Administrators shall, at the request of the Small Industries Bank, weeive to the credit of such employees the account tube so credited to their Provident Fund Accounts.

Provided that the Small Industries Bank shall not required in make contribution in respect of any am: lints so paici . into the luta (vi Notwithstanding anything to IL continry conlailied in these Regulations, till such nine an associate institution establishes its own provident fund Moo: framing the necessary regulations it talcs. as the case may he the Administrators may. in their discretion, receive subseriptions from persons who me employees of associate. institutions and contributions on their behalf by thc employer-associate institutions and retaia such subscriptions and comr6ulions and maintain and continue to maintain their accounts in the Fund and the powers in respect of such accounts may be exercised by the Administrators, or such persons as may be nominated by the Adniiitistrators in this behalf, notwithstanding that such subscribeis may not be or may have ceased to be employees of the Small Industries Bank.

Explanation For the purpme of this Regulation; an institution shall be deemed to be an 'associate institution', if in the capital of such institution the Small Industries Bank holds or held not less than 40 percent share.

(9) Rate of subscription.-4i) The rate of subs.

cription shall, as from the date on which the subscriber commences to subscribe, be fixed by the subscribed himself at not more than 10 per cent nor less than 5 pc: rent of his pay.

In addition to the subscription made under sub- Regulation (i) any subscribe: may make to the fund a subscription of an amount upto the pay minus the amount subscribed under Regblation 9(1) but not less than 5 per cent of his pay.

&very person subscribing to the Ftmd under sub-regulation (ii) shall give a notice to the Small Industries Bank specifying the rate of subscription in provident Fund from 7 annexed hereto.

Such F utk..cr; pt ions shall be deducted by the Small Industries Bank from his monthly pay in amounts calculated to the nearest rime:. The. rate of subscriotim yoithin these limits when once fixed by the subscriber can be altered only after written intimation of his el:sire to do so has been given by him, not less thr a one calendcr mcmh - fr advance to the 'ollieer responsible for paying him.

Explanation :

In this Regulation, the expression ' pay' (0 includes substantive pay, special pay, personal pay. special personal pay. overseas pay and officiating pay,

(ii) does not include any allowance or other ' emoluments unless specially classed a. pa) by the Board.

t It)) Subscription of subscriber on leav;:.—The subscription of a subscriber absent on leave shall, during the period of such absence, be assessed on his leave pay but any such subscriber shall be at liberty to subscribe on the full amount of his pay provided notice in writing of his desire to do so is given by him not less than 14 days in advance of the first payment ot his leave salary to the officer responsible for paying him.

(II) Small Industries Banks' contribution.--Sae us otherwise provided in these Regulations. the Small Industries Bank shall contribute every month a sum equal to that sulicribcd by each subscriber to his account in the I and, provided that no such Lone& bution shall be made by the Small Industries Bank in respect of subseinptions permitted under sub regulation (iii) of Regulation 7 and sub-regulation (11) ol Regulation 9.

Provided further that in the ca e of a temporary employee subscribing under sub-regulation (iii) of Regulation 7 who is subsequently taken into the permanent employment of the Small Industries Hank, the Small Industries Bank shall contribute, on the employee being made permanent, a turn equal to the amount subscribed by him during his temporary service.

, Provided further that in respect of subscriber who has been permitted to subscribe under clan c (b) of sub-regulation (iii) of Regulation, 7 the Small Industries Bank shall be liable to make.contributions only if the conditions of service of such subscriber provide for the Small Industries Bank making such contributions.

Notwithstanding anything contained in Regulation 11, where the terms of service of a Chairman or Managing Director provide for his tubseribing to the Fund, the Small Industries Dank shall; from such date as may be applicable under such terms of serviee, contribute every month to his account in the Fund such sum, if any, as may be provided for in the said terms of service. ' Interest—The Small Industries Bank hall credit interest on the amount standing to each subscriber's credit at the end of every half-year at a rate which shall be fixed by the Small Industries Bank haeing regard to the return which can be obtained on the investment of other provident, charitable.

(14) Annual Statement of each subFcriber's account—Every subscriber shall receive from the Administrators an .annual statement showing the amount standing to his credit in the Fund.

(15) Borrowing from Fund.—(i) At the there- (ion of the Small Inciu tries Bank, a temporary advance, the amount of which shall not in any ease exceed the subscriber's own subscriptions and interce t thereon, may be granted m a subscriber On application, Iron) the amount standing to hi, credit in tne Fund, subject to the following conditions (A) The Small Industries Bank is satisfied that the amount will be expended on the following object or objects and not otherwise :--

(1) to pay expenses in connection wItli 'line s or disability, including when: necessary, the travelling expenses, of the subscriber or any person actually dependant i him :

(2) to meet the cost of higher able:Mon.

including where mices ary, the travelline expenses, of the subscriber or any person actually dependant on hint in the follow- Mg eases, namely :— for education outside India for an academic, technical, professional or vocational course beyond the HIM School stage ; and for any medical, engineering, technical, professional or specialised, vocational course after the successful completion of ten years rtudy in school conducted by any recognised institution and leading to a degreeldiploma or certificate :

(3) to pay obligatoty expenses on a scale appropriate to the status which by customary usage .the iubscriber has to incur in connection with marriages or other ceremonies of himself or of his children or of any other person actually dependant on him;

Provided that the condition of actual dependence shall not apply in the ease of a son or daughter of ;he subscriber or in the case of an advance required to meet the funeral expenses of a parent of Mx

(4) to meet the cost of legal proceedincs instituted by the subscriber for vindicating his potion in regard to any allegation made against him in respeet of any act done or purporting to be done by him in the discharge of his official duty. flit advance in this case being available in addition to any advance admissible for the fame purpose from any other source from the Small Industries Bank :

Provided that the advance under this subclause shall not be adrnissibk to a ::7-1 744j :mbsCriber who institutes legal proceedings in any court of law either in resp.mt of any matter unconnected with his oTeial duty or against the Small Industries Ban'.

in respect of any condition of seri ice or penalty imposed on him ;

to meet the cost of his defences where the subscriber is prosecuted by the Small Industries Bank in any court of law ;

to meet any other expenses or liability which, in the opinion of the Small Industries Bank, is unforeseen and extraordinary and beyond ordinary means of the Subs- Criber ;

(B) An advance shall not, except for crecial reasons,— Cl) exceed 3 months' pay (may' a definoil in the explanation to Regulation 9) or half the amount of the subscriber's own subsdriptions to the Fund and Inter, si thereon, whichever Is less ; or

(2) be granted until the final repayment of the previous advance.

(ii) (a) An advance !hall be recovered from the subscriber in such number of equal monthly instalments as the Small Industries Bank may direct ;

but. such numb-r shall not be less than 12 unless the subscriber so elects for more than 24 provided that in special cases where the amount of advance exceeds three months' pay of the subscriber as provided by clause (B) of sub-regulation (1) the Small Industries Bank may fix such number of instalments to be more than 24 but in no case more than 36. A subscriber may at his option repay more than one instalment in one month. Each innalment shall be a number of whole rupees, the amount of the advance being raised or !educed, if necessary, to admit of the fixation of such instalmerits.

Recoveries shall commence' when the subscriber draws his pay for the full month for the first time after the advance is made. Recovery shall tint be made except with the subsdrIber's consent while he is on leave, other than leave on full nay. or in receipt of subsistence grant.

Recoveries made under this sub-regulation shall be credited as they are made to the sub.cr;ber's account in the Fund.

(16) (I) At the discretion of the Small Ittilustries Bank and subject to such conditions and limitationas it may impose, an advance may be granted to a subscriber on application, from the amount standing to his &edit in the Fund, for the purpose of purchasing share-, in a Co-operadve Housing Society or of making any deposit or payment of money by way of earnest or otherwise, in each MC solely with a view to securing a suitable house or premises fur hi - residence or the residence of any person dependant on him..

(ii) An advance under this .Regulation shall be permitted only once during the service of the employee and shall not exceed the amount of the subscriber', subscriptions to the Fund and interest 16 THE GAZETTE OF INDIA :LXI RAORDINAM [Pau 111--Scc 4) thereon, or the amount actually required for the purpose for which the advance has been applird for, whichever is less

(iii) An advance under this Regulation hr recovered in such number of monthly imtalMent , at such times and of .such amount, as the Small Ind:1stries Bank may direct, the number of instalments not exceeding 120 in any case. A suligribcr may at option.repay more than one instalment in one month and each instalment shall be a number of whole rupees.

(17) Insurance Policies.—(j) Sums to meet payments towards a policy of insurance on the life of the suliscriber effected under a scheme of instirance maintained or 1,pnroyed by the Small Industries Bank twiv he vidthe'd `min subscriptions to the Fund or k` iffillrawil from the amount sithrrrihed the by the sithscriher (including interest thereon). Iii) Where sums are withheld from subscritrittms to the fund or withdrawn from the amount subscrib.id thereto by the subscriber under sub-regulation 01 above, the nolicv or insurance in resocet of which sych slim; arc' withheld for withdrnwn shall be. transferred to VI,- Small Industries Bark in consideration of the payment of nreir,in on such mfficy and on such terms and conditions as the Small Industries Bank may inmosc in resneet of the amount, if any, recovered lw the Small Industries Bank from the insurer,

(18) When interest ceases to arcrue.—Interest on all slims standing in the books o' the Fund tO the credit of a stilisrriber shall cease to accrue on the expiry of period of six months from :

if be leaves the service or the Small Industries Bank on the •expi-y of any period of leave, commencing f-om or after the date on which he would have retired from the service of the Small 'Industrie.. Interest shall cease to accrue on the said sums or, as the case may be, on such portion, from the date on which the said sums are. or any portion thereof, is authorised to be (!isbursed, or as the case may be.

(19) Payment of amount standing to credit of subseribcr.---(i) The sums standing to the credit of a subscriber shall become Payable on the termination of his service or on hi:: death :

Provided that a subscriber on leave preparatory to retirement may at his melon withdraw from the sums standing to his credit in the Fund an amount not exceeding his own subscriptions and the interest thereon ;

Provided also that a subscriber, including any person permitted to subscribe to the Fund, under sub-clause (b) of clause (iii) of Regulation '7 may.

at any time after completion of 15 years servlee, if the. wihdrawal is for the purpose specified in clause

Liplanation :

(ii) (a) Subject to such terms and conditions as may be imposed by the Small Industries Bank, a withdrawal under the second proviso. to. sub-regulation (i) may be permitted fort) meeting the cart of higher education, including where necessary the travelling expenses, of any child of the subscriber actually dependant On Hill. in the following CaSCS, namely—

(i) for education outside India for academic.

technical. professional or vocational course.

beyond the high school stage; and

(b) for any medical, engineering. technical, professional or special ised, vocational course after the successful completion ol ten years' study in school conducted by any recognised institution and leading to a degrec 'diploma or certificate.

2) meeting the expenditure in connection with the marriage of the subscriber himself or the subscriber': son or daughter and if he has no daughter, of any other female re.`ation dependant on him.

(3) meeting the expepses in connection with :he illness. including where necessary, the Be' voting expenses. of the, subscriber or in' person actually dependant on him;

Provided that a rubscriber may, at his option.

return to the Fund in lump sum the whole or any part of the sum so withdrawn by him.

(h) Subject to the provisions or clauses (c) to (p withdrawals under the second proviso to sub-regulation

(i) may also he permitted for the following purpose;

(5) payment of stamp duty and registration charges in connection with acquisition of a hones or a site;

Provided that withdrawals shall not be granted for acquisition of more than one house in site except in a case, covered by sub-regulation (v) of regulation 19, (e I The house 'in chased or built should be fur subscriber himself and in the case of a site, it should be for hui'ding a house for the subscriber himself; the house or site shah be at the station where the subscriber is working or at the place to be declared by him in writing, ar the place where he Intends to reside after retirement.

(d) The amount permitted to be withdrawn shall not exceed the, amount required for the purpose for sel4ch withdrawal is permitted, any excess of the amount withdrawn over the amount actually required Juin forthwith be refunded.

(e) The subscriber may at any time be required to satisfy the Small Industries Bank, in such manner as it may specify, of any of the following matters, ntrniely :

(hithat the amount sought to he withdrawn tor permitted to be withdrawn is actually re quired for the purpose for which withdrawal is sought or has been permitted, and that b has been applied to such purpose:

(2, that the amount somffit to be withdrawn 01 permitted to be withdrawn together with other funds, if any, available to the subscriber, is sufficient for the purpose for which withdrawal is sought or has been permitted:

that the subscriber has obtained or will obtain a good title to the site or the house, or where construction is to be 'put up on a site belonging to the subscriber's spouse, or both of them jointly haslhave °brained or will obtain n good title to the site or the house:

and that the subieriber has obtained or will obtain all the permissions and approvals necessary for building the hciuse and the subscriber shall comply With such requirement.

(i) The subscriber shall not without the previous written permission of the Small Industries Bank, transfer, morgage or otherwise alienate the site or house; in default, the subscriber shall be liable to refund in ono instalment the entire amount withdrawn.

(1) The obseriber may, at his option, return to the Fund the whole or any wart of the stun withdrawn hy hint.

For the purpose of sub-regulation (ii) the exnrcsion "parch:is: or house- shall include-- tiI TT Man. as a member of a co-openttive hou•ing ii.cicty. whether by rumba., of 'Mires in, or by depositing sums with, such society, of residential accommoadtion allotted by the society; end

(b) the purchase of a residential 11011F.0 or premises on hire-purchase basis or otherwise, front a Housing Board, City Improvement Trust or other like authority, formed or established under any law for the time being in force;

ani clauses (c). (d), ), (e)(2), (i) and (j) of sub-regulation (ii) shall, so far as may be, apply accordingly to withdrawals for such acquisition or purchase.

(iv) Where a withdrawal has been permitted under sub-regulation (ii) read with sub-regulation (iii), the following conditions till also apply •— . (a) The subscriber may be required to satisfy the Small Industries Bank that he has obtained title to the shares in the co-operative housing society concerned or has obtained the documents evidencing the deposit of sums with the society; or that he has obtained the documents evidencing his right to the residential house or premises purchased on hire purchase basis or otherwise from a Housing Board, City Improvement Trust or other like authority, formed or established under any law for the time being in force.

(b) The residential accommodation is obtained by the member before the expiry of six months, or such longer period as the Small Industries Bank may allow, from the tile ot the subscriber receivine the amount withdrawn or any part thereof;

' (c) The amount may be permitted to be withdrawn in such number of instalments and nt such time or times as the Small Industries Bank may determine.

(d) Excent with the nrevious written permission of the Small Industries Bank, the subscriber shall not transfer, assign or create any encumbrance on such share or such shares, deposit or his interest in the residential accommodation allotted to him: in default, the subscriber shall be liable to refund forthwith in one instalment the entire amount withdrawn.

(v) In the event of a subscriber transferring, assigning or creating any interest whatsoever, in the house acquired by him with the help of a withdrawal under these Regulations, the subscriber shall refund to the Small Industiies Bank the entire amount withdrawn by him forthwith one such transfer, assignment or cleation of interest, as the case may be.

.1'rovided where such transfer, assignment or creation lit interest in with the permission of the Small Industries Bank and the subscriber has refunded, to the Small Inditstriea Batik the amount withdrawn by him, he shall be eligible for a fresh withdrawal from the fund.

..iibieet to the other proisions of these regulation:.

(20) I imits and Conditions as to withdrawal.— Ait um wi'lidrawn by a subscriber at any one jaw ii, one or more of the purposes specified in clause (a) or still-clause (4) of caluse (b) of sohregulation (ii) of Regulation 19 from the armittin ‘tanding to 104 ctedit in the Fund shall not ordinarily exceed one-halr of his own subscriptions and the interest thereon or six month? pay ('pay' as defined in the Explanation to regulation 9) whichever is less.

The sanctioning authority may, however, sanction the withdrawal of an amount in excess of this limit up to 31 4ths of his own subscriptions and the interest thereon ia the Fund having due regard to (i) the object for which the Avithdrawal is being made, (ii) the status of the subscriber and (iii) the amount of his own subscriptions and the interest thereon in the Fund.

Any sum withdrawn by a subscriber under clause (h) of sub-regualtion (ii) oi Regulation 19 [except sub-clause (4) of that clause) shall not exceed his own subscriptions and interest thereon.

Provided that in a case where both the husband and wife are employees or the Small Industries Bank subscribing to the Fund and are each others nominees.

A subscriber who has been permitted to withdraw money from the Fund under sub-regualtion (ii) of Regulation 19 shall satisfy the Small Industries Bank within a reasonable period as may be specified by the Small Industries Bank that the money has been wig-eft for the mirnose for which it was withdrawn, and if he fails to do so, the whole of the sum so withdrawn, or so much thereof as has not been aninlied for the purpose for which it was withdrawn, shal t lbeo4 p th y;

(21) Conversion of advance into withdrawal.—A subscriber who has been ranted an advance under Regulation IS or Regulation 16 for any of the rim- - noses sneeified therein. may be nermitted by the Small Indirtries Bank to convert the balance niiinanding arninst such advnnce into a withdrawal under Regain-

(22) Sanctioning authority and delegation of powers.--(i) The Administrators may, subject to such conditions as they may think fit to impose, delegate to any officer of the Small Industries Bank as they may specify in this behalf all or any of the powers conferred upon them by these Regulations with the exception Of the powers conferred by Regulation 5 and the proviao to Regulation 70ii)(b).

(ii) Without •prejudice to the provisions of sub- An advance under Regulation 15 or Regulation 16 upto six months' pay of the subscriber or one-half of the subscriber's own subscriptions. and interest thereon, whichever is higher. may he sanctioned by the General Manager and any other advance from the Fund may be sanctioned by an Executive Director or Managing Director;

Withdrawals tinder the first proviso to subregualtion (i) of Regulation 19 may be sanctioned by On General Manager, Withdrawals under the second proviso to sub-regulation (i) of Regulation 19 up to six months' pay of the subscriber or one-half of the subscriber's own subscriptions and interest thereon, whichever is higher, may be sanctioned by the General Manager and any other withdrawal tinder that Regulation may be sanctioned by an Executive Director or Managing Director.

(iii) For the purpose of this Regulation— "General Manager" includes a Deputy General Manager and a Manager;

"Pay" has the sdme meaning as in the Explanation to Regulation 9.

(23) Nominations.—(i) Every subseriber shall nominatz in Form 2 annexed to these Regulations one or more members of his family to whom the amount standing at his credit in the Fund shall be payable in the event of his death. A subscriber who has no family shall nominate a person in Form •3 annexed to these Regulations provided that such nomination shall be valid only for so long as the subscriber has no family and that if a member subsequently acquires a family he shall formally cancel the previous nomimotion and nominate a member of the fimily in Form 2.

Provided that any nomination made under the Industrial Development Bank of India Employees' Provident Flue Regulation by•the transferred employee shall he deemed to he a nomination made under this Regulation.

A subscriber may in his nomination distribute the amount that may stand to his credit in the Fund amongst his nominees at his own discretion.

A nomination may he cancelled hv a subscriber and replaced by any nomination which is permitted ID be -made under this Regulation.

(iv) No nomination or notice-of •eancellation shall be effective unless it has been receivd in the Head Office of the Small Industries Bank while the subscriber is still in the service of Small Industries Baruc and has been registered in the books of the Funds.

(s) Without prejudice to his right under sbb-regulation (iii) to cancel a previous nomination, a subscriber shall, along with every nomination made by him under this Regulation, send to the Head °thee of the Small Industries Bank a contingent notice or cancellation which shall be in such one of the Forms (4 and 5) annexed to these Regulations as is appropriate in the circumstances.

Explanation 1 In this Regulation, and in Regulation 25 'family' means the wife or wives, or husband and children of a subscriber and the widow or widows and children of a deceased son of a subscriber:-

Provided that. if a subscriber proves that his wife has been judicially separated from his or has ceased under the customary law of community tn which she belongs, to be entitled to maintenance she shall no longer be deemed to be a member of the family unless the subscriber subsequently indicates by express notification in writing to the Administrator, that she shall continue to be so rettarded :

Provided further that if a subscriber by notification in writing to the Administrators expresses her desire to exclude her husband from the family, the husband shall no longer be deemed to be a member of the family unless the subscriber subsequently cancels formally in writing her notification excluding him :

Provided further that, in cases where adoption is recognised by the personal law governing the subscriber, an adopted child shall be considered as a child.

EXPLANATION II For the purpose of this Regulation 'person' includes the Central Government, a -State Government, a lo- Cal authority, a .company, an association or body ot individuals, whether incorporated or not, or any person xlesignated by virtue of office.

(24) Nomination of dependants in certain cases.— Notwithstanding anything contained Is Regulation 23.

a subscriber may nominate any person who is a denendant as defined in the Provident Funds Act, 1925, if the Small Industries Bank is satisfied that the making or the subsistence of a nomination in accordance with that Regulation would .canse undue hardship or would not be just and equitable. Such nomination shall be malde in Form 6 annexed to these Regulations.

(25) Payment on death of a subscriber.—On the death of the subscriber—

(i) When the subscriber leaves a family—

(a) If a nomination made by the subscriber in accordance with these Reeubtions in favour of a member or members of his family subsists, the amount standing to his credit in the Fund or the part thereof to which the nomination relates, shall become payable to Regulation (i) :

(h) If no such nomination in favour of a member or members of the family of the -subscriber subsists or if such nomination relates only to a part of the amount standing to his credit in the Fond, the whole amount or the part thereof to which the nomination does not relate, as the case may he, shall notwithstanding any nomination purporting to be in favour of arty person or persons other than a member or members of his family, become payable to the menibers of his family in equal shares :

Provided that no share shall be payable to— sons who have attained legal majority;

sons of a deceased son who have attained legal majority:

married daughters whose husbands arc alive;

married daughters of a deceased son whose husbands are alive;

If there is any member of the family other than those specified in clauses (1), (2), (3) and

(4);

Provided further that the widow or widows and the ch:lti or children of a deceased son shall receive between them in equal parts only the share which that son would have received if he has survived.the subscriber and if, in a case where had he survived the subscriber, he would have been excluded from a share under clause (i) of the first proviso, be had not been so excluded.

Provided further that if a nomination under Regulation 24 in favour of a dependant or dependants subsists, the amount standing to the credit of the subscriber or the part thereof to which the nomination relates shall, notwithstanding anything contained in this sub-clause, become payable to nominee or nominees in the proportion specified in the nomination.

(ii) When the subscriber leaves no family......

(a) if a nomination made by the subscribe r in accordance with these Regulations in favour of any person or persons, who is or are a dependant or dependants of the subtscriber as defined in clause (c) of Section 2 of the Pro.

vident Funds Act, 1925, subsists the amount standing to hi- credit in lb.'. Fund as the case muy be, the patt thereof to vitich the nomination relates, shall Lecome payable to his nominee or nominees in the proportion specified in (Ile nom i nation;

if no such nomination subsists, or it such nomi mtion relates only to a part of the amount standing to the credit or the sub.-1/4criher in the Fund, the whole or as the case may he. the part thereof to which the nomination does not relate. shall become payable to any person appearing to the Administrators to be otherwise entitled to receive it, if the whole sum or, as the case may be, 0)2 part thereof does not exceed five thous:it:LI rupees;

any sum or any part thereof which is not payable to any person tinder sub-clause (a), (I)), (c) shall become payable to any person on production of probate or letters of administration evidencing the grant to him of administration to the estate of the deceased or a succession certificate in accordance with clause (c) of Section 4 of the Provident Funds Act, 1925 Note:

When a nominee or other person is a dependant of the subscriber, as defined in clause (c) of Section 2 of the Provident Funds Act, 1925, the amount payable to such nominee hr other person under under these Regulations vests id the dependant under sub-section

(26) Agreement to be executed by subscribers.— F.very employee on becoming a subscriber to the Fund shall execute an agreement in Provident Fund Form annexed :

Provided that any similar ugreenicni executed by a Transferred Employee for the purpose of the industrial Development Bank of India Employees' Provident Fund Regulations shall be deemed to be an agreement executed for the purpose of this regulation.
