PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY पर्ाावरण, वन और िलवार्ु पररवतान मतं्रालर् अजधसचूना नई दिल्ली, 11 जसतम् बर, 2024 का.आ. 3895(अ).— केन्द रीर् सरकार, पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29) की धारा 3 की उपधारा (3) द्वारा प्रित् त िज तर्ों का प्रर्ोग करते हुए और भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना का.आ. सं. 1533(अ), तारीख 14 जसतंबर, 2006 (जिसे इसमें इसके पश् चात् उ त अजधसूचना कहा गर्ा ह)ै के अनुसरण में राज् र् स्ट् तर पर्ाावरण समाघात जनधाारण प्राजधकरण गुिरात (जिसे इसमें इसके पश् चात ् प्राजधकरण कहा गर्ा ह)ै का गठन करती ह,ै जिसमें जनम् नजलजखत सिस्ट् र् होंगे, अर्ाात्:-
(1) श्री एच. के. िास, प्लाट नं. 829, सेटर-8, गांधीनगर, गुिरात-382007 अध्र्क्ष;
(2) श्री चन्दरप्रकाि गोपालिास भागचंिानी, एसोजसएट प्रोफेसर, एल.डी.कालेि ऑफ इंिीजनर्ररंग, अहमिाबाि, गुिरात सिस्ट्र्;

2. प्राजधकरण के अध्र्क्ष और सिस्ट्र्, रािपत्र में इस अजधसूचना के प्रकािन की तारीख से तीन वर्ा की अवजध के जलए पि धारण करेंग े।
3. प्राजधकरण, ऐसी िजक्तर्ों का प्रर्ोग करेगा और ऐसी प्रदिर्ा का अनुसरण करेगा िो उक्त अजधसूचना में जवजनर्िाष् ट हैं ।
4. प्राजधकरण, अपन े जवजनश्चर् पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् की अजधसूचना सं. का.आ.
2581(अ), तारीख 13 िून, 2023 द्वारा गरठत राज्र् स्ट्तर जविेर्ज्ञ अंकन सजमजत की जसफाररिों के आधार पर करेगा ।
5. प्राजधकरण के सभी जवजनश्चर् बठैक में जलए िाएंग ेऔर साधारणतर्ा सवासम्मजत से होंगे:
परंत ुबहुमत द्वारा दकए गए जवजनश्चर् की ििा में उसके जलए र्ा उसके जवरुद्ध िजृिकोणों के ब्र्ौरे कार्ावृत्त में स्ट्पि रूप से अजभजलजखत दकए िाएंगे और उसकी एक प्रजत कें रीर् सरकार को भेिी िाएगी ।
6. प्राजधकरण के अध्र्क्ष और सिस्ट्र् जहतों के टकराव से बचने के जलए- (क) र्ह घोजर्त करेंग ेदक वे दकस परामिा सगंठन और पररर्ोिना के प्रस्ट्तावक से िुड ेहैं;
(ख) दकसी पररर्ोिना के जलए पर्ाावरणीर् समाघात जनधाारण और पर्ाावरण प्रबंधन र्ोिना की तैर्ारी के जलए कोई परामिा र्ा सहर्ोग नहीं लेंगे, िो उनके कार्ाकाल के िौरान प्राजधकरण द्वारा जवजनजश् चत और मलू्र्ांदकत की िानी ह ै।
7. प्राजधकरण ऐसी िजक्तर्ों का प्रर्ोग करेगी और ऐसी प्रदिर्ाओं का पालन करेगी िो उक्त अजधसूचना में जवजनर्िाष् ट हैं ।
8. प्राजधकरण सामूजहक उत्तरिाजर्त्व के जसद्धांत पर काम करेगी और अध्र्क्ष प्रत्र्ेक मामल ेमें सवासम् मजत पर पहुचंन े का प्रर्ास करेगा और र्दि सवासम् मजत पर नहीं पहुचंा िा सकता ह ैतो बहुमत का मत अजभभावी होगा ।
9. गुिरात राज्र् सरकार, दकसी जवभाग र्ा संगठन को जवजनर्िाि करेंगी, िो प्राजधकरण और सजमजत के जलए सजचवालर् के रूप में कार्ा करेगा और सभी जवत्तीर् और संभार तंत्र संबंधी सहार्ता, जिसके अंतगात वास-सुजवधा, पररवहन और उक्त अजधसूचना के अधीन उनके कृत्र्ों की बाबत अन्दर् सुजवधाएं भी हैं, उपलब्ध कराएगी ।
10. प्राजधकरण के अध्र्क्ष और सिस्ट्र्ों तर्ा सजमजत के अध्र्क्ष और सिस्ट्र्ों की बैठक की फीस, र्ात्रा भत्ता और मंहगाई भत्ता गुिरात राज्र् सरकार के जनर्मों के अनुसार संित्त दकर्ा िाएगा। [फा. सं. आईए3-13/4/2023-आई.ए. III] डॉ. सुिीत कुमार बािपेर्ी, संर्ुक्त सजचव MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 11th September, 2024 S.O. 3895(E).— In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, number S.O.1533(E), dated the 14th September, 2006 (hereinafter referred to as the said notification), the Central Government hereby constitutes the State Level Environment Impact Assessment Authority, Gujarat (hereinafter referred to as the Authority) comprising of the following Members, namely: -
1. Shri H. K. Dash, Plot No. 829, Sector-8, Gandhinagar, Gujarat-382007 - Chairman;

2. The Chairman and Members of the Authority shall hold office for a period of three years from the date of publication of this notification in the Official Gazette.
3. The Authority, shall exercise such powers and follow such procedures as specified in the said notification.
4. The Authority, shall take the decision based on the recommendations of the State Level Expert Appraisal Committee constituted by the Ministry of Environment, Forest and Climate Change vide notification number S.O.
2581(E) dated 13th June, 2023.
5. All decisions of the Authority shall be taken in a meeting and shall ordinarily be unanimous:
Provided that, in case a decision is taken by majority, the details of views, for and against it, shall be clearly recorded in the minutes and a copy thereof shall be sent to the Central Government.
6. In order to avoid any conflict of interest, the Chairman and Members of the Authority, shall.-
(a) declare to which consulting organisation they have been associated with and also the project proponents;
(b) not undertake any consultation or associate with regard to preparation of Environment Impact Assessment and Environment Management Plan for project, which is to be decided by the Authority, or to be appraised by the Committee during their tenure; and
7. The Authority shall exercise such powers and follow such procedures as specified in the said notification.
8. The Authority shall function on the principle of collective responsibility and the Chairman shall endeavour to reach consensus in each case, and if they fail to reach consensus, the views of the majority shall prevail.
9. The State Government of Gujarat shall specify Department or an organisation which shall act as Secretariat of the Authority and shall provide all financial and logistic support including accommodation, transportation and such other facilities in respect of their functions under the said notification.
10. The sitting fee, travelling allowance and dearness allowance to the Chairman and Members of the Authority, shall be paid as per the rules of the State Government of Gujarat.
