2. प्राजधकरण पंिाब, के अध्र्क्ष और सिस्ट्र्, रािपत्र में इस अजधसूचना के प्रकािन की तारीख से तीन वर्ा की अवजध के जलए पि धारण करेंग े।
3. प्राजधकरण, पंिाब ऐसी िजक्तर्क का प्रर् ग करेगा और ऐसी प्रदिर्ा का अनुसरण करेगा ि उक्त अजधसूचना में जवजनर्िाष् ट की गर्ी ाैं।
4. प्राजधकरण, पंिाब इस अजधसूचना प)रा 5 के अधीन पंिाब राज्र् के जलए गरठत राज्र् स्ट्तरीर् जविेर्ज्ञ अंकन सजमजतर्क (एसईएसी) की जसफाररिक पर अपना जवजनश्चर् करेगा।
5. कें रीर् सरकार, पंिाब की राज्र् सरकार, के परामिा से प्राजधकरण पंिाब की साार्ता करने के जलए राज्र् स्ट्तर जविेर्ज्ञ अंकन सजमजत (जिसे इस अजधसूचना में इसके पश्चातउ एस.ई.ए.सी., पंिाब काा गर्ा ा)) का गठन करती ा) जिसमें जनम्नजलजखत सिस्ट्र् ा त ेाैं, अर्ाातउ: -

6. एस.ई.ए.सी. पंिाब के अध्र्क्ष और सिस्ट्र्, रािपत्र में इस अजधसूचना के प्रकािन की तारीख से तीन वर्ा की अवजध के जलए पि धारण करेंगे।
7. एसईएसी, पंिाब ऐसी िजक्तर्क का प्रर् ग करेगा और ऐसी प्रदिर्ा का अनुसरण करेगा ि उक्त अजधसूचना में जवजनर्िाष् ट की गर्ी ाैं।
8. एसईएसी, पंिाब सामूजाक उत्तरिाजर्त्व के जसद्ांत पर काम करेगी और अध्र्क्ष प्रत्र्ेक मामले में सवासम् मजत पर पए चंने का प्रर्ास करेगा और र्दि सवासम् मजत पर ना पए चंा िा सकता ा) त बए मत का मत अजभभावी ा गा ।
9. जात के दकसी जवर ध से बचने के जलए, - [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (क) प्राजधकरण पंिाब और एसईएसी पंिाब, के अध्र्क्ष और सिस्ट्र्, र्ा घ र्णा करेंग ेदक वे दकस परामिािाता संगठन के सार् सारु्क्त और पररर् िना प्रस्ट्तावक भी ाैं:
(ख) प्राजधकरण पंिाब और एसईएसी, पंिाब, के अध्र्क्ष और सिस्ट्र्, पररर् िना के जलए पर्ाावरण समाघात जनधाारण (ईआईए) और पर्ाावरण प्रबंधन र् िना पररर् िना, त)र्ारी के सार् क ई परामिा र्ा सार् ग ना करेंग ेजिसे उनके कार्ाकाल िौरान प्राजधकरण, पंिाब और एसईएसी, पंिाब द्वारा अंकन दकर्ा िाना ा); और (ग) र्दि जपछल ेपााँच वर्ों में, प्राजधकरण पंिाब और एसईएसी, पंिाब के अध्र्क्ष र्ा सिस्ट्र्क में से क ई दकसी पररर् िना के प्रस्ट्तावक के जलए परामिा सेवाएाँ प्रिान करता ा) र्ा ईआईए अध्र्र्न प्रिान करता ा), त उस घटना में ऐसे प्रस्ट्तावक द्वारा प्रस्ट्ताजवत दकसी भी पररर् िना के अंकन की प्रदिर्ा में वे खुि क प्राजधकरण, पंिाब और एसईएसी, पंिाब की ब)ठकक से ाटा िेंगे
10. पंिाब राज्र् सरकार, प्राजधकरण पंिाब और एसईएसी, पंिाब के जलए सजचवालर् के रूप में कार्ा करने के जलए दकसी अजभकरण क अजधसूजचत करेंगी और सभी जवत्तीर् और संभार तंत्र संबंधी साार्ता, जिसके अतंगात वास-सुजवधा, पररवान और उनके सभी कानूनी कृत्र्क के संबंध में ऐसी अन्दर् सुजवधाएं भी ाैं, उपलब्ध कराएगी ।
11. प्राजधकरण पंिाब और एसईएसी, पंिाब के अध्र्क्ष और सिस्ट्र् , क ब)ठक की फीस, र्ात्रा भते्त और मागंाई भते्त पंिाब राज्र् सरकार के जनर्मक के अनुसार भुगतान दकए िाएग।े [फा. सं. िे -11013/43/2007—आईए.II (I)] सुिीत कुमार बािपेर्ी, संर्ुक्त सजचव MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 3rd February, 2021 S.O. 524 (E).—In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) and in pursuance of the notification of the Government of India in the erstwhile Ministry of Environment and Forests, number S.O.1533(E), dated the 14 th September, 2006 (hereinafter referred to as the said notification), the Central Government hereby constitutes the State Level Environment Impact Assessment Authority, Punjab(hereinafter referred to as the Authority, Punjab) comprising of the following Members, namely: -

2. The Chairman and Members of the Authority, Punjab shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.
3. The Authority, Punjab shall exercise such powers and follow such procedures as specified in the said notification.

4. The Authority, Punjab shall take its decision on the recommendations of the State Level Expert Appraisal Committee (SEAC) constituted under paragraph 5 for the State of Punjab.
5. For the purpose of assisting the Authority, Punjab, the Central Government in consultation with the State Government of Punjab, hereby constitutes the State Level Expert Appraisal Committee (SEAC) (hereinafter referred to as SEAC, Punjab) comprising of the following Members, namely: -

6. The Chairman and Members of SEAC, Punjab shall hold office for a term of three years from the date of publication of this notification in the Official Gazette.
7. The SEAC, Punjab shall exercise such powers and follow such procedures as specified in the said notification.
8. The SEAC, Punjab shall function on the principle of collective responsibility and the Chairman shall endeavor to reach a consensus in each case, and if consensus cannot be reached, the view of the majority shall prevail.
9. In order to avoid any conflict of interest, - [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5
(a) the Chairman and Members of the Authority, Punjab and SEAC, Punjab shall declare as to which consulting organisation they have been associated with and also the project proponents;
(b) the Chairman and Members of the Authority, Punjab and SEAC, Punjab shall not undertake any consultation or associate with preparation of Environment Impact Assessment (EIA) Environment Management Plan for a project, which is to be appraised by the Authority, Punjab and SEAC, Punjab during their tenure; and
(c) if in the past five years, the Chairman or any of the Members of the Authority, Punjab and SEAC, Punjab have provided consultancy services or conducted EIA studies for any project proponent, in that event they shall recuse themselves from the meetings of the Authority, Punjab and SEAC, Punjab in the process of appraisal of any project being proposed by such proponents.
10. The Government of Punjab shall notify an agency to act as Secretariat for the Authority, Punjab and SEAC, Punjab and the Secretariat shall provide all financial and logistic support including accommodation, transportation and such other facilities in respect of all their statutory functions.
11. The sitting fee, traveling allowances and dearness allowances to the Chairman and Members of the Authority, Punjab and SEAC, Punjab shall be paid as per the rules of the State Government of Punjab.
