40.2 ~ ~TRfr ~ ~~ 'ij; qlff dl ~ 'ffi;r ~ or ~ ~~ cpT .3ffitR' ~ ~ 31¥Ic\Ci 'ij; ftW ~ ~ ~ cpT ~ ~I MINISTRY OF EXTERNAL AFFAIRS (SAARC DIVISION) NOTIFICATION New Delhi, the 5th August, 2013 The South Asian University First Rules, 2013 F.No.-BI-321/60/ll.- In exercise of the powers conferred by sub-section (2) of section 20 () of the South Asian University Act, 2008 (8 of 2009), the Inter-Governmental Steering Committee of the South Asian Association for Regional Cooperation (SAARC) hereby makes the first rules, for the operation of the South Asian University, to be called as the South Asian University First Rules, 2013, which shall apply to the main campus, Regional Centres, campuses or centers of the University and shall be deemed to have come into force on the 7th day of March, 201 J, namely:- RULE 1: Definitions.-
1.1 "Academic Council" means the Academic Council of the University.
1.2 "Academic Staff" means staff and posts whose function is primarily teaching or research in the University,
1.3 "Act" means the South Asian University Act, 2008.
1.4 "Agreement" means the Agreement for Establishment of University signed in New Delhi on 4th April 2007 (Annexed).
1.5 "Authority" means' any officer or body of the University who is empowered to take decisions and implement them., .;
1.6 "Bye-laws" means the Bye-laws of the University.
1.7 "Centre" means a unit of the University providing, teaching, consultancy and research facilities;
1.8 "Departments" means the Departments created within Faculties .•
1.9 "Employee" means-any person appointed by the University and includes academic and other staff of the University.
I.lo "Executive Council" means the Executive Council of the University.

1.11 "Faculty" means the faculty of the University and would comprise a unit of study of a single or a group of disciplines/subjects.
1.12 "Governing Board" means the Governing Board of the University.
1.13 "Officers of the University" means President, Vice President(s), Registrar, Director Finance, Dean of Students, Proctor, Librarian, Director of Admissions and Examinations, Director of Information and Communication Technology and other officers .so designated by the Governing Board of the University.
1.14 "Prescribed" means prescribed by Rules, Regulations and Bye-laws of the University.
J .15 "President" means the President of the University who would also be the Chief Executive Officer of the University.
1.16 "Proctor" means the Proctor of the University.
I. I7 "Regional Campus" means a campus, other than the Main Campus of the University in New Delhi, established anywhere else in SAARC countries.
1.18 "Registrar" means the Registrar of the University.
1.19 "Regulations" means the Regulations of the University.
1.20 "Research Staff' means scholars appointed for specific purpose of research by the University.
I .21 "Rules" means the Rules of the University.
1.22 "SAARC" means the South Asian Association for Regional Cooperation.
1.23 "Teacher" means Professor, Associate Professor and Assistant Professor appointed or recognized by the University, as also Honorary Professor, Visiting Professor, Visiting Scholar, Adjunct Professor, Emeritus Professor.
1.24 "University" means the South Asian University Main Campus, Regional Campuses and Centres established in pursuance ofthe Agreement for Establishment of South Asian University signed by the Member States of the South Asian Association for Regional Cooperation (SAARC) on 4th April 2007 in New Delhi.
1.25 "Visiting Scholar" means temporary member of academic I research staff invited I appointed for specific academic purpose.
1.26 "Visitor" means the Visitor of the University .
• RULE 2: Visitor.- ..:..
2.1 The Chairperson of SAARC shall be the Visitor of the University.
2.2 The Visitor shall preside over the Convocation of the University for conferring degrees including honorary degrees.
2.3 If the Visitor is unable to be present, he or she may nominate the Foreign Minister or any other eminent person to preside over the Convocation.
2 ['lWf III-~ 4] RULE 3: The Governing Board.-
3.1 Composition of the Governing Board
3.1.1 The Governing Board shall have two members from each SAARC Member-State to be nominated by respective Member-States in the manner described in Regulations.
3.1.2 The President will be ex-officio member ofthe Governing Board.
3.1.3 The Governing Board will be headed by a Chairperson who shall be from a Member State other than the one to which the President of the University belongs.
3.1.4 The Chairperson of the Board shall be elected from amongst the members of the Governing Board for a single term of one year on a rotational basis. .
3.1.5 Members of the Governing Board shall hold the position for a fixed term of three years and shall not hold the office for more than two consecutive terms ..
3. 1.6 The Secretary General of SAARC or his/her representative will participate in all meetings of the Governing Board.
3.1.7 The Registrar shall act as Secretary of the Governing Board, without any decision making roles.
3.2 Powers of the Governing Board
3.2.1 The Governing Board shall be the highest policy and decision making body of the University.
All decisions in the Governing Board shall be taken on the basis of unanimity in accordance with the principles laid down in SAARC Charter.
3.2.2 The Governing Board will oversee the academic, administrative and financial management of the University and will primarily be responsible for liaison with the SAARC Secretariat and SAARC Member States in matters relating to the University.
3.2.3 The Governing Board shall approve the plans, annual budget and academic programmes of the University.
3.2.4 The Governing Board shall have power to appoint or remove the President of the University and approve his or her emoluments and service conditions.
3.2.5 The Governing Board will nominate expert members of the selection committees for appointment of teachers and officers of the University.
3.2.6 The Governing Board will have the power to approve and amend Regulations and Bye-laws of the University and-recommend amendments in Rules to the Standing Committee for their approval.. '.
3.2.7 The Governing Board will authorize the Executive Council and the President to implement the Rules, Regulations and Bye-laws.
3.2.8 The Governing Board shall ensure the proper functioning of the Executive Council, the Academic Council and the Finance Committee as per the provisions of the Agreement, Rules, Regulations and Bye-laws.
3.2.9 The Governing Board will monitor the progress of the University through the annual report including the periodical reports submitted by the President on. behalf of the Executive Council and will have powers to give directions to the Executive Council as per Agreement, Rules, Regulations and Byelaws. ..

3.2.10 The Governing Board may refer any unresolved issues to the Standing Committee and SAARC Council of Ministers for resolution.
3.2.11 The Governing Board will have the power to fix or alter the salaries and service conditions of all employees.
Rule 4: Funding of the University.-
4.1 University will derive its funds through the following, namely:-
(a) State contributions,
(b) Students fee,
(c) License fee for residential and other kinds of accommodation,
(d) Donations and Endowments,
(e) Research Grants and Consultancies,
(f) Public - Private Partnerships, (PPP method)
(g) any other means with the approval ofthe Governing Board.
4.2 For the first phase of five years (calendar years 2010 to 20114), the share of the Member-States in funding the operational cost of the Main campus ofthe University will be as follows: Afghanistan, 2.30 million; Bhutan, 2.30 million; Bangladesh, US$ 4.92 million; India, US$ 34.42 mi1lion; Maldives, US $
2.30 million; Nepal US$ 2.95 million; Pakistan, US$ 7.85 million, and Sri Lanka, US$ 2.95 million.
4.3 Cost share of the Member-States for the operational cost of the University beyond phase 1 will be determined later.
RULE 5: Appointment and Powers of the President.-
5.1 Appointment of tbe President.
5.1.1 i) The President shall be appointed by the Governing Board. ii) He or she shall be a citizen of one of the SAARC countries and shall be a person with global perspective and understanding, particularly of the SAARC region. iii) The person should be of outstanding academic excellence having at least 10 years of teaching and research experience at the level of Professor in a recognized University or academic institutions. The person should also have proven professionalism and leadership qualities.
5.1.2 The first President of the University shall be nominated by the host country. Subsequent Presidents of the University shall be nominated by the respective Member-States of SAARC on the principle of alphabetical rotation.
5.1.3 The host country will submit a panel of three names as its nominees based on the qualification as laid down in Rule 5.1.1 for appointment of the first President by the Governing Board .

5.1.4 Subsequent Presidents will be nominated by the respective SA ARC Member States and appointed by the Governing Board in the same manner as outlined in Rule 5.1.3.
5.1.5 In the exceptional circumstance that the Governing Board does not approve any of the names included in the panel, it may request for a fresh panel from the nominating Member-State.
5.1.6 The President shall hold office for a term of five years from the date on which he or she assumes office and shall not be eligible for reappointment.
5.1.7 The President shall be entitled to such emoluments as prescribed in the Regulations.
5.2. Powers and Functions of the President.
4 ['WT1II-~ 4] 31 In addition to the powers and functions of the President given in the enclosed Agreement, the President will have the following functions and powers:
5.2.1 The President shall be responsible to maintain and promote efficiency and good order of the University.
5.2.2 It shall be the duty of the President to make every effort to ensure that the provisions of the Rules, the Regulations and Bye-laws are duly observed and the decisions taken by the authorities of the University are implemented.
5.2.3 The President shall have the power to convene meetings of the Executive Council, Academic Council and the Finance Committee and shall perform all such functions as may be necessary to carry out the provisions of Rules, Regulations and Bye-laws.
5.2.4 The President, in consultation with the Executive Council, shall actively work and facilitate the inflow of funds in term of private donation, endowments, and national or international grants, promote public-private collaboration, and University-industry interfaces, as per the guidelines approved by the Governing Board.
5.2.5 The President shall be entitled to be present at and to address any meeting of any authority or body or committee of the University, but shall not be entitled to vote thereat unless he or she is a member of such authority or body or committee.
5.2.6 If, in the opinion of the President, any emergency has arisen which requires immediate action to be taken, he or she shall take such action as he/she deems necessary and shall report the same, for approval, at the next meeting to the authority which, in the ordinary course, would have dealt with the matter. Provided that, if the action taken by the President is not approved by the authority concerned, he/she may refer the matter to the Executive Council whose decision thereon shall be final.
5.2.7 If the office of the President becomes vacant, the functions of he or she office shall, until some person is appointed under Rule 5.1 to the vacant office, be performed by the Vice President and if there are two or more Vice-Presidents, by the senior-most Vice-President.
5.2.8 The President shall exercise such other powers as may be prescribed by the Regulations.
RULE 6: Vice President.-
6.1 The President will identify up to three professors working in the University tor appointment as Vice Presidents. Subject to the availability of suitable candidates, the Vice Presidential candidates should be from SAARC Member States other than that of the President. The next President will strive to look for Vice Presidential candidates from amongst the countries other than those to which the previous set of Vice Presidents belonged.
6.2 If there are more than one Vice-Presidents, the senior most among them shall be designated "Senior Vice-President" .
6.3 Terms and conditions of service of the Vice President shall be as laid down in the Regulations.. '.
6.4 Vice Presidents will have tenure of five years and their appointment will be eo- terminus with that of the President.
6.5 The Vice President shall have the following powers and functions:

6.5.1 i) The Vice President shall assist the President in respect of such matters as may be specified and entrusted by the President on his behalf. ii) He or she shall also exercise such other powers and perform such duties as may be delegated to himlher by the President, from time to time.
6.5.2 Where the President is the Chairperson of any authority, body or committee of the University and he or she is absent for any reason whatsoever from any meeting of such authority, body or committee, he or she wi1\ authorize one of the Vice Presidents to chair the meeting. In the absence of such an authorization, the senior-most Vice President shall preside over such meetings.
6.5.3 The Vice President shall, on being authorized by the President on hislher behalf, be entitled to be present at and to address any meeting of any authority, body or committee of the University but shall be entitled to vote thereat only if the President was a voting member of that authority, body or committee.
RULE 7: Deans of Faculties>
7.1 Every Dean of Faculty shall be appointed by the President from amongst, the Professors of respective Faculties, for a period of three years and he/she shall be eligible for reappointment for a second term only if other eligible professors are not available:
Provided that when the office of the Dean is vacant or when the Dean is, by reason of illness or absence or any other cause, unable to perform the duties of hislher office, the duties of the office shall be performed by such person as the President may appoint for that purpose
7.2 i) The Dean shall be the Head of the Faculty and shall be responsible for the conduct, and standard of teaching and research in the Faculty. ii) He or she shall also perform such other functions as are laid down in by the Regulations.
7.3 The Dean shall have the right to be present and to speak at any meeting of a Board or Committee of the Faculty but not the right to vote thereat unless he or she is a member thereof.
7.4 Duties and powers of the Deans of Faculties shall be such as may be specified in Regulations.
RULE 8: Registrar>
8.1 The Registrar of the University shall be appointed by the Executive Council, by an open selection through advertisement and interview, and shall be a full-time officer ofthe University:
Provided that when the office of the Registrar is vacant or when the Registrar is. by reason of illness or absence for any other cause, unable to perform the duties of the office, such duties shall be performed by such persons as the President may appoint for the purpose.
8.2 The Registrar shall be the non-voting Member Secretary of the Executive Council as well as the Academic Council ofthe University.
8.3 Duties and powers of Registrar shall be such as may be specified in the Regulations.
RULE 9: Director FfnaRce.-
9.1 The Director Finance of the University shall be appointed by the Executive Council, by an open selection through advertisement and interview, or invited on deputation and shall be a full-time officer of the University. Provided that when the office of the Director Finance is vacant or when the Director Finance is, by reason of illness or absence for any other cause, unable to perform the duties 6 - -------- ---- ---- -- --- ['lWf 1II-l9US 4 ] 33 of office, such duties shall be performed by such persons as the President may appoint for the purpose.
9.2 The Director Finance shall be the non-voting Member-Secretary of the Finance Committee of the University.
9.3 Duties and Powers of the Director Finance will be as laid down in Regulations.
RULE 10; Other Officers of the University.-
10.1 The following shall also be the officers ofthe University, namely.-
(i) Dean of Students
(ii) Proctor
(iii) Librarian
(iv) Director of Admissions and Examinations
(v) Director oflnfonnation and Communication Technology (lCT)
10.2 Appointment and duties of Dean of Students.
10.2.1 i) The Dean of Students shall be appointed by the Executive Council from amongst the Professors of the University on the recommendation of the President

10.3.2 ii) The Dean so appointed shall be a full-time officer and shall hold office for a term of three years and may be eligible for re-appointment for one additional term.
The person who is appointed as the Dean of Students shall continue to hold his/her lien on his/her substantive post and shall be eligible to all the benefits that would have otherwise accrued to him/her but for his/her appointment as the Dean of Students.
When the office of the Dean of Students is vacant or when the Dean of Students is, by reason of illness or absence for any other cause, unable to perform the duties of hislher office, such duties shall be performed by such persons as the President may appoint for that purpose.
The duties and powers of the Dean and the Associate Dean of Students shall be as laid down in the Regulations.
Appointment and duties of the Proctor.
The Proctor shall be appointed by the Executive Council from amongst the Professors of the University on the recommendation of the President and shall exercise such powers and perform such duties in respect of the maintenance of discipline and cooperation aimed at promoting healthy academic life.in the University.
The Proctor shall hold office for a tenn of three years and shall be eligible for re-appointment for one additional tenn.
Appointment and duties oUhe Librarian.

10.4.1 The Librarian shall be appointed by the Executive Council by an open selection through advertisement and interview, and shall be a full-time officer ofthe University.
10.4.2 The duties and powers of the Librarian shall be such as specified in the Regulations.
10.5 Appointment and Duties of Director of Admissions and Examinations.
10.5.1 The Director of Admissions and Examinations shall be appointed by the Executive Council by an open selection through advertisement and interview, and shall be a full-time officer ofthe University.
10.5.2 The duties and powers of the Director of Admissions and Examinations shall be as laid down in the Regulations.
10.6 Appointment and Duties of the Director Information and Communication Technology
10.6.1 (i) The Director of Information and Communication Technology shall be appointment by the Executive Council by an open selection through advertisement and interview, and shall be a full-time officer of the University.
(ii) He/She will be responsible for implementing and maintaining in the University a state of the art in the field ofinfonnation technology and e-governance,
10.62 The duties and powers of the Director of Information'and Communication Technology shall he as laid down in the Regulations.
RULE It: The Executive Council.- The Executive Council shall consist of the following members, namely:11.1

(v) the President (ex-officio), who shall be the Chairperson of the Executive Council;
all Vice Presidents, ex-officio;
all Heads of Regional Campuses;
the Chairperson of the Library Committee;
four persons nominated by the Governing Board from amongst the leaders of industry, commerce and professional/research/educational institutions. These nominations would be on rotational basis from SAARC member States;
(vi) the Dean of Students, ex-officio;
(vii) not more than five Deans of Faculties, nominated by the President by rotation according to seniority;
(viii) the Registrar as non-voting Member Secretary; and •(ix) the ~!rt;qtor Finance as a non-voting member;
I 1.2 The nominated members of the Executive Council shall hold office for a term of two years commencing from the date of their nomination.

11.3 Two-thirds of the member of the Executive Council shall form the quorum for its meetings and decisions shall be taken by three-fourths majority of the members present and voting.
11.4 The Executive Council shall meet at least twice each year. A special meeting of the Council may be convened by the President as warranted by necessity or on signed requisition of 50% of the members of the Executive Council. The agenda for all meetings of the Council shall be supplied to each member of the Council entitled thereto not less than fifteen (15) clear working days before the day assigned.
11.5 Powers of Executive Council will be as laid down in Regulations.
RULE 12: The Academic Council>
12.1 The Academic Council shall consist of the following members, namely:
(i) the President, who shall be the; ex-officio, Chairperson of the Academic Council;
(ii) the Vice President (s), ex-officio;
(iii) Deans of Faculties, ex- officio;
(iv) Directors of Institutes set up by the University, ex-officio;
(v) Heads of Regional Campuses
(vi) Chairpersons of Interdisciplinary Research Centres, ex-officio;
(vii) Dean of Students. ex-officio;
(viii) Librarian, ex-officio;
(ix) Chairman of the Library Advisory Committee;
(x) Heads of Departments, ex-officio;
(xi) the Chairperson of Special Centres and Specialized Laboratories, ex-officio;
(xii) One Professor and one Associate Professor other than the ex-officio members from each Faculty, nominated by the President by rotation in order of seniority within the Faculty; and
(xiii) Three experts (not being employees of the University or an institution recognized by it), eo-opted by the Academic Council on the recommendation ofthe President.
12.2 All members of the Academic Council, other than the ex-officio members, shall hold office for a term of two years from the date of their nomination. The term of the members shall commence on the date of their nomination or eo- option, as the case may be.
12.3 For specific items, on a written request from the students, the President may allow up to two students to present their point of view to the Academic Council.

12.4 Two-thirds ,~.fthe membership of the Academic Council shall form the quorum for its meetings and decisions shall be taken by three-fourths majority of the members present and voting.
12.5 Powers of the Academic Council will be such as specified in Regulations.

13. I The University will have Regional Campus in different SAARC Member States by following the procedures laid down in the Regulations.
13.2 The Regional Campus will have a Head who would be the Chief Executive Officer of the campus and would administer the Regional Campus guided by the Regional Council. Powers and functions of the Head of the Regional Campus and that of the Regional Council shall be laid down in the Regulations.
13.3 (i) The Head of the Regional Campus shall be appointed by the Governing Board.
(ii) He or she shall be a citizen of one of the SAARC countries with qualifications laid down by the Governing Board.
13.4 The first Head of each Regional Campus shall be nominated by the host country and thereafter subsequent Heads of the Regional Campuses shall be nominated by the respective Member States of SAARC on the principle of alphabetical rotation and appointed by the Governing Board on the same basis as outlined in Rule 13.5 below.
13.5 The host country will submit a panel ofthree names as its nominees from which Head ofthe Regional Campus will be selected by the Governing Board.
13.6 In the exceptional circumstance that the Governing Board does not approve any of the names included in the panel, it may request for a fresh panel·from the nominating Member State.
13.7 The Head of the Regional Campus shall hold office for a single non-renewable term of five years from the date on which he/she assumes office.
13.8 The Regional Campus in any SAARC Member State would be a Centre of academic excellence that would strive to take advantage and make use of special expertise and proven knowledge and skills available in that country including its achievements in science and technology and its geographic, environmental, socio-economic and cultural features.
13.9 The governance structure, financial authority, faculty and student body of the Regional Campus will generally be in tune with those of the Main Campus, as laid down in the Regulations.
RULE 14: Faculties, Research Centres. other Institutions.-
14.I i) The University shall have such Faculties, Departments, Research Institutions, Interdisciplinary Research Centres, Specialized Laboratories, and other academic units as are specified in the Regulations. Such entities should be established by the authorization of the Governing Board.
ii) Academic programmes of the University particularly PhD, should be geared to meet the objectives stated in Article 2 of the Agreement.
14.2 New academic activities in the form of Research Centres, Research Institutions, Faculties, Departments or any other academic unit may be established in the University by following the procedures laid down in the Regulations.

14.3 English ';,nl be the official language of instruction and communication in the University.
14.4 Every Faculty shall have a Board of Studies consisting of the following members, namely:
(i) the Dean of the Faculty who shall preside over the meeting of the Board;
(ii) the Associate Deans I Heads ofthe Departments in the Faculty/Institute;

(iii) all Professors in the Faculty;
(iv) two Associate Professors and two Assistant Professor by rotation according to seniority, from within the Faculty in case the Faculty has no Departments;
(v) if the Faculty has Departments, one Associate Professor and one Assistant Professor by rotation according to seniority, from each Department within the Faculty;
(vi) three members nominated by the Academic Council for their special knowledge in any subject assigned to the Faculty or in any allied branch of knowledge;
14.5 All members of the Board other than the ex-officio members shall hold office for a term of two years. The term of members shall commence from the date of nomination.
14.6 Every Board shall have such powers and shall perform such duties as may be prescribed by the Regulations.
14.7 The conduct of the meetings of a Board and the quorum required shall be as laid down in the Regulations. ' RULE 15: Departments.-
15.1 A Faculty may have such Department or Departments as may be assigned to it by the Regulations.
15.2 Each Department shall have a Head who shall be appointed, on rotational basis, by the President from amongst the Professors of the Department for a period of two years. Provided that if any Department has no Professor, the Presiderrt may appoint one of the Associate Professors as the Chairperson of the Department.
15.3 Each Department will have an Academic Committee consisting of the following members:
(i) Head ofthe Department;
(H) Teachers of the Department;
(iii) Honorary Professors, if any, attached to the Department; and
(iv) Two persons from other faculties or Departments, nominated by the Academic Council for their knowledge in subjects allied to those dealt with in the Departments.
15.4 Two-thirds of the membership of the Academic Committee will form the quorum for its meetings and decisions will be taken by two-thirds majority of the members present and voting.
15.5 The duties and functions of a Head or Chairperson of the Department shall be such as may be specified in the Regulations.
RULE 16: The FinanceCommittee.-
16.1 The Finance Committee shall consist of the following members, namely;
(i) the President;
(H) Vice Presidents;
(iii) One person nominated by the Governing Board;

(iv) two persons from any two SAARC Member States on the principle of rotation, who are not employees of the University or of any recognized institution, at least one of them being an experienced Chartered Accountant, nominated by the Executive Council;
(v) the Registrar, as non-voting member;
(vi) two Deans of the Faculties by rotation, nominated by the President;
(vii) the Director Finance as non-voting Member Secretary.
16.2 The President shall preside over the meeting of the Finance Committee.
16.3 All members of the Finance Committee, other than the ex-officio members, shall hold office for a term of three years.
16.4 The Finance-Committee shall meet at least twice every year to examine accounts, prepare the budget and scrutinize proposals for expenditure.
16.5 The annual accounts and financial estimates of the University prepared by the Director Finance shall be laid before the Finance Committee for consideration and comments and thereafter submitted to the Executive Council for approval with or without amendments.
16.6 Two-thirds of the membership of the Finance Committee shall form the quorum for its meetings. and decisions will be taken by three-fourths majority of the members present and voting.
RULE 17: Appointment ofCommittees.- 17 The Governing Board, Executive Council or the Academic Council may appoint Committees consisting of members ofthe authority making such appointment and of such other persons (if any) as that authority in each case may think fit; and any such Committee may deal with any subject assigned to it, contingent upon subsequent confirmation by the authority which appointed it.
RULE 18: Alternate Arrangement for Presiding over meetings 1g Where, by the Statues or the Regulations, no provision is made for a Chairperson to preside over a meeting of any University Authority, Board or Committee, or when the Chairperson so provided for is absent, the members present shall elect one among them to preside at the meeting.
RULE 19: Resignatioo.-
19.1 Any member other than an ex-officio Member of any Authority of the University or Board or Committee may resign by submitting a letter of resignation addressed to the Registrar and the resignation shall take etTect from the date of acceptance by the Authority or Board or Committee, as the case may be.
19.2 Any officer of the University (whether salaried or otherwise) may resign from hislher office by submitting a"letter of resignation addressed to the Registrar. Provided that such resignation shall take effect fromlhe date of its acceptance by the authority competent to fill the vacancy.
12 ['l1JlT IU-~ 4] 39 RULE 20: Disqualification of Members of Authorities.-
20.1 A person shall be disqualified for being chosen as, and for being, a member of any of the Authorities of the University;
(i) if he or she is found insane by a competent authority;
(ii) if he or she has been involved in a case of financial embezzlement so established by a fact finding committee of the University;
(iii) if he or she has been convicted by a Court of Law for an offence involving moral turpitude and sentenced in respect thereof to imprisonment for not less than six months.
20.2 If any question arises as to whether a person is or had been subjected to any of the disqualifications mentioned in clause 20.1, the question shall be referred for decision to the Executive Council and its decision shall be final, and no suit or other proceeding shall lie in any court of law against such decision.
RU LE 21: Conferment of honorary degrees.- 21 Any proposal for the conferment of honorary degrees shall be made by the Academic Counci I to the Executive Council, and the proposal, if accepted by the Executive Council, shall require the approval ofthe Governing Board.
RULE 22: Withdrawal of degrees. diplomas distinctions, etc.- 22 The Academic Council may, by a special resolution passed by a majority of not less than threefourths of the members present and voting, recommend to the Executive Council, the withdraw any degree or academic distinction conferred on, or any certificate or diploma granted to, any person by the University for good and sufficient cause:
Provided that no such resolution shall be passed until a notice in writing has been given to that person calling upon him or her to show cause within such time as may be specified in the notice why such resolution should not be passed and until hislher objections, if any, and any evidence he or she may produce in support of them, have been considered by the Academic Council.
RULE 23: Teachers ofthe University.-
23.1 Teachers of the University shall be the following:-
(i) full time employees of the University appointed by the Executive Council as Professors, Associate Professors and Assistant Professors;
(ii) persons appointed by the Executive Council as Honorary Professors, Visiting Professors, Visiting Scholars, Adjunct Professors or Emeritus Professors ofthe University.
23.2 Teachers of the University will predominantly be the citizens of the SAARC Member States. Subject to . availability, teachers from any of the SAARC Member States should comprise at least 4% of all "teachers in the University, Up to 20% of the sanctioned posts of teachers may be filled by citizens of countries oliiside SAARC region with the proviso that' teachers from SAARC region may be appointed ifnon-SAARC teachers are not available.
23.3 All teachers will be selected strictly on basis of merit, by procedures laid down in Regulations.

23.4 Teachers appointed in a particular Faculty will have option of joining another Faculty as an Adjunct faculty member as per procedures laid down in the Regulations.
23.5 No person shall be appointed as a teacher of the University under sub-clause 23.1 above except on the recommendations of a Selection Committee constituted for the purpose except when appointed by the Executive Council under Rule 24.
23.6 The duties of the University Teachers shall include the following:-
(i) to be non-partisan, non-denominational and strictly neutral;
(ii) to teach the students by means oflectures, tutorials, discussions, seminars, demonstrations etc;
(Hi) to conduct, guide and supervise research;
(iv) to maintain individual guidance and supervise the students in extracurricular activities;
(v) to assist the authorities in preparing courses, syllabi, conducting .examinations, or organizing libraries, laboratories and other curricular and extracurricular activities of the university;
(vi) to perform such other functions and duties as are assigned to them by the University.
RULE 24: Appointment by Invitation.- 24 Notwithstanding anything contained in Rule 23, the Executive Council may invite a person of high academic distinction and professional attainment to accept a post of Professor in the University, as the case may be, on such terms and conditions as it deems fit, and on the person agreeing to do so, appoint him or her to the post.
RULE 25: Condition of Service ofemployees.-
25.1 Every employee of the University shall be appointed under a written contract, which shall be lodged with the University and a copy thereof shall be furnished to the employee concerned.
25.2 (i) Any dispute arising out of a contract between the University and any employee shall, at the request of the employee concerned, be referred to a Tribunal of Arbitration consisting of one member nominated by the employee concerned, one person nominated by the University and an umpire appointed by the Governing Board, who would serve as the Chairperson of the Tribunal, as laid down in Bye-laws.
(ii) The decision ofthe Tribunal shall be final.
RULE 26: Admissions ofStudents.-
26.1 (i) Students of the University will be selected on the basis of common admission tests according to the procedu.res laid down in the Regulations .
•
(ii) All ~~mission tests of the University will be conducted in English.
26.2 Not more than 50% of the students will be admitted from the host country.
26.3 Up to 10% of the students may be admitted from countries outside the SAARC region.

26.4 Students from the Member State other than the host country shall generally be based upon the population proportion with not less that 4% of students from each Member States provided they fulfil!
admission criteria.
26.5 If, however sufficient qualified students are not available to fill the minimum quota (4%) of any country. the President, on advice of the Academic Council, may offer the vacant seats to students from other countries after exhausting the waiting lists from other SAARC Member States.
26.6 In Regional Campuses of the University, 50% of the students will be admitted from the host country, 10% from outside SAARC region, and the remaining students will be admitted from other SAARC Member-States in proportion of their populations with a minimum of 4% of students from each Member State. If some quota seats remain vacant, they may be offered to the eligible candidates of the host country (on the panel of waiting list, after exhausting the waiting lists from other SAARC Member States).
RULE 27: Visa and Residential PermiL- 27 As per Article 6 of the Agreement, the member States will provide appropriate visas to the students, faculty and staff for travel in all SAARC Member States and grant necessary residential permits for students, faculty and the administrative staff to work in the University and its different campuses, Centres and collaborative educational institutions.
RULE 28: Rights and Responsibilities orStudents.- 28 All students admitted to the University shall have such rights and liabilities as may be specified in the . "Hand-book for Students for South Asian University" that will form an integral part of the University's Bye-laws.
RULE 29: Discipline of Students>
29.1 All powers relating to discipline and disciplinary action in relation to students shall vest In the President.
29.2 The President may delegate all or such ofhislher powers as he/she deems proper to the Proctor and to such other person or persons as he/she may specify in this behalf.
29.3 Without prejudice to the generality of hislher powers relating to the maintenance of discipline and taking such action in the interest of maintaining discipline as may seem to him/her appropriate, the President may, in the exercise of hislher aforesaid powers, order or direct that any student or students be expelled from any Department, Faculty, or Research Centre / Institution maintained by the University, Department, or be, for a stated period rusticated or be not, for a stated period, admitted to a course or courses of study in any such Department, Faculty, or Research Centre / Institution maintained by the University, or be fined a sum that may be specified, or be debarred from taking an examination or examinations for one or more semesters or that the results of student or students concerned in the examination or examinations in which he/she has or they have appeared be cancelled or withheld.

29.4 The Deans otthe Faculties, Heads of Regional Campuses, the Heads of Institutions, Departments, Research Centres or any other academic units in the University shall have the authority to exercise all such disciplinary powers over the students in their respective jurisdictions as may be necessary tor the proper conduct of such academic units.
29.5 Without prejudice to the powers of the President and the Proctor as specified in these the Rules or under Regulations, the Deans, the Heads of Regional Campuses, Heads of the Institutions, )5 42 THE GAZETIE OF INDIA: EXTRAORDINARY [PART ill -SEC. 4] Departments, Research Centres and other academic units may also frame such supplementary rules as considered essential for their specific academic functioning.
RULE 30: Alumni Association.-
30.1 There shall be an Alumni Association established for the University.
30.2 The subscription for membership of the Alumni Association shall be as prescribed by the Regulations.
30.3 No member of the Alumni Association shall be entitled to vote or stand for election unless he/she has been a member of the Association for at least one year prior to the date of the election and is a graduate of the University of at least five years' standing, provided that the condition relati ng to the completion of one year's membership shall not apply in the case of the first election after the establishment of the University.
RULE 31: Annual Report.- 31 The Annual Report of the University shall be prepared by the Executive Council under the direction of the Governing Board and shall be considered by the Governing Board before submission to the Visitor.
RULE 32: Audit of Accounts.-
32. J (i) The accounts of the University shall, once at least every year and or at an interval not more than 15 months, be audited by an experienced Audit Firm of regional or international repute, authorized by the Governing Board.
(ii) The process of selection of the audit firm will be facilitated by the Executive Council.
32.2 If the audit report points to specific problems, the same will be remedied by the University in an expedient manner through mechanisms laid down in Bye-laws.
32.3 A copy of the University Accounts along with Audit Report will be submitted to the Governing Board for consideration and approval.
RULE 33: Intelledual Property Rights.-
33.1 While it is not a principal aim of the University to undertake research solely in anticipation of profit.
financial benefits may be derived from the products of research activity in the University. Such activity must be undertaken within a framework which fairly and adequately safeguards the interests of both the individuals who create the intellectual property as well as the interests of the University.
33.2 For this purpose the University will notify from time to time, its rules for sharing the Intellectual Property Rights in the "Hand-book of Intellectual Property Rights", as laid down in the Bye-laws.
RULE 34: Policy od Procedures on Gender Based Harassment>
34.1 Gender based Harassment shall be strictly prohibited in the University and it will be applicable to all teachers, academic, administrative and service staffs and the students.
34.2 For this purpose, the "Hand-book to Counter Gender-based Harassment", as laid down in the Bye-laws, would suggest specific procedures for investigating complaints related to gender based 16 ['I11ll IlI-~ 4] 43 harassment and the provisions of punitive actions including expulsion or dismissal against the perpetrator ofthe gender based harassment.
ROLE 35: Regulations.-
35.1 Subject to the provisions of the Agreement and these Rules, the Regulations may provide for all but not restricted to following matters, namely:- •...:.

(i) the fees to be charged for courses of study in the University and for admission to the examinations, degrees, diplomas and certificates of the University;
(ii) the conduct of examinations, including the terms of office and manner of appointment and the duties of examining bodies, examiners and moderators; .
(iii) the conditions for the award offellowships, scholarships, studentships, medals and prizes;
(iv) the maintenance of discipline among the students of the University;
(v) the conditions of residence of students at the University;
(vi) the numbers, qualifications, emoluments and the terms and conditions of service, of employees of the University;
(vii) the management of Faculties, Departments, Institutions. and Research Centres maintained by the University;
(viii) the supervision and inspection of Faculties, Departments, Institutions, and Research Centres of the university; and
(ix) all other matters which by the Agreement or these Rules are to be or may be provided for by the Regulations .
The Regulations shall be made by Executive Council with the approval ofthe Governing Board.
The Regulations may be amended, repealed or added to, at any time, by the Governing Board.
Notwithstanding anything .contained in sub-clauses 35.2 and 35.3, no Regulations shall be made, amended, or added that affect adversely the conditions of residence or discipline of students, except after consultation with the Academic Council. .
No Regulations shall be made, amended or added affect adversely the admission or enrolment of students or prescribing examinations, to be recognized as equivalent to the University examinations;
or affect adversely the conditions, mode of appointment or duties of examiners or the conduct or standard of examination or any course of study, unless draft of such Regulation has been considered and approved by the Academic Council.
The Executive Council shall not have the power to amend any draft proposed by the Academic Council under Rule 35.3.) to 35.3.2 but may reject the proposal or return the draft to the Academic Council fOt;.r~sideration either in whole or in part, together with any amendments which the Executive Council may suggest.
Where the Executive Council has sent a draft to the Academic Council for reconsideration, the Academic Council shall reconsider and resubmit the draft, either in the original form or in a revised form, to the Executive Council within six months from the date of receipt of reference for the Executive Council.

35.6 All Regulations made by the Executive Council shall the submitted, as soon as may be, to the Governing Board, and shall be considered by the Governing Board at its next meeting; and the Governing Board shall have the power, by a resolution to cancel any Regulation(s) made by the Executive Council. and any such Regulation shall, from the date of such resolution, cease to have effect.
RULE 36: BYE-LAWS.-
36.1 The authorities ofthe University may make Bye-laws consistent with the Act, Agreement, these Rules and the Regulations for all, but not restricted to, the following matters. namely:
(i) laying down the procedure to be observed at the meeting of any authority, body or Committee, and the number of members required to form a quorum;
(ii) providing for all matters which by the Agreement, these Rules or the Regulations are to be prescribed by the Bye-laws; and
(iii) providing for all other matters solely concerning such authorities, bodies, or committees appointed but not provided for by the Agreement, these Rules or the Regulations.
36.2 Every Bye-law shall include provisions for giving of notice to the member of such authority, body or committee of the dates of meetings and of the business to be considered at the meeti ng and for keeping ofthe record ofthe proceedings of such meetings.
36.3 The Executive Council may direct the amendment in such a manner as it may specify, of any Byelaws made under these Rules or the Regulations, or the annulment of any such Bye-laws.
RULE 37: Degrees. Diplomas. Certificate.-
37.1 The University shall award Degrees, Diplomas and Certificates in such subjects as may be specified in the Regulations.
37.2 Degrees, Diplomas and Certificates awarded by the University will be duly recognized by educational institutions and higher education commissions / bodies in all SAARC Member States.
RU LE 38: Quality Assurance! Assessment of Main and Regional Campuses.- 38 The University will have Quality Assurance programmes for the pedagogy and evaluation of academic performance, as per the norms laid down in.the Byelaws.
RULE 39: Institutions under the University.-
39. I The University may have institutions maintained or recognized by it or associated with it.
39.2 The terms and conditions, under which any institution may be recognized by the University, and the notice of association of any institution with the University, shall be such as may be specified in Regulatio.o~. '.
RULE 40: AmeRdment of Rules.-
40.1 The Executive Council may propose amendment to the Governing Board, which will consider the proposal and take a decision. Member States may also directly propose amendments to Rules to the Governing Board at least three months before a Governing Body meeting, through the SAARC 18 ['q)TT I1I--~ 4] 45 Secretariat, which the Governing Board will consider in consultation with the Executive Council of the University and take a decision.
40.2 If the Governing Board decides in favor of the amendment, it will forward the amendment to the SAARC Standing Committee for final approval.
