CHAPTER.I Short title and commencement These Rules may be called the State Highways Authority of Jharkhand (appoinUnent, terms of offrce and other conditions of service of the expert *L*U.rt of the governing council, member (technical), member (finance) and member (adiinistation), powers and duties of the chairperson, chief executive officer and other members of the committee, budgel accounts, audi! investment of funds and power to enter premises) rules, 2010' Thry shall come into with effect from their publication in the Official Gazette.

Definitions In these rules, unless the context otherwise requires;

"Act,'means the State Highways Authority of Jharkhand Act, 2007;

"Annual Report" means the Annual Report referred to in Section 25 of the Act;

"Annual Statement of Accounts" means statement of accounts to be prepared on annual basis as per advice of the Accountant General, Jharkhand as referred to in Section 26 of the Act;

'Audit Officer" means the Accountant General, Jharkhand and includes a person appointed by him in connection with the audit of accounts of the Authority;

f "chairperson" means the chairperson of the Governing council of the Authority;

"Executive Committee" means the Executive Committee under section l0 of the Act;

"Financial Year" means the financial year of the State Government starting from the first day of April each year and ending on thirty frst March of ttre following year.

"Form" means a form appended to these rules;

"Government" means the Government of Jharkhand;

"Member" means the Member of the Goveming Council of the Authority wrder section 4 of the Act;

"Sectiorr" means a Section of the Act;

"Vice Chairperson" means the Vice Chairperson of the of the Governing Council of the Authority;

Words and expression used herein and not,defined but defined in the Act shall have the meaning respectively assigned to them in the Act.

uFundu means the State Highways Authority Fund constihrted under section 2l of the Act;

CIIAPTER.II APPOINTMENT, TERMS OF OFFICE AND OTHER CONDITIONS OF SERVICE OF THE EXPERT MEMBERS OF THE GOVERNING COUNCIL AND MEMBER (TECTINICAL), MEMBER (FINANCE) AND MEMBER (ADMINISTRATION) Appointment of expert Members The Expert Members shall be appointed by the Governing Council on the recommendation of the Selection Committee consisting of :-

(i) Is employed in the cental Government, or any state Government or Public Sector UnJertaking or the Autonomous Body established under Law for the time being in force;

(ii) Has held a Post(s);

(a) For at least 3 yeius as General Manager in a Public Sector Undertaking/lointSecretaryinStateGovernmenUDeputy Secretary in Cental Government and

(b) no, at ieast 15 years in the field of Economics, Finance, Administration or Banking

(iii) Desirable Qualification for a person qualified under sub-rule (A) is as under:-

(i)

(ii) Has a degree in CMI Engineqring i and Is employed in the cental Government or a state Government or Public Undertaking or an autonomous body established under law for the time being in force ; and

(iii) Has held a post(s)-

(a) For at least 4 years as General Manager in a Public Sector Undertaking/ Superintending Engineer in State Government or for 8 years as Deputy General Manager in a public Sector Undertaking / Executive Engineer in State Government and

(b) For at least 15 years in the field of Highway Engineering.

Disqualification for appointment as Expert Member of ttre;Governing Council A person shall be disqualified for being appointed as an expert-member of the Governing Council if he:-

(a) has been convicted and sentenced to imprisonment for an offence which in the opinion of the Governing Council, involved moral hupitude; or

(b) is an undischarged insolvent; or

(c) is of ursound mind and stands so declared by a competent court; or

(d) has been removed or dismissed from the service of ttre Government or a Corporation owned or controlled by any , State Government; or Government of India or

(e) has, in the opinion of the Governing Council , such financial or other interest in the Authority as is likely to affect prejudicially the discharge by him of his functions as an expert-member of the Governing Council.

Medical Fitness No person shall be appointed as an Expert Member unless he is declared medically fit by a Medical Board to be constituted by the Governing Council for the purpose.

Terms of Office The Expert Member shall hold ofEce for a tenn of 3 years.

Termination of Appointment The appointment of the Expert Member may be terminated on three months notice by either side without a-ssigning any reason thereof.

CHAPTE.R-III POWERS AI\[D DUTIES OF THE CHAIRPERSON, CHIEF EXECUTIVE OTTICER AND OTIIER MEMBERS OF THE COMMITTEE Administration and Management The Goveming Council shall be the highest polioy making body of the Authority.

Subject to these Rules and such Rules as may hereafter be made from time to time, the administation and management of the Authority shall vest in the Governing Council.

The Govenring Council will periodically review and monitor the hctivities of the Authority and take such measures as deemed recessary to meet the objectives of the Authority.

The Governing Council will be assisted by the Exeoutive Committee for the total technical, financial and adrninisfiative management of the Authority under the overall confiol and guidance of the Goveming Council.

The Executive committee will be competent to authorize any of its members or officers of the Authority to sign and execute documents and contracts on behalf of the Authority.

The Executive Committee may appoint, such committees and subcommittees to assist itself in discharge of its functions and with such powers, durations (of existence) and on such terms as it may deem fit and can also dissolve any or all of them.

Powei and Duties of the Governing Council The Governing Council shall have the following powers and functions, namely to:

Frame Policy Guidelines and directives for efiicient functioning of the Authority.

Approve the Amual Budget of the Authority.

Approve the Balance Shee! annual report and Audited Accounts for the previous financial Year.

Determine the sfength and conditions of service of personnel to be appointed by the AuthoritY Delegate such of its powers to any officer or member of the Authority and ,onrdt rt committees to assist itself in exercise of its firnctions as it may consider nesessary and ProPer,

13. Power and Duties of the Chairperson The Chief Minister, Governmlnt of Jharkhand shall be the ex'offrcio Chairperson of the Governing Council of the Authority' I The Chairperson shall have the overall power of supervisiorU direction and contol over all affairs of the Authority and its functioning.

4 The Chairperson shall preside over the Meetings of the Governing Council" In his absince the Vici Chairperson shatl preside over the Meetings and in absence of the chairperson, thi powers of the Chairperson shall be vested in the Vice-Chairperson. In the absence of both, the Minister (member) of the Governing Council authorized by ttre Chairperson shall be the presiding oflicer' 5 In case the votes for and against a particular issue are equal the Chairperson shall exercise his casting vote.

6 The Chairperson shall exercise the powers of the Governing Council of the Authority in the interregnum between two Meetings of the Governing Council. All decisions taken by the Chairperson, acting in such gapacity, shall be placed in the next Meeting of the Governing Council for ratification.

t4. Power and Duties of the Executive Committee Subject to the general confiol and supervision of the Governing Council, the B*."rrtive Coilnrittee shall generally pursue and carry out objectives of the Authority as set forth in the Act.

The Executive Committee shall exercise all executive and finanoial powers of the Authority, subject to such directions as may be issued by the Governing Council from time to time.

In particular and without prejudice - to the generality of the foregoing provisions, the Executive committee shall have the power to Elr{gug TIETd qrreqR, 2 ;rirtrR, 2010 Prepare and execute detailed plans and programmes for the fi,rtherance of the objectives of the Authority" To consider the annual and supplementary budgets placed before it and pass them with such modifications as may be deemed necessary, for submission to the Governing Council.

Prepare annual report and accounts of the Authority for the consideration of the Governing Council" iv Appoint staffas per stength and on terms sanctioned by the Governing Council" vll Appoint the Technical Agencies and determine the tasks to be performed by them.

Monitor the physical and financial progress of works and exp enditure incurred thereon.

Take up research activities relating to infrastructure, including execution of pilot projects by appropriate Technical tnstitutions.

Engage the services of Technical Experts as and when necessary.

Arange suitable Training Programmes for officers of the Authority as well as the State Government deptt. concerned with the implementation of the Road Programmes.

Receive and to have custody of the firnds of the Authority and manage the properly of the Authority.

Remain in overall Charge of planning, implementation and monitoring of all activities of the AuthoritY;

Remain in overall charge of the funds of the Authority and open and operate the Authority's accounts in the Bank($ as per rules / guidelines/ decision of the Authority;

The Chief Executive Officer shall preside over the Meetings of the Executive Committee for which proceedings shall be maintained;

The Chief Executive Oflicer may call a meeting of the Executive Committee at any time;

The Chief Executive Officer shall exercise such financial potvers as are delegated by the Governing Corurcil;

The Chief Executive Officer shall be the Appointing Authority for all the posts sanctioned by the Governing Council, on deputation, contact or part-time basis to the Authority;

The Chief Executive Offrcer shall be authorised to invite any other persons to aftend the Meeting of the Executive Committee to aid in discharge of its functions;

The Chief Executive Officer shall exercise the powers of the Executive Committee of the Authority in the interregnum between two Meetings of the Executive Committee. All decisions taken by the Chief executive Officer, acting in such capacity shall be placed in the next Meeting of the Executive Committee for ratification;

The Chief Executive Ofiicer shall have all necessary powers for carrying on the day to day functions of the Authority;

Prescribe duties and responsibilities of all officers and employee(s) of the Authority and exercise such supervision and disciplinary control thereupon as may be reasonable subject to provisions of relevant regulations, if any;

To exercise such powers as may be necessary for achieving the objectives of the Authority subject to directions of the Governing Council" 35 l0 ll l3 ..

Be responsible for formulation and management of all the contracts in t ,o*.ition with Engineering aspects of the Authority.l ., Scrutinize the technical proposals, DPR's, technical viability of the project,' ' ;;;-n"r.rrury modifications and recommend the proposal for the apProval of the AuthoritY' I Examine and make recommeodations on all proposals pertaining to technical features *a Gigrs and, where ever necessary may take expert opinion for the PurPose' 4 Examine the requirement of funds for Projects and other purposes according to the approved progranrme and make thenecessary recommendation in this regard.

17. Pow'er and Duties of the Member (Administration) Member (Admtnistration) shall be a full time member of the Auttrority and shall be responsible for the adminishation of the affairs of the Authority subject to the direction and guidelines issued by the Authority.

In particular and without prejudice to the generality of the foregoing provisions, the Member (Adrninistation) shall I Be responsible for establishment and Administrative matters of the Authority.

Z Be responsible for co-coordinating with Road Construction Departrrent and other agencies/organizations for legal, legislative, administrative and other residual matters not handled by any other member.

3 Monitor compliance of the decisions of the Governing Council and Executive Committee and assist in formulation of agenda.

4 Be responsible for preparation of annual report on the working of the Authority and its submission to the State Govemment and cause to place it in ttre Legislative Assembly after approval by the Authority on a date not later than the dates specified in this regard.

5 Be responsible for matters relating to Land Agquisition, Forests & Environment and shifting of utilities.

18. Power and Duties of the Member (Finance) shall be a full time member of the Authority and he, as' the principal Finance Officer of the Authority, shall be in overall charge of the Finance Wing of the Authority subject to the direction and guidelines issued bY the AuthoritY' In particular and without prejudice to the generality of the foregoing provisions, the Member (Finance) shall I Be responsible for the Annual Accounts of the Authority and its ' Budgegihich shall be prepared under his overall supervision and guidance.

Z Be responsible for managing and monitoring the fund of the Authority.

3 Be responsible for formulating models for mobilization of institutional resources including external iid, private investrnent and through other financial instruments besides mobilizing grant-in-aid and all other activities incidental thereto.

4 Act as the financial advisor of the Authority' 5 Be responsible for maintaining tue and proper -accounts of the Authority including checking and auditing in respect thereof periodically.

(2) CIIAPTER-IV BUDGET, ACCOIINTS AND AUDIT Preparation and submission of budget The budget estimates of the Authority for every financial year shall be prepared in forms A-l to A-5 and fonn C by the Chief Executive officer or such employee of the Authority as maybe authorized by him in this behalf.

A copy of the budget estimates so prepared shall be sent to eachl Member at least'fourteen days before the meeting of the Authority at which such estimates are to be considered.

The Authority shall consider and sanction the budget estimates with such changes as it thinls fit at the meeting fixed for the purpose.

The budget estimates of the next financial year of the Authority shall be forwarded to the state Government by the 15th day of ootober, of the ongoing financial year;

Provided that the state Government may at the request of the Authority fix such later date, but not beyond the 3 ls day of December.

Supplimentary budget The Authority may, where necessary, also forward to the state Government the Supplementary budget in respect of the financial year to which it relates, in Forms A-l to A-5 before such date as may be specified by the state Government.

Accounts of the Authority The accorurts of the Authority including:

(a) all sums of money received and expended by the Authority.

(b) all sales and purchases of goods or services of the Authority.

(c) the assets and the liabilities of the Authority shall be maintained in such forms as may be specified by the State Govemment from the time in consultation with the Accountant General of Jharkhand.

Preparation and suhmission of annual report and annual account The Authority shall prepare, as soon as may be, after the oommencement of each financial year:'

(a) the annual report; and

(b) the annual statement of accounts as the state Govemment may in consultation with the Accountant General of Jharkhand, direct.

The Annual report shall include an account of the activities of the Authority during the previous financial year on the following matters namely:-

(a) a statement of corporate and operational goals and objectives of the Authority;

(b) annual targets and physical and financial terms set for various activities in the back-ground of clause (a) above together with a brief review of the actual performance with reference to those targets;

(c) an administative report on the activities of Authority during the previous financial year and an account of the activities which are likely to be taken up during the ongoing financial year;

(d) a summary of the actual financial results during the previous financial year and year of repor! as indicated by way of statement of

(i) income and expenditure (ii) souroes and application of funds and

(iii) cash flow.

(e) important changes in policy and specific measures either taken or proposed to be taken, which have influenced or are likely to inlluence the profitability or functioning of the Authority;

(f) new projects or expansion schemes contemplated together with their advantages, financial implications and programrne foi execution;

(g) important changes in the organizational set up of the Authority;

(h) report on human resources and welfare activities of the Authority;

and

(i) report on such other miscellaneous subjects as deemed fit by ttre . Authority or as the State Government may direct.

(3) The annual report shall be plaoed for adoption in the meeting of the Authority and shall be signed by the Chief Executive offioep or in his absence by two members authorized for the purpose by the Chidf Executive Officer and authenticated by fi*ing the common seal of the Authority and required copies thereof shall be submitted to the State Government by the 30ft day of September.

The annual accounts of the Authority, after approval of the Authority, shall be signed on behalf of the Authority by its Chief Executive officer or in his absence by trvo members authorized for purpose by the Auttrority and authenticated by affixing the common seal of the Authority and shall be fonrarded for audit to the Accountant General ,Jharkhand not later than 30th day of June of each calendar year or by such date as extended by the State Government.

The Audit Officer shall audit and report on the annual accounts of the Auttrority and certiS whether in his opinion the annual account contains all particulars and are properly drawn up to as to exhibit a true and fair state of affairs of the Authority and in case he has called for any inforrnation from ttre Authority or any of its officers, whether it has been given and whether it is satisfactory.

The Authority shall be borurd to give information and explanation in its annual report containing, inter-ali4 duly audited accorurts or in an addendum thereto on every reservation, qualilication or adverse remarks contained in

(8) i the Auditor's report duly signed by its Chief Executive oftricer or in his absence by two members so authorized by the Authority and authenticated by affrxing common seal of the Authority.

The annual accounts and the auditor's report thereon along-with the annual report shall be submitted to the State Government by 13th day of September or by such date as extended by the State Government.

(9) Cost of Audit :- The Authority shall arrange to pay to the Accountant General Jharkhand, the expendinre incurred by him in connection with the annual audit of its accounts, within three montfu from the date on which the demand is made by him.

CIIAPTER.V INVESTMENT OF FI]NDS AND RESERVE FUND Manner of Investment of Fund All money standing at the credit of the Fund which can not immediately be applied for the purposes specified in sub-section (2) of section 2l of the Act, shall be deposited in any Nationalized or Scheduled Bank specified in the First Schedule to the Banking Companies (Acquisition and Transfer of Undertaking) Aot, 1910 (5 of 1970) or the Banking Companies (Acquisition and Transfer of Undertaking) Act, 1980 (40 of 1980) or in such Financial Institutions as may be decided by the Goveming Council.

Reserue Fund

(l) h respect of every loan raised by the Authority not being a loan repayable before the expiration of one year from the date of the loan, the Authority 23, 2,4.

(2) shall set apart a sum half-yearly, out of its income in a reserve fund, sufficient to liquidate the loan within a period which shall not be in any case exceed thirty years or the period fixed by the State Government..

The sums set apart by the Authority under sub-rule (l) may be invested in securities of the State Government/Cental Government or in such other securities or in such other manner as the Goveming Council may approve in this behal{ for the purposes of the Act by the Authority" The Authority may applythe sums accumulated in a reserve fund or any part thereof towards the discharge of the loan liabilities.

i A reserve fund established for the liquidation of any loan shall be subject to annual examination by such person as may be appointed by the Governing Council in this behalf and the person so appointed shall ascertain that the reserye fund has been judiciously invested and whether the contribution into the fund requires to be modified to meet the repayment obligations or any other matter as specified.

CHAPTER.VI PO}YER TO ENTER LAND OR PREMISES Mode of service on notice Before entering upon any land or premises under section 33 of the Act, the authorized person shall serve on the owner of the land or premises intended to be entered upon" notice in Form B, The notice may be served by delivering or tendering a copy of such notice to the person for whom it is intended or his representative or by sending it by registered post with acknowledgment duly addressed to that person at his usual or last known place of residence or business

(3) Where the serving officer delivers or tenders the copy of the notice under sub-rule (2), he shall require the signatue of the person to whom the copy is delivered or tendered to and acknowledgment of service endorsed on the original.

(4) Where the person or the adult member(s) of the family of the person concerned or representative of such person refuses to sigtr ttre acknowledgment or where the serving officer, after using all the due and .reasonable diligeooe, cannot frnd such person and there is no adult member, of the family or representative of such person, the serving officer shall affix' a copy of notice on the outer door or some other conspicuous part of the ordinary residence or usual place of business of such person and then shall return the original to the competent authority who served the notice, with a report endorsqd thereon or annexed thereto stating that he has had to affrx a copy, the circumstances under which he did so and the name and address of the person, if any, by whom the usual or last known place of residence, or business, as the case may be, was identified and in whose presence the copy was affixed.

Power to relax Where the State Government is of the opinion that it is necessary or expedient to do so, it may, for reasons to be recorded in writing, relax any of the provisions of these Rules.

Interpretetion If any question arises relating to the iuterpretation of these Rules, it shall be referred to the State Government.
