To be Published in Part II, Section 4 of the Gazette of India Government of India Ministry of Defence Notification Delhi, July 10, 2015 SR.O.27. In exercise of the powers conferred by sub-section (1) of section 123 of the Coast Guard Act, 1978 (30 of 1978), the Central Government hereby makes the following rules further to amend the Coast Guard (General) Rules, 1986, namely:

1. (1) These rules may be called the Coast Guard (General) Amendment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Coast Guard (General) Rules, 1986 (hereinafter referred to as the said rules), in rule 7, in clause (a), after sub-clause (i), the following sub-clause shall be inserted, namely:- "(ia) Additional Director General"

4. In the said rules, in rule 21, in the table, in column 1 relating to "Competent Authority", for the words "Deputy Director General, the words "Additional Director General shall be substituted

5. In the said rules, in rule 22.-

(a) in sub-rule (5).

(i) in clause (b), for the words "the service", the words "the service, or shall be substituted.

(ii) after clause (b), the following clause shall be inserted, namely:- "(c) Compulsorily retired from the service.":

(b) in sub-rule (6), for the words "or remove the officer from the service", the words "or remove the officer from the service or compulsorily retire him from the service with pension and gratuity, if any, admissible to him" shall be substituted.

(c) in sub-rule (8), for the words "order as it may deem fit for the dismissal or removal of the officer", the words "order as it may deem fit for the dismissal or removal of the officer or compulsorily retire him from the service with pension and gratuity, if any, admissible to him." shall be substituted.

6. In the said rules, in rule 23, in sub-rules (1), (3), (4) and (5), for the words "Deputy Director General", the words "Additional Director General" shall be substituted.

7. In the said rules, in rule 24, in sub-rules (1) and (3), for the words "Deputy Director General, the words "Additional Director General shall be substituted.

8. In the said rules, in rule 25, for the words "Deputy Director General", the words "Additional Director General" shall be substituted.

9. In the said rules, in rule 26, in sub-rules (4) and (5), for the words "Deputy Director General", the words "Additional Director General shall be substituted.

10. In the said rules, in rule 27, in sub-rules (2) and (3), for the words "Deputy Director General, the words "Additional Director General" shall be substituted.

11. In the said rules, in rule 29, in the table, in column (4) relating to "Prescribed authority",

(i) against section 9, in item 3, for the words "Deputy Director General, the words "Additional Director General shall be substituted;

(ii) against section 13(1), in item 2. for the words "Deputy Director General", the words "Additional Director General" shall be substituted.

12. In the said rules, in rule 37, the following proviso shall be inserted, namely;

"Provided that when character or reputation of an officer is likely to be a material issue, the Presiding Officer of such inquiry wherever possible, will be senior in rank and other members at least equivalent in rank to that officer."
