No. I3|2|88-Vig.—In exercise of the powers conferred bv Section 39 read with Section 34 of the Spices Board Act, 1986 (10 of 1986), the Spices Board, with the previous approval of the Central Government, hereby makes the following regulations, namely :— !
PART—I PRELIMINARY
1. Short title and commencement.—(1) These regulations may be called the Spices Board Service (Classification, Control and Apoeal) Regulations,
1992.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions.—In these regulations, unless the context otherwise requires,—

(i) the authority empowered to make appoint ments to the post which the Board's employee for the time being holds, or
(ii) the authority which appointed the Board's employee to the post which he for tlie time being holds ;
(b) "Board" means the Spices Board constitu ted under the Spices Board Act, 1986 (10 of 1986);
(c) "Board's employee" means any person employed under the Board and includes a servant of the Central Government or State Government so employed ;
(d) "Chairman" means the Chairman of the Board ;
(e) "Disciplinary Authority" means the autho rity competent under thesi regulations to impose on a Board's employee any of the penalties specified in these regulations;
(f) "Pay" has the meaning assigned to it in F.R. 9(21) (a) (i) of the Fundamental Rules applicable to the Centrnl Govern ment employees.

(g) "Schedule" means the Schedule to these regulation^ ;
(h) "Secretary" means the Secretary of the Board ;
(i) "Service" means the se^ice under the Board;
(j) "The pay" or "Scale of pay" of a post means ihe pay or scale of pay attached tc that post.
3. Application.—(1) These regulations shall apply to all the Board's employees, but shflll not apply to— l
(a) any person in casual employment;
(b) any person or daily wages ;
(c) any person subject to discharge from ser vice on less than one monuYs notice ; and
(d) any person not brought to the regular establishment.
(2) Notwithstanding anything contained in subregulation (1)H the Board may, with the previous approval of the Central Government, by order, exclude from the operation of all or any of these regulations, any employee or groups of employees of the Board.
(3) If any doubt arises whether these regulations or any of them apply to any persons, the matter shall be referred to the Central Government for decision.
PART—II CLASSIFICATION
4. Classification of posts,—All posts under the scivice of the Board shall be classified as follows :— SI. Description of post* No.

1. A Board's post carrying a pay or scale Group 'A' of Rs. 4,000 and above.
2. A Board's post carrying a pay or a scale Group 'B' of pay of Rs. 2,900 or above but less thanRs.4,000.
3. A Board's.post carrying a pay or a scale Group 'C of pay of over Rv 1,150, but less than R». 2,900.
4. A Board's post carrying a pay or a scale Group TV of pay of Rs. 1,150 or less
PART-^III APPOINTING AUTHORITIES
5. Appointment to the service.—Appointments to posts mentioned in sub-section (1) of section 4 of the Spices Board Act, 1986 shall be made by the autho rities specified in this behalf in the Schedule.
PART—IV SUSPENSION
6. Suspension.—(I) The Appointing Authority ot any authority Co whieh it is subordinate or the Disci plinary Authority or any other authority empowered in that behalf b|/ the Chairman by general or special order, may place a Board's employe^ under suspen sion :—
(a) Where a disciplinary proceeding against him is contemplated or is pending; or
(b) Where, in the opinion of the authority afore said, he has engaged himself in activities prejudicial to the interests of the security of State; or
(c) Where a case against him in respect of any criminal offence is under investigation, in quiry or trial.
Provided that, where the order to suspension is made b)v an authority lower than the Appointing Authority or without the specific authority from the Chairman, such authority shall forthwith report to the Chairmam or the concerned authority the circum stances in which the order was made and seek the approval of the action taken by it.
(2) A Board's employee shall be deemed to have been placed under suspension \\y an order of the Ap pointing Authority :
(a) With effect; from the date of his detention if he is detained in custody, whether on a criminal charge or otherwise, for a period exceeding forty eight hours, or
(b) With effect from the date of his conviction, if, in the event of a conviction for an offence he is sentenced to a term of imprisonment exceeding forty eight hours and is not forth with dismissed or removed or compulsorily retired consequent to such conviction.
Explanation :•—The period of forty eight hours re ferred to in clause (b) of this sub-regulation shall be computed from the commencement of the imprison ment after the conviction and for this purpose, intermil'&.it pediods of imprisonment, if any, shall be taken into account.
3. Where a penalV of dismissal, removal or com pulsory retirement from service imposed upon a Board's employee under suspension is set aside in appeal or on review under these regulations and the oac^ is remitted for further inquitv or action or with any other directions, the order of his suspension shall be dccm?d to have con'inued in force on and from the date of the original order of dismissal, removal or compusory retirement and shall remain in force uitil further orders.

(4) Where a penaltv of dismissal, removal or com pulsory retirement from service imposed upon a Board's employee is iet aside or declared or render ed void in consequence of or by a decision of a Court of Law and the Disciplinary Authority, on a consi deration op the circumstances of the case decides to hold a further inquiry against him o.i the allegations on which the penalty of dismissal, removal or com pulsory retirement was originally imposed, the Boards cmplqee shall be deemed to have been placed under suspension by the authority competent so to do from the date ol' the originul order of dismissal, removal or compulsory retirement and shall continue to remain under suspension until further orders :
Provided that on such further inquiry shall be or dered unless i: is intended to m:et a situation where the Court has passed an order purely on technical grounds without going into the merits of the case.
(5) (a) An order of suspension made or deemed to have been made under ':his regulation shall continue to remain in force until it is modified or revoked by the authority competent so to do.
(b) Where a Board's emplq/ee is suspended or is deemed to have been suspended (whelher in connec tion with any disciplinary proceeding or otherwise) and any other disciplinary proceeding is commenced against him during the continuance of that suspension, 'the authority competent to place him under suspen sion may, for reasons to be recorded in writing, direct that the Board's employee shall continue to be under suspension until the 'termination of all or aniv of such proceedings.
(c) An, order of suspension made or deemed to have been made under this regulation may, at any time, be modified or revoked by the authority which made or is deemed ''o have made the order or by any authority to which that authority is subordinate.
PART V PENALTIES AND DISCIPLINARY AUTHORITIES
7. Penalties.—The following penalties may, for good and sufficient reasons, and as hereinafter provi ded, be imposed on a Board's employee, namely :— Minor penalties
(i) Censure;
fii) withholding of his promotion;
(iii) recovery from his pay. of the whole or part, of anv necuniarjv loss caused by him to the Board by negligence or breach of orders;
(iv) withholding of increments of pay;
Minor penalties (\) reduction to a lower stage in the time-scale OF pay for a specified period, with turthei direction as to whether or not the Board's employee will earn increments uf nay duri.i? the period of such reduction, and whedi'r on the exnjry or such period, the reduction will or will not hare the effect of postponing the future increments of his pa,v;
(vi) reduction to a lower time-scale of pay, grade or post which shill ordinarily be a bar to the promotion of the Board's em ployee to the time-scale of pay, grade or pos'l from which he was reduced, with or without further directions regarding condi tions of restoration to the grade or post from which 'the Board's employee was reduced and his seniority and pay on such restoration to that grade or post;
(vii) compulsory retirement;
(viii) removal from service which shall not be a disqualification for future employment under tha Board;
fix) dismissal from service which shall be a dis qualification for fut'irc employment under the Board :
Provided that in every case in which the charge of acceptance from any person of any gratification, other than legal remuneration, as a motive or reward for doing or for bearing to do any official act is establish ed, the penalty mentioned in clause (viii) or clause fix) shall be imposed :
Provided further that in ary/ exceptional case and for special reasons recorded in writing, any other penalty may be imposed.
Explanation.—-The following shall no; amount to a penalty within the meaning of this regulation, namely :
(i) withholding of increments of pay of a Board's1 employee for his failure to pass any depart mental examination in accordance with the rules or orders governing the service or post which he holds or the terms of his appoint ment; t
(ii) stoppage, of Board's employee at the effi ciency bar in the iime-scale of pay on the ground of his unfitness to cross the bar;
(iii) non-promotion of a Board's employee whether in a substantive or officiating capa city, after consideration of his case, to a grade or post for promotion to which he is eligible;
(iv) reversion of a Board's employee officiating in a higher grade or post in the service to a lower grade or post on the ground that he is considered to be unsuitable for such higher grade or post or on any adminis trative ground unconnected with his con duct;
(v) reversion of a Board's employee appointed on probation to any other grade or post.
to his permanent grade or post during or at the end of the period of probation in accordance with the terms of his appoint ment or the rules and orders governing such probation;
(vi) replacement of the services of a Board's employee whose services have been bor rowed from a State Government or the 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART 1 H _ S E C . 4 | Central Government or any other authority under the control of a State Government or the Central Government, at the disposal of the authority which had lent his ser vices;
(vii) compulsory retirement of a Board's emp loyee in accordance with the provisions re lating to his superannuation or retirement;
(viii) termination of the services—
(a) of a Board's employee appointed on pro bation, during or at the end of the period of his probation, in accordance with the terms of his appointment or the rules and orders governing such probation; or
(b) of a temporary Board's employee in ac cordarjee with the terms of his appoint ment; or
(c) of a Board's employee, employed under an agreement, in accordance with the terms of such agreement
8. Disciplinary Authorities,—(L) The Chairman may impose any of ihe penalties specified in regula tion 7 upon any Board',; employee.
(2) Without prejudice to the provisions of subregulation (1), any of the penalties specified in regu lation 7 m,ay be imposed on any Board's employee by the Appointing Authority or by any other autho rity not lower than the appointing authority em powered in this behalf by a general or a special order of the Board.
*). Authority to institute proceedings,-—(1) The Chairman or any other authority empowered by a general or special order under regulation 8 may—
(a) institute disciplinary proceedings against any Board's employee;
(b) direct a Disciplinary Authority subordinate to him or it to institute disciplinary pro ceedings against any Board's employee on whom that disciplinary authority is compe tent to impose under these regulations any of the penalties specified in regulation 7.
(2) A Disciplinary Authority competent under these regulations to impose any of the penalties speci fied in clauses (i) to (iv) of regulation 7 may institute disciplinary' proceedings against oiny Boards emp loyee for the imposition of any of the penalties speci fied in clauses (v) to fix) of regulation 7, notwithstanding that such Disciplinary Authority is not com petent under these regulations to impose any of the latter penalties.
PART VI PROCEDURE FOR IMPOSING PENALTIES
10. Procedure for imposing major penalties.—(I) No Order imposing any of the penalties specified in clauses (v) to (ix) of regulation 7 shall be made ex cept after an inquiry held as far as ro,ay be, in the manner provided in this regulation and regulation 11.
(2) Whenever the Disciplinary Authority is of the opinion that there are grounds for inquiring into the truth of any imputation of misconduct or misbehaviour against a Board's employee, it may itself inquire into, or appoint under this regulation an authority to in quire into the truth thereof. |
Explanation.—Where the Disciplinary Authority itself holds the inquiry, any reference in other subregulations of this regulation, to the inquiring autho rity shall be construed as a reference to the Discip linary Authority.
(3) Where it is proposed to hold an inquiry against a Board's employee under this regulation and regu lation 11, the Disciplinary Authority shall draw up or cause to be drawn up—
(i) the substance of the imputations of miscon duct or misbehaviour into definite and dis tinct articles of charge;
(ii) a statement of imputations of misconduct or misbehaviour in support of each article of charge, which shall contain— (a") a statement of all relevant facts, including ) any i admission or cbnfesjrion made by the Board's employee;
(b) a list of documents by which, and a list of witnesses by whom,, the articles of charge are proposed to be sustained.
(41 The Disciplinary Authority shall deliver or cause to be delivered to the Board's employee, a copy of the articles of charge, the statement of the imputations of misconduct or misbehaviour and a list of documents and witnesses by which each article of charge is proposed to be sustained and shall require the Board's employee to submit within such time as may be specified, a written statement of his defence and to state whether he desires to be heard in person.
(5) (a) On receipt of the written statement of de fence, the Disciplinary Authority may itself inquire into such of the articles of charge as are not admitted, or, if it considers it necessary to do so, appoint under sub-regu lation (2) an inquiring authority for the putpose, and where all the articles of charge have been admitted by the Board's emplovee ;n his written statement of defence, the Disciplinarv Authority shall record its findings on each charge after taking such evidence as it mav think fit, and shall act in the manner laid down in regulation 12 :
Provided that where the proceeding is institu ted in pursuance of any order under re gulation 7, the authority which instituted [«rrt III—vw 4] w r ^r ffjprjr: wiwi 15 the proceeding shall, if it is not the Disciplinury Authority, submit the records to the Disciplinary Authority concerned for disposal of the case; '
(b) ii no written statement of defence is sub mitted by the Board's employee, tUe Dis ciplinary Authority may itself inquire into die articles of charge, or may, if it consi ders it necessary so to do, appoint under sub-regulation (2) an inquiring authority for the purpose,
(c) where the Disciplinary Authority itself in quires into any article of charge or appoints an inquiring authority for holding an in quiry into such charge, it may, by an order, appoint a Board's employee or a legal practitioner, to be known as the "Present ing Officer", to present on its behalf the case in support of the articles of charge.
(6) The Disciplinary Authority shall, where it is not the inquiring authority, forward to the inquiring authority—
(i) a copy of the articles of charge and the statement of imputations of misconduct or misbehaviour; 1
(ii) a copy of the written statement of defence, if any, submitted by the Board's employee;
(iii) a copy of the statements of witnesses, if any, referred to in sub-clause (b) of clause
(ii) of sub-regulation (3);
(iv) evidence proving the delivery of the docu ments referred to in sub-regulation (3) to the Board's employee; and
(v) a copy of the order appointing the "Present ing Officer".
(7) The Board's employee shall appear in person before the inquiring authority on such day and at such time as the inquiring authority may, by a notice in writing, specify, in this behalf, or within such fur ther time, not exceeding ten days as the inquiring authortty m.ay allow.
(8) (a) Tht Board's employee may take the assis tance of any other employee of the Board, to present the case on his behalf, but may not engage a legal practitioner for the pur pose unless the Presenting Officer appoin ted by the Disciplinary Authority is a l.gal practitioner, or, the Disciplinary Authority, having regard to the c;rcumstances of the case, so permits; {
Provided that the Board's employee shall not take the assistance of any other employee of the Board if he has (wo pending disciplinary cases on hand in which he has to g;ve assistance. 1
(b) The Board's employee may also take the assistance of a retired employee of the Board to present the case on his behalf, subject to such conditions as may be spe cified by the Chairman.
(9) 11 the Boards employee who has not admitted any of the articles of charge in his written statement of defence or has not submitted any written state ment of defence, appears before the inquiring autho riiy, such authority shall ask him whether he is guilty or has any defence to make and if he pleads guilty to any of the articles of charge, the inquiring authority shall record the plea, sign the record' and obtain the signature of the Board's employee thereon.
(10) The inquiring authority shall relnrn a find ing of guilt in respect of those articles of charge to which the Board's employee pleads guilty.
(11) The inquiring authority shall, if the Board's employee fails to appear within the specified time or refuses or omits to plead, require the Presenting Oillcer to produce the evidence by which he pro poses to prove the articles of charge, and shall adjourn the case to a later date not exceeding thirtj days, after recording an order that the Board's employee may, for the purpose of preparing his defence—
(i) inspect, within five days of the order or within such further time not exceeding five days as the inquiring authority may allow, the documents specified in the list referred to in sub-clause (b) of Clause (ii) of subregulation (3).
(ii) submit a list of witnesses to be examined on his behalf. ( Note : If the Board's employee applies in writing for the supply of copies of the statements of wit nesses mentioned in the list referred to in subregulation (3), the inquiring authority shall furnish him with such copies as are available, as early as possible and in any case not later than three days before the commencement of the examination of the witnesses on behalf of the Disciplinary Authority;
(iii) give a notice, within ten days of the order or within such further time not exceeding ten days as the inquiring authority may allow, for the discovery or production of any documents which are in the possession of the Board, but not mentioned in the list referred <o in sub-regulation (3). .
Note ; The Board's employee shall indicate in his notice, the relevance of the documents required by him to be discovered or produced by the Board.
(12) The inquiring authority shall, on receipt of the notce for the discovery or production of docu ments. forward the same or copies thereof to the authority in whose custody or possession the docu ments tire kept, with a requisition for the produc tion of the documents by such date as may be speci fied in such requisition : 1
Provided that the inquiring authority may. IOT reasons to be recorded bv it in writing, refuse to recursion such of the documents as are, in its '-ijnnion. not relevant to the case.
(13) On receipt of the requisition referred to in sub-regulation (12), every authority having the cus tody or possession of the requisitioned documents 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART 111—SEC. 4] shall produce the same before the inquiring autho rity ;
Provided that if the authority having, the custody or possession of the requisitioned documents is satis fied for reasons to be recorded in writing that the production of all or any of such documents would be against the public interest or security of the State, it shall inform the inquiring authority accordingly and the inquiring authority shall, on being so in formed, communicate the information to the Board's employee and withdraw the requisition made by it for the production or discovery of such documents.
(14) On the date fixed for the inquiry, the oral and documentary evidence by which the articles of charge are proposed to be proved shall be produced by or on behalf of the Disciplinary Authority. The witnesses shall be examined by or on behalf of the Presenting Officer and may be cross-examined by or on behalf of the Board's employee. The Presenting Officer shall be entitled to re-examine the wit nesses on any points on which they have been cross-examined, but not on any new matter, without the leave of the inquiry authority. The inquiring au thority may als0 put such questions to the witnesses as it may deem fit.
(15) If it shall appear necessary before the close of the case on behalf of the Disciplinary Authority, the inquiring authority may, in its discretion, allow the Presenting Officer to produce evidence not includ ed in the list given to the Board's employee or may itself call for new evidence or recall and re-exomine any witness and in such case the Board's employee shall be entitled to have, if he demands it, a copy of the list of further evidence proposed to be produ ced and an adjournment of the inquiry for three clear days before the production of such new evidence, ex clusive of the day of adjournment and the day to which the inquiry is adjourned. The inquiring autho rity shall give the Board's employee an opportunity of inspecting such documents before they are taken on the record. The inquiring authority may also allow the Board's employee to produce new evidence. if it is of the opinion that the production of such evi dence is necessary in the interest of justice.
Note : —New evidence shall not be permitted or called for or any witness shall not be recalled to fill up any gap in the evidence. Such evidence may be called for only when there is an inherent lacune or defect in the evidence which has been produced ori ginally.
(16) When the case for the Disciplinary Authority is closed, the Board's employee shall be requited to state his defence, orally or in writing, as he may prefer. If the defence is made orally, it shall be recorded and the Board's employee shall be required to sign the record. In cither case, a copy of the state ment of defence shall be given to the Presenting Officer, if any, appointed.
(17) The evidence on behalf of the Board's emp loyee shall then be produced. The Board's employee may examine himself in his own behalf if he so pre fers. The witnesses produced by the Board's emp loyee shall then be examined and shall be liable to cross-examination, re-examination and examination by the inquiring authority according to the provisions applicable to the witnesses for the Disciplinary Au thority.
(18) The inquiring authority may, after the Board's employee close?) his case, and shall, if the Board's employee has not examined himself, gentrally ques tion him on the circumstances appearing against him in the evidence, for the purpose of enabling the Board's imployce In explain any circumstances appearing in the evidence against him.
(19) The inquiring authority may, after the comp letion of the production of evidence, hear the Present ing Officer, if any, appointed, and the Board's emp loyee, or permit them to file written briefs of their respective cases, if they so desire.
(20) If the Board's employee to whom a copy of the articles of charge has been delivered, does not submit the written statement of defence on or before the date specified for the purpose or does not appear in person before the inquiring authority or otherwise fails or refuses to comply with the provisions of this regulation, the inquiring authority may hold the inquiry ex-parte.
(21) (a) Where a Disciplinary Authority compe tent to impose any of the penalties specified in clauses (i) to (iv) of regulation 7, has it self inquired into or, caused to be inquired into the articles of any charge and that authority, having regard to its own findings or having regard to its decision on any of the findings of any inquiring authority ap pointed by it, is of thu opinion that Ihe pe nalties specified in clauses (v) to (ix) of regulation 7 should be imposed on the Board's employee, that authority shall for ward the records of the inquiry to such Dis ciplinary Authority as is competent to impose the last mentioned penalties.
(b) the Disciplinary Authority to which the re cords are so forwarded may act on the evi dence on record or may, if it is ot the opinion that further examination of any of the witnesses is necessary in the interests of justice, recall the witnesses and examine, cross-examine and re-examine the witnesses and may impose on the Board's employee such penalty as it may deem fit in accord ance with these regulations.
(22) Whenever any inquiring authority, after hav ing heard and recorded the whole or any part of the evidence in an inquiry, ceases to exercise jurisdiction therein, and is succeeded by another inquiring autho rity which has, and which exercises, such jurisdiction, the inquiring authority so succeeding may act on the evidence so recorded by its predecessor, or partly re corded by itself :
Provided that if the succeeding inquiring authority is of the opinion that further examination of any oi1 the witnesses whose evidence has already been re corded is necessary in the interests of justice, it may recall, examine, cross-examine and re-examine any [ mi II—*i» 4] V\TH TT Tsn^ . ^ S W T 17 such witnesses as hereinbefore provided.
(23)0) After the conclusion of the inquiry, a re port shall be prepared and it shal) con tain-—
(a) articles of cliaigo and the statement of the imputations ot misconduct or misbeha viour;
(b) the defence of the Board's employee in respect of each article of charge;
(c) an assessment of the evidence in respect of cac'i article of chnrg";
(d) the findings on eacii -Article of' charge and the reasons therefor.
Explanation.—-If in the opinion of the inquiring au thority the proceedings of the inquiry establish any article of ciiarge different from the original articles of the charge, i t ma> ii;.ord u.> nnihngs on such article or charge :
Provided that the findings on such article of charge shall not be recorded unless the Board's employee has either admitted the facts on which such article of charge is based or has had a rcasorable opportunity of defending himself against such article of charge;
(ii) the inquiring authority, where it is not itself the Disciplinary Authority, shall forward to the Disciplinary Authority the records of inquiry which shall include—
(a) the report prepared by it under clause (i);
(b) the written statement of defence, if, any, submitted by the Board's employee;
(c) the oral and documentary evidence produ ced in the course of the inquiry;
(d) written briefs, if any, filed by the Present ing Officer or the Board's employee or both during the course- of the inquiry; and
(e) the orders, if any, mad*.1 by the .disciplin ary Authority and the inquiring authori ty in regard to the inquiry.
11. Action on the inquiry report:- (1) The Disci plinary Authority, if it is not itself the inquiring au thority may, for reasons to be recorded by it in writ ing, remit the case to the inquiring authority for fur ther inquiry and report, and the inquiring authority shall thereupon proceed to hold the further inquiry, as far as may be, according to the provisions of regu lation 10.
(2) The Disciplinary Authority shall, if it disagrees with the findings of the inquiring authority on any article of charge, record its reasons for such disagree ment and record its own findings on such charge if the evidence on record is sufficient for the purpose.
(3) If the Disciplinary Authority having to its find ings on all or any of the articles of charge is of the opinion that any of the penalties specified in clauses
(i) to (iv) of regulation 7 should be imposed on the 1009 GT[92—3 Board's employee, it shall, notwithstanding anything contained in regulation 12, make an order imposing such penalty.
(4) If the Disciplinary Authority having retard tn its findings on all or any of the articles of charge and on the basis of the evidence adduced during the in quiry is of the opinion that any of the penalties speci fied in clauses (v) to (ix) of regulation 7 should be imposed on the Board's employee, it shall make an order imposing such penalty and it shall not be neces sary to give the Board's employee any opportunity of making representation on the penalty proposed to bo impos--'.

(ti) inf(>Ti,iing the Board's employee in writ ing of the proposal to take action against him and of the imputations of misconduct or misbehaviour on which it is proposed to be taken, and giving him reasonable opportunity of making sutih representa tion as he may wist to make against the proposal;
(b) holding an inquiry in the manner laid down m sub-regulations (3) to (23) of regula'ion JO. in every case in which the Disciplinary Authority is of the opinion that such inquiry is necessary;
(c) taking the representation, if any, submit'ed by the Board's employee under clause (a) and the record of inquiry, if any, held under clause (b) into consider ation;
(d) recording a finding on each imputation of misconduct or misbehaviour.
(2) Notwithstanding anything contained in clause
(b) of sub-regulation (1) , if in a case it is pro posed after considering the representa'ion, if any made by the Board's employee under clause (a) of that sub-regulation, to withold increments of pay and such withsholding of increments is likely to effect adversely (he amoun* of pension payable to the Board's employee or to withhold increments of pay for a period exceeding three years or to with hold increments of pay wi'h cumulative effect for any period*, an inquiry shall be held in the manner laid down in sub-regulations (3) to (23) of regu lation 10, before making any order imposing on the Board's employee any such pentlty.
(3) The record of proceedings in such cases' shall include —
(i) a copy of the intimation to the Board's employee of the proposal to take action against him;
(ii) a conv of the statement of imputations of misconduct or misbehaviour delivered to him;
(iii) his representation, if any;

(iv) the evidence produced during'the inquiry;
(v) the findings on each imputation of miscon duct or. misbehaviour; and
(vi) the ordeis on the case together with the reasons therefor.
13. Communication of order.—Orders made by tre Disciplinary Authority shall be communicated to the Board's employee who shall also be supplied with a copy of the report of the inquiry, if any, held by the Disciplinary Authority and a copy of its findings on each article of charge, or where the Disciplinary Authority is not the inquiring authority a copy of the report of the inquiring authortiy and a statement of the findings of the Disciplinary Autho rity fog'M'':cr with brief rea'-ons for its disagreement, if any, with the findings of the inquiring authority unless they have already been supplied to him.
14. Common proceedings.—(1) Where two or more Board's employees are. concerned in any cat _\ the Chairman or any other authority com petent to impose the penalty of dismissal from ser vice on all such Board's employees may make an order directing that disciplinary action against all of them may lie taken in a common procuring.
Note:—If the authorities competent to impose the penalty of dismissal on such Board's employees are different, an order for taking disciplinary action in a common proceeding may be made by the highest of such authorities with the consent of the others.
(2) Any such order shall specify -—
(i) the authority which may function as the Disciplinary Authority for the purpose of such common proceeding;
(ii) the penalties specified in regulation 7 which such Disciplinary Authority shall be competent to impose;
(iii) whether the procedure laid down in regula tion 10 and regulation 11 or regulation 12 shall be followed in the proceeding.
15. Special procedure in certain cases.—Notwithster.^n;; anything contained in regulation 10 —•
(i) where any penalty is imposed on a Board's employee on the gTOund of conduct which has led to his conviction on a criminal charge, or
(ii) Where the Disciplinary Authority is1 satis fied for reasons to be recorded by it in writing that it is not reasonably practicable to hold an inquiry in th© manner provided in these regulations, or
(iii) where the Board, in consultation with the Central Government, is satisfied that in the interest of the security of State, it is not expedient to hold any inquiry in the man ner provided in these regula'-ions, the Disciplinary Authority may consider the circumstances of the case and make sucT-i orders thereon as it deems fit.
16. Provisions regarding officers lent to Govern ments, etc.—(1) Where the services of a Board'semployee are lent to Government ot an authority subordinate thereto or to a local or oTiier authority (hereafter in this regulation referred to as "the borrowing authority"), the borrowing authority shall have th<j powers of the Appointing Authority for the purpose of placing such employee under suspension and of the Disciplinary Authority for the purpose of conducting a disciplinary proceeding against him :
Provided that the borrowing authority shall forwthwith inform the authority which lent the services of the Board's employee (hereafter in this regulation referred to as "the lending authority") of the circums tances leading to the order of suspension of such Board's employee or the commence ment of the disciplinary proceeding, as the case may be.
(2) Tn the light of the findings in the disciplinary proceeding conducted against the Board's emp loyee,—
(i) if the borrowing authority is of the opinion that any of the penalties specified in cla uses (i) to (iv) of regulation 7 should bo imposed on the Board's employee, it may, after consultation with the lending autho rity, make .such orders on the case as it deems necessary :
Provided that in the event of a difference of opinion between the borrowing authority and the lending authority, the services of the Board's 'employee shall be replaced at the disposal of the lending authority;
(ii) if the borrowing authoirty is of the opinion that any of the penalties specified in cla uses (v) to fix) of regulation 7 should be imposed on the Board's employee, it shall replace his services at the disposal of the lending authority and transmit to it the proceedings of the inquiry and thereupon the lending authority may, if it is the Discipilinary Authority, pass, such orders there on as if may deem necessary, or, if it is not the Disciplinary Authority, submit the case to the Disciplinary Authority which shall pass such orders on the case as it may deem necessary.
Explanation.—-The Disciplinary Authority may make an order under ihis sub-regulation on the basis of the record of the proceedings transmitted to it by the borrowing authority, or after holding such further inquiry as it may deem necessary as far as< may be, in accordance with regulation 10.
17. Provisions regarding officers borrowed from Government, e tc—(1) Where an order of suspen sion is made or a disciplinary proceeding is condueled against an employee whose services have been borrowed from a Government or an authority subordinate thereto or a local or other authority, the authority lending his services (hereafter in this regulation referred to as "the lending autho rity") shall forthwith be informed of the circum stances leading to the order of suspension or of the commencement of the disciplinary proceeding, as the car.'e may be.

(2) In the light of the findings in the disciplinary proceeding conducted uguinst the Board's employee, if the Disciplinary Authori y is- of the opinion that any of the penalties specified in clauses (1) to (iv) of regulation 7 should be imposed on him, may, subject to the provisions of sub-regulation (2) of regulation 11 and after consultation with the lending authority, pa?,s such orders" on 'the case as it may deem necessary :
Provided that
(i) in the event of a difference of opinion bet ween the borrowing authority and the lending authority, the services of the emplovee shall be replaced at the disposal of the lending authority;
(ii) if the Disciplinary Authority is of the opinion that any of the penalties specified in clauses
(v) to (ix) of regulation 7 should be im posed on the employee, it shall replace the services of such employee at the disposal of the lending authority and transmit to it the proceedings of the inquiry for such action as it may deem necessary.
PART-VU APPEALS
18. Orders against which no appeal lies.—Notwith standing anything contained in this Part, no appeal shall lie against—
(i) any order made by the Central Government;
(ii) any order of an interlocutory nature or of the nature of a step-in-aid or the final dis posal of a rlisein'inarv ^ronseding, other than an order of suspension;
(in) any order passed by an inquiring authority in the course of an inquiry under regula tion 10 19, Orders against which appeal lies.—Subject to the provisions of regulation 18, a Board's employee may prefer an appeal against all or any of the fol lowing orders, namely :—
(i) an order of suspension made or deemed to Have been made under regulation 6;
(ii) an order imposing any of the penalties spe cified in regulation 7, whelher made by the Disciplinary Authority or by any reviewing authority;
(iii) an order enhancing any penalty, imposed under regulation 7;
(iv) an order which— fa) denies or varies to his disadvantage, his pay, allowances, peusion or other condi tions of service as regulated by regula tions or by agreement; or 'b ) interprets to his disadvantage the provi sions of any 5uch reflation or agree ment;

(v) an order—
(a) stopping him at the efficiency bar in tho time-scale of pay ou the ground of his unfitness 'io c;oss the bar,
(b) reverting him while officiating in a. higher service, grade or post to a lower service, grade or post, otherwise than as a penal ty,
(c) reducing or withholdirg the pension or denying the maximum pension admissible to him under the rules;
(d) determining the substance and other allow ances to be paid to him for the period of suspension or for the period during which he is deemed to be under suspen sion or for any portion thereof;
(e) determining his pay and allowances—
(i) for the pteriod of suspension, or
(ii) for the period from the date of his dis missal, removal, or compulsory retire ment from service, OT from the date of his reduction to a lower service, grade, post, time-scale of pay or stage in a time-scale of pay, to the date of his re instatement or restoration to his service, grade or post; or
(f) deermining whether or not the period from the date of his suspension or from tho date of his dismissal, removal, compulsory retirement or reduction to a lower service, Sade, post, time-scale of pay or stage a time-scale of pay to the date of his reinstatement or restoration to his service, grade of post shall be treated us a period spent on duty for any purpose.
Explanation.—In this regulation—
(i) the expression "Board's employee" includes a person who has ceased to be in the Board's service;
(ii) the expression "pension" includes additional pension, gratuity and sny other retirement benefit.
20. Appellate Authorities—(1) A Board's em ployee, including a person w^o has ceased to be in Board's service, may prefer an anneal against all or any of the orders specified in regulation 19 to ihe authority specified in this behalf in the Schedule.
(2) Notwithstanding anything contained in subregulation (1) —
(i) an am^nl aenin-t an o>"der in a common proceeding held under regulation 14 <;hn|] Ire to <he au/horifv <o which the authority functioning as the Disciplinary Authority for the m.rrxw of ffnt proceeding is imme diately subordinate;

(3) A Board's employee may prefer an appeal against an order imposing any of the penalties specified in regulation 7 to the Central Government, where no such appeal lies to that authority under sub-regula'ion
(1) or sub-regulation (2) , if such penalty is imposed, by any authority of the Board on such Board's employee in respec' of his activities connected with his work as an office-bearer of an association, federa tion or union recognised: by the Board as a service organisation.

(3) In an appeal against any o*her order specified in reeu'ation 19, the appellate authority shall consider all the circumstances of the case and make such orders as it may deem just and equitable.
24. Implementation of orders in appeal.—The authority which made the order appealed against shall give effect to the orders passed by the appellate authority.

PART VIII PART IX .REVISION AND REVIEW
25. Central Government's power to revise.—
(1) Notwithstanding anything contained in these regulations, the Central Government may, at any time, either on its own motion or otherwise, call for the records of the case, revise any order made under these regulations or under the rules repealed by regu lation 29 from which an appeal is allowed, but from which no appal has been preferred or from which no appeal is allowed, and may—
(a) confirm, modify or set aside the order; or
(b) confirm, reduce, enhance or set aside the penalty imposed by the order, or impose any penalty where no penalty has been imposed; or
(c) remit the case to the authority which made the order or 'o any other authority, d'recHug such aii'hority to make such further inquiry as' it may consider proper in the citcumistances of the case; or
(d) pass such other1 orders as it may d':cm fit:

26. Chairman's power to review.—-The Chairman may ou his own motion or otherwise call for records of the case in a disciplinary proceeding taken under these regulations by any puthori y subordinate to him:, review any order passed in such a case and pass such orders as he deems fit, as if' the Board's em^Vivee had preferred an appeal to him against such order:
Provided that the powers of rev'w, under this regula ion may also be exercised m respect of orders specified in c'ausc (iv) of regulation 19;
Provided further T,,j"jt no action mvW thi.- regula tion shall be initiated more than six mon'hs af c - the date of the order to be reviewed.
MISCELLANEOUS
27. Service of orders, notices, etc—Every order, notice and o?her process made or issued under these regulations shall be served in person on the Board's employee concerned or communicated to him by re gistered post.
28. Power to relax time-limit and to condone delay.—Save as otherwise) expressly provided* in these regulations, the authority competent under these regulations to make any order may, for good and sufficient reasons or if sufficient cause is shown, ex'end the time specified in these regulations for anything required to be done under these regulations or condone any delay.
2l). Repeal arid saving.— (J) The Cardamom Board Service (Classification, Con IT1 and Appeal) Rules, J 971 are bei'iby repealed :
Provided thai-— fa) such repeal shall not affect the previous operation of {he said rules, or any notifica tion or order made, or anything done or anj action taken, thereunder;

(3) An appeal pending at the commencement of the^o res.,ulai;ons against an order made before such commencement shall be considered and orders thereon shall be made, in accordance with fhese regulations, as if such orders were made and the appeal were preferred under these regulations.
(4) As from the commencement of these rejrulationsi any appeal or application for review or revision against any orders made before such commencement shall be preferred or made under 'hese regulations as if such orders were made under these regulations.
30. Removal of doubts.—If any doubt arises as to the interpretation of any of the provisions of these regulations, the matter shall be referred to the Central Government for* decision.
