PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY कृजि एव ंककसान कल्याण मतं्रालय (कृजि, सहकाररता एव ंककसान कल्याण जवभाग) अजधसचूना नई कदल् ली, 31 िनवरी, 2020 का.आ 531(अ).—िबकक कें द्र सरकार ने डा. अिोक बनाम भारत संघ और अन् य के द्वारा दायर ररट याजचका संख् या 1988 के 1094 के मामल े में भारत के माननीय सवोच् च न् यायालय के आदेिों के अनुसरण में कीटनािकों और खतरनाक रसायनों के प्रयोग की समीक्षा करने के जलए एक अतंरमंत्रालयी सजमजत का गठन ककया था। िबकक अंतरमतं्रालय सजमजत न े8 िनवरी, 2019 और 10 अक् टूबर, 2019 को आयोजित अपनी बैठक में राइसाईकलािोल और बुपरोफेजिन के प्रयोग पर पररचचाा करने बाद उसकी समीक्षा की ह।ै इस अवसर पर पुन: यह जनणाय जलया गया ह ै कक चावल की फसल में उक् त कीट नािक की बाबत यूरोपीय संघ द्वारा जनधााररत अजधकतम अपिेि सीमा को दजृ टगत रखते हुए समग्र रूप में राइसाईकलािोल और बुपरोफेजिन के उपयोग, प्रभावकाररता और सुरक्षा का पुन: िायिा जलया िाए। और िबकक कें द्र सरकार उक् त अंतरमंत्रालयी सजमजत द्वारा अजभव् यक् त जवचारों पर गौर करने के बाद इस जन किा पर पहुचंी ह ै कक राइसाईकलािोल और बुपरोफेजिन के इस्ट् तेमाल से मानवों, पिुओं और पयाावरण को नुकसान पहुचं सकता ह।ै इससे संभाजवत रूप में प्रभाजवत होने वाले सभी व् यजक् तयों के सूचनाथा कें द्र सरकार द्वारा प्रस्ट् ताजवत मसौदा आदेि एतद्द्वारा प्रकाजित ककया िाता ह ैतथा एतद्द्वारा यह नोरटस कदया िाता ह ैकक उस तारीख से 30 कदनों की अवजध समाप् त होन ेके बाद उक् त मसौदा आदेि पर जवचार ककया िाएगा जिस पर आदेि के साथ समाजहत भारत के रािपत्र की प्रजतयां लोगों को उपलब् ध कराई िाएंगी। स.ं 493] नई कदल्ली, सोमवार, फरवरी 3, 2020/माघ 14, 1941 No. 493] NEW DELHI, MONDAY, FEBRUARY 3, 2020/MAGHA 14, 1941 सी.जी.-डी.एल.-अ.-06022020-215980 CG-DL-E-06022020-215980 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] उक् त मसौदा आदेि के संबंध में ककसी सुझाव अथवा आपज त को इस प्रकार जवजनर्दद ट अवजध के भीतर संयुक् त सजचव (पादप संरक्षण), कृजि एवं ककसान कल् याण मंत्रालय, कृजि, सहकाररता एवं ककसान कल् याण मंत्रालय, भारत सरकार, कृजि भवन, नई कदल् ली-110001 को अग्रेजित ककया िा सकता ह।ै अब, इसजलए, कीटनािक अजधजनयम, 1968 (1968 का 46), की धारा 28 के साथ परठत धारा 27 की उपधारा (2) द्वारा प्रद त िजक् तयों का प्रयोग करते हुए कें द्र सरकार एतद्द्वारा जनम् नजलजखत आदेि बनाने का प्रस्ट् ताव करती ह।ै अथाात— मसौदा आदिे
1. सजंक्षप् त िीिाक और प्रारंभ- (1) इस आदेि को कीटनािक (जनिधे) आदेि 2020 कहा िाएगा।
(2) यह रािपत्र में अपन ेअंजतम प्रकािन की तारीख से लागू होगा।
2. कीटनािकों पर जनिधे-
(1) कोई भी व् यजक् त राइसाईकलािोल और बुपरोफेजिन का आयात, जनमााण, जवजनमााण, जवक्रय, पररवहन, जवतरण, भंडारण और प्रयोग नहीं करेगा।
(2) उक् त अजधजनयम की धारा 9 के तहत राइसाईकलािोल और बुपरोफेजिन के जलए प्रद त पंिीकरण के प्रमाणपत्र को जनरस्ट् त माना िाएगा।
(3) राइसाईकलािोल और बुपरोफेजिन के जलए प्रद त पंिीकरण से संबंजधत प्रमाणपत्र रखने वाले सभी पंिीकरण धारक उन् हें पंिीकरण सजमजत के समक्ष प्रस्ट् तुत करेंग।े
(4) यकद पंिीकरण प्रमाणपत्र रखन ेवाला कोई व् यजक् त पंिीकरण सजमजत को प्रमाणपत्र वापस नहीं कर पाता ह ै तो उसके जवरुद्ध तीन महीने की अवजध के भीतर उप-पैराग्राफ (3) में उजल् लजखत उक् त धारा में प्रस्ट् तुत प्रावधानों के अनुसार कारावाई की िाएगी।
(5) प्र यके राज् य सरकार उक् त अजधजनयम और उसके तहत बनाए गए जनयमों के अनुसार ऐसे कदम उठाएगी िो वह राज् य में इस आदेि के कायाान् वयन हतेु आवश् यक समझती ह।ै [फा. सं. 13035/46/2016-पीपी-I (खंड-ii)] अतीि चंद्र, संयुक् त सजचव MINISTRY OF AGRICULTURE AND FARMERS WELFARE (Department of Agriculture, Co-operation and Farmers Welfare) NOTIFICATION New Delhi, the 31 st January, 2020 S.O. 531(E).—Whereas the Central Government, in pursuance of the orders of Hon’ble Supreme Court of India in its judgment in the case of Writ Petition No. 1094 of 1988 filed by Dr.
Ashok vs. Union of India and others, constituted an Inter Ministerial Committee to review the use of insecticides and hazardous chemicals;
Whereas the Inter Ministerial Committee, in a meeting held on 8 th January, 2019 and 10 th October, 2019 has discussed and reviewed the use of Tricyclazole and Buprofezin. It has been further decided to revisit the usefulness, efficacy and safety of the Tricyclazole and Buprofezin in a holistic manner keeping in view the maximum residue limit fixed by European Union in respect of said insecticides on rice crop;
And whereas the Central Government, after considering the views expressed by the said Inter Ministerial Committee, is of the opinion that the use of Tricyclazole and Buprofezin involves health hazards to human beings, animals and the environment;
The Draft Order, which the Central Government proposes to make, is hereby published for information of all persons likely to be affected thereby; and notice is hereby given that the said Draft Order shall be taken into consideration after expiry of a period of thirty days from the date on which the copies of the Gazette of India containing the Order are made available to the public.
भाग II खण् ड (ii) भारत का रािपत्र : असाधारण 3 Any suggestion or objection in respect of the said Draft Order may be forwarded to the Central Government within the period so specified to the Joint Secretary (Plant Protection), Ministry of Agriculture and Farmers Welfare, Department of Agriculture, Cooperation and Farmers Welfare, Krishi Bhavan, New Delhi-110001.
Now, therefore, in exercise of the powers conferred by sub-section (2) of section 27 read with section 28 of the Insecticides Act, 1968 (46 of 1968), the Central Government hereby proposes to makes the following Order, namely:- DRAFT ORDER
1. Short title and commencement.—(1) This Order may be called the Insecticides (Prohibition) Order, 2020
(2) It shall come into force on the date of its final publication in the Official Gazette.
2. Prohibition of insecticides. -
(1) No person shall import, formulate, manufacture, sell, transport, distribute, stock and use Tricyclazole and Buprofezin.
(2) The certificate of registration granted for Tricyclazole and Buprofezin under section 9 of the said Act shall be deemed to be cancelled.
(3) All registrants having certificate of registration granted for Tricyclazole and Buprofezin shall submit the same to the Registration Committee.
(4) If any person, who holds the certificate of registration fails to return the certificate to the Registration Committee, referred to in sub-paragraph (3), within a period of three months, action shall be taken under the provisions contained in the said Act.
(5) Every State Government shall take such steps under the said Act and the rules made thereunder, as it considers necessary, for the implementation of this Order in the State.
