PART II—Section 3—Sub-section (ii) ᮧािधकार स ेᮧकािशत PUBLISHED BY AUTHORITY पयाᭅवरण, वन और जलवाय ुपᳯरवतᭅन मंᮢ ालय अिधसचूना नई ᳰद᭨ली, 20 अ तूबर, 2020 का.आ. 3751(अ).—के᭠ ᮤ ीय सरकार, पयाᭅवरण (संरᭃण) अिधिनयम, 1986 (1986 का 29) कᳱ धारा 3 कᳱ उपधारा (3) ᳇ारा ᮧद᭜ त शि तयᲂ का ᮧयोग करत ेᱟए और भारत सरकार के त᭜कालीन पयाᭅवरण और वन मंᮢ ालय कᳱ अिधसूचना सं. का.आ. 1533(अ), तारीख 14 िसतंबर, 2006 (िजसे इसमᱶ इसके प᭫ चात् उ त अिधसूचना कहा गया ह)ै के अनुसरण मᱶ और भारत के राजपᮢ, असाधारण, भाग 2, खंड 3, उपखडं (ii) तारीख 16 अᮧलै 2006 मᱶ ᮧकािशत भारत सरकार के त᭜कालीन पयाᭅवरण और वन मंᮢ ालय कᳱ अिधसूचना सं. का.आ. 852 (अ), तारीख 15 अᮧैल, 2010 का अिधᮓा᭠त करत ेᱟए, उन बातᲂ के िसवाय िज᭠हᱶ ऐसे अिधᮓमण से पहल ेᳰकया गया ह ैया करन ेका लोप ᳰकया गया ह,ै रा᭔ य ᭭ तर पयाᭅवरण समाघात िनधाᭅरण ᮧािधकरण,नागालडᱹ (िजसे इसमᱶ इसके प᭫ चात् ᮧािधकरण, नागालडᱹ कहा गया ह)ै का गठन करती ह,ै िजसमᱶ िन᭥ निलिखत सद᭭ य हᲂग,े अथाᭅत:्-

3. अितᳯरᲦ ᮧधान मुय वन संरᭃक, (पयाᭅवरण और जलवाय ु पᳯरवतᭅन), नागालडᱹ सरकार सद᭭य सिचव।
2. ᮧािधकरण, नागालᱹड के अ᭟यᭃ और सद᭭य राजपᮢ मᱶ इस अिधसूचना के ᮧकाशन कᳱ तारीख से तीन वषᭅ कᳱ अविध के िलए पद धारण करᱶग े।
3. ᮧािधकरण, नागालडᱹ ऐसी शिᲦयᲂ का ᮧयोग करेगा और ऐसी ᮧᳰᮓया का अनुसरण करेगा जो उᲦ अिधसूचना मᱶ िविन᳸दᭅ᭬ ट ह ᱹ।
4. ᮧािधकरण, नागालडᱹ अपने िविन᳟य नागालᱹड रा᭔य के िलए पैरा 5 के अधीन गᳯठत रा᭔य ᭭तर िवशेष᭄ अंकन सिमित कᳱ िसफाᳯरशᲂ के आधार पर अपने िविन᳟य देगा ।
5. के᭠ᮤीय सरकार, ᮧािधकरण, नागालडᱹ कᳱ सहायता के उे᭫य के िलए नागालᱹड रा᭔य सरकार के परामशᭅ से रा᭔ य ᭭तरीय िवशेष᭄ अंकन सिमित, (िजसे इस अिधसूचना मᱶ इसके प᳟ात् एस.ई.ए.सी., नागालᱹड कहा गया ह)ै का गठन करती ह ै िजसमᱶ िन᳜िलिखत सद᭭य हᲂग,े अथाᭅत:्--

6. एस.ई.ए.सी., नागालडᱹ के अ᭟यᭃ और सद᭭य इस अिधसूचना के राजपᮢ मᱶ ᮧकाशन कᳱ तारीख से तीन वषᭅ कᳱ अविध के िलए पद धारण करᱶग े।
7. एस.ई.ए.सी., नागालᱹड ऐसी शिᲦयᲂ का ᮧयोग करेगी और ऐसी ᮧᳰᮓयाᲐ का पालन करेगी जो उᲦ अिधसूचना मᱶ िविन᳸दᭅ᭬ ट ह ᱹ।
8. एस.ई.ए.सी., नागालडᱹ सामिूहक उᱫरदािय᭜व के िसांत पर काम करेगी और अ᭟यᭃ ᮧ᭜येक मामल ेमᱶ सवᭅस᭥ मित पर पᱟचंने का ᮧयास करेगा और यᳰद सवᭅस᭥ मित पर नहᱭ पᱟचंा जा सकता ह ैतो बᱟमत का मत अिभभावी होगा ।
9. नागालडᱹ रा᭔य सरकार, ᮧािधकरण नागालडᱹ और एस.ई.ए.सी., नागालᱹड के िलए सिचवालय के ᱨप मᱶ कायᭅ करन ेके िलए ᳰकसी अिभकरण को अिधसूिचत करᱶगी और सिचवालय सभी िवᱫीय और संभार तंᮢ संबंधी सहायता, िजसके अंतगᭅत वास-सुिवधा, पᳯरवहन और उनके सभी कानूनी कृ᭜यᲂ कᳱ बाबत अ᭠य सुिवधाएं भी ह,ᱹ उपल᭣ध कराएगी ।
10. ᮧािधकरण, नागालडᱹ के अ᭟यᭃ और सद᭭यᲂ तथा एस.ई.ए.सी., नागालडᱹ के अ᭟यᭃ और सद᭭यᲂ कᳱ बैठक कᳱ फᳱस, याᮢा भᱫा और महंगाई भᱫा नागालडᱹ रा᭔य सरकार के िनयमᲂ के अनुसार संदᱫ ᳰकया जाएगा । [फा. सं. जे-11013/12/2010ई.ए.।।(।)] अरᳲवंद नॉᳯटयाल,संयᲦु सिचव [भाग II—ख᭛ ड 3(ii)] भारत का राजपᮢ : असाधारण 3 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 20th October, 2020 S.O. 3751 (E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, number S.O.1533(E), dated the 14th September, 2006 (hereinafter referred to as the said notification), and in supersession of the Government of India in the erstwhile Ministry of Environment and Forests vide number S. O. 852(E), dated the 15th April, 2010 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section(ii), dated the 16th April, 2010, except as respect things done or omitted to be done before such super-session, the Central Government hereby constitutes the State Level Environment Impact Assessment Authority, Nagaland (hereinafter referred to as the Authority, Nagaland) comprising of the following Members, namely: —
1. Shri I. Panger Jamir C/o Rochester Institute of Technology (RIT’S) Building Naharbari Junction, Purana Bazar, Dimapur - 797116 Chairman;
2. Shri T Yannger Ao, Retired Chief Engineer, Irrigation and Flood Control Department House Number 320, Uppare Agri, Kohima- 797001 Member;
3. Additional Principal Chief Conservator of Forests, (Environment and Climate Change), Government of Nagaland Member-Secretary.
2. The Chairman and Members of the Authority, Nagaland shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.
3. The Authority, Nagaland shall exercise such powers and follow such procedures as specified in the said notification.
4. The Authority, Nagaland shall take its decision on the recommendations of the State Level Expert Appraisal Committee constituted under paragraph 5 for the State of Nagaland.
5. For the purpose of assisting the Authority, Nagaland, the Central Government in consultation with the State Government of Nagaland, hereby constitutes the State Level Expert Appraisal Committee (hereinafter referred to as SEAC, Nagaland) comprising of the following Members, namely:—
1. Shri Albert Solo, Indian Forest Service (Retired), Forest Colony, Kohima, Nagaland.
Chairman;
2. Dr. Glenn T. Thong, Department of Geology, Nagaland University, Kohima Campus, Meriema – 797004.
Member;
3. Dr. Neizo Puro, Department of Botany, Nagaland University, Lummi Zunheboto – 798627.
Member;
4. Shri H. K. Chishi, Director (Retired), House Number - 53A, Ao – Khel Road North Basti, Dimapur, Nagaland.
Member;
5. Engineer Mhondamo Ovung House Number - P.237 (Near KROS College) Lerie Colony, Kohima.
Member;
6. Chief Conservator of Forest (Environment, Biodiversity and Research), Government of Nagaland Member Secretary.
6. The Chairman and Members of SEAC, Nagaland shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.
7. The SEAC, Nagaland shall exercise such powers and follow such procedures as specified in the said notification.
8. The SEAC, Nagaland shall function on the principle of collective responsibility and the Chairman shall endeavor to reach a consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail.
4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] . The Government of Nagaland shall notify an agency to act as Secretariat for the Authority, Nagaland and SEAC, Nagaland and the Secretariat shall provide all financial and logistic support including accommodation, transportation and such other facilities in respect of all their statutory functions.
10. The sitting fee, travelling allowances and dearness allowances to the Chairman and Members of the Authority, Nagaland and SEAC Nagaland shall be paid as per rules of the State Government of Nagaland.
