PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY सड़क पररवहन और रािमागग मतं्रालय अजधसचूना नई दिल्ली, 28 मई, 2021 का.आ. 2159(अ).— कें द्रीय सरकार की यह राय ह ैदक व् यज त जवजिष् ट प्रकार के यानों को चलाने के जलए चालन अनुज्ञज त के ज्ञान के संबंध में करिनाइयों का सामना कर रह ेहैं और जवजध प्रवतगन अजभकरण, जिनेवा अजभसमय, 1949 के अनुसार अतंरराष् रीय चालन अनुज्ञा में उजल् लजखत यान के वगग के जनवगचन में करिनाइयों का सामना कर रह ेहैं और ऐसा करना आवश् यक समझा गया ह ै। अत: अब कें द्रीय सरकार, मोटर यान अजधजनयम, 1988 (1989 का 59) की धारा 41 की उपधारा (4) द्वारा प्रित् त िज तयों का प्रयोग करते हुए, िारी की गई चालन अनजु्ञज त के आधार पर मोटर यान के प्रकारों को जवजनर्िगष् ट करने के जलए जनम् नजलजखत आिेि िारी करती ह,ै अर्ागत ्:- “यानों के वगग के जलए िारी की गई चालन अनजु्ञज त के आधार पर मोटरयानों के प्रकार” सारणी मोटर यान चालन अनुज्ञज त के वगग कें द्रीय मोटर यान जनयम 1989 के अनुसार यान के प्रवगग जिनेवा अजभसमय 1949 के आधार पर यान के वगग जिनेवा अजभसमय 1968 के आधार पर यान के वगग

3. मध् यम और भारी मोटर यान । पररवहन यान एन 2 सी सी/सी1ई एम 3 डी डी एन 3 ई सीई इस आिेि के प्रयोिनों के जलए –
1. उपररजलजखत 1. – एन2 प्रवगग के मोटर यान जिनका सकलयान भार 3.5 टन से अजधक ह ैलेदकन 7.5 टन से अनजधक ह ै।
2. उपररजलजखत 2 – एम3 प्रवगग के मोटर यान जिनका सकलयान भार 5 टन से अजधक ह ैलेदकन 7.5 का से अनजधक ह ै।
2. प्रवगग टी अर्ागत् रेलर और अर्द्ग-रेलर िो मोटर यान (मुख् य पररवाहक या पलुर) द्वारा खचचे िाते हैं और उसका यान वगग, मोटर यान (मुख् य पररवाहक या पुलर) के प्रवगग पर जनभगर करेगा ।
3. जिनवेा अजभसमय 1949 के आधार पर यान का वगीकरण क : साइड-कार के सार् या उसके जबना मोटर साइदकल, अि त यात्री गाड़ी और 400 दक.्ा. (900 एलबीएस) से अनजधक लिान रजहत भार के सार् जतपजहया मोटर यान;
ख: याजत्रयों के पररवहन के जलए उपयोग दकया गया मोटर यान और जिसमें चालक सीट के अजतरर त 8 सीटें समाजवष् ट होंगी या िो माल के पररवहन के जलए उपयोग में जलए िाते हैं और जिनका अनुज्ञेय अजधकतम भार 3,500 (7,700 एलबीएस) से अनजधक ह ै। इस प्रवगग के यान हल् के रेलर के सार् युजम मत हो सकें गे ;
ग : माल के पररवहन के जलए उपयोग दकए िान े वाल े मोटर यान और जिनका अनुज्ञेय अजधकतम भार 3,500 दक.्ा. (7,700 एलबीएस) से अजधक ह ै। इस प्रवगग के यान हल् के रेलर के सार् युजम मत हो सकें ग े;
घ : मोटर यान िो याजत्रयों के पररवहन के जलए प्रयोग दकए िाते हैं और जिसमें चालक सीट के अजतरर त आि से अजधक सीटें समाजवष् ट ह ै। इस प्रवगग के यान हल् के रेलर के सार् युजम मत हो सकें ग े;
[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 ड : प्रवगग ख, ग या घ के उपरो त यर्ाप्राजधकृत मोटर यान िो हल् के रेलर से जभ न के सार् हैं ।
4. जिनवेा अजभसमय 1968 के आधार पर यान का वगीकरण क. मोटर साइदकल;
क 1 : 125 सेमी3. यबू से अनजधक घनषमता और 11 दक.वा. से अनजधक की िज त के सार् मोटर साइदकल (हल् की मोटर साइदकल);
ख . मोटर यान िो प्रवगग क से जभ न हैं, जिनका अनुज्ञेय अजधकतम द्रव् यमान की 3,500 दक.्ा. से अनजधक ह ैऔर जिनमें ड्राइवर सीट के अजतरर त 8 सीटों से अनजधक है; या रेलर के सार् युजम मत प्रवगग ख के मोटर यान, जिनका अनुज्ञेय अजधकतम द्रव् यमान 750 दक.्ा. से अनजधक ह;ै या रेलर के सार् युजम मत प्रवगग ख के मोटर यान, जिनका अनुज्ञेय अजधकतम द्रव् यमान 750 दक.्ा. से अनजधक ह ैलेदकन िो मोटर यान के लिान रजहत द्रव् य मान के अनजधक ह ैिहां इस प्रकार युजम मत यान का अजधकतम अनुज्ञेय संयु त द्रव् यमान 3500 दक.्ा. से अनजधक ह;ै ख 1 : जतपजहया और चौपजहया मोटर ;
ग : मोटर यान, िो प्रवगग घ से जभ न हैं, जिनका अनुज्ञेय अजधकतम द्रव् यमान की 3,500 दक.्ा. से अनजधक ह ैऔर ; या रेलर के सार् युजम मत प्रवगग ग के मोटर यान जिनका अनजु्ञेय अजधकतम द्रव् यमान 750 दक.्ा. से अनजधक ह;ै ग 1 : उनके अपवाि में मोटर यान िो प्रवगग घ में है, जिनका अनुज्ञेय अजधकतम द्रव् यमान 3500 दक.्ा. से अजधक ह ैलेदकन 7500 दक.्ा. से अनजधक ह ैया रेलर से युजम मत ग1 उप प्रवगग के मोटर यान जिनका अनुज्ञेय अजधकतम द्रव् यमान 750 दक.्ा. से अनजधक ह ै। गङ. : रेलर से युजम मत प्रवगग ग के मोटर यान जिनका अनुज्ञेय अजधकतम द्रव् यमान 750 दक.्ा. से अजधक ह;ै ग1ङ : रेलर से युजम मत उपप्रवगग ग के मोटर यान जिनका अनुज्ञेय अजधकतम द्रव् यमान 750 दक.्ा. से अजधक ह ैलेदकन िो मोटर यान के लिान रजहत द्रव् य मान के अनजधक ह ैिहां इस प्रकार युजम मत यान का अजधकतम अनुज्ञेय संयु त द्रव् यमान 12000 दक.्ा. से अनजधक ह;ै घ : याजत्रयों के पररवहन के जलए उपयोग दकए गए मोटर यान और जिसमें चालक के अजतरर त 8 स ेअजधक सीट ह;ै या रेलर के सार् युजम मत प्रवगग के मोटर यान जिनका अनुज्ञेय अजधकतम द्रव् यमान 750 दक.्ा. से अजधक ह ै। [फा. स.ं आर टी – 11036/127/2020-एमवीएल] अजमत वरिान, संयु त सजचव MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 28th May, 2021 S.O. 2159(E).—Whereas, the Central Government is of the opinion that persons are facing difficulties in respect of knowledge of driving license to drive particular types of vehicles, and the law enforcement agencies are facing difficulties in interpretation of vehicle class mentioned in the International Driving Permit as per Geneva Convention, 1949 and it is considered necessary so to do. Now, therefore, in exercise of the powers conferred by subsection (4) of section 41 of the Motor Vehicles, Act, 1988 (59 of 1989), the Central Government hereby issues the following Order to specify types of Motor Vehicle on the basis of driving license issued, namely: - “Types of Motor Vehicles based on driving license issued for class of vehicle 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] TABLE Motor Vehicles Driving License Classes Category of vehicle as per the Central Motor Vehicle Rules, 1989 Vehicle Classes based on Geneva Convention, 1949 Vehicle Classes based on Vienna Convention, 1968

3. Medium and Heavy Motor Vehicle.

1. Superscript 1- Motor Vehicle of N2 category having a Gross Vehicle Weight exceeding 3.5 tonnes but not exceeding 7.5 tonnes.
Superscript 2- Motor Vehicle of M3 category having a Gross Vehicle Weight exceeding 5 tonnes but not exceeding 7.5 tonnes.
2. Category T i.e. trailers and semi-trailers are towed by a motor vehicle (prime mover or puller) and its vehicle class shall depend on the category of motor vehicle (prime mover or puller).
3. Vehicle Classification based on Geneva Convention, 1949 A: Motor cycles, with or without a side-car, invalid carriages and three-wheeled motor vehicles with an unladen weight not exceeding 400 kg (900 lbs);
B: Motor vehicles used for the transport of passengers and comprising, in addition to the driver's seat, at most eight seats, or those used for the transport of goods and having a permissible maximum weight not exceeding 3,500 kg (7,700 lbs). Vehicles in this category may be coupled with a light trailer;
C: Motor vehicles used for the transport of goods and of which the permissible maximum weight exceeds 3,500 kg (7,700 lbs). Vehicles in this category may be coupled with a light trailer;
D: Motor vehicles used for the transport of passengers and comprising, in addition to the driver's seat, more than eight seats. Vehicles in this category may be coupled with a light trailer;
E: Motor vehicles of category B, C, or D, as authorized above, with other than light trailer.
4. Vehicle Classification based on Vienna Convention, 1968 A: Motorcycles;
[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 A1: Motorcycles with a cubic capacity not exceeding 125 cm³ and a power not exceeding 11 kW (light motorcycles);
B: Motor vehicles, other than those in category A, having a permissible maximum mass not exceeding 3,500 kg and not more than eight seats in addition to the driver's seat; or motor vehicles of category В coupled to a trailer the permissible maximum mass of which does not exceed 750 kg; or motor vehicles of category В coupled to a trailer the permissible maximum mass of which exceeds 750 kg but does not exceed the unladen mass of the motor vehicle, where the combined permissible maximum mass of the vehicles so coupled does not exceed 3,500 kg;
B1: Motor tricycles and quadricycles;
C: Motor vehicles, other than those in category D, having a permissible maximum mass exceeding 3,500 kg; or motor vehicles of category С coupled to a trailer the permissible maximum mass of which does not exceed 750 kg;
C1: Motor vehicles, with the exception of those in category D, the permissible maximum mass of which exceeds 3,500 kg but does not exceed 7,500 kg; or motor vehicles of subcategory C1 coupled to a trailer, the permissible maximum mass of which does not exceed 750 kg;
CE: Motor vehicles of category С coupled to a trailer whose permissible maximum mass exceeds 750 kg;
C1E: Motor vehicles of subcategory C1 coupled to a trailer the permissible maximum mass of which exceeds 750 kg but does not exceed the unladen mass of the motor vehicle, where the combined permissible maximum mass of the vehicles so coupled does not exceed 12,000 kg;
