(ख) वे पररर् िना के जलए पर्ाावरण समााात जनधाारण (ईआईए) और पर्ाावरण प्रबंधन र् िना पररर् िना, त)र्ारी के सार् क ई परामिा र्ा सार् ग नाीं करेंगे जिसे उनके कार्ाकाल िौरान प्राजधकरण, ग वा और एसईएसी, ग वा द्वारा अंकन दकर्ा िाना ा); और (ग) र्दि जपछले पााँच वषों में, प्राजधकरण मााराष्ट्र और पाले एसईएसी, िसूरे एसईएसी और तीसरे एसईएसी, मााराष्ट्र के अध्र्क्ष र्ा सिस्ट्र्क में से क ई भी, ा) दकसी भी पररर् िना के प्रस्ट्तावक के जलए परामिा सेवाएाँ प्रिान करता ा) र्ा ईआईए अध्र्र्न प्रिान करता ा), उस ाटना में ऐसे प्रस्ट्तावक द्वारा प्रस्ट्ताजवत दकसी भी पररर् िना के अंकन की प्रदक्र्ा में वे खुि क प्राजधकरण, ग वा और एसईएसी, ग वा की ब)ठकक से ाटा िेंग े
10. पाला एसईएसी िसूरा एसईएसी और तीसरा एसईएसी, मााराष्ट्र ऐसी िजिर्क का प्रर् ग करेगा और उि रािपत्र अजधसूचना में प्रगजणत की गई प्रदक्र्ाओं का पालन करें।
11. पाला एसईएसी, िसूरा एसईएसी और तीसरा एसईएसी, मााराष्ट्र सामूजाक उत्तरिाजर्त्व के जसिांत पर काम करेगी और अध्र्क्ष प्रत्र्ेक मामले में सवासम् मजत पर पए चंन ेका प्रर्ास करेगा और र्दि सवासम् मजत पर नाीं पए चंा िा सकता ा) त बए मत का मत अजभभावी ा गा ।
12. मााराष्ट्र राज्र् सरकार, प्राजधकरण मााराष्ट्र और पाले एसईएसी, िसूरे एसईएसी और तीसरे एसईएसी, मााराष्ट्र के जलए सजचवालर् के रूप में कार्ा करन ेके जलए दकसी अजभकरण क अजधसूजचत करेंगी और सभी जवत्तीर् और संभार तंत्र संबंधी साार्ता, जिसके अंतगात वास-सुजवधा, पररवान और उनके सभी कानूनी कृत्र्क की बाबत अन्दर् सुजवधाएं भी ाैं, उपलब्ध कराएगी ।
13. प्राजधकरण मााराष्ट्र के अध्र्क्ष और सिस्ट्र्, मााराष्ट्र और पाले एसईएसी िसूरे एसईएसी और तीसरे एसईएसी, मााराष्ट्र के अध्र्क्ष और सिस्ट्र्, क ब)ठक की फीस, र्ात्रा भते्त और मागंाई भते्त मााराष्ट्र राज्र् सरकार के जविर्मान जनर्मक के अनुसार भुगतान दकर्ा िाएगा। [फा.सं. िे-11013/30/2007-आईए.II (I)] सुिीत कुमार बािपेर्ी, संर्िु सजचव [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 11th January, 2021 S.O. 107(E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, number S.O. 1533(E), dated the 14 th September, 2006 (hereinafter referred to as the said Gazette notification), and in supersession of the notification number S.O. 850(E) dated the 17 th March, 2017 of the Government of India in the Ministry of Environment, Forest and Climate Change except as respects things done or omitted to be done before such supersession, the Central Government hereby constitutes the State Level Environment Impact Assessment Authority, Maharashtra (hereinafter referred to as the Authority, Maharashtra) comprising of following Members, namely:—

2. The Chairman and Members of the Authority, Maharashtra shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.
3. The Authority, Maharashtra shall exercise such powers and follow such procedures as enumerated in the said Gazette notification.
4. The Authority, Maharashtra shall take its decision on the recommendations of the State level Expert Appraisal Committees (SEACs) constituted for the State of Maharashtra by this notification.
5. 8. The Chairman and Members of the first SEAC, second SEAC and third SEAC, Maharashtra shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.
9. In order to avoid any conflict of interest,—
(a) the Chairman and Members of the Authority, Maharashtra and first SEAC, second SEAC and third SEAC, Maharashtra shall declare to which consulting organisation they have been associated with and also the project proponents;
(b) they shall not undertake any consultation or associate with preparation of Environment Impact Assessment (EIA) and Environment Management Plan for a project, which is to be appraised by the Authority, Goa and SEAC, Goa during their tenure; and [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7
(c) if in the past five years, the Chairman or any of the Members of the Authority, Maharashtra and first SEAC, second SEAC and third SEAC, Maharashtra have provided consultancy services or conducted EIA studies for any project proponent, in that event they shall recuse themselves from the meetings of the Authority, Goa and SEAC, Goa in the process of appraisal of any project being proposed by such proponents.
10. The first SEAC, second SEAC and third SEAC, Maharashtra shall exercise such powers and follow such procedures as enumerated in the said Gazette notification.
11. The first SEAC, second SEAC and third SEAC, Maharashtra shall function on the principle of collective responsibility and the Chairman shall endeavor to reach a consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail.
12. The State Government of Maharashtra shall notify an agency to act as Secretariat for the Authority, Maharashtra and the first SEAC, second SEAC and third SEAC, Maharashtra. The Secretariat shall provide all financial and logistic support including accommodation, transportation and such other facilities in respect of all its statutory functions.
13. The sitting fees, travelling allowances and dearness allowances to the Chairman and Member of the Authority, Maharashtra and the Chairman and Members of the first SEAC, second SEAC and third SEAC, Maharashtra shall be paid in accordance with the existing rules of the State Government of Maharashtra.
