1. सिंᭃ᳙ नाम, िव᭭तार और ᮧारंभ.—(1) इन पᳯरिनयमᲂ का संिᭃ᳙ नाम भारतीय इंजीिनयᳳरग िव᭄ान और ᮧौ᳒ोिगकᳱ सं᭭ थान, िशबपुर, पᳯरिनयम, 2017 है ।

(2) ये राजपᮢ मᱶ ᮧकाशन कᳱ तारीख को ᮧवृᱫ हᲂगे ।

2. पᳯरभाषाएं.—(1) इन पᳯरिनयमᲂ मᱶ, जब तक संदभᭅ से अ᭠यथा अपेिᭃत न हᲂ,-- (क) “अिधिनयम” स ेरा᳦ीय ᮧौ᳒ोिगकᳱ सं᭭थान, िव᭄ान िशᭃा और अनुसधंान अिधिनयम, 2007 अिभᮧेत ह ᱹ;

(ख) ᳰकसी सं᭭थान के संबंध मᱶ “ᮧािधकाᳯरयᲂ”, “अिधकाᳯरयᲂ” और “संकाय सद᭭यᲂ” से सं᭭थान के ᮧािधकारी, अिधकारी और संकाय सद᭭य अिभᮧेत हᱹ ;

(ग) “बोडᭅ” से सं᭭ थान का शासक बोडᭅ अिभᮧेत ह;ै (घ) “िनमाᭅण और संकमᭅ सिमित” से ᮧथम पᳯरिनयम सं᭎या 12 के अधीन गᳯठत सं᭭थान कᳱ िनमाᭅण और संकमᭅ सिमित अिभᮧेत ह ै;

(ङ) “कᱶ ᮤीय सरकार” से भारत सरकार अिभᮧेत ह ै;

(च) “पᳯरषद” से सं᭭ थानᲂ कᳱ पᳯरषद अिभᮧेत ह;ै 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (छ) “िवभाग या िव᳒ालय या कᱶ ᮤ” से, यथाि᭭थित, अकादिमक िवभाग या िव᳒ालय, िजसे कᱶ ᮤ ने िशᭃण दनेे के िलए या ᳰकसी िविश᭬ ट ᭃेᮢ या िशᭃा शाखा या अंतर-िवषयक ᮧकृित से संबंिधत अकादिमक और अनुसधंान ᳰᮓयाकलापᲂ का पालन करने के िलए या को सुकर बनाने के िलए ᭭ थािपत ᳰकया ;

(ज) “िनदशेक” से पᳯरिनयम 17 के अधीन िन᳸द᭬ ट सं᭭ थान का िनदशेक अिभᮧेत है ;

(झ) “िवᱫ सिमित” से पᳯरिनयम 10 के अधीन गᳯठत सं᭭थान कᳱ िवᱫ सिमित अिभᮧेत है;

(ञ) यथाि᭭ थित, िवभाग या िव᳒ालय या कᱶ ᮤ के संबंध मᱶ ‘ᮧमुख’ या ‘अ᭟ यᭃ’ से उसका ᮧमुख अिभᮧेत है;

(ट) “सं᭭ थान” से भारतीय इंजीिनयᳳरग िव᭄ान और ᮧौ᳒ोिगकᳱ सं᭭ थान, िशबपुर अिभᮧेत है ;

(ठ) “कायᭅᮓम” से सं᭭थान का कोई शैᭃिणक कायᭅᮓम अिभᮧेत ह ै;

(ड) “िनयम” से अिधिनयम के अधीन बनाए गए िनयम अिभᮧेत है ;

(ढ) “अनुसूची” से इन पᳯरिनयमᲂ से उपाब᳍ अनुसूची अिभᮧेत है;

(ण) “िसनेट” से पᳯरिनयम 7 के अधीन िन᳸द᭬ ट सं᭭ थान का िसनेट अिभᮧेत है;

(2) उन श᭣दᲂ और पदᲂ के, जो इसमᱶ ᮧयुᲦ ह ैऔर पᳯरभािषत नहᱭ हᱹ, ᳴कतु अिधिनयम मᱶ पᳯरभािषत हᱹ, वही अथᭅ हᲂगे जो उस अिधिनयम मᱶ हᱹ ।

3. ᮧािधकारी.—सं᭭थान के िन᳜िलिखत ᮧािधकारी हᲂगे, अथाᭅत ्:--

(i) शासक बोडᭅ, जो अिधिनयम कᳱ धारा 11क के अधीन गᳯठत ᳰकया जाए ;

(ii) िसनेट, जो अिधिनयम कᳱ धारा 14 के अधीन गᳯठत कᳱ जाए ;

(iii) िवᱫ सिमित, जो ᮧथम पᳯरिनयम 10 के अधीन गᳯठत कᳱ जाए ; और

(iv) िनमाᭅण और संकमᭅ सिमित, जो ᮧथम पᳯरिनयम 12 के अधीन गᳯठत कᳱ जाए ।

4. शासक बोडᭅ और उसके अिधवशेन.—(1) बोडᭅ के ᮧितिनिधयᲂ को नाम िन᳸द᳥ या िनवाᭅिचत करने के िलए हकदार िनकायᲂ को उस तारीख से, िजसको ऐसे आमंᮢण कुल-सिचव ᳇ारा जारी ᳰकए गए हᲂ, आठ स᳙ाह से अनिधक कᳱ अविध के भीतर ऐसा करने के िलए उसके ᳇ारा आमंिᮢत ᳰकए जाएंगे और बोडᭅ कᳱ आकि᭭मक ᳯरिᲦयां ऊपर यथा िविन᳸द᭬ ट के अधीन िविन᳸द᳥ ᮧᳰᮓया को अपनात ेᱟए भरी जाएंगी ।

(2) बोडᭅ साधारणतः एक कलᱶडर वषᭅ के दौरान चार बार अिधवेशन करेगा ।

(3) बोडᭅ के अिधवेशन अ᭟यᭃ ᳇ारा या तो ᭭वᮧेरणा से या िनदशेक के अनुरोध पर या बोडᭅ के चार से अ᭠यून सद᭭यᲂ ᳇ारा ह᭭ताᭃᳯरत अ᭟यापेᭃा पर बुलाए जाएंगे ।

(4) बोडᭅ के अिधवेशन के िलए गणपूᳶत छह सद᭭यᲂ से होगी :

परंतु यᳰद अिधवेशन गणपूᳶत मᱶ अभाव के कारण ᭭थिगत होता ह ैतो वह आगामी स᳙ाह मᱶ उसी ᳰदन, उसी समय और उसी ᭭थान पर या ऐसे अ᭠य ᳰदन, समय या ᭭थान पर, जैसा अ᭟यᭃ अवधाᳯरत करे, होगा और यᳰद ऐसे ᳰकसी अिधवेशन मᱶ गणपूᳶत, अिधवेशन बुलाए जान ेके िलए अनुसूिचत समय से आधे घंटे के भीतर, नहᱭ होती है तो उपि᭭थत सद᭭य से गणपूᳶत होगी ।

(5) बोडᭅ के अिधवेशनᲂ मᱶ िवचार ᳰकए गए सभी ᮧ᳤ अ᭟यᭃ सिहत उपि᭭थत सद᭭यᲂ के बᱟमत ᳇ारा िविनि᳟त ᳰकए जाएंगे और यᳰद मत समान ᱨप स ेिवभािजत हो जाते हᱹ तो अ᭟यᭃ िनणाᭅयक मत रखेगा ।

(6) अ᭟यᭃ, यᳰद उपि᭭थत ह ैतो, बोडᭅ के ᮧ᭜येक अिधवेशन कᳱ अ᭟यᭃता करेगा :

परंतु अ᭟यᭃ कᳱ अनुपि᭭थित मᱶ, उपि᭭थत सद᭭य अिधवेशन कᳱ अ᭟यᭃता करने के िलए अपने मᱶ से एक सद᭭य को िनवाᭅिचत करᱶगे । ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 3

(7) ᮧ᭜येक अिधवेशन कᳱ िलिखत सूचना, कुल-सिचव ᳇ारा ᮧ᭜येक सद᭭य को, उसमᱶ अिधवेशन का ᭭थान, तारीख और समय वᳶणत करते ᱟए अिधवेशन कᳱ तारीख से कम स ेकम प᭠ᮤह ᳰदन पूवᭅ, भेजी जाएगी :

परंतु अ᭟यᭃ, अ᭜याव᭫यक मामलᲂ पर िवचार करने के िलए अ᭨प सूचना पर बोडᭅ का िवशेष अिधवेशन बुला सकेगा ।

(8) सूचना को बोडᭅ के कायाᭅलय मᱶ यथा अिभिलिखत ᮧ᭜येक सद᭭य के पते पर, द᭭ती पᳯरदᱫ कᳱ जा सकेगी या पंजीकृत डाक ᳇ारा या ई-मेल अथवा फै᭍स ᳇ारा भेजी जा सकेगी और इस ᮧकार भेजी गई सूचना को उस समय स᭥यᲦ ᱨप स े पᳯरदᱫ ᳰकया गया समझा जाएगा िजसको सूचना डाक के साधारण अनुᮓम मᱶ पᳯरदᱫ कᳱ गई होती ।

(9) कायᭅसूची अिधवेशन से कम से कम दस ᳰदन पूवᭅ सभी सद᭭यᲂ को कुल-सिचव ᳇ारा पᳯरचािलत कᳱ जाएगी ।

(10) कायᭅसूची मᱶ ᳰकसी मद को सि᭥मिलत करने के िलए ᮧ᭭ताव सूचना अिधवेशन से कम से कम एक स᳙ाह पूवᭅ कुल-सिचव के पास पᱟचं जानी चािहए:

परंतु अ᭟यᭃ ऐसी ᳰकसी मद के, िजसके िलए स᭥यᲦ सूचना ᮧा᳙ नहᱭ ᱟई ह,ै सि᭥मिलत ᳰकए जाने को अनु᭄ात कर सकेगा ।

(11) ᮧᳰᮓया के सभी ᮧ᳤ᲂ के संबंध मᱶ अ᭟यᭃ का िविन᭫ चय अंितम होगा ।

(12) बोडᭅ के अिधवेशन कᳱ कायᭅवाही के कायᭅवृᱫ कुल-सिचव ᳇ारा तैयार ᳰकए जाएंगे और भारत मᱶ उपि᭭थत बोडᭅ के सभी सद᭭यᲂ को पᳯरचािलत ᳰकए जाएंगे और उनको ᮧ᭭तािवत ᳰकसी संशोधन के साथ पुि᳥करण के िलए बोडᭅ के अगले अिधवेशन मᱶ उसके समᭃ रखे जाएंगे और कायᭅवृᱫᲂ कᳱ पुि᳥ और अ᭟यᭃ ᳇ारा ह᭭ताᭃᳯरत ᳰकए जान ेके प᳟ात ्उनको कायᭅवृᱫ पु᭭तक मᱶ अिभिलिखत ᳰकया जाएगा ।

(13) कायᭅवृᱫ पु᭭तक को कायाᭅलय समय के दौरान सभी समय पर बोडᭅ और पᳯरषद ्के सद᭭यᲂ के िनरीᭃण के िलए खुला रखा जाएगा ।

(14) यᳰद बोडᭅ का कोई सद᭭य बोडᭅ से अनुपि᭭थित इजाजत के िबना लगातार तीन अिधवेशनᲂ मᱶ उपि᭭थत रहने मᱶ असफल रहता ह ैतो वह बोडᭅ का सद᭭य नहᱭ रहेगा ।

(15) िवᱫ से संबंिधत कोई िवषय बोडᭅ के समᭃ तब तक नहᱭ रखा जाएगा जब तक उस पर िवᱫ सिमित ᳇ारा िवचार न कर िलया गया हो ।

(16) कोई ऐसा िवषय, िजस पर िनमाᭅण और संकमᭅ सिमित ᳇ारा पहले िवचार ᳰकया जाना चािहए, बोडᭅ के समᭃ तब तक नहᱭ रखा जाएगा जब तक ᳰक उस पर बोडᭅ का ᮧशासिनक अनुमोदन अिभᮧा᳙ करने के प᳟ात ् िनमाᭅण और संकमᭅ सिमित ᳇ारा िवचार न कर िलया गया हो ।

5. बोडᭅ कᳱ शिᲦया-ं-अिधिनयम कᳱ धारा 13 कᳱ उपधारा (1) के अधीन उपबंिधत शिᲦयᲂ के अितᳯरᲦ बोडᭅ िन᳜िलिखत के िलए सशᲦ होगा :--

(i) सं᭭थान मᱶ ᳰकसी पद कᳱ नामावली को समा᳙ करना, पुनः अिभिहत या पᳯरवᳶतत करना ;

(ii) समय-समय पर कुला᭟यᭃ कᳱ पूवᭅ अनुमित से पᳯरिनयम बनाना, उ᭠हᱶ उपांतᳯरत या समा᳙ करना ;

परंतु नए पᳯरिनयम, िव᳒मान पᳯरिनयमᲂ मᱶ जोड़ा जाना या उनमᱶ संशोधन केवल कुला᭟यᭃ कᳱ सहमित के प᳟ात ्लागू हᲂगे ; और

(iii) सं᭭थान कᳱ िवᱫ सिमित या िसनेट कᳱ िसफाᳯरश पर सभी या ᳰक᭠हᱭ अ᭟यादशेᲂ को इस शतᭅ के अधीन बनाया जाना, उपांतᳯरत और समा᳙ ᳰकया जाना ᳰक ऐसा बनाया जाना, उपांतᳯरत और समा᳙ ᳰकया जाना अिधिनयम और उसके अधीन बनाए गए पᳯरिनयमᲂ के उ᭨लंघन मᱶ नहᱭ होगा ।

6. अिधᮧमाणन.—बोडᭅ के सभी आदशेᲂ और िविन᳟यᲂ को इस िनिमᱫ बोडᭅ ᳇ारा ᮧािधकृत िनदशेक या कुल-सिचव या ᳰकसी ᳞िᲦ के ह᭭ताᭃर ᳇ारा अिधᮧमािणत ᳰकया जाएगा । 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

7. िसनटे.—(1) िसनेट, जब कभी आव᭫यक हो, बुलाई जाएगी ᳴कतु साधारणतः एक कलᱶडर वषᭅ के दौरान चार बार स ेकम नहᱭ बुलाई जाएगी ।

(2) िसनेट के अिधवेशन िसनेट के अ᭟यᭃ ᳇ारा या तो अपनी ᭭वᮧेरणा से या िसनेट के एक बटा पांच से अ᭠यून सद᭭यᲂ ᳇ारा ह᭭ताᭃᳯरत अ᭟यपेᭃा पर बुलाया जाएगा ।

(3) अ᭟यपेᭃा पर आयोिजत अिधवेशन, कायᭅसूची कᳱ केवल उन मदᲂ पर, िजनके िलए अ᭟यपेᭃा दी गई है, िवचार-िवमशᭅ करने के िलए िवशेष अिधवेशन होगा और उसकᳱ आव᭫यक ᱨप स ेिनदशेक ᳇ारा अ᭟यᭃता कᳱ जाएगी तथा अ᭟यपेᭃा अिधवेशन िसनेट के अ᭟यᭃ ᳇ारा सुिवधाजनक तारीख और समय पर बुलाया जाएगा ।

(4) िसनेट के कुल सद᭭यᲂ के एक-ितहाई सद᭭यᲂ से िसनेट के अिधवेशन कᳱ गणपूᳶत होगी ।

(5) िनदशेक, िसनेट के ᮧ᭜येक अिधवेशन कᳱ अ᭟यᭃता करेगा :

परंतु िनदशेक कᳱ अनुपि᭭थित मᱶ, उप िनदशेक अ᭟यᭃता करेगा और िनदशेक तथा उप िनदशेक, दोनᲂ कᳱ अनुपि᭭थित मᱶ उपि᭭थत ᭔ये᳧तम आचायᭅ अिधवेशन कᳱ अ᭟यᭃता करेगा ।

(6) कायᭅसूची के साथ ᮧ᭜येक अिधवेशन कᳱ िलिखत सूचना अिधवेशन से कम से कम एक स᳙ाह पूवᭅ िसनेट के सद᭭यᲂ को कुल-सिचव ᳇ारा पᳯरचािलत कᳱ जाएगी :

परंतु िसनेट का अ᭟यᭃ ᳰकसी ऐसी मद को, िजसके िलए स᭥यᲦ सूचना नहᱭ दी गई है, सि᭥मिलत करने के िलए अनु᭄ात कर सकेगा ।

(7) उप पᳯरिनयम (6) के उपबंधᲂ मᱶ ᳰकसी बात के होते ᱟए भी, िनदशेक, िवशेष मामलᲂ पर िवचार करने के िलए अ᭨पसूचना पर िसनेट का कोई आपात अिधवेशन बुला सकेगा ।

(8) ᮧᳰᮓया के सभी ᮧ᳤ᲂ के संबंध मᱶ िसनेट के अ᭟यᭃ का िविन᭫ चय अंितम होगा ।

(9) िसनेट के अिधवेशन कᳱ कायᭅवािहयᲂ के कायᭅवृᱫ, शैᭃिणक संकाय अ᭟यᭃ के परामशᭅ से कुल-सिचव ᳇ारा तैयार ᳰकए जाएंगे और भारत मᱶ उपि᭭थत िसनेट के सभी सद᭭यᲂ को पᳯरचािलत ᳰकए जाएंगे ;

परंतु यᳰद िसनेट ऐसे पᳯरचालन को सं᭭थान या भारत सरकार को िहतᲂ के ᮧितकूल समझता है तो ऐसा कोई कायᭅवृᱫ पᳯरचािलत नहᱭ ᳰकया जाएगा ।

(10) कायᭅवृᱫ ᮧ᭭तािवत संशोधनᲂ, यᳰद कोई हᲂ, के साथ िसनेट के आगामी अिधवेशन मᱶ पुि᳥करण के िलए रखे जाएंगे और कायᭅवृᱫᲂ कᳱ पुि᳥ और िसनेट के अ᭟यᭃ ᳇ारा ह᭭ताᭃᳯरत ᳰकए जान ेके प᳟ात ्उनको कायᭅवृᱫ पु᭭तक मᱶ अिभिलिखत ᳰकया जाएगा, जो कायाᭅलय समय के दौरान सभी समय पर िसनेट के सद᭭यᲂ, बोडᭅ और पᳯरषद ्के िनरीᭃण के िलए खुली रहगेी ।

8. िसनटे कᳱ शिᲦया.ं—अिधिनयम के उपबंधᲂ के अधीन रहते ᱟए, िसनेट को िन᳜िलिखत शिᲦया ंहᲂगी :—

(i) िविभ᳖ िवभागᲂ और कᱶ ᮤᲂ के िलए पाᲹᮓमानुसार अ᭟ययनᲂ हतेु पाᲹचयाᭅ और पाᲹ िववरण को िवरिचत और पुनᳶवलोᳰकत करना ;

(ii) परीᭃाᲐ के संचालन के िलए ᳞व᭭थाएं करना, परीᭃकᲂ, अनुसीमकᲂ, सारणीकारᲂ कᳱ िनयुिᲦ करना और परीᭃाᲐ से संबंिधत अ᭠य िवषय ;

(iii) परीᭃाᲐ के पᳯरणाम घोिषत करना या ऐसा करने के िलए सिमितयᲂ या अिधकाᳯरयᲂ कᳱ िनयुिᲦ करना और िडᮕी, िड᭡लोमा तथा अ᭠य शैᭃिणक िविश᳥ताᲐ या उपािधयᲂ को ᮧदान या अनुदान करने से संबंिधत बोडᭅ को िसफाᳯरशᱶ करना ;

(iv) िवभागᲂ या कᱶ ᮤᲂ के कायᭅ से संब᳍ शैᭃिणक िवषयᲂ पर िसफाᳯरशᱶ करने के िलए सं᭭थान के िवभागᲂ या कᱶ ᮤᲂ के िलए सलाहकार सिमितया ंया िवशेष᭄ सिमितया ंया दोनᲂ कᳱ िनयुिᲦया ंकरना ;

(v) ऐसे िविन᳸द᳥ तथा मह᭜वपूणᭅ शैᭃिणक िवषयᲂ पर, जो िसनेट ᳇ारा ᳰकसी ऐसी सिमित को िन᳸द᳥ ᳰकए जाएं, सलाह दनेे के िलए िसनेट के सद᭭यᲂ, सं᭭थान के अ᭠य िशᭃकᲂ और बाहर से िवशेष᭄ᲂ मᱶ से सिमितया ंिनयुᲦ करना ;

(vi) यथाि᭭ थित, िविभ᳖ िवभागᲂ या िव᳒ालय या कᱶ ᮤᲂ से संलᲨ सलाहकार सिमितयᲂ और उनकᳱ िवशेष᭄ तथा अ᭠य सिमितयᲂ कᳱ िसफाᳯरशᲂ पर िवचार करना तथा ऐसी कारᭅवाई करना (िजसमᱶ बोडᭅ को िसफाᳯरशᱶ करना सि᭥मिलत ह)ᱹ, जो ᮧ᭜येक मामले मᱶ आव᭫यक समझी जाए ;

(vii) िवभागᲂ या कᱶ ᮤᲂ के ᳰᮓयाकलाप का कािलक पुनᳶवलोकन करना और समुिचत कारᭅवाई करना (िजसमᱶ बोडᭅ को िसफाᳯरशᱶ करना सि᭥मिलत ह)ᱹ ;

(viii) सं᭭थान के पु᭭तकालय के कायᭅ का अधीᭃण करना ;

(ix) सं᭭थान के भीतर अनुसंधान और शैᭃिणक िवकास या ᳰᮓयाकलाप का संव᳍ᭅन करना और जब कभी आव᭫ यक समझा जाए, उनमᱶ लगे ᳞िᲦयᲂ से ऐसे अनुसंधान या शैᭃिणक िवकास या कारᭅवाई पर ᳯरपोटᱸ मांगना ;

(x) कᭃाᲐ, ᮧयोगशालाᲐ, पु᭭तकालय और आवािसक हो᭭टलᲂ के िनरीᭃण के िलए उपबंध करना ;

(xi) सं᭭थान के छाᮢᲂ कᳱ सह-पाᲹᮓम ᳰᮓयाकलापᲂ को तैयार करना ;

(xii) वृिᱫका, छाᮢवृिᱫ, पदक और पुर᭭कार ᮧदान करना और ऐसी शतᲄ के अनुसार अ᭠य पुर᭭कार दनेा, जो पुर᭭कारᲂ से संलᲨ कᳱ जाएं ;

(xiii) यथाि᭭ थित, िवभागᲂ या िव᳒ालयᲂ या कᱶ ᮤᲂ के सृजन या पुनःसंरचना और िव᳒मान िवभागᲂ, िव᳒ालयᲂ या कᱶ ᮤᲂ कᳱ समाि᳙ के संबंध मᱶ बोडᭅ को िसफाᳯरशᱶ करना ;

(xiv) रा᭔य या दशे के िविभ᳖ भागᲂ या दशे के बाहर दरू᭭थ िशᭃण रीित के मा᭟यम से ᭄ान का ᮧसार करने के िलए बोडᭅ को िसफाᳯरशᱶ करना ; और

(xv) िसनेट के अिधवेशन मᱶ नीित या अनुशासिनक िवषयᲂ से असंब᳍ सामा᭠य ᮧकृित के िवचार-िवमशᭅ के दौरान दो छाᮢ ᮧितिनिधयᲂ तक को आमंिᮢत करना ।

9. िसनटे के अ᭟यᭃ का आपात ि᭭थित मᱶ शिᲦयᲂ का ᮧयोग ᳰकया जाना.—यᳰद िसनेट के अ᭟यᭃ कᳱ राय मᱶ कोई ऐसी आपात ि᭭थित उ᭜प᳖ हो गई ह,ै िजसमᱶ rqjar कारᭅवाई कᳱ जानी अपेिᭃत ह ैतो वह ऐसी कारᭅवाई, जो वह आव᭫यक समझे, कर सकेगा और िसनेट के अगले अिधवेशन मᱶ उसके अनुमोदन के िलए उसकᳱ ᳯरपोटᭅ करेगा ।

10. िवᱫ सिमित.—(1) ᮧ᭜येक सं᭭थान के िलए एक िवᱫ सिमित होगी, जो िन᳜िलिखत सद᭭यᲂ से िमलकर बनेगी, अथाᭅत ्:—

(i) शासक बोडᭅ का अ᭟यᭃ, पदने अ᭟यᭃ ;

(ii) िनदशेक, पदने सद᭭य ;

(iii) सं᭭थान से ᳞वहार करने वाला संयुᲦ सिचव या उसका नाम िनदᱷिशती और िवᱫ सलाहकार (मानव संसाधन िवकास) या उसके नामिनदᱷिशती सद᭭य ;

(iv) बोडᭅ के सद᭭यᲂ मᱶ स ेबोडᭅ ᳇ारा नामिनदᱷिशत दो ᳞िᲦ ; और

(v) कुल सिचव, पदने सद᭭य-सिचव :

परंतु उपरोᲦ के अितᳯरᲦ अ᭟यᭃ, िनदशेक के परामशᭅ से ᳰकसी िवशेष᭄ को िवशेष आमंिᮢत के ᱧप मᱶ आमंिᮢत कर सकेगा और ऐसे िवशेष आमंिᮢत ᭪ यि᭍ त को मतदान के अिधकार नहᱭ हᲂगे ।

(2) सभी िवᱫीय ᮧ᭭तावᲂ का िवचार और अनुमोदन के िलए बोडᭅ के समᭃ रखे जाने से पूवᭅ िवᱫ सिमित के समᭃ रखा जाएगा ।

(3) िवᱫ सिमित, अिधमानतः शासक बोडᭅ के अिधवेशन से पूवᭅ एक वषᭅ मᱶ साधारणतः चार बार अिधवेशन करेगी ।

(4) िवᱫ सिमित कᳱ बैठक कᳱ गणपूᳶत चार सद᭭यᲂ से होगी । 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(5) अ᭟यᭃ, िवᱫ सिमित के अिधवेशन कᳱ अ᭟यᭃता करेगा और उसकᳱ अनुपि᭭थित मᱶ िनदशेक अिधवेशन कᳱ अ᭟यᭃता करेगा ।

(6) अिधवेशन कᳱ सूचना, कायᭅसूची मᱶ मदᲂ को सि᭥मिलत करने और कायᭅवृतᲂ कᳱ पुि᳥ के संबंध मᱶ बोडᭅ के अिधवेशनᲂ को लागू इन पᳯरिनयमᲂ के उपबंध, िवᱫ सिमित के अिधवेशन के संबंध मᱶ यथासा᭟य अनुसᳯरत ᳰकए जा सकᱶ गे ।

(7) िवᱫ सिमित के ᮧ᭜येक अिधवेशन के कायᭅवृᱫᲂ कᳱ एक ᮧित बोडᭅ के समᭃ रखी जाएगी ।

11. िवᱫ सिमित कᳱ शिᲦया.ं—िवᱫ सिमित को िन᳜िलिखत शिᲦया ंहᲂगी :--

(i) िनदशेक ᳇ारा तैयार ᳰकए गए सं᭭थान के वाᳶषक बजट कᳱ परीᭃा और संवीᭃा करना तथा बोडᭅ को िसफाᳯरशᱶ करना ;

और

(ii) बोडᭅ को या तो बोडᭅ या िनदशेक कᳱ पहल पर या ᭭वे᭒छा से सं᭭थान को ᮧभािवत करने वाले ᳰकसी िवᱫीय ᮧ᳤ पर अपने िवचार दनेा और अपनी िसफाᳯरशᱶ करना ।

12. िनमाᭅण और सकंमᭅ सिमित.—ᮧ᭜येक सं᭭थान के िलए एक िनमाᭅण और संकमᭅ सिमित होगी, जो िन᳜िलिखत सद᭭यᲂ से िमलकर बनेगी, अथाᭅत् :—

(i) िनदशेक, पदने अ᭟यᭃ ;

(ii) मंᮢालय मᱶ सं᭭थान का कायᭅ करने वाला िनदशेक या उप सिचव या उसका नाम िनदᱷिशती या मंᮢालय मᱶ सं᭭थान का िवᱫीय कायᭅ करने वाला िनदशेक या उप सिचव या उसका नाम िनदᱷिशती कᱶ ᮤीय सरकार के पदने सद᭭यᲂ के ᱨप मᱶ ;

(iii) शासक बोडᭅ ᳇ारा नामिन᳸द᳥ एक सद᭭य- सद᭭य ;

(iv) कुल सिचव, पदने सद᭭य-सिचव ;

(v) संकाया᭟यᭃ, योजना और िवकास या समान ि᭭थित पर - सद᭭य;

(vi) कᱶ ᮤीय या रा᭔य सरकार या ᮧ᭎यात ᭭वायᱫ िनकाय के िसिवल या इलैि᭍ᮝकल इंजीिनयरी खंड, ᮧ᭜येक से एक सद᭭य - सद᭭य ।

(2) िनमाᭅण और संकमᭅ सिमित, िजतनी बार आव᭫यक हो, अिधवेशन करᱶगी, ᳴कतु साधारणतः एक वषᭅ मᱶ चार बार से कम नहᱭ होगी ।

(3) िनमाᭅण और संकमᭅ सिमित के अिधवेशन के िलए गणपूᳶत चार सद᭭यᲂ से होगी ।

(4) अिधवेशन कᳱ सूचना, कायᭅसूची मᱶ मदᲂ को सि᭥मिलत करने और कायᭅवृᱫᲂ कᳱ पुि᳥ के संबंध मᱶ बोडᭅ के अिधवेशन को लागू इन पᳯरिनयमᲂ के उपबंध, िनमाᭅण और संकमᭅ सिमित के अिधवेशनᲂ के संबंध मᱶ भी यथासा᭟य अनुसᳯरत ᳰकए जाएंगे ।

(5) िनमाᭅण और संकमᭅ सिमित के ᮧ᭜येक अिधवेशन के कायᭅवृᱫ कᳱ एक ᮧित िविन᳸द᳥ ᮧ᭭ताव या ᮧ᭭तावᲂ पर, िजनके िलए बोडᭅ का अनुमोदन अपेिᭃत ह,ै िवᱫ सिमित कᳱ िसफाᳯरशᲂ के साथ, बोडᭅ के समᭃ रखी जाएगी ।

13. िनमाᭅण और संकमᭅ सिमित कᳱ शिᲦया ंऔर कृ᭜य.—(1) िनमाᭅण और संकमᭅ सिमित, --

(i) बोडᭅ के िनदशेᲂ के अधीन बोडᭅ से आव᭫यक ᮧशासिनक अनुमोदन और ᳞य कᳱ मंजूरी के प᳟ात् सभी ᮧमुख कायᲄ का सि᳖माᭅण कराएगी ;

(ii) सं᭭थान के अनुमोᳰदत बजट उपबंधᲂ के भीतर लघु कायᲄ और मर᭥मत और अनुरᭃण से संबंिधत कायᲄ के िलए आव᭫यक ᮧशासिनक अनुमोदन और ᳞य मंजूरी दनेे कᳱ शिᲦ होगी ;

(iii) भवनᲂ कᳱ लागत और अ᭠य पूंजीगत कायᭅ, लघु कायᭅ, मर᭥मत, अनुरᭃण और इसी ᮧकार के कायᲄ कᳱ लागत का ᮧाᲥथन तैयार करवाएगी और लघु संकमᭅ, लघु मर᭥मतᲂ और ररखाव के िलए लागत ᮧाᲥलनᲂ का अनुमोदन करेगी ;

(iv) िडजाइन कᳱ तकनीकᳱ संवीᭃा करने ᮧाᲥथनᲂ और सामᮕी के िविनदᱷशᲂ को, जो आव᭫यक समझे जाएं, बनाने के िलए उᱫरदायी होगी ;

(v) उपयुᲦ ठेकेदारᲂ कᳱ भतᱮ और टᱶडरᲂ कᳱ ᭭वीकृित के िलए उᱫरदायी होगी तथा जहां आव᭫यक हो वहां िवभागीय कायᲄ के िलए िनदᱷश दनेे कᳱ शिᲦ होगी ;

(vi) टᱶडर के अंतगᭅत नहᱭ आने वाली दरᲂ को तय करने और ठेकेदारᲂ के साथ दावᲂ और िववादᲂ को तय करने कᳱ शिᲦ होगी ।

(2) यᳰद, िनमाᭅण और संकमᭅ सिमित के अ᭟यᭃ कᳱ राय मᱶ कोई ऐसी आपात ि᭭थित उ᭜प᳖ हो गई है, िजससे rqjar कारᭅवाई ᳰकया जाना अपेिᭃत है तो वह ऐसी कारᭅवाई करेगा और िनमाᭅण और संकमᭅ सिमित तथा बोडᭅ को उनके अगले अिधवेशन मᱶ उसकᳱ ᳯरपोटᭅ दगेा ।

(3) िनमाᭅण और संकमᭅ सिमित ऐसे कृ᭜य का िनवᭅहन और ऐसी शिᲦयᲂ का ᮧयोग भी करेगी जो समय-समय पर बोडᭅ ᳇ारा सᲅपी जाएं ।

14. अ᭟यᭃ, शासक बोडᭅ कᳱ शिᲦया.ं—अिधिनयम मᱶ उपबंिधत शिᲦयᲂ के अितᳯरᲦ, शासक बोडᭅ के अ᭟यᭃ को िन᳜िलिखत शिᲦयां हᲂगी,—

(i) वह चयन सिमित कᳱ िसफाᳯरशᲂ पर अिधिनयम के उपबंधᲂ के अधीन उन पदᲂ के संबंध मᱶ, िजन पर बोडᭅ ᳇ारा िनयुिᲦया ंकᳱ जा सकती हᱹ, वेतनमान के ᭠यूनतम ᭭तर से उᲬतर ᭭तर पर ᳰकसी पदधारी के ᮧारंिभक वेतन को िनयत करने कᳱ शिᲦ रखेगा ;

(ii) ऐसे िनबंधनᲂ और शतᲄ के अ᭟यधीन, जो बोडᭅ ᳇ारा समय-समय पर अिधकिथत कᳱ जाए, भारत स ेबाहर ᮧिशᭃण के िलए या ᳰकसी िशᭃण पाठय़ᮓम के िलए सं᭭थान के ᭭टाफ के सद᭭यᲂ को ᮧितिनयुᲦ करना, बशतᱷ ᳰक िनदशेक ᳇ारा ᳰकसी भी ᳰदशा मᱶ िवदशे के दौरे को अ᭟यᭃ, रा᳦ीय ᮧौ᳒ोिगकᳱ सं᭭थान, िव᭄ान िशᭃा और अनुसंधान पᳯरषद ᳇ारा अनुमोᳰदत ᳰकया जाएगा ;

(iii) वह कᱶ ᮤीय सरकार कᳱ ओर से सं᭭थान और िनदशेक या उप िनदशेक के बीच सेवा संिवदा को िन᭬पाᳰदत करना ; और

(iv) आपात मामलᲂ मᱶ कारᭅवाई करना और पुि᳥करण और अनुसमथᭅन के िलए ऐसी कारᭅवाई से बोडᭅ को सूिचत करना ।

15. याᮢा भᱫ ेऔर बैठक फᳱस.—अिधिनयम या इन पᳯरिनयमᲂ के अधीन गᳯठत या बोडᭅ और अ᭠य ᮧािधकाᳯरयᲂ ᳇ारा िनयुᲦ ᳰकए गए बोडᭅ के सद᭭य और सं᭭थान के अ᭠य ᮧािधकारी तथा सिमितयᲂ के सद᭭य ᮧािधकरणᲂ और उनकᳱ सिमितयᲂ के अिधवेशनᲂ मᱶ हािजर होने के िलए समय-समय पर बोडᭅ ᳇ारा अिधकिथत याᮢा भᱫे, दिैनक भᱫा और बैठक फᳱस के िलए हकदार हᲂगे ।

16. िवभाग, िव᳒ालय या कᱶ ᮤ.—सं᭭थान उतने िवभागᲂ, िव᳒ालयᲂ या कᱶ ᮤᲂ ऐसे नामᲂ से, जैसा बोडᭅ ᳇ारा िसनेट कᳱ िसफाᳯरशᲂ पर, समय-समय पर, बजटीय उपबंधᲂ के भीतर अनुमोᳰदत करे, गᳯठत होगा ।

17. िनदशेक और उसकᳱ शिᲦया.ं—(1) सं᭭थान का िनदशेक, कुला᭟यᭃ ᳇ारा, संिवदा आधार पर, उसके ᳇ारा गᳯठत कᳱ गई ऐसी चयन सिमित कᳱ िसफाᳯरश पर, जो रा᳦ीय और अंतराᭅ᳦ीय ᭭तर के अनुभव सिहत तकनीकᳱ िशᭃा के ᭃेᮢ मᱶ अनुभव रखने वाले कम से कम पांच सद᭭यᲂ से अ᭟यᭃ सिहत िमलकर बनेगी, िनयुᲦ ᳰकया जाएगा ।

(2) िनदशेक, पांच वषᭅ कᳱ अविध के िलए िनयुᲦ ᳰकया जाएगा और अनुसूची क मᱶ िविन᳸द᳥ ᮧᱨप मᱶ सं᭭थान तथा िनदशेक के बीच मᱶ ᳰकए गए सेवा संिवदा के िनबंधनᲂ और शतᲄ ᳇ारा शािसत होगा ।

(3) िविन᳸द᳥ ᮧयोजन के िलए बनाए गए बजट उपबंधᲂ के अधीन रहते ᱟए िनदशेक ऐसी ᮧᳰᮓया के अनुसार, जो अ᭟यादशेᲂ मᱶ अिधकिथत कᳱ जाए, ᳞य उपगत करने कᳱ शिᲦ रखेगा । 8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(4) िनदशेक, ᮧ᭜येक मद के िलए कᱶ ᮤीय सरकार मᱶ िवभाग के ᮧमुख के िलए िविन᳸द᳥ सीमा तक आवतᱮ बजट िनयत करते ᱟए िविभ᳖ मदᲂ के संबंध मᱶ िनिधयᲂ का िविनयोग करने कᳱ शिᲦ रखेगा :

परंतु ऐस ेिविनयोग मᱶ आगामी वषᲄ मᱶ, बजट मᱶ कोई वृि᳍ और कोई दािय᭜व अंतवᭅि᭨लत नहᱭ करेगा :

परंतु यह और ᳰक ऐसा ᮧ᭜येक िविनयोग यथाशीᮖ बोडᭅ को ᳯरपोटᭅ ᳰकया जाएगा ।

(5) िनदशेक, ऐसे अनुबंधᲂ के जो समय-समय पर बोडᭅ ᳇ारा ᳰकए जाएं अधीन रहते ᱟए दस हजार ᱧपए कᳱ सीमा तक के अᮧितसंᱡणीय नुकसान को और पᲬीस हजार ᱧपए कᳱ सीमा तक सामा᭠य टूट-फूट या अᮧयुᲦ होन ेके कारण खोई ᱟᲊ या सेवा के अयो᭏य होने वाली भंडार कᳱ व᭭तुᲐ के अवसूलीय मू᭨य को अपिलिखत करने कᳱ शिᲦ रखेगा ।

(6) िनदशेक, ऐसे बेकार उप᭭करᲂ या भंडार कᳱ व᭭तुᲐ को, जो िनदशेक ᳇ारा इस ᮧयोजन के िलए गᳯठत कᳱ गई ᳰकसी सिमित ᳇ारा पहचान कᳱ जाएं, सं᭭ थान के समीप मᱶ ᳰकसी शैᭃिणक सं᭭थान को, उस सीमा तक, जो समय-समय पर बोडᭅ ᳇ारा िविनि᳟त कᳱ जाए, संदान दनेे कᳱ शिᲦ रखेगा ।

(7) िनदशेक, जहां वह िनयुिᲦ ᮧािधकारी है, चयन सिमित कᳱ िसफाᳯरशᲂ पर इस अिधिनयम या इन पᳯरिनयमᲂ के उपबंध ᳇ारा उसमᱶ िनिहत शिᲦयᲂ के अधीन उसके ᳇ारा कᳱ गई िनयुिᲦयᲂ के पदᲂ के संबंध मᱶ, ᭠यूनतम वेतनमान स े उᲬतर ᮓम पर ᳰकसी पदधारी के ᮧारंिभक वेतन को, ᳴कतु पांच वेतनवृि᳍यᲂ से अिधक अंतवᭅिलत न हो, िनयत करने कᳱ शिᲦ रखेगा ।

(8) िनदशेक, एक वषᭅ से अनिधक के िलए ऐसे पाᳯर᮰िमक पर, जो बोडᭅ ᳇ारा िनि᳟त ᳰकया जाए, समय-समय पर आकि᭭मकता के िलए संदᱫ ᮧयोगशालाᲐ मᱶ अ᭟यापन सहायक कमᭅचाᳯरवंृद, तकनीकᳱ ᳞िᲦयᲂ या तकनीकᳱ अनुदशेकᲂ और कुशल कमᭅकारᲂ का िनयोजन करने कᳱ शिᲦ रखेगा ।

(9) िनदशेक ऐसे िनबंधनᲂ और शतᲄ के अधीन रहते ᱟए, जो अ᭟यादशेᲂ ᳇ारा िविन᳸द᳥ कᳱ जाएं, भारत मᱶ कमᭅचाᳯरयᲂ को ᮧिशᭃण मᱶ भेजने या ᮧिशᭃण के अनुᮓम मᱶ उपि᭭थत होने के िलए भेजने कᳱ शिᲦ रखेगा ।

(10) िनदशेक ᳰकसी भवन को ᳰकसी ऐसे ᮧयोजन से िभ᳖ िजसके िलए उसका सि᳖माᭅण ᳰकया गया था, अ᭭थायी आबंटन को मंजूर करने कᳱ शिᲦ रखेगा ।

(11) यᳰद कुल -सिचव ᳰकसी कारण से एक मास से अनिधक कᳱ अविध के िलए अनुपि᭭थत ह ैतो िनदशेक कुल-सिचव के ᳰक᭠हᱭ कृ᭜यᲂ को, जैसा वह ठीक समझे, ᮕहण कर सकेगा या सं᭭थान के ᳰकसी संकाय-सद᭭य या कमᭅचारी को समनुदिेशत कर सकेगा :

परंतु यᳰद ᳰकसी समय कुल-सिचव कᳱ अनुपि᭭थित एक मास से अिधक होती ह ैतो बोडᭅ, यᳰद ठीक समझता ह ै तो, िनदशेक को कुल-सिचव के कृ᭜य ᮕहण करने या समनुदिेशत करने के िलए ᮧािधकृत कर सकेगा ।

(12) सं᭭थान और िनदशेक के बीच कᳱ संिवदा के िसवाय सं᭭थान के िलए और उसकᳱ ओर से सभी संिवदाएं इस िनिमᱫ पाᳯरत बोडᭅ के संक᭨प ᳇ारा िलिखत मᱶ ᮧािधकृत कᳱ जाएंगी और सं᭭ थान के नाम मᱶ अिभ᳞Ღ करते ᱟए कᳱ जाएंगी तथा ऐसी ᮧ᭜येक संिवदा िनदशेक ᳇ारा सं᭭थान कᳱ ओर से िन᭬पाᳰदत कᳱ जाएंगी ᳴कतु िनदशेक ऐसी संिवदा के अधीन ᳰकसी बात के संबंध मᱶ ᳞िᲦगत ᱨप से दायी नहᱭ होगा ।

(13) िनदशेक, मु᭎यालयᲂ से अपनी अनपुि᭭थित के दौरान िवशेष ᱨप से उप िनदशेक को या उसकᳱ अनुपि᭭थित मᱶ उपि᭭थत संकाय अ᭟यᭃᲂ या ᭔ये᳧तम आचायᲄ मᱶ से एक को कमᭅचाᳯरवंृदᲂ का याᮢा भᱫा, आकि᭭मकता और िचᳰक᭜सा उपचार के िलए अिᮕम मंजूरी दनेे को तथा इस िनिमᱫ िबलᲂ पर ह᭭ताᭃर या ᮧितह᭭ताᭃर करने के िलए िलिखत मᱶ ᮧािधकृत कर सकेगा ।

(14) िनदशेक, ᭭विववेकानुसार से ऐसी सिमितया,ं जो वह सं᭭थान के कृ᭜यᲂ को सुचाᱨ ᱨप स ेचलाने के िलए समुिचत समझे, गᳯठत कर सकेगा ।

(15) अ᭟यᭃ के पद पर उसकᳱ मृ᭜य ुया ᭜यागपᮢ या अ᭠यथा ᳰकसी कारण से ᱟई ᳰकसी ᳯरिᲦ कᳱ दशा मᱶ या अ᭟यᭃ के उसकᳱ अनुपि᭭थित, बीमारी या ᳰकसी अ᭠य कारण से उसके कृ᭜यᲂ के िनवᭅहन मᱶ असमथᭅ होने कᳱ दशा मᱶ िनदशेक, अिधिनयम कᳱ धारा 16 के अधीन अ᭟यᭃ को समनुदिेशत कृ᭜यᲂ का िनवᭅहन कर सकेगा । ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 9

(16) िनदशेक, अिधिनयम और पᳯरिनयमᲂ के आधार पर उसमᱶ िनिहत कᳱ गई उसकᳱ ᳰकसी शिᲦ, ᮧािधकार या उᱫरदािय᭜व को बोडᭅ के अनुमोदन से सं᭭थान के एक या अिधक शैᭃिणक या ᮧशासिनक कमᭅचारी के को ᮧ᭜यायोिजत कर सकेगा ।

18. उप िनदशेक.—(1) उप िनदशेक कᳱ िनयुिᲦ, बोडᭅ ᳇ारा वᳯर᳧ संकाय सद᭭यᲂ मᱶ से चयन सिमित कᳱ िसफाᳯरशᲂ पर कᳱ जाएगी ।

(2) उप िनदशेक तीन वषᭅ कᳱ अविध के िलए पद ᮕहण करेगा, जो बोडᭅ कᳱ िसफाᳯरश पर दो वषᭅ या एक वषᭅ कᳱ और अविध के िलए िव᭭ताᳯरत कᳱ जा सकेगी ।

(3) उप िनदशेक, अनुसूची (ख) मᱶ िविन᳸द᳥ ᮧᱨप मᱶ सं᭭थान और उप िनदशेक के बीच ᱟए सेवा संिवदा के िनबंधनᲂ और शतᲄ ᳇ारा शािसत होगा ।

(4) िनदशेक कᳱ अनुपि᭭थित या ᳯरिᲦ के दौरान उपिनदशेक, िनदशेक कᳱ सभी शिᲦयां रखेगा ।

(5) उप िनदशेक, शैᭃिणक और ᮧशासिनक कायᲄ तथा उᲬतर िशᭃा और अनुसंधान के अ᭠य सं᭭थानᲂ सिहत तथा औ᳒ोिगक उपᮓमᲂ और अ᭠य कमᭅचाᳯरयᲂ के साथ भी संपकᭅ बनाए रखने मᱶ िनदशेक कᳱ सहायता करेगा।

19. संकाया᭟यᭃ—

(1) सं᭭थान, सात से अिधक संकाया᭟यᭃता ᭭थािपत नहᱭ करेगा ।

(2) िनदशेक, बोडᭅ के अ᭟यᭃ के अनुमोदन से संकाया᭟यᭃ कᳱ िनयुिᲦ करेगा।

(3) संकाया᭟यᭃ अपने पद को दो वषᲄ के िलए धाᳯरत करेगा िजसको एक और वषᭅ के िलए िव᭭ताᳯरत ᳰकया जा सकेगा ।

(4) संकाया᭟यᭃ आचायᲄ या सहयुᲦ आचायᲄ मᱶ से िनयुᲦ ᳰकया जाएगा ।

(5) संकाया᭟यᭃᲂ के बोडᭅ कृ᭜य अनुसूची “ग” मᱶ ᮧगिणत ᳰकए गए हᱹ ।

20. िवभाग, िव᳒ालय या कᱶ ᮤ के ᮧमखु—

(1) सं᭭थान का ᮧ᭜येक िवभाग या िव᳒ालय या कᱶ ᮤ ऐसे ᮧमुख के ᮧभार मᱶ होगा िजसका िनदशेक ᳇ारा उस िवभाग या िव᳒ालय या कᱶ ᮤ के आचायᲄ और सहयुᲦ आचायᲄ मᱶ से चयन ᳰकया जाएगा :

परंतु यᳰद ᳰकसी िवभाग या िव᳒ालय या कᱶ ᮤ मᱶ कोई आचायᭅ या सहयुᲦ आचायᭅ नहᱭ है तो िनदशेक उस िवभाग या िव᳒ालय या कᱶ ᮤ के ᳰकसी सहायक आचायᭅ को िवभाग या िव᳒ालय या कᱶ ᮤ के ᮧमुख के ᱨप मᱶ िनयुᲦ कर सकेगा ।

(2) िवभाग या िव᳒ालय या कᱶ ᮤ का ᮧमुख अपने पद को दो वषᭅ कᳱ अविध के िलए धाᳯरत करेगा :

परंतु अपन ेपद कᳱ अविध समाि᳙ के प᳟ात ्वह अपने उᱫरवतᱮ कᳱ िनयुिᲦ तक पद पर बना रहगेा :

परंतु यह और ᳰक कोई ᳞िᲦ ᳰकसी िवभाग या िव᳒ालय या के᭠ᮤ का लगातार तीन वषᭅ से अिधक कᳱ अविध के िलए ᮧमुख नहᱭ होगा जब तक वह कम से कम ि᳇तीय अविध के िलए िवशेष ᱨप से िनयुᲦ न ᳰकया गया हो ।

(3) िनदशेक छह मास से अनिधक कᳱ अविध के िलए ᳰकसी िवभाग, िव᳒ालय या कᱶ ᮤ का अ᭭थायी ᮧभार ᭭वयं ले सकेगा या ᳰकसी अ᭠य िवभाग के उपिनदशेक या ᳰकसी आचायᭅ के ᮧभार मᱶ सᲅप सकेगा।

(4) िवभाग या िव᳒ालय या कᱶ ᮤ का ᮧमुख, िनदशेक के साधारण िनयंᮢण और अधीᭃण के अधीन रहते ᱟए िवभाग के संपूणᭅ कायᭅ के िलए उᱫरदायी होगा ।

(5) िवभाग का ᮧमुख यह दखेने के िलए कतᭅ᳞ ᳇ारा आब᳍ होगा ᳰक सं᭭थान के ᮧािधकरणᲂ के और िनदशेक के िविन᳟य िन᳧ापूवᭅक लागू ᳰकए जा रहे ह ᱹ। वह ऐस ेअ᭠य कतᭅ᳞ᲂ का पालन करेगा जो उसको िनदशेक ᳇ारा समनुदिेशत ᳰकए जाएं ।

(6) जब िवभाग, िव᳒ालय या के᭠ᮤ के ᮧमुख के पद पर िनयुिᲦ स᭥यक् हो तब िनदशेक इस ᮧकार िनयुᲦ होने के िलए ᮧमुख के ᱨप मᱶ िनयुᲦ ᳰकए जाने वाले पाᮢ ᳞िᲦयᲂ कᳱ रजामंदी सुिनि᳟त करेगा और साधारणतः पाᮢ तथा रजामंद ᳞िᲦयᲂ मᱶ से चᮓानुᮓम ᳇ारा ᳰकसी ᳞िᲦ का चयन करेगा । 10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(7) जब कभी चᮓानुᮓम के ᳲस᳍ांत स ेिवचिलत होना ᮧ᭭तािवत हो तब ऐसी िनयुिᲦ केवल अ᭟यᭃ, शासक बोडᭅ के पूवᭅ अनुमोदन से और लेखब᳍ ᳰकए जाने वाले कारणᲂ से कᳱ जाएगी तथा िसनेट और बोडᭅ के आगामी अिधवेशनᲂ मᱶ िवचलन के कारणᲂ सिहत िसनेट और बोडᭅ को ᳯरपोटᭅ भी ᳰकया जाएगा ।

21. कुल-सिचव.—(1) कुल-सिचव, ᮧितिनयुिᲦ या संिवदा आधार पर पांच वषᭅ से अनिधक कᳱ ᳰकसी िनयत अविध के िलए िनयुᲦ होगा ।

(2) एक वषᭅ कᳱ सेवा पूरी करने पर कुल सिचव के कायᭅपालन का पुनᳶवलोकन संिवदा कᳱ शेष अविध के जारी रखने के ᮧयोजन के िलए बोडᭅ ᳇ारा गᳯठत कᳱ जान ेवाली सिमित ᳇ारा ᳰकया जा सकेगा और त᭜प᳟ात,् बोडᭅ जब कभी वह चाह,े कुल सिचव के कायᭅपालन का पुनᳶवलोकन कर सकेगा।

(3) कुल-सिचव बोडᭅ, िसनेट और ऐसी अ᭠य सिमितयᲂ के िजसके िलए वह इस ᮧकार कायᭅ करने को पᳯरिनयमᲂ ᳇ारा अपेिᭃत ᳰकया जा सकेगा, सिचव के ᱨप मᱶ कायᭅ करेगा ।

(4) कुल सिचव अपन ेसभी कृ᭜यᲂ, िजसके अंतगᭅत बोडᭅ का सिचव भी ह,ै के िलए सं᭭थान के िनदशेक को ᳯरपोटᭅ करेगा ।

22. कमᭅचाᳯरवृदंᲂ का वगᱮकरण—

(1) आकि᭭मक ᳞य से संदᱫ कमᭅचाᳯरयᲂ के मामले के िसवाय सं᭭थान के कमᭅचाᳯरवंृद िन᳜िलिखत ᱨप मᱶ वगᱮकृत हᲂगे :—

(i) शᭃैिणक कमᭅचाᳯरवृदं—िनदशेक, उप िनदशेक, आचायᭅ, सहयुᲦ आचायᭅ, सहायक आचायᭅ, ᮧिशᭃण और ᭭थानन आचायᭅ और ऐसे अ᭠य शैᭃिणक पद जो बोडᭅ ᳇ारा समय-समय पर िविनि᳟त ᳰकए जाएं ;

(ii) तकनीकᳱ कमᭅचारी—तंᮢ ᮧबंधक, तंᮢ िव᳣ेषक, कायᭅᮓमकताᭅ, पु᭭तकालय अ᭟यᭃ, कायᭅशाला अधीᭃक, सहायक कायᭅशाला अधीᭃक, फोरमैन, तकनीकᳱ, ᮧिशᭃक, ᮧयोगशाला सहायक, मैकेिनक, सवᱷᭃक, तकनीकᳱ सहायक, ᮧाᱨपकार और ऐसे अ᭠य तकनीकᳱ पद िज᭠हᱶ बोडᭅ ᳇ारा समय-समय पर िविनि᳟त ᳰकया जाए : और

(iii) ᮧशासिनक और अ᭠य कमᭅचाᳯरवृंद—कुलसिचव, उपकुलसिचव और सहायक कुल सिचव, लेखा अिधकारी, संपरीᭃा अिधकारी, संपदा अिधकारी, कायᭅपालक इंजीिनयर, सहायक इंजीिनयर, किन᳧ इंजीिनयर, िचᳰक᭜सा अिधकारी, िचᳰक᭜सा सहायक, उ᳒ान सहायक या अिधकारी, कायाᭅलय अधीᭃक, सुरᭃा अिधकारी, भंडार अिधकारी, भंडारी, कायाᭅलय सहायक, आंकडे ᮧिवि᳥ ᮧचालक और ऐसे अ᭠य ᮧशासिनक तथा अ᭠य कमᭅचाᳯरवंृद जैसे बोडᭅ ᳇ारा समय-समय पर िविनि᳟त ᳰकए जाएं ।

(2) शैᭃिणक कमᭅचाᳯरवंृद के ᱨप मᱶ वगᱮकृत पद केवल ᮧावकाश पद हᲂगे ।

23. िनयिुᲦया.ं—(1) सं᭭थान के पद अिखल भारतीय ᭭तर पर िव᭄ापन ᳇ारा भरे जाएंगेः परंतु िनदशेक या उप िनदशेक के पदᲂ से िभ᳖ पदᲂ के िलए सीधी भतᱮ या ᮧो᳖ित वाले पदᲂ के बीच अनपुात भतᱮ िनयमᲂ के अनुसार होगी ।

(2) पदᲂ का आरᭃण के᭠ᮤीय सरकार के िनयमᲂ के अनुसार होगा ।

(3) िनयुिᲦ के ᮧयोजनᲂ के िलए के᭠ᮤीय सरकार के कमᭅचाᳯरयᲂ को लागू िनयम, लागू हᲂगे ।

(4) सं᭭थान के कमᭅचाᳯरवंृदᲂ मᱶ से सीधी भतᱮ ᳇ारा या ᮧो᳖ित ᳇ारा सं᭭थान के अधीन पदᲂ को (संिवदा आधार पर पदᲂ से िभ᳖) भरने के िलए चयन सिमितयᲂ का ऐसी रीित से जो मानव संसाधन िवकास मंᮢालय, उᲬतर िवभाग, भारत सरकार या बोडᭅ ᳇ारा समय-समय पर अ᭟यादशेᲂ ᳇ारा अिधकिथत कᳱ जाएं, गठन ᳰकया जाएगा ।

(5) सं᭭थान के कमᭅचाᳯरवंृदᲂ मᱶ स ेसीधी भतᱮ ᳇ारा या ᮧो᳖ित ᳇ारा सं᭭थान के अधीन पदᲂ को (संिवदा आधार से िभ᳖) भरने के िलए चयन सिमितयᲂ का िन᳜िलिखत रीित से गठन ᳰकया जाएगा, अथाᭅत् :- ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 11 (क) शैᭃिणक कमᭅचारीवंृद कᳱ (िनदशेक को छोड़कर) भतᱮ के िलए या ᮧो᳖ित के िलए चयन सिमित िन᳜ ᮧकार होगी:

(1) िनदशेक या उप िनदशेक अ᭟यᭃ

(2) कुला᭟यᭃ का नामिनदᱷिशती सद᭭य

(3) बोडᭅ के दो नामिनदᱷिशती िजसमᱶ एक िवशेष᭄ होगा ᳴कतु बोडᭅ के सद᭭य से िभ᳖ सद᭭य

(4) सं᭭थान से बाहर का िसनेट का एक िवशेष᭄ नामिनदᱷिशती सद᭭य

(5) संब᳍ िवभाग का ᮧमुख (आचायᭅ के पद से िभ᳖ के िलए) सद᭭य (ख) तकनीकᳱ पदᲂ के िलए चयन सिमित िन᳜ ᮧकार होगी :

(1) िनदशेक या उप िनदशेक अ᭟यᭃ

(2) सं᭭थान से बाहर का एक िवशेष᭄ सद᭭य

(3) मानव संसाधन िवकास मंᮢालय का नामिनदᱷिशती सद᭭य

(4) संब᳍ िवभाग का ᮧमुख सद᭭य

(5) कुल सिचव सद᭭य (ग) ᮧशासिनक और अनुसिचवीय कमᭅचाᳯरवंृद के िलए चयन सिमित िन᳜ ᮧकार होगी :

1) िनदशेक या उप िनदशेक अ᭟यᭃ

(2) सं᭭थान से बाहर का एक िवशेष᭄ सद᭭य

(3) मानव संसाधन िवकास मंᮢालय का नामिनदᱷिशती सद᭭य

(4) कुल सिचव सद᭭य (घ) ᭔ये᳧ ᮧशासिनक और सहायक आचायᭅ तथा उससे ऊपर के वेतनमान वाले अ᭠य सदृ᭫ य पदᲂ के िलए चयन सिमित िन᳜ ᮧकार होगी :

(1) िनदशेक या उप िनदशेक अ᭟यᭃ

(2) सं᭭थान से बाहर का एक िवशेष᭄ सद᭭य 12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(3) मानव संसाधन िवकास मंᮢालय का नाम िनदᱷिशती सद᭭य

(4) बोडᭅ का नामिनदᱷिशती सद᭭य

(5) कुल सिचव सद᭭य

(6) यᳰद चयन कुल सिचव या समतु᭨य पद के िलए ᳰकया जाता है तो बोडᭅ ᳰकसी ᭪ यि᭍ त को चयन सिमित का सद᭭ य नामिनदᱷिशत करेगा और कुल सिचव उसमᱶ सद᭭ य के ᱨप मᱶ नहᱭ बैठेगा ।

(7) उप िनदशेक कᳱ अनुपि᭭थित मᱶ िनदशेक सं᭭थान कमᭅचाᳯरवंृद के ᳰकसी सद᭭ य को उसके ᭭थान पर चयन सिमित के सद᭭य के ᱨप मᱶ नामिनदᱷिशत कर सकेगा ।

(8) जहां कोई पद संिवदा आधार पर या आमंᮢण ᳇ारा भरा जाना है वहां बोडᭅ ऐसी तदथᭅ चयन सिमित, जो आव᭫ यक हो, गᳯठत कर सकेगा ।

(9) जहां ᳰकसी पद को सं᭭थान के सद᭭यᲂ मᱶ से ᮧो᳖ित ᳇ारा या अ᭭थायी ᱨप से बारह मास से अनिधक कᳱ अविध के िलए भरा जाना है वहां उसके िलए ᮧᳰᮓया वैसी होगी जो अ᭟यादशेᲂ ᳇ारा िविन᳸द᳥ कᳱ जाएगी ।

(10) इन पᳯरिनयमᲂ मᱶ ᳰकसी बात के होते ᱟए भी बोडᭅ िवभाग या िव᳒ालय या के᭠ᮤ कᳱ अ᭜याव᭫यकता के िलए उिचत िवशेष कौशल या ᭄ान रखने वाले ᳞िᲦयᲂ कᳱ िनयुिᲦ करने कᳱ शिᲦ रखेगा ।

(11) यᳰद पद को िव᭄ापन ᳇ारा भरा जाना ह ैतो पद के िनबंधन और शतᱸ िव᭄ापन मᱶ वᳶणत ᳰकए जाएंगे तथा पाᮢ और सवाᭅिधक वांछनीय अ᭤यᳶथयᲂ को चयिनत सूची के ᮧयोजन के िलए अनुवेᭃण सिमित िव᭄ापन मᱶ िविन᳸द᳥ तारीख के भीतर ᮧा᳙ सभी आवेदनᲂ का अनवेुᭃण करेगी ।

(12) कुछ पदᲂ को साᭃा᭜कार से छूट दी जा सकेगी जो बोडᭅ ᳇ारा िविनि᭫ चत ᳰकया जाएगा । यᳰद, जहां साᭃा᭜ कार अिनवायᭅ ह,ै वहां चयन सिमित ऐसे सभी अ᭤ यᳶथयᲂ, जो साᭃा᭜कार के िलए बुलाए गए हᱹ, के ᮧ᭜यय-पᮢᲂ कᳱ परीᭃा करेगी, पाᮢ अ᭤यᳶथयᲂ का साᭃा᭜कार लेगी और सवाᭅिधक उपयुᲦ अ᭤यथᱮ कᳱ िनयुिᲦ कᳱ िसफाᳯरश सᭃम ᮧािधकारी को अनुमोदन के िलए करेगी ।

(13) चयन सिमित कᳱ िसफाᳯरशᱶ साᭃा᭜कार कᳱ तारीख से एक वषᭅ कᳱ अविध के िलए िविधमा᭠य रहᱶगी और यᳰद िसफाᳯरशᱶ ᳰकसी कारण से सᭃम ᮧािधकारी ᳇ारा अनुमोᳰदत नहᱭ कᳱ जाती ह ᱹ या िनयुिᲦ आदशे िसफाᳯरशᲂ के अनुमोदन के प᳟ात ्एक वषᭅ कᳱ उᲦ अविध के भीतर जारी नहᱭ ᳰकए जात ेहᱹ तो िसफाᳯरशᱶ समा᳙ हो जाएंगी और नया िव᭄ापन जारी ᳰकया जाएगा ।

(14) ᳰकसी चयन सिमित का कोई कायᭅ या ᮧᳰᮓया केवल चयन सिमित के ᳰकसी सद᭭य या सद᭭यᲂ कᳱ अनुपि᭭थित के आधार पर ᮧ᳤गत नहᱭ कᳱ जाएगी ।

(15) जब तक ᳰक इन पᳯरिनयमᲂ के अधीन अ᭠यथा उपबंध न ᳰकया जाए तब तक ᳰकसी पद पर िनयुिᲦ के िलए िसफाᳯरशᱶ करने के ᮧयोजन के िलए गᳯठत कᳱ गई चयन सिमित उस पद के संबंध मᱶ अपने कृ᭜यᲂ का िनवहᭅन उस पद पर िनयुिᲦ ᳰकए जाने तक जारी रखेगी ।

(16) सं᭭थान मᱶ कᳱ गई सभी िनयुिᲦया ंबोडᭅ के अगले अिधवेशन मᱶ उसको ᳯरपोटᭅ कᳱ जाएंगी ।

(17) सुिनि᳟त वृिᱫ ᮧगित (ए.सी.पी.) के अधीन ᮧो᳖ित के िलए पाᮢ कमᭅचाᳯरयᲂ के आवेदन ᳰकसी ᮧो᳖ित या उ᳖यन के िलए िसफाᳯरश ᳰकए जाने से पूवᭅ िवभागीय ᮧो᳖ित सिमितयᲂ ᳇ारा िवचाᳯरत ᳰकए जाएंगे ।

(18) िवभागीय ᮧो᳖ित सिमित िन᳜ानसुार हᲂगी, अथाᭅत ्:—

1. िनदशेक या उप िनदशेक अ᭟यᭃ

2. संब᳍ िवभाग का ᮧमुख सद᭭य

3. अ᭠य िवभाग से िवभाग का ᮧमुख सद᭭य

4. कुल सिचव सद᭭य ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 13

24. ᭭थायी कमᭅचाᳯरयᲂ कᳱ सेवा के साधारण िनबधंन और शत.ᱸ—सं᭭थान के ᭭थायी कमᭅचारी िन᳜िलिखत िनबंधनᲂ और शतᲄ ᳇ारा शािसत हᲂगे, अथाᭅत ्-

(i) अिधिनयम और पᳯरिनयमᲂ के उपबंधᲂ के अधीन रहते ᱟए, सं᭭थान के अधीन पदᲂ पर सभी िनयुिᲦयां दो वषᭅ कᳱ अविध के िलए पᳯरवीᭃा पर कᳱ जाएंगी और पᳯरवीᭃा अविध पूरी करने के प᳟ात ्कमᭅचारी कᳱ उसके पद पर पुि᳥ कᳱ जाएगी:

परंतु यᳰद ᳰकसी कमᭅचारी कᳱ पᳯरवीᭃा संतोषजनक नहᱭ पाई जाती ह ै तो िनयुि᭍ त ᮧािधकारी को ᳰकसी कमᭅचारी कᳱ पᳯरवीᭃा कᳱ अविध को एक वषᭅ से अनिधक और अविध के िलए िव᭭ताᳯरत करने कᳱ शिᲦ होगी;

(ii) पुि᭬ टकृत के ᱨप मᱶ, कमᭅचारी अिधिनयम और पᳯरिनयमᲂ के उपबंधᲂ के अ᭟ यधीन उस मास के अंत तक िजसमᱶ वे अपने-अपने पदᲂ मᱶ अिधवᳶषता कᳱ आयु के अनुसार सेवािनवृ᭜ त हᲂगे, अपने पद पर बने रहᱶगे;

(iii) अिधवᳶषता कᳱ आयु वैसी होगी जो के᭠ᮤीय सरकार ᳇ारा सं᭭थान के कमᭅचाᳯरयᲂ के िविभ᳖ वगᲄ और ᮧवगᲄ के िलए िविन᳸द᳥ कᳱ जाए ।

(iv) सं᭭थान के कमᭅचारी, के᭠ᮤीय सरकार के कमᭅचाᳯरयᲂ के िलए यथा अनुझेय वेतन के अितᳯरᲦ भᱫᲂ के िलए हकदार हᲂगे ।

(v) सं᭭थान के कमᭅचारी, के᭠ᮤीय िसिवल सेवा (िचᳰक᭜सीय पᳯरचयाᭅ) िनयम, 1944 के अनुसार उनके और उनके कुटंुबᲂ पर उपगत िचᳰक᭜सीय ᳞यᲂ कᳱ ᮧितपूᳶत के िलए हकदार हᲂगे ।

(vi) सं᭭थान के कमᭅचारी के᭠ᮤीय िसिवल सेवा (आचरण) िनयम, 1964 ᳇ारा शािसत हᲂगे ।

(vii) ऐसे कमᭅचारी जो 4.3.2014 को या उसके प᳟ात् िनयुᲦ ᳰकए गए ह ᱹकᱶ ᮤीय सरकार ᳇ारा घोिषत नई पᱶशन ᭭कᳱम ᳇ारा शािसत हᲂगे ।

(viii) सं᭭थान के कमᭅचाᳯरयᲂ के आवेदन का सं᭭थान के बाहर िनयोजन के िलए अनुसूची-घ मᱶ िविन᳸द᳥ ᮧᳰᮓया के अनुसार एक वषᭅ मᱶ केवल तीन बार अᮕेिषत ᳰकए जाएंगे ।

(ix) सं᭭थान के कमᭅचारी, के᭠ᮤीय सरकार के कमᭅचाᳯरयᲂ को यथा अनु᭄ेय छुᲵी याᮢा ᳯरयायत (एलटीसी) के िलए हकदार हᲂगे ।

(x) अितकािलक और रािᮢ भᱫा, जैसा के᭠ᮤीय सरकार के कमᭅचाᳯरयᲂ को यथा अनु᭄ेय है के अनुसार सं᭭थान के पाᮢ कमᭅचाᳯरयᲂ को संदᱫ ᳰकया जाएगा।

25. आचार सिंहता.—कमᭅचाᳯरयᲂ के िलए आचार संिहता, के᭠ᮤीय सरकार के परामशᭅ से भारतीय इंजीिनयᳳरग िव᭄ान और ᮧौ᳒ोिगकᳱ सं᭭ थान, िशबपुर ᳇ारा बनाई जाएगी और जब तक कमᭅचाᳯरयᲂ के िलए आचार संिहता िवरिचत नहᱭ कᳱ जाती है, तब तक सं᭭ थान कᱶ ᮤीय िसिवल सेवा (वगᱮकरण, िनयंᮢण और अपील) िनयम, 1965 का अनुसरण करेगा ।

26. अ᭭थायी कमᭅचाᳯरयᲂ कᳱ सवेा के साधारण िनबधंन और शत.ᱸ—(1) अ᭭थायी कमᭅचाᳯरयᲂ कᳱ सेवाएं या तो कमᭅचारी ᳇ारा िनयुिᲦ ᮧािधकारी को या िनयुिᲦ ᮧािधकारी ᳇ारा कमᭅचारी को िलिखत मᱶ एक मास कᳱ सूचना पर ᳰकसी भी समय समापन के अधीन होगी ।

(2) ऐसे कमᭅचारी कᳱ सेवा के अ᭠य िनबंधन और शत ᱸ ऐसी हᲂगी जैसी िनयुिᲦ ᮧािधकारी ᳇ारा उसके िनयुिᲦ पᮢ मᱶ िविन᳸द᳥ कᳱ जाएं ।

27. सिंवदा पर िनयिुᲦया.ं—(1)इन पᳯरिनयमᲂ मᱶ ᳰकसी बात के होते ᱟए भी, कुला᭟यᭃ कᳱ पूवᭅ अनुमित से बोडᭅ, िवशेष पᳯरि᭭थितयᲂ मᱶ पांच वषᭅ स ेअनिधक कᳱ अविध के िलए संिवदा पर ᳰकसी िव᭎यात ᳞िᲦ को िनयुᲦ कर सकेगी ।

(2) अिधिनयम के उपबंधᲂ के अधीन रहते ᱟए बोडᭅ ᳰकसी ᳞िᲦ को संिवदा पर तीन वषᭅ से अनिधक कᳱ अविध के िलए िविहत वेतनमान मᱶ और सुसंगत पद के िलए लागू िनबंधन और शतᲄ पर िनयुᲦ कर सकेगा ।

(3) ऐसी िनयुिᲦया ंकरने के िलए अ᭟यᭃ का शासक बोडᭅ ऐसी तदथᭅ चयन सिमित का गठन करेगा जैसा ᮧ᭜येक मामले कᳱ पᳯरि᭭थितयᲂ मᱶ अपेिᭃत हो :

परंतु सिमित के ऐसे गठन कᳱ पुि᳥ के िलए बोडᭅ को ᳯरपोटᭅ कᳱ जाएगी । 14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

28. भिव᭬य िनिध और पᱶशन ᭭कᳱम.—कᱶ ᮤीय सरकार उन कमᭅचाᳯरयᲂ, जो त᭜ कालीन बंगाल इंजीिनयᳳरग और िव᭄ान िव᭫ विव᳒ालय के सं᭭ थान मᱶ पᳯरवतᭅन के प᭫ चात् सेवािनवृ᭜ त होते ह,ᱹ के संबंध मᱶ पᱶशन का दािय᭜ व ᮕहण करेगी और टेक ओवर के प᭫ चात् सं᭭ थान के िव᳒मान कमᭅचाᳯरयᲂ को अपनी सेवा शतᲄ के संबंध मᱶ िवक᭨ प ᳰदए जाएंगे और तदनुसार पᱶशन दािय᭜ व िन᭥ नानसुार हᲂगे :—

(i) रा᭔ य पᱶशन िनयमᲂ के अधीन समािव᭬ ट िव᳒मान पᱶशन भोिगयᲂ के संदाय का दािय᭜ व रा᭔ य सरकार पर बना रहेगा । तथािप, ऐसे कमᭅचारी, जो बंगाल इंजीिनयᳳरग और िव᭄ान िव᭫ विव᳒ालय के सं᭭ थान मᱶ पᳯरवतᭅन कᳱ तारीख के प᭫ चात् अिधवᳶषता पर सेवािनवृ᭜ त होते ह ᱹकᳱ पᱶशन कᳱ संदाय का दािय᭜ व कᱶ ᮤीय सरकार पर होगा ।

(ii) 1 जनवरी, 2004 से पूवᭅ भतᱮ कमᭅचारी, जो कᱶ ᮤीय सरकार ᳇ारा ᮧशािसत पᱶशन ᭭ कᳱम का िवक᭨ प दतेे हᱹ, कᱶ ᮤीय िसिवल सेवा (पᱶशन) िनयम, 1972 ᳇ारा िविनयिमत हᲂगे और यᳰद वे िव᳒मान पᱶशन ᭭ कᳱम अथाᭅत् रा᭔ य सरकार पᱶशन ᭭ कᳱम का िवक᭨ प दतेे ह ᱹतो उ᭍ त उपबंधᲂ ᳇ारा िविनयिमत हᲂगे ;

(iii) 1 जनवरी, 2004 को या उसके प᭫ चात् और 4 माचᭅ, 2014 से पूवᭅ भतᱮ कमᭅचारी जो कᱶ ᮤीय सरकार ᳇ारा ᮧशािसत पᱶशन ᭭ कᳱम का िवक᭨ प दतेे हᱹ नई पᱶशन ᭭ कᳱम ᳇ारा िविनयिमत हᲂगे और यᳰद रा᭔ य सरकार पᱶशन ᭭ कᳱम का िवक᭨ प दतेे ह ᱹउ᭍ त उपबंधᲂ ᳇ारा िविनयिमत हᲂगे; और

(iv) 4 माचᭅ, 2014 अथाᭅत् बंगाल इंजीिनयᳳरग और िव᭄ान िव᭫ विव᳒ालय के सं᭭ थान मᱶ पᳯरवतᭅन कᳱ तारीख के प᭫ चात् भतᱮ कमᭅचारी नई पᱶशन ᭭ कᳱम ᳇ारा िविनयिमत हᲂगे ।

29. पद᭜याग.—इन ᮧथम पᳯरिनयमᲂ के पूवᭅगामी उपबंधᲂ मᱶ ᳰकसी बात के होते ᱟए भी सं᭭थान का कोई कमᭅचारी पद᭜याग कर सकेगा यᳰद :

(i) वह ᭭थायी कमᭅचारी ह ैतो अपने िनयुिᲦ ᮧािधकारी को िलिखत मᱶ केवल तीन मास कᳱ सूचना दनेे के प᳟ात ्या उसके ᭭थान पर तीन मास के वेतन संदᱫ ᳇ारा ; और

(ii) वह ᭭थायी कमᭅचारी नहᱭ ह ैतो अपने िनयुिᲦ ᮧािधकारी को िलिखत मᱶ केवल एक मास कᳱ सूचना दनेे के प᳟ात ्या उसके ᭭थान पर एक मास के वेतन संदᱫ ᳇ारा :

परंतु ऐसा पद᭜याग केवल उस तारीख को िजसको ᭜यागपᮢ, िनयुिᲦ ᮧािधकारी ᳇ारा ᭭वीकृत ᳰकया गया ह,ै ᮧभावी होगा ।

30. सवेािनविृᱫ.—(1) कोई कमᭅचारी अहᭅक सेवा के बीस वषᭅ पूरे करने के प᳟ात ् ᳰकसी भी समय वह िनयुिᲦ ᮧािधकारी को िलिखत मᱶ तीन मास से अ᭠यून कᳱ सूचना दकेर समय-समय पर के᭠ᮤीय सरकार ᳇ारा अपने कमᭅचाᳯरयᲂ के िलए अिधकिथत िनबंधनᲂ और शतᲄ के अनुसार संवा से सेवािनवृᱫ हो सकेगा ।

(2) िनयुिᲦ ᮧािधकारी को, के᭠ᮤीय िसिवल सेवा (पᱶशन) िनयम, 1972 के उपबंध के अनुसार समयपूवᭅ सेवािनवृिᱫ के ᱨप मᱶ अिधवᳶषता से पूवᭅ, कमᭅचारी को सेवािनवृᱫ करने का अिधकार होगा ।

(3) कोई कमᭅचारी, िन᳜िलिखत शतᲄ के अधीन रहते ᱟए ᳰकसी ऐसी शारीᳯरक या मानिसक शैिथ᭨यता के कारण जो ᭭थायी ᱨप से उसको सेवा से असमथᭅ करती ह,ै सेवा से सेवािनवृᱫ हो सकेगा, अथाᭅत् :—

(i) कमᭅचारी, अपना आवेदन रिज᭭ᮝार को उिचत मा᭟यम और ᮧᳰᮓया से ᮧ᭭तुत करेगा और एक िचᳰक᭜सीय ᮧमाणपᮢ, ऐस ेिचᳰक᭜सा ᮧािधकारी से जो अ᭟यादशेᲂ ᳇ारा िविन᳸द᳥ ᳰकया जाए, ᮧ᭭तुत करेगा ;

(ii) यᳰद िचᳰक᭜सा ᮧािधकारी ᳰकसी िन᳜तर पद के िलए आरो᭏य ᮧमाणपᮢ ᮧदान करता ह ैतो कमᭅचारी यᳰद इ᭒छुक है तो केवल ऐसे पद पर जो उपल᭣ध है िनयुᲦ ᳰकया जा सकेगा ; और

(iii) ᭭वा᭭᭝य ᳯरपोटᭅ, सेवािनवृ᭜ त कᳱ तारीख से पहले या स᭥पाती होनी चािहए । ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 15

31. अिधदाय.—सं᭭थान के ᭭थायी कमᭅचारी, के᭠ᮤीय सरकार के कमᭅचाᳯरयᲂ को यथा अनु᭄ेय िविभ᳖ ᮧयोजनᲂ के िलए अिधदाय िनकालने कᳱ सुिवधा रखᱶगे ।

32. ᮧितिनयिुᲦ.—ᮧितिनयिुᲦ, लोकिहत मᱶ (अ᭭थायी ᭭थानांतरण) िनयुिᲦ के िलए रा᳦ीय ᮧौ᳒ोिगकᳱ सं᭭थान स े बाहर अ᭠य रा᳦ीय ᮧौ᳒ोिगकᳱ सं᭭थान, के᭠ᮤीय सरकार, रा᭔य सरकार, िव᳡िव᳒ालयᲂ या ᭭वायᱫशासी िनकायᲂ मᱶ िजनमᱶ सावᭅजिनक ᭃेᮢ के उपᮓम भी सि᭥मिलत हᱹ और भतᱮ िनयमᲂ मᱶ िविन᳸द᳥ िनबंधनᲂ और शतᲄ के अधीन रहते ᱟए अनु᭄ेय हᱹ ।

33. कमᭅचाᳯरयᲂ के िलए िनवास ᭭थान.—(1) सं᭭थान के ᮧ᭜येक कमᭅचारी को केवल िनवासीय उपयोग के िलए सं᭭थान के पᳯरसर के भीतर एक असुसिᲯत घर, यᳰद उपल᭣ध होगा तो, आबंᳯटत ᳰकया जा सकेगा िजसमᱶ उसस,े ऐसी शतᲄ के अधीन रहते ᱟए जो सं᭭थान के गृह आबंटन िनयमᲂ ᳇ारा अिधकिथत कᳱ जाएं, िनवास करने कᳱ अपेᭃा जाएगी ।

(2) सं᭭थान के ऐसे कमᭅचारी से, िजसको िनवासीय उपयोग के िलए घर आबंᳯटत ᳰकया गया है, समय-समय पर बोडᭅ ᳇ारा यथा िनयत दर पर अनु᭄ि᳙ फᳱस ᮧभाᳯरत कᳱ जाएगी ।

(3) अनु᭄ि᳙ फᳱस के अितᳯरᲦ, जल, िव᳒ुत और दी गई ᳰकसी अ᭠य सेवा के ᮧभार, ᳰकसी कमᭅचारी से वा᭭तिवक आधार पर या ऐसी दरᲂ पर जो समय-समय पर बोडᭅ ᳇ारा अवधाᳯरत कᳱ जाएं, वसूल कᳱ जाएंगे ।

(4) बोडᭅ, यᳰद सं᭭थान के िहत मᱶ ऐसा करना आव᭫यक समझता है तो ᳰकसी ᮧवगᭅ के कमचारी को कोई अनु᭄ि᳙ फᳱस उ᭞गृहीत ᳰकए िबना या ᳯरयायती दरᲂ पर ऐसी फᳱस उ᭞गृहीत करते ᱟए सुसिᲯत या असुसिᲯत वास सुिवधा आबंᳯटत कर सकेगा ।

34. छुᲵी.—सं᭭थान के सभी कमᭅचाᳯरयᲂ के िलए छुᲵी के᭠ᮤीय िसिवल सेवा (छुᲵी) िनयम, 1972 ᳇ारा शािसत हᲂगी ।

35. छाᮢविृᱫया,ं अ᭟यतेाविृᱫया,ं पदक और पुर᭭कार.—बोडᭅ, िसनेट कᳱ िसफाᳯरश पर ऐसी छाᮢवृिᱫयां, अ᭟येतावृिᱫया,ं पदक और पुर᭭कार जो आव᭫यक समझी जाएं, संि᭭थत कर सकेगा ।

36. फᳱस.—सं᭭थान िन᳜िलिखत फᳱसᱶ ᮧभािवत करेगा, अथाᭅत ्:—

(i) अ᭟यापन और छाᮢावास फᳱस दो भागᲂ मᱶ समािव᳥ होगी (क) रा᳦ीय ᮧौ᳒ोिगकᳱ सं᭭थान, िव᭄ान िशᭃा और अनुसंधान पᳯरषद ्᳇ारा अवधाᳯरत फᳱस ; और (ख) ऐसी फᳱसᱶ जो शासक बोडᭅ ᳇ारा अवधाᳯरत कᳱ जाएंगी ।

(ii) अवधान रािश, छाᮢᲂ, िव᳇ानᲂ और अ᭟येताᲐ को अंितम ᱨप से सं᭭थान छोड़ने के समय सुसंगत दयेᲂ कᳱ यᳰद कोई हो, कटौती करने के प᳟ात ्ᮧितदये होगी और जहां ᳰकसी ᮧितदाय का कोई दावा अंितम ᱨप से सं᭭थान छोड़ने के दो वषᭅ के भीतर ᮧा᳙ नहᱭ ᱟआ ह ैवहां अवधान रािश को छाᮢ क᭨याण िनिध मᱶ जमा ᳰकया जाएगा ।

(iii) ऐसी फᳱस ᳯरयायत और छाᮢवृिᱫयां, जो समय-समय पर के᭠ᮤीय सरकार ᳇ारा अवधाᳯरत कᳱ जाएं, सभी रा᳦ीय ᮧौ᳒ोिगकᳱ सं᭭थानᲂ को लागू हᲂगी ।

37. छाᮢᲂ के छाᮢावास और छाᮢिनवास.—(1) ᮧ᭜येक सं᭭थान एक आवािसक सं᭭थान होगा और सभी छाᮢ तथा अनुसंधानिवद ्इस ᮧयोजन के िलए सं᭭थानᲂ ᳇ारा िनᳶमत छाᮢावासᲂ और छाᮢ िनवासᲂ मᱶ िनवास करᱶगे:

पर᭠तु कितपय मामलᲂ के िलए िनदशेक िलखत मᱶ कारणᲂ को अिभिलिखत करते ᱟए ᳰकसी छाᮢ या िव᳇ान को अपने माता-िपता या संरᭃक के साथ िनवास करने कᳱ अनु᭄ा द ेसकेगा ᳰक᭠तु जहां कोई ऐसी अनु᭄ा ᳰकसी छाᮢ या िव᳇ान को दी गई है वहां यथाि᭭थित, ऐसा छाᮢ या िव᳇ान उसी ᮧकार ऐसे ᳰकराए के संदाय के िलए दायी होगा जैसा वह छाᮢावास मᱶ िनवास कर रहा होता तो वह ᳰकराए के संदाय के िलए दायी होता ।

(2) छाᮢावासᲂ और छाᮢ िनवासᲂ का ᮧ᭜येक िनवासी इस ᮧयोजन के िलए सं᭭थान ᳇ारा अिधकिथत िनयमᲂ का पालन करेगा ।

(3) ᮧ᭜येक छाᮢावास या छाᮢ िनवास के िलए एक वाडᭅन होगा और उतने सहायक वाडᭅन तथा अ᭠य कमᭅचारी हᲂगे िजतने समय-समय पर बोडᭅ ᳇ारा अवधाᳯरत ᳰकए जाएं ।

(4) शैᭃिणक कमᭅचाᳯरवृ᭠दᲂ को वाडᭅन और सहायक वाडᭅन के ᱨप मᱶ िनदशक ᳇ारा िनयुᲦ ᳰकया जाएगा । 16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(5) वाडᭅन और सहायक वाडᭅन उस ᮧकार के आवास गृह के समान ही िजसके िलए वे सामा᭠यतया हकदार ह,ᱹ ᳰकराया मुᲦ असुसिᲯत आवास गृह के िलए हकदार हᲂगे ।

(6) बोडᭅ छाᮢावासᲂ और छाᮢिनवासᲂ के ᮧबंध के िलए िनयम अिधकिथत करेगा ।

38. स᭥मािनक उपािधयᲂ का ᮧदान ᳰकया जाना - सं᭭थान, कितपय असाधारण और ᮧितभाशाली ᳞िᲦयᲂ को उनके संबंिधत ᭃेᮢᲂ मᱶ उनके ᮧ᭎यात योगदान के िलए स᭥मािनक उपािधयᲂ को ᮧदान कर सकेगा :

पर᭠तु स᭥मािनक उपािधयᲂ को ᮧदान करने के िलए सभी ᮧ᭭ताव िसनेट ᳇ारा ᳰकए जाएंगे और बोडᭅ ᳇ारा अनुमोᳰदत ᳰकए जाएंगे । भारतीय इंजीिनयᳳरग िव᭄ान और ᮧौ᳒ोिगकᳱ सं᭭ थान अनसुचूी ‘क’ [पᳯरिनयम 17(2) दखेᱶ] “रा᳦ीय ᮧौ᳒ोिगकᳱ सं᭭थान, िव᭄ान िशᭃा और अनुसंधान अिधिनयम, 2007 (िजसे इसमᱶ इसके प᳟ात् अिधिनयम कहा गया है) कᳱ धारा 17(1) और पᳯरिनयम 17(2) (भारतीय इंजीिनयᳳरग िव᭄ान और ᮧौ᳒ोिगकᳱ सं᭭ थान, िशबपुर कᳱ दशा मᱶ) (िजसे इसमᱶ इसके प᳟ात ् पᳯरिनयम कहा गया है) के िनबंधनᲂ मᱶ, कुला᭟यᭃ, सं᭭थान के िनदशेक के ᱨप मᱶ पांच वषᭅ कᳱ संिवदा पर िनयुᲦ ᳞िᲦ कᳱ िनयुिᲦ का अनुमोदन करते हᱹ और िनयुᲦ ᳞िᲦ ने इसमᱶ इसके प᳟ात ्किथत िनबंधनᲂ और शतᲄ पर ऐसी िनयुिᲦ को ᭭वीकार कर िलया है । यह िवलेख नीचे उि᭨लिखत बातᲂ का साᭃी है और पᭃकार िन᳜िलिखत करार करते हᱹ :--

(1) इस सेवा करार के संबंध मᱶ यह माना जाएगा ᳰक उसे सभी समयᲂ पर अिधिनयम के और समय-समय पर ᭭थायी पुि᳥कृत कमᭅचाᳯरयᲂ को लागू यथा ᮧवृᱫ सं᭭थानᲂ को सि᭥मिलत करने वाले पᳯरिनयमᲂ के उपबंधᲂ के अधीन ᳰकया गया ह ै।

(2) िनयुᲦ ᳞िᲦ पदभार ᮕहण करने कᳱ तारीख से पांच वषᭅ कᳱ अविध के िलए करार के अधीन सेवा पर होगा । परंतु यᳰद ऊपर उि᭨लिखत सेवा कᳱ अविध कᳱ समाि᳙ पर िनयुᲦ ᳞िᲦ 70 वषᭅ से कम आय ुका ह,ै तो उसकᳱ सेवा उस वषᭅ के 30 जून तक जारी रहगेी, िजसमᱶ िनयुᲦ ᳞िᲦ सेवा कᳱ उᲦ अविध को पूरा करता ह ैया जब तक वह 70 वषᭅ कᳱ आयु पूरी करता है, दोनᲂ मᱶ से जो भी पूवᭅतर हो ।

(3) िनयुᲦ ᳞िᲦ सं᭭थान का ᮧधान शैᭃिणक और कायᭅकारी अिधकारी होगा और वह उᲦ अिधिनयम तथा पᳯरिनयमᲂ मᱶ उपबंिधत शिᲦयᲂ और कतᭅ᳞ᲂ के साथ सं᭭थान के पूणᭅकािलक िनदशेक के ᱨप मᱶ सेवा करेगा ।

(4) िनयुᲦ ᳞िᲦ अपना पूणᭅ समय सं᭭थान कᳱ सेवा को समᳶपत करेगा और वह आचरण िनयमᲂ और उᲦ अिधिनयम तथा पᳯरिनयमᲂ के अ᭠य उपबंधᲂ के अधीन होगा । िनयुᲦ ᳞िᲦ ᳇ारा सेवा के दौरान या सेवा के संबंध मᱶ ᮧा᳙ कᳱ गई ᳰकसी जानकारी और उसके ᳇ारा ᳰकए गए ᳰकसी कायᭅ को गु᳙ और गोपनीय माना जाएगा और िनयुᲦ ᳞िᲦ को सभी ᮧकार से समय- समय पर यथा संशोिधत भारतीय शासकᳱय गु᳙ बात अिधिनयम, 1923 के अधीन माना जाएगा ।

(5) िनयुᲦ ᳞िᲦ अपनी सेवा कᳱ अविध के दौरान, िसवाय िनलंबन कᳱ ᳰकसी अविध और साथ ही िबना वेतन कᳱ छुᲵी कᳱ ᳰकसी अविध के, भारतीय आयकर के अधीन रहते ᱟए .......... ᱧपए के वेतनमान मᱶ ........... ᱧ. के आरंिभक वेतन का हकदार होगा परंतु यᳰद ᳰकसी भी समय िनयुᲦ ᳞िᲦ भारत स ेबाहर ᮧितिनयुᲦ ᳞िᲦ पर जाता है तो उसकᳱ ᮧितिनयुᲦ ᳞िᲦ कᳱ अविध के दौरान उसका वेतन और भᱫे वे हᲂगे, जो शासक बोडᭅ ᳇ारा िविनि᳟त ᳰकए जाएं । इसके अितᳯरᲦ, िनयुᲦ ᳞िᲦ महगंाई भᱫा, नगर ᮧितकारा᭜मक भᱫा आᳰद जैसे भᱫᲂ का आहरण करेगा, जो सं᭭थान के िनयमᲂ के अनुसार समय-समय पर अनु᭄ेय हᲂ ।

(6) इस िवलेख के अधीन अपनी सेवा के दौरान िनयुᲦ ᳞िᲦ पᳯरिनयमᲂ मᱶ ᳰकए गए उपबंधᲂ के अनुसार और इन उपबंधᲂ मᱶ ऐसे उपांतरणᲂ के, िज᭠हᱶ समय-समय पर ᳰकया जाए, अधीन सं᭭थान कᳱ अिभदायी भिव᭬य िनिध - सह - उपदान मᱶ अिभदाय करेगा और साथ ही वह पᳯरिनयमᲂ के अनुसार ᭭थायी पुि᳥कृत कमᭅचाᳯरयᲂ को यथा लागू सं᭭थान के अिभदाय का भी हकदार होगा । िनयुᲦ ᳞िᲦ के ᳰकसी अ᭠य रा᳦ीय मह᭜ व के सं᭭थान का कमᭅचारी होने और उसके ᳇ारा अिभदायी भिव᭬य िनिध - सह - उपदान ᭭कᳱम या साधारण भिव᭬य िनिध - सह - पᱶशन - सह - उपदान ᭭कᳱम का फायदा िलए जाने कᳱ दशा मᱶ, वह पᳯरिनयमᲂ के अधीन यथा अनु᭄ेय इस एकᮢण के ᭭थानांतरण के साथ सं᭭थान कᳱ त᭜समान ᭭कᳱम का अिभदायी बनेगा । उस दशा मᱶ, जहां िनयुᲦ ᳞िᲦ सं᭭थान का कमᭅचारी ह ैतो वह अिभदायी भिव᭬य िनिध - सह - उपदान ᭭कᳱम या साधारण भिव᭬य िनिध - सह - पᱶशन - सह - उपदान ᭭कᳱम ᳇ारा उसी ᱨप मᱶ शािसत होता रहगेा, िजस ᮧकार वह इस संिवदा िनयिुᲦ के तुरंत पूवᭅ शािसत होता था और वह पᳯरिनयमᲂ के अनुसार सं᭭थानᲂ के अ᭠य ᭭थायी कमᭅचाᳯरयᲂ कᳱ भांित इस संिवदा के अधीन अपनी सेवा कᳱ अविध मᱶ ᭭कᳱम के फायदᲂ के िलए हकदार होगा ।

(7) इसमᱶ इससे पूवᭅ अंतᳶव᳥ ᳰकसी बात के होते ᱟए भी, जब तक ᳰक सं᭭थान ᳇ारा अ᭠यथा िविन᳟य न ᳰकया जाए, िनयुᲦ ᳞िᲦ वेतनमान के पुनरीᭃण और ऐस ेसेवािनवृिᱫ फायदᲂ मᱶ, िज᭠हᱶ सं᭭थान ᳇ारा सं᭭थान कᳱ शाखा के सद᭭यᲂ कᳱ सेवा, ऐसी सेवा, िजससे वह त᭜समय संबंध रखता ह,ै के िनबंधनᲂ और शतᲄ मᱶ इस िवलेख कᳱ तारीख के अधीन रहते ᱟए ᮧभावी ᳰकया गया हो, ᳰक᭠हᱭ सुधारᲂ के फायदᲂ का, सं᭭थान ᳇ारा यथा अवधाᳯरत ᱨप मᱶ पूणᭅ ᱨप से या भाग ᱨप मᱶ ᮧा᳙ करने का हकदार होगा और ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 17 िनयुᲦ ᳞िᲦ कᳱ सेवा के िनबंधनᲂ और शतᲄ मᱶ ऐस ेसुधार के संबंध मᱶ सं᭭थान का िविन᳟य इस ᮧकार ᮧवृᱫ होगा िजससे ᳰक इस िवलेख के उपबंधᲂ को उस सीमा तक उपांतᳯरत ᳰकया जा सके ।

(8) िनयुᲦ ᳞िᲦ, पᳯरिनयमᲂ के अधीन सं᭭थान के ᭭थायी गैरᮧावकाश कमᭅचाᳯरयᲂ को यथा अनु᭄ेय छुᲵी के िलए हकदार होगा ।

(9) िनयुᲦ ᳞िᲦ सं᭭थान के शासक बोडᭅ ᳇ारा यथा ᭭वीकृत ᱨप मᱶ सं᭭थान के पᳯरसर मᱶ अनु᭄ि᳙ शु᭨क रिहत सुसिᲯत कायाᭅलय- सह आवास का हकदार होगा ।

(10) िनयुᲦ ᳞िᲦ, पᳯरिनयमᲂ मᱶ उपबंिधत ᳰकए गए अनुसार िचᳰक᭜सीय पᳯरचयाᭅ और उपचार के संबंध मᱶ िवशेषािधकार का पाᮢ होगा ।

(11) (i) िनयुᲦ ᳞िᲦ को सं᭭थान मᱶ पदभार ᮕहण करने के िलए, िनयुᲦ ᳞िᲦ कᳱ िनयुिᲦ को लोक िहत मᱶ ᭭थानांतरण पर मानत े ᱟए कᱶ ᮤीय सरकार के ᭭थानांतरण याᮢा भᱫे िनयमᲂ के अधीन कᱶ ᮤीय सरकार के समतु᭨य पंिᲦ के ᳰकसी अिधकारी को यथा अनु᭄ेय याᮢा भᱫे का संदाय ᳰकया जाएगा ।

(ii) यᳰद िनयुᲦ ᳞िᲦ से सं᭭थान के ᳰकसी कायᭅ के िहत मᱶ याᮢा करने कᳱ अपेᭃा कᳱ जाती ह ैतो वह समय-समय पर ᮧवृᱫ सं᭭थान के याᮢा भᱫे िनयमᲂ मᱶ उपबंिधत याᮢा भᱫे और मान का हकदार होगा । इसी ᮧकार िनयुᲦ ᳞िᲦ सं᭭थान के िनयमᲂ के अनुसार अपने गृह नगर कᳱ याᮢा करने के िलए छुᲵी याᮢा ᳯरयायत का हकदार होगा ।

(12) िनयुᲦ ᳞िᲦ ᳇ारा, उसकᳱ लागत पर उसके ᳇ारा ᮧकािशत पु᭭तकᲂ और लेखᲂ से ᮧा᳙ होने वाली ᳰकसी रकम को उस ᭃेᮢ मᱶ उसे कायᭅ करते रहने के िलए ᮧो᭜साहन के ᱨप मᱶ िनयुᲦ ᳞िᲦ को दे ᳰदया जाएगा । उसे समय-समय पर बोडᭅ ᳇ारा अिधकिथत िनयमᲂ के अनुसार परामशᱮ सेवा और उसके फायदᲂ को धाᳯरत करने कᳱ अनु᭄ा भी दी जाएगी ।

(13) संिवदा कᳱ अविध के दौरान िनयᲦु ᳞िᲦ कᳱ सेवा को सं᭭थान ᳇ारा ᳰकसी भी समय, इस संिवदा के अधीन सेवा के दौरान ᳰकसी भी समय तीन कलᱹडर मास कᳱ िलिखत सूचना दकेर, िबना कोई कारण बताए समा᳙ ᳰकया जा सकेगा । परंतु सं᭭थान सदवै इसमᱶ उपबंिधत सूचना के ᭭थान पर िनयुᲦ ᳞िᲦ को तीन मास कᳱ मूल वेतन कᳱ रकम के समतु᭨य रािश का संदाय कर सकेगा । िनयुᲦ ᳞िᲦ सं᭭थान को तीन कलᱹडर मास कᳱ िलिखत सूचना दकेर अपनी सेवा समा᳙ कर सकेगा ।

(14) िनयुᲦ ᳞िᲦ को उसकᳱ िवशेष᭄ता के िवभाग मᱶ आचायᭅ कᳱ हिैसयत अनु᭄ात कᳱ जाएगी और उसे उसकᳱ सुिवधानुसार उᲦ िवभाग मᱶ अ᭟यापन और अनुसंधान मᱶ भाग लेने कᳱ अनु᭄ा दी जाएगी ।

सािᭃयᲂ के ह᭭ताᭃर, पते सिहत कᳱ उपि᭭थित मᱶ, िनदशेक, भारतीय इंजीिनयᳳरग िव᭄ान और ᮧौ᳒ोिगकᳱ सं᭭ थान, िशबपुर अनसुचूी ‘ख’ [पᳯरिनयम 18 (3) देखᱶ] उपिनदशेक के पद के िलए सवेा सिंवदा आज तारीख ................. एक पᭃकार के ᱨप मᱶ ............................. (िजसे इसमᱶ इसके प᳟ात ्िनयुᲦ ᳞िᲦ कहा गया है) और दसूरे पᭃकार के ᱨप मᱶ रा᳦ीय ᮧौ᳒ोिगकᳱ सं᭭थान, िव᭄ान िशᭃा और अनुसंधान अिधिनयम, 2007 (2007 का 29) के अधीन िनगिमत भारतीय इंजीिनयᳳरग िव᭄ान और ᮧौ᳒ोिगकᳱ सं᭭ थान, िशबपुर के बीच ᳰकया गया सेवा हतेु करार । 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] “रा᳦ीय ᮧौ᳒ोिगकᳱ सं᭭थान, िव᭄ान िशᭃा और अनुसंधान अिधिनयम, 2007 (िजसे इसमᱶ इसके प᳟ात् अिधिनयम कहा गया है) कᳱ धारा 18(3) और पᳯरिनयम 17(5) (भारतीय इंजीिनयᳳरग िव᭄ान और ᮧौ᳒ोिगकᳱ सं᭭ थान, िशबपुर कᳱ दशा मᱶ) (िजसे इसमᱶ इसके प᳟ात ् पᳯरिनयम कहा गया ह)ै के िनबंधनᲂ मᱶ, उपिनदशेक कᳱ िनयुि᭍ त बोडᭅ ᳇ारा वᳯर᭬ ठतम संकाय सद᭭ यᲂ मᱶ से चयन सिमित कᳱ िसफाᳯरशᲂ पर बोडᭅ के अ᭟ यᭃ ᳇ारा आरंभ मᱶ तीन वषᭅ कᳱ अविध के िलए कᳱ जाएगी, िजसे बोडᭅ कᳱ िसफाᳯरश पर दो बार, ᮧ᭜ येक बार एक वषᭅ के िलए िव᭭ ताᳯरत कᳱ जा सकेगी और िनयु᭍ त ᭪ यि᭍ त ने इसमᱶ इसके प᭫ चात् आने वाले िनबंधनᲂ और शतᲄ पर ऐसी िनयुि᭍ त को ᭭ वीकार कर ᳰदया ह ै। यह िवलेख नीचे उि᭨लिखत बातᲂ का साᭃी ह ैऔर पᭃकार िन᳜िलिखत करार करते हᱹ :—

(2) िनयुᲦ ᳞िᲦ ............... तारीख (जो पदभार ᮕहण करने कᳱ तारीख है) से तीन वषᭅ कᳱ अविध के िलए, जो वषᭅ दर वषᭅ आधार पर दो वषᭅ के िलए िव᭭तारणीय ह,ै करार के अधीन सेवा पर होगा । परंतु यᳰद ऊपर उि᭨लिखत सेवा कᳱ अविध कᳱ समाि᳙ पर िनयुᲦ ᳞िᲦ 65 वषᭅ से कम आयु का है, तो उसकᳱ सेवा ............. वषᭅ के 30 जून तक जारी रहगेी, िजसमᱶ िनयुᲦ ᳞िᲦ सेवा कᳱ उᲦ अविध को पूरा करता ह ैया जब तक वह 65 वषᭅ कᳱ आयु पूरी करता है, दोनᲂ मᱶ से जो भी पूवᭅतर हो ।

(3) िनयुᲦ ᳞िᲦ अिधिनयम तथा पᳯरिनयमᲂ मᱶ उपबंिधत शिᲦयᲂ और कतᭅ᳞ᲂ के साथ सं᭭थान के पूणᭅकािलक उप-िनदशेक के ᱨप मᱶ सं᭭थान कᳱ सेवा करेगा । वह अपने कᱫᭅ᳞ᲂ के िनवᭅहन मᱶ िनदशेक को ᳯरपोटᭅ करेगा ।

(6) इस िवलेख के अधीन अपनी सेवा के दौरान िनयुᲦ ᳞िᲦ पᳯरिनयमᲂ मᱶ ᳰकए गए उपबंधᲂ के अनुसार और इन उपबंधᲂ मᱶ ऐसे उपांतरणᲂ के, िज᭠हᱶ समय-समय पर ᳰकया जाए, अधीन सं᭭थान कᳱ अिभदायी भिव᭬य िनिध - सह - उपदान मᱶ अिभदाय करेगा और साथ ही वह पᳯरिनयमᲂ के अनुसार ᭭थायी पुि᳥कृत कमᭅचाᳯरयᲂ को यथा लागू सं᭭थान के अिभदाय का भी हकदार होगा । िनयुᲦ ᳞िᲦ के ᳰकसी अ᭠य रा᳦ीय मह᭜ व के सं᭭थान का िनयोजक होने और उसके ᳇ारा अिभदायी भिव᭬य िनिध - सह - उपदान ᭭कᳱम या साधारण भिव᭬य िनिध - सह - पᱶशन - सह - उपदान ᭭कᳱम का फायदा िलए जाने कᳱ दशा मᱶ, वह पᳯरिनयमᲂ के अधीन यथा अनु᭄ेय इस एकᮢण के ᭭थानांतरण के साथ सं᭭थान कᳱ त᭜समान ᭭कᳱम का अिभदायी बनेगा । उस दशा मᱶ, जहां िनयुᲦ ᳞िᲦ सं᭭थान का कमᭅचारी ह ैतो वह अिभदायी भिव᭬य िनिध - सह - उपदान ᭭कᳱम या साधारण भिव᭬य िनिध - सह - पᱶशन - सह - उपदान ᭭कᳱम ᳇ारा उसी ᱨप मᱶ शािसत होता रहगेा, िजस ᮧकार वह इस संिवदा िनयिुᲦ के तुरंत पूवᭅ शािसत होता था और वह पᳯरिनयमᲂ के अनुसार सं᭭थानᲂ के अ᭠य ᭭थायी कमᭅचाᳯरयᲂ कᳱ भांित इस संिवदा के अधीन अपनी सेवा कᳱ अविध मᱶ ᭭कᳱम के फायदᲂ के िलए हकदार होगा ।

(7) इसमᱶ इससे पूवᭅ अंतᳶव᳥ ᳰकसी बात के होते ᱟए भी, जब तक ᳰक सं᭭थान ᳇ारा अ᭠यथा िविन᳟य न ᳰकया जाए, िनयुᲦ ᳞िᲦ वेतनमान के पुनरीᭃण और ऐस ेसेवािनवृिᱫ फायदᲂ मᱶ, िज᭠हᱶ सं᭭थान ᳇ारा सं᭭थान कᳱ शाखा के सद᭭यᲂ कᳱ सेवा, ऐसी सेवा, िजससे वह त᭜समय संबंध रखता ह,ै के िनबंधनᲂ और शतᲄ मᱶ इस िवलेख कᳱ तारीख के अधीन रहते ᱟए ᮧभावी ᳰकया गया हो, ᳰक᭠हᱭ सुधारᲂ के फायदᲂ का, सं᭭थान ᳇ारा यथा अवधाᳯरत ᱨप मᱶ पूणᭅ ᱨप से या भाग ᱨप मᱶ ᮧा᳙ करने का हकदार होगा और िनयुᲦ ᳞िᲦ कᳱ सेवा के िनबंधनᲂ और शतᲄ मᱶ ऐस ेसुधार के संबंध मᱶ सं᭭थान का िविन᳟य इस ᮧकार ᮧवृᱫ होगा िजससे ᳰक इस िवलेख के उपबंधᲂ को उस सीमा तक उपांतᳯरत ᳰकया जा सके ।

(8) िनयुᲦ ᳞िᲦ, पᳯरिनयमᲂ के अधीन सं᭭थान के ᭭थायी ᮧावकाश कमᭅचाᳯरयᲂ को यथा अनु᭄ेय छुᲵी के िलए हकदार होगा । ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 19

(9) िनयुᲦ ᳞िᲦ सं᭭थान के शासक बोडᭅ ᳇ारा यथा ᭭वीकृत ᱨप मᱶ सं᭭थान के पᳯरसर मᱶ अनु᭄ि᳙ शु᭨क रिहत सुसिᲯत वास सुिवधा का हकदार होगा ।

(11) िनयुᲦ ᳞िᲦ को सं᭭थान मᱶ पदभार ᮕहण करने के िलए, िनयुᲦ ᳞िᲦ कᳱ िनयुिᲦ को लोक िहत मᱶ ᭭थानांतरण पर िनयुिᲦ मानत ेᱟए कᱶ ᮤीय सरकार के ᭭थानांतरण याᮢा भᱫे िनयमᲂ के अधीन कᱶ ᮤीय सरकार कᳱ समतु᭨य पंिᲦ के ᳰकसी अिधकारी को यथा अनु᭄ेय याᮢा भᱫे का संदाय ᳰकया जाएगा । यᳰद िनयुᲦ ᳞िᲦ स ेसं᭭थान के ᳰकसी कायᭅ के िहत मᱶ याᮢा करने कᳱ अपेᭃा कᳱ जाती ह ैतो वह समय-समय पर ᮧवृᱫ सं᭭थान के याᮢा भᱫे िनयमᲂ मᱶ उपबंिधत याᮢा भᱫे और मान का हकदार होगा । इसी ᮧकार िनयुᲦ ᳞िᲦ सं᭭थान के िनयमᲂ के अनुसार अपन ेगृह नगर कᳱ याᮢा करने के िलए छुᲵी याᮢा ᳯरयायत का हकदार होगा ।

(14) िनयुᲦ ᳞िᲦ को उसकᳱ सुिवधानुसार ..................... िवभाग मᱶ अ᭟यापन और अनुसंधान मᱶ भाग लेने के िलए उसकᳱ िवशेष᭄ता के िवभाग मᱶ आचायᭅ कᳱ हिैसयत अनु᭄ात कᳱ जाएगी।

(15) ऐसे ᳰकसी िवषय के संबंध मᱶ, िजसके िलए इस करार मᱶ कोई उपबंध नहᱭ ᳰकया गया ह,ै िनयुᲦ ᳞िᲦ उᲦ रा᳦ीय ᮧौ᳒ोिगकᳱ सं᭭थान, िव᭄ान िशᭃा और अनुसंधान अिधिनयम, 2007 या त᭜समय ᮧवृᱫ उसके ᳰकसी उपांतरण और त᳍ीन बनाए गए त᭜समय ᮧवृᱫ पᳯरिनयमᲂ ᳇ारा शािसत होगा । इसके साᭃी ᭭वᱨप ऊपर िलिखत तारीख को सं᭭थान के शासक बोडᭅ के अ᭟यᭃ और िनयुᲦ ᳞िᲦ ने इस पर अपन-ेअपने ह᭭ताᭃर ᳰकए ह ᱹ। सं᭭थान के शासक बोडᭅ के अ᭟यᭃ ᳇ारा भारतीय इंजीिनयᳳरग िव᭄ान और ᮧौ᳒ोिगकᳱ सं᭭ थान, िशबपुर सं᭭थान के िलए ह᭭ताᭃᳯरत और पᳯरदᱫ ᳰकया गया सािᭃयᲂ के ह᭭ताᭃर, पते सिहत, कᳱ उपि᭭थित मᱶ उᲦ िनयुᲦ ᳞िᲦ ᳇ारा ह᭭ताᭃᳯरत और पᳯरदᱫ ᳰकया गया .................................. सािᭃयᲂ के ह᭭ताᭃर, पते सिहत कᳱ उपि᭭थित मᱶ, उप िनदशेक, भारतीय इंजीिनयᳳरग िव᭄ान और ᮧौ᳒ोिगकᳱ सं᭭ थान, िशबपुर अनुसूची ‘ग’ [पᳯरिनयम 19(5) दिेखए] संकाया᭟यᭃता सं᭭थान मᱶ सात से अिधक संकाया᭟यᭃ पद नहᱭ हो सकᱶ गे । शासक बोडᭅ के अनुमोदन से भारतीय इंजीिनयᳳरग िव᭄ान और ᮧौ᳒ोिगकᳱ सं᭭ थान मᱶ िन᳜िलिखत संकाया᭟यᭃ पद हो सकᱶ गे :

संकाया᭟यᭃ शैᭃिणक संकाया᭟यᭃ योजना और िवकास संकाया᭟यᭃ छाᮢ क᭨याण संकाया᭟यᭃ संकाय क᭨याण संकाया᭟यᭃ (अनुसंधान और परामशᭅ) 20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] संकाया᭟यᭃ पद कायाᭅ᭜मक पद ह ैन ᳰक ᮧशासिनक पद और उसका इसकᳱ उिचत भावना से िनवहᭅन ᳰकया जाए । आचायᲄ/सह आचायᲄ मᱶ से ही संकाया᭟यᭃ को िनदशेक ᳇ारा नामिनदᱷिशत ᳰकया जाना चािहए ᳰक᭠तु िवभागा᭟यᭃ ᳇ारा नहᱭ होना चािहए । संकाया᭟यᭃ पद का कायᭅकाल साधारणतया दो वषᭅ का होगा िजसे एक और वषᭅ के िलए बढाया जा सकेगा । पर᭠तु िनदशेक, अ᭟यᭃ शासक बोडᭅ के अनुमोदन से ऐसी अविध से पूवᭅ ᳰकसी या सभी संकाया᭟यᭃᲂ को कायᭅमुᲦ कर सकेगा । संकाया᭟यᭃᲂ के कᱫᭅ᳞ तथा उᱫरदािय᭜व संकाया᭟यᭃᲂ को िन᳜िलिखत कᱫᭅ᳞ और उᱫरदािय᭜व सᲅप ेगए ह ᱹ:—

1. संकाया᭟यᭃ (शᭃैिणक) वह िनदशेक को िन᳜िलिखत पर सलाह दगेा/दगेी :

(क) छाᮢᲂ के ᮧवेश तथा उनके नामांकन ;

(ख) शैᭃिणक कैलᱶडर, समय सारिणयᲂ, पाठय़ᮓम कायᭅ तथा परीᭃाᲐ के िलए छाᮢᲂ का रिज᭭ᮝीकरण, कᭃा कᭃ ᳞व᭭था तथा कᭃा कायᭅ के उिचत संचालन के िलए सभी अ᭠य अपेᭃाᲐ को अि᭠तम ᱨप दनेा ;

(ग) कᭃा परीᭃणᲂ को संचािलत करना और सᮢ के मू᭨यांकनᲂ को अि᭠तम ᱨप दनेे को समि᭠वत करना तथा समय पर पᳯरणामᲂ कᳱ घोषणा सुिनि᳟त करने के िलए ;

(घ) सभी ᮧवगᲄ के छाᮢᲂ के अ᳒तन शैᭃिणक अिभलेखᲂ के रखरखाव का पयᭅवेᭃण ;

(ङ) पाB~य िववरण का ᮧकाशन और िवतरण ;

(च) सभी सं᭭थान ᭭तरीय शैᭃिणक िनकायᲂ कᳱ बैठकᱶ आयोिजत करना ;

(छ) छाᮢᲂ के िलए सभी शैᭃिणक ᮧमाण-पᮢᲂ, पदकᲂ तथा पुर᭭कारᲂ को ᮧदान करने के िलए ᳞व᭭था करना ;

(ज) उन परीᭃाᲐ को संचािलत करने कᳱ ᳞व᭭था करना िज᭠हᱶ सं᭭थान के िविनयमᲂ मᱶ अनुबंिधत ᳰकए गए अनुसार सं᭭थान ᳇ारा संचािलत ᳰकया जाना ह ै;

(झ) अनुसंधान के संचालन के िलए नीितया ं बनाना और शासक बोडᭅ/िसनेट के िविन᳟य को कायाᭅि᭠वत करके उपयुᲦ मानक बनाए रखने के िलए उपाय करना ;

(ञ) ᳩातकोᱫर, पीएचडी और अ᭠य अनुसंधान कायᭅᮓमᲂ के, िजनमᱶ शोध-ᮧबंध कᳱ परीᭃा भी सि᭥मिलत ह,ै संचालन मᱶ िसनेट कᳱ नीित को िन᭬पाᳰदत करना ;

(ट) दीᭃांत समारोह के संचालन को समि᭠वत करना ;

(ठ) िशᭃण कायᭅᮓमᲂ मᱶ पᳯरवतᭅन करने के िलए सभी ᮧ᭭तावᲂ पर बीओएसी ᳇ारा िवचार ᳰकया जाएगा िजसके िलए संकाया᭟यᭃ (शैᭃिणक) अथाᭅत् अ᭟यᭃ और यᳰद अनुमोᳰदत ᳰकया जाता ह,ै उ᭠हᱶ औपचाᳯरक अनुमोदन के िलए िसनेट को भेजा जाएगा ;

(ड) ᮧायोिजत ᮧांरिभक संकाय ᮧवेश कायᭅᮓमᲂ तथा अ᭤यᳶथयᲂ के Ფािलटी सुधार कायᭅᮓम को ᭭वीकार करना ;

(ढ) उᲬ शैᭃिणक मानकᲂ के िलए ᮧयास करने के िलए समय- समय पर उपयुᲦ कदम उठाने हतेु िनदशेक को सुझाव दनेा ।

2. संकाया᭟यᭃ (योजना और िवकास) वह िनदशेक को िन᳜िलिखत मᱶ सलाह दगेा/दगेी:— (क) सं᭭थागत ᳰᮓयाकलापᲂ के िव᭭तार तथा िविवधता कᳱ योजना और िसिवल, वै᳒ुत, संकमᭅ, ᭭व᭒छता, नेटवकᭅ ᮧणाली, आᳰद से संबंिधत योजना तथा ᮧाᲥलनᲂ के ᮧ᭭तुत ᳰकए जाने कᳱ सीमा तक सभी िवकासा᭜मक ᮧ᭭तावᲂ को तैयार करना । ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 21 (ख) मानव संसाधन िवकास मंᮢालय और अ᭠य अिभकरणᲂ को भेजे जाने वाली आविधक ᱨप से अपेिᭃत िविभ᳖ ᳯरपोटᲄ के संकलन के िलए अपेिᭃत योजना एवं पᳯरयोजना संबंधी सभी आव᭫यक सांि᭎यकᳱय आंकडᲂ का रखरखाव । (ग) वा᭭तिवक ल᭯यᲂ को मािनटर करने तथा पᳯरयोजनाᲐ और परामशᭅ कᳱ बाबत िनिधयᲂ का उपयोग तथा ᮧगित ᳯरपोटᲄ को ᮧ᭭तुत करने के िलए सुसंगत कागज पᮢᲂ को तैयार करना ;

(घ) नए पाठय़ᮓमᲂ के ᮧ᭭ताव तैयार करने और इस संबंध मᱶ इस ᮧयोजन के िलए संकाय सद᭭यᲂ और बा᳭ िवशेष᭄ᲂ कᳱ बैठकᱶ आयोिजत करना :

(ङ) सं᭭थान कᳱ परामशᭅ, परीᭃण एवं ᮧायोिजत अनुसंधान के ᳰᮓयाकलापᲂ का िव᭭तार करने और उ᭠हᱶ मािनटर करने का ᮧयास करने तथा ᮧगित ᳯरपोटᲄ कᳱ ᮧ᭭तुित सुिनि᳟त करना ;

(च) अनौपचाᳯरक तथा सᱫ िशᭃा और िव᭭तार कायᭅᮓमᲂ को तैयार करने एवं उनके संचालन को समि᭠वत करना ;

(छ) पᳯरयोजनाᲐ तथा परीᭃण एवं परामशᭅ संबंधी उप᭭करᲂ के उपापन के िलए बैठक का कायᭅवृᱫ और उसके आयोजन कᳱ ᳞व᭭था करना ;

(ज) रिज᭭ᮝार को िनमाᭅण और संकमᭅ सिमित के िलए बजट तथा नए ᮧाᲥलनᲂ एवं योजनाᲐ के िलए आव᭫यक आंकड़े उपल᭣ध कराना ।

3. संकाया᭟यᭃ (छाᮢ क᭨याण) (क) वह छाᮢ परामशᭅ आयोजन करने मᱶ िनदशेक को सलाह दगेा/दगेी ;

(ख) वह छाᮢ पिᮢकाᲐ, समाचार बुलेᳯटन, समाचार पᮢᲂ आᳰद के ᮧकाशन के िलए िज᭥मेदार होगा/होगी ;

(ग) वह छाᮢ, अनुशासन तथा क᭨याण संबंधी िवषयᲂ मᱶ िनदशेक को सलाह दगेा/दगेी ;

(घ) वह छाᮢ संघ/संगम/पᳯरषद संबंधी िवषयᲂ मᱶ िनदशेक कᳱ सहायता करेगा/करेगी :

(ङ) वह एनसीसी,एनएसएस, खेल, तरणताल, ᮓᳱडा, सां᭭कृितक और छाᮢᲂ कᳱ पाठय़ᮓम के साथ तथा पाठयᮓयातीत गितिविधयᲂ को समि᭠वत करेगा/करेगी ;

(च) वह पूवᭅ छाᮢᲂ का अिभलेख रखेगा/रखेगी और उनके साथ पᮢाचार करेगा/करेगी ;

(छ) वह अनुशासनहीनता मᱶ संिल᳙ छाᮢᲂ कᳱ जांच कराएगा/कराएगी ;

(ज) वह छाᮢᲂ के माता िपता/संरᭃकᲂ से उनकᳱ ᮧगित एवं ᳞ैिᲦक सम᭭याᲐ/क᭨याण के बारे मᱶ पᮢाचार करेगा/करेगी ।

4. संकाया᭟यᭃ क᭨याण वह िन᳜िलिखत से संबंिधत िवषयᲂ पर िनदशेक को सलाह दगेा/देगी :

(क) Ფािलटी सुधार कायᭅᮓम के अधीन िविभ᳖ सं᭭थाᲐ को, उ᭠हᱶ लागू िनयमᲂ के अधीन, संकाय कᳱ ᮧितिनयुिᲦ ;

(ख) वह िविभ᳖ स᭥मेलनᲂ, सेिमनारᲂ, अ᭨पाविध पाठयᮓमᲂ, ᮧिशᭃण कायᭅᮓमᲂ, िवदशेी िशᭃण/ᮧिशᭃण समनुदशेन आᳰद के िलए संकाय सद᭭यᲂ कᳱ ᮧितिनयुिᲦ के िलए िनदशेक को सलाह दगेा/दगेी ;

(ग) वह संकाय सद᭭यᲂ ᳇ारा स᭥मेलनᲂ/सेिमनार मᱶ ᮧ᭭ तुत ᳰकए गए या ᮧ᭭तुत ᳰकए जाने वाले कागजपᮢᲂ कᳱ मू᭨यांकन सिमित कᳱ बैठकᲂ कᳱ अ᭟यᭃता करेगा/करेगी ;

(घ) वह संकाय के िलए ᮧिशᭃण कायᭅᮓम आयोिजत करने मᱶ िनदशेक कᳱ सहायता करेगा/करेगी ;

(ङ) वह भवनᲂ, सड़कᲂ, जलᮧदाय, ᭭व᭒छता, घास के मैदानᲂ तथा उ᳒ानᲂ, संसूचना नेटवकᲄ, वाटर कूलरᲂ, वातानूकूलकᲂ, टेलीफोनᲂ आᳰद के संिनमाᭅण और रखरखाव के पयᭅवेᭃण मᱶ िनदशेक कᳱ सहायता करेगा/करेगी ;

(च) वह िविभ᳖ िवभागᲂ और संकाय सद᭭यᲂ के बीच अनुशासन तथा कायᭅ लोकाचार को बनाए रखने मᱶ िनदशेक कᳱ सहायता करेगा/करेगी ;

(ज) संकाय अनुशासन, समᮕता और ᮧितब᳍ता का पयᭅवेᭃण ।

5. संकाया᭟यᭃ (अनसुधंान और परामशᭅ) वह िन᳜िलिखत से संबंिधत िवषयᲂ मᱶ िनदशेक को सलाह दगेा/देगी :

(क) औ᳒ोिगक ᱨप से ᮧायोिजत अनुसधंान और परामशᭅ के िलए िनयम बनाना ;

(ख) संकाय िवशेष᭄ता के संबंध मᱶ डाटा बेस सृिजत करना और उसे बनाए रखना ;

(ग) अनुसंधान/परामशᭅ कायᭅ, पᳯरयोजना कमᭅचाᳯरवंृद कᳱ भतᱮ करने के िलए आव᭫यक उप᭭कर उपा᳙ करने मᱶ उसके कायाᭅलय संकाय के मा᭟यम से सुकर बनाना ;

(घ) छाᮢᲂ के िलए पाठय़ᮓम के साथ कᳱ गितिविधयᲂ (तकनीकᳱ उ᭜सव, ᮧ᳤ोᱫरी आᳰद) को समि᭠वत करना :

(ङ) ऐसे अिभकरणᲂ जैसे िव᭄ान और ᮧौ᳒ोिगकᳱ िवभाग (डीएसटी), भाभा परमाण ु अनुसंधान के᭠ᮤ (बीएआरसी), नाभकᳱय िव᭄ान अनुसंधान बोडᭅ (बीआरएनएस), भारतीय अ᭠तᳯरᭃ अनुसंधान सगंठन (इसरो),रᭃा अनुसंधान और िवकास सगंठन (डीआरडीओ), वैमािनकᳱ अनुसंधान और िवकास बोडᭅ (एआरएंडडीबी), सूचना ᮧौ᳒ोिगकᳱ मंᮢालय, आᳰद को िवᱫ पोषण के िलए ᮧ᭭ताव ᮧ᭭तुत करने के िलए मागᭅदशᭅन ᮧदान करना । अनसुचूी ‘घ’ [पᳯरिनयम 24(7) दिेखए] अ᭠यᮢ िनयोजन के िलए आवेदनᲂ का अᮕषेण शासक बोडᭅ ᳇ारा अनुमोᳰदत संि᳖यमᲂ के अनुसार ही िनयोजन के िलए आवेदन अᮕेिषत ᳰकए जाएंगे :

सभी कमᭅचाᳯरयᲂ से उनकᳱ सेवा के िनबंधनᲂ के अधीन अपेᭃा कᳱ जाती ह ै ᳰक वे सरकारी/ᮧाइवेट या अ᭠यᮢ मᱶ अ᭠य नौकᳯरयᲂ के िलए आवेदन करने के िलए िन᳜िलिखत संि᳖यमᲂ का पालन करᱶ :-

1. साधारण िस᳍ा᭠त:

(i) अ᭒छी ᮧो᳖ित संभावनाᲐ वाला ᭭थायी कमᭅचारी अपने पद के कᱫᭅ᳞ᲂ के ᮧित पूरे मन से अपनी शिᲦ लगाने के िलए सामा᭠य बा᭟यताधीन ह ै। यह अनिुचत नहᱭ होगा यᳰद अ᭠य िनयोजन के िलए उसका आवेदन रोक िलया जाता ह ैऔर अᮕेिषत नहᱭ ᳰकया जाता ह ै।

(ii) ᳰकसी अ᭭थायी कमᭅचारी का आवेदन तब तक न रोका जाना चािहए जब तक ऐस े अ᭭थायी कमᭅचारी के िलए अिभिलिखत तथा उसे संसूिचत ᳰकए जाने वाले बा᭟यकारी आधार न हᲂ । ᳰकसी ऐसे अ᭭थायी कमᭅचारी से ᮧा᳙ आवेदन पर, िजसकᳱ स᭥यक अनुᮓम मᱶ ᭭थायी होने कᳱ अ᭒छी संभावनाएं हᲂ, गुणागुण के आधार पर कारᭅवाई कᳱ जानी चािहए ।

(iii) ऐसे कमᭅचाᳯरयᲂ को, िज᭠हᱶ सरकारी/सं᭭थान के खचᱷ पर कोई तकनीकᳱ ᮧिशᭃण ᳰदया गया ह,ै कम से कम ब᭠धपᮢ अविध तक सं᭭थान मᱶ सेवा करते रहना चािहए और ऐसे ᳰकसी मामले मᱶ आवेदन रोकना औिच᭜यपणूᭅ ह ै। बोडᭅ ऐस े मामलᲂ मᱶ नीित का िविन᳟य कर सकेगा ।

(iv) जहां ᳰकसी कमᭅचारी को ह᭭तगत मह᭜वपूणᭅ कायᭅ को ग᭥भीर नुकसान पंᱟचाए िबना कायᭅमुᲦ नहᱭ ᳰकया जा सकता ह,ै वहां उसके आवेदन को रोका जा सकता है ।

2. संघ लोक सेवा आयोग ᳇ारा िव᭄ािपत पदᲂ के िलए आवेदन ¹Hkkx IIµ[k.M 3(i)º Hkkjr dk jkti=k % vlk/kj.k 23 सं᭭थान के कमᭅचारी संघ लोक सेवा आयोग ᳇ारा िव᭄ािपत पदᲂ के िलए सीधे आवेदन पᮢ कर सकते हᱹ पर᭠तु उ᭠हᱶ इसकᳱ सूचना िवभागा᭟यᭃ और िनदशेक को दनेी चािहए । त᭜प᳟ात ्उसे ऐसी िनयुिᲦ के िलए, ᳰक᭠तु साᭃा᭜कार के िलए उपि᭭थत होने से पूवᭅ, अनु᭄ा ᮧा᳙ करनी चािहए ।

3. अ᭠य भारतीय इंजीिनयᳳरग िव᭄ान और ᮧौ᳒ोिगकᳱ सं᭭थान /के᭠ᮤीय िव᳡िव᳒ालयᲂ और अ᭠य तु᭨य उᲬतर िशᭃा सं᭭थाᲐ मᱶ पद :

(क) ᭭थायी कमᭅचारी से ᮧा्᳙ आवेदन पᮢ के साथ यह वचनबंध संलᲨ होना चािहए ᳰक वह या तो संबंिधत भारतीय इंजीिनयᳳरग िव᭄ान और ᮧौ᳒ोिगकᳱ सं᭭थान मᱶ पुनः पद ᮕहण करेगा या तीन वषᭅ के प᳟ात ् रा᳦ीय ᮧौ᳒ोिगकᳱ सं᭭थान मᱶ उसके ᳇ारा धाᳯरत पद से ᭜यागपᮢ दगेा। (ख) अ᭭थायी कमᭅचारी को उसके चयन और नई िनयुिᲦ कᳱ ᭭वीकृित कᳱ दशा मᱶ ᭜यागपᮢ दनेे का एक वचनबंध दनेा चािहए । खुले िव᭄ापनᲂ के संबंध मᱶ िवदशेी समनुदशेन :

(क) कमᭅचारी, अ᭟यᭃ, शासक बोडᭅ कᳱ पूवᭅ अनु᭄ा से आवेदन कर सकता ह ैिजसकᳱ पुि᳥ शासक बोडᭅ ᳇ारा कᳱ जाए । (ख) यᳰद समय का अभाव ह,ै तो एक अिᮕम ᮧित संब᳍ अिभकरण को, उिचत मा᭟यम स ेअनुमोदन के िलए अ᭟यᭃ, शासक बोडᭅ को ᮧित दतेे ᱟए, भेजी जा सकती है । (ग) ऐसे कमᭅचारी पर संब᳍ भारतीय इंजीिनयᳳरग िव᭄ान और ᮧौ᳒ोिगकᳱ सं᭭थान के शासकᳱय नामिनदᱷिशती के ᱨप मᱶ िवचार नहᱭ ᳰकया जाएगा । वे पद िज᭠हᱶ िव᭄ािपत या पᳯरचािलत नहᱭ ᳰकया गया ह ै :

आवेदन अᮕेिषत नहᱭ ᳰकया जाएगा । रोजगार कायाᭅलय मᱶ रिज᭭ᮝीकरण अ᭭थायी कमᭅचारी अनुमित लेकर नाम रिज᭭ᮝर करा सकते ह ᱹᳰक᭠तु उ᭠हᱶ चयन हो जाने पर ᭜यागपᮢ दनेा चािहए । ᭭थायी कमᭅचारी अपना नाम िन᳜िलिखत दशाᲐ मᱶ रिज᭭टर करा सकता है :

(क) केवल सरकारी/पि᭣लक से᭍टर उपᮓम/᭭वायᱫ िनकाय के अधीन उᲬतर पद के िलए हो, (ख) भारतीय इंजीिनयᳳरग िव᭄ान और ᮧौ᳒ोिगकᳱ सं᭭ थान से अनापिᱫ ᮧमाण पᮢ ᮧ᭭तुत ᳰकए जाने पर, और (ग) एक वचनबंध दकेर ᳰक वह नए पद को ᮕहण करने के तीन वषᭅ पूरे हो जाने पर या तो संब᳍ भारतीय इंजीिनयᳳरग िव᭄ान और ᮧौ᳒ोिगकᳱ सं᭭ थान मᱶ पुनः पद ᮕहण करेगा या उससे ᭜यागपᮢ दगेा । (घ) जब कोई कमᭅचारी अपने मूल कायाᭅलय मᱶ पुनःपद ᮕहण करता ह ै तो उसे रोजगार कायाᭅलय मᱶ पुनः अपना नाम रिज᭭टर कराने के िलए तीन वषᭅ कᳱ अविध तक “ अनापिᱫ ᮧमाण पᮢ” ᮧदान नहᱭ ᳰकया जाएगा । ऐसा कमᭅचारी जो िनलंबनाधीन ह ैया िजसे आरोप पᮢ जारी ᳰकया गया ह ै :

कोई आवेदन अᮕेिषत नहᱭ ᳰकया जाना चािहए यᳰद कमᭅचारी िनलंबनाधीन रहता है या उसे आरोप पᮢ जारी ᳰकया गया ह/ै आरोप पᮢ ᭠यायालय मᱶ फाइल ᳰकया गया ह ैया उसके अिभयोजन के िलए मंजूरी द ेदी गई है । ऐसे कमᭅचारी िजनका आचरण अ᭠वेषणाधीन है :

ऐसे ᳰकसी कमᭅचारी का आवेदन, िजसका आचरण अ᭠वेषणाधीन ह,ै अिभकथनᲂ कᳱ ᮧकृित पर संिᭃ᳙ ᳯट᭡पिणयᲂ सिहत और इस ᳯट᭡पण के साथ ᳰक उसे तब तक मुᲦ नहᱭ ᳰकया जाएगा यᳰद कमᭅचारी ᳲनलिबत ᳰकया गया ह ैया उसे आरोप पᮢ जारी ᳰकया गया ह/ैआरोप पᮢ ᭠यायालय मᱶ फाइल िलया गया ह ैया उसके अिभयोजन के िलए मंजूरी उसके चयन से पूवᭅ ᮧदान कᳱ गई है, अᮕेिषत ᳰकया जा सकेगा । [सं. फा. 33-10/2014-टीएस-III ] एस. पी. गोयल, संयु᭍ त सिचव 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] MINISTRY OF HUMAN RESOURCE DEVELOPMENT (Department of Higher Education) NOTIFICATION New Delhi, the 24th March, 2017 G.S.R. 293(E).—In exercise of the powers conferred by sub-section (1) of section 26, of the National Institutes of Technology, Science Education and Research Act, 2007 (29 of 2007), the Central Government with the prior approval of the Visitor hereby frames the following Statutes for Indian Institute of Engineering Science and Technology, Shibpur, namely:-

1. Short title, extent and commencement.—(1) These Statutes may be called the Statute of the Indian Institute of Engineering Science and Technology, Shibpur Statute, 2017.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.—(1) In these Statutes, unless the context otherwise requires, -

(a) “Act” means the National Institutes of Technology, Science Education and Research Act, 2007;

(b) “Authorities”, “Officers” and “Faculty Members”, in relation to the Institute, respectively mean, the authorities, officers and faculty members of the Institute;

(d) “Building and Works Committee” means the Building and Works Committee of the Institute constituted under Statute 12;

(e) “Central Government” means the Government of India;

(f) “Council” means the Council of the Institutes;

(g) “Department or School or Centre” means an Academic Department or School or as the case may be, the Centre established to impart instruction or for carrying out or facilitating the academic and research activities relating to any particular area or discipline or areas of inter-disciplinary nature;

(h) “Director” means the Director of the Institute referred to under Statute 17;

(i) “Finance Committee” means the Finance Committee of the Institute referred to under Statute 10;

(j) ‘Head’ or ‘Chair’ in relation to a Department or School or as the Case may be, the Centre means the Head thereof;

(k) “Institute” means the Indian Institute of Engineering Science and Technology, Shibpur;

(l) “Programme” means an academic programme of the Institute;

(m) “rules” means the rules made under the Act;

(n) “Schedule means a schedule annexed to these Statutes;

(o) “Senate” means the Senate of the Institute referred to under Statute 7;

(2) Words and expressions used herein and not defined but defined in the Act, shall have the meanings respectively assigned to them in the Act.

3. Authorities.—The following shall be the authorities of the Institute, namely:—

(i) the Board of Governors as constituted under section 11A of the Act;

(ii) the Senate as constituted under section 14 of the Act;

(iii) the Finance Committee as constituted under Statute 10; and

(iv) the Building and Works Committee as constituted under Statute 12

4. Board of Governors and Meeting thereof.—(1) The bodies entitled to nominate or elect representatives of the Board shall be invited by the Registrar to do so within a period not exceeding eight weeks from the date on which such invitations are issued and casual vacancies on the Board shall be filled by following the same procedure as specified above.

(2) The Board shall ordinarily meet four times during a calendar year.

(3) The meetings of the Board shall be convened by the Chairperson either on his own motion or at the request of the Director or on a requisition signed by not less than four members of the Board.

(4) The quorum of the meeting of the Board shall be six members :

Provided that if a meeting is adjourned for want of quorum, it shall be held on the same day in the next week at the same time and place or on such other day, time and place, as the Chairperson may determine, and if at such a meeting, a quorum is not present within haft-an-hour from the scheduled time for holding a meeting, the members present shall form the quorum.

(5) All questions considered at the meeting shall be decided by a majority of the votes of the members present including the Chairperson and if the votes are equally divided, the Chairperson shall have a casting vote.

(6) The Chairperson, if present, shall preside over every meeting of the Board: Provided that in the absence of the Chairperson, the members present shall decide a member from amongst themselves to preside at the meeting.

(7) The Registrar shall send a written notice of every meeting to every member at least fifteen days before the date of the meeting mentioning therein the place, date and time of the meeting:

Provided that the Chairperson may call a special meeting of the Board at short notice to consider urgent issues.

(8) The notice may be delivered either by hand or sent by registered post or speed post or e-mail or fax, at the address of each member as recorded in the office of the Board and if so sent, shall be deemed to be duly delivered at the time at which notice would be delivered in the ordinary course of post.

(9) The agenda of the meeting shall be circulated by the Registrar to all members atleast ten days before the meeting.

(10) Notices of motions for inclusion of any item on the agenda must reach the Registrar at least one week before the meeting.

Provided that the Chairperson may permit inclusion of any item for which due notice has not been received.

(11) The decision of the Chairperson with regard to all questions of procedure shall be final.

(12) The minutes of the proceedings of a meeting of the Board shall be drawn up by the Registrar and circulated to all members of the Board present in India and the same along with any amendment suggested shall be placed before the Board in its next meeting for confirmation and after the minutes are confirmed and signed by the Chairperson, they shall be recorded in the minute book.

(13) The minute book shall be kept open for inspection of the members of the Board and the Council at all times during office hours.

(14) If a member of the Board fails to attend three consecutive meetings without leave of absence from the Board, he shall cease to be a member of the Board.

(15) No matter relating to finance shall be placed before the Board unless the same has been approved by the Finance Committee.

(16) No matter which shall be first considered by the Building and Works Committee shall be placed before the Board unless the same has been considered by the Building and Works Committee after obtaining the administrative approval of the Board.

5. Powers of the Board.—In addition to the powers specified under sub-section (1) of section 13 of the Act, the Board shall be empowered, -

(i) to abolish, re-designate or change the nomenclature of any post in the Institute without any financial implication;

(ii) to make, modify or cancel the Statutes with the approval of the visitor from time to time:

Provided that the new Statutes, additions or amendments of existing Statutes shall be applicable only after the assent of the Visitor; and

(iii) to make, modify and cancel all or any ordinances on recommendations of the Finance Committee or Senate of the Institute subject to the condition that making, modification and cancellation shall not be in contravention of the Act and the Statutes made thereunder.

6. Authentication.—All orders and decisions of the Board shall be authenticated by the signature of the Director and in the absence of the Director, any person-authorised by the Board in this behalf.

7. Senate.—(1) The Senate shall meet as often as necessary, but ordinarily not less than four times during a calendar year.

(2) The meetings of the Senate shall be convened by the Chairman of the Senate either on his own motion or on a requisition signed by not less than one fifth of the members of the Senate.

(3) The meeting convened on the requisition shall be a special meeting to discuss only those items of agenda for which requisition is given and shall necessarily be presided over by the Director and shall be convened by the Chairman of the Senate on convenient date and time.

(4) One third of the total number of members of the Senate shall form a quorum for a meeting of the Senate.

(5) The Director shall preside over every meeting of the Senate:

Provided that in absence of the Director, the Deputy Director shall preside and in the absence of both, the senior most Professor present shall preside over the meeting.

(6) The Registrar shall circulate a written notice of every meeting together with the agenda to the members of the Senate at least a week before the meeting:

Provided that the Chairman of the Senate may permit inclusion of any item for which due notice has not been given.

(7) Notwithstanding the provisions contained in sub-statute (6), the Director may call an emergency meeting of the Senate at short notice to consider urgent special issues.

(8) The decision of the Chairman of the Senate with regard to all questions of procedure shall be final.

(9) The minutes of the proceedings of a meeting of the Senate shall be drawn up by the Registrar in consultation with the Dean Academics and circulated to all the members of Senate present in India:

Provided that no such minute shall be circulated, if the Senate considers such circulation prejudicial to the interests of the Institute or the Central Government.

(10) The minutes along with amendments, if any, suggested shall be placed for confirmation at the next meeting of the Senate and after the minutes are confirmed and signed by the Chairman of the Senate, they shall be recorded in a minutes book which shall be kept open for inspection of the members of the Senate, the Board and the Council at all times during office hours.

8. Powers of the Senate.—Subject to the provisions of the Act, the Senate shall have the power to—

(i) frame and revise curricula and syllabi for the courses of studies for the various Departments or Schools or as the Case may be, Centres;

(ii) make arrangements for the conduct of examinations, appointment of examiners, moderators, tabulators and other matters relating to the examinations;

(iii) declare the results of the examinations or to appoint Committees or Officers to do so and to make recommendations to the Board regarding conferment or grant of degrees or as the case may be, the diplomas and other academic distinctions or titles;

(iv) appoint Advisory Committees or Expert Committees or both for the Department or School or as the case may be the Centre of the Institute to make recommendations on academic matters connected with the working of the Department, School or Centre;

(v) appoint Committees from amongst the members of the Senate, other teachers of the Institute and experts from outside to advise on such specific and important academic matters as may be referred to any such Committee by the Senate;

(vi) consider the recommendations of the Advisory Committees attached to various Departments or Schools or as the case may be Centres and that of expert and other Committees and take such action (including the making of recommendations to the Board) as may be considered necessary;

(vii) make periodical review of the activities of the Department or School or as the case may be, the Centre and take appropriate action (including the making of recommendations to the Board);

(viii) supervise the working of the Library of the Institute;

(ix) promote research and academic development or activity within the Institute and seek reports on such research or academic development or activity from the persons engaged therein whenever felt necessary;

(x) provide for the inspection of the class rooms, Laboratories, Library and the residential hostels;

(xi) plan co-curricular activities of the students of the Institute;

(xii) award stipends, scholarships, medals and prizes and such other awards in accordance with such conditions as may be attached to the awards;

(xiii) make recommendations to the Board with regard to the creation or restructuring of Department or School or as the case may be the Centre and the abolition of existing Department, School or Centre;

(xiv) make recommendations to the Board to disseminate knowledge through distance learning mode to various parts of the State or country or abroad;

(xv) invite up to two students representatives during discussion of general nature not involving policy or disciplinary matters in the Senate meetings.

9. Chairman of the Senate to exercise powers in emergency.—If, in the opinion of the Chairman of the Senate, any emergency has arisen which requires immediate action, he may take such action as he deems necessary and shall report the same for approval to the Senate in its next meeting.

10. Finance Committee.—(1) There shall be a Finance Committee for the Institute consisting of the following members, namely:-

(i) the Chairperson of the Board of Governors, ex-officio Chairman;

(ii) the Director, ex-officio;

(iii) Joint Secretary dealing with the Institute or his nominee and Financial Advisor (Human Resource Development) or his nominee;

(iv) two persons nominated by the Board from amongst its members; and

(v) the Registrar, ex-officio, Member-Secretary:

Provided that in addition to the above, the Chairman may invite an expert as special invitee, in consultation with the Director and such special invitee may not have voting rights.

(2) All financial proposals shall be placed before the Finance Committee before placing it to the Board for consideration and approval.

(3) The Finance Committee shall meet ordinarily four times in a year preferably before the meeting of the Board of Governors.

(4) The quorum of a meeting of the Finance Committee shall be four members.

(5) The Chairman, shall preside over the meetings of the Finance Committee and in his absence, the Director shall preside over the meetings.

(6) The provisions in these Statutes regarding notices of the meeting, inclusion of items in the agenda and confirmation of the minutes shall, so far as practicable may be applicable to the meeting of the Finance Committee.

(7) A copy of the minutes of every meeting of the Finance Committee shall be placed before the Board.

11. Powers of the Finance Committee— The Finance Committee shall have power to -

(i) examine and scrutinise the annual budget of the Institute prepared by the Director and make recommendations to the Board; and

(ii) give its views and make its recommendations on any financial proposal or issues or question affecting the Institute, to the Board either on the initiative of the Board or of the Director, or on its own motion.

12. Building and Works Committee.—(1) There shall be a Building and Works Committee for the Institute, consisting of following members, namely:—

(i) the Director, ex-officio Chairman;

(ii) Director or Deputy Secretary or his nominee dealing with the Institute in the Ministry and Director or Deputy Secretary or his nominee dealing with Finance of the Institute in the Ministry as Ex-Officio Members of the Central Government ;

(iii) one member nominated by the Board of Governors – Member;

(iv) Registrar, ex-officio, Member- Secretary;

(v) Dean, planning and development or similar position – Member;

(vi) one expert each from Civil and Electrical Engineering Wing of Central or State Government or any autonomous body of repute – Member.

(2) The Building and Works Committee shall meet as often as necessary, but ordinarily not less than four times a year.

(3) The quorum of a meeting of the Building and Works Committee shall be four members.

(4) The provisions in these Statutes regarding notice of meeting, inclusion of items in the agenda and confirmation of the minutes shall, as far as practicable, may be applicable to the meetings of the Building and Works Committee.

(5) A copy of the minute of every meeting of the Building and Works Committee shall be placed before the Board together with the recommendations of the Finance Committee on specific proposal or proposals which requires approval of the Board.

13. Powers and Functions of the Building and Works Committee.—(1) The Building and Works Committee shall,—

(i) under the directions of the Board, undertake construction of all major works after the necessary administrative approval and expenditure sanction from the Board;

(ii) have the power to give the necessary administrative approval and expenditure sanction for minor works and works pertaining to repair and maintenance within the approved budgetary provision of the Institute;

(iii) cause to prepare estimates of cost of buildings and other capital works, minor works, repairs, maintenance and the like and shall approve the cost estimates for minor works, minor repairs and maintenance;

(iv) be responsible for making technical scrutiny of the design, estimates and specifications of the material as may be considered necessary;

(v) be responsible for enlistment of suitable contractors and acceptance of tenders and shall have the power to give directions for departmental works where necessary;

(vi) have the power to settle rates not covered by tender and settle claims and disputes with contractors.

(2) If, in the opinion of the Chairman of the Building and Works Committee, any emergency has arisen which requires immediate action, he may take such action as to be deemed necessary, and report the same for approval by the Building and Works Committee and the Board at their next meeting.

(3) The Building and Works Committee shall also perform such other functions and exercise such other powers as may be entrusted by the Board from time to time.

14. Powers of the Chairperson, Board of Governors - In addition to the powers provided under the Act, the Chairperson of the Board shall have the following powers, namely:—

(i) on the recommendations of the Selection Committee, fixing the initial pay of an incumbent at a stage higher than the minimum of the scale in respect of posts to which the appointments can be made by the Board under the provisions of the Act;

(ii) deputing members of the staff of the Institute, for training or for a course of instruction outside India subject to such terms and conditions as may be laid down by the Board from time to time provided that the visit abroad by the Director to anyside shall be approved by the Chairman, Council of National Institutes of Technology, Science Education and Research.

(iii) execution of the contract of service between the Institute and the Director or Deputy Director on behalf of the Central Government; and

(iv) taking action in emergent cases and to inform the Board of such action for confirmation and ratification.

15. Travelling allowances and sitting fees.—The members of the Board and other authorities of the Institute and members of the Committees constituted under the Act or these Statutes or appointed by the Board and other authorities shall be entitled to travelling allowance, daily allowance and sitting fee for attending the meetings of the authorities and their Committees as laid down by the Board from time to time.

16. Departments, Schools or Centres - The Institute shall consists of such number of Departments, Schools or Centres to be known by such names, as the Board may within the budgetary provision approve from time to time, on the recommendations of the Senate.

17. Director and his Powers - (1) The Director of the Institute shall be appointed by the Visitor on contract basis on the recommendation of a Search-cum-Selection Committee consisting of at least five members including the Chairman who are experts in the field of science and technical education with experience at national and international level.

(2) The Director shall be appointed for a period of five years and shall be governed by the terms and conditions of the contract of service entered into between the Institute and the Director in the manner specified in Schedule ‘A’.

(3) Subject to the budget provisions made for the specific purpose, the director shall have the power to incur expenditure in accordance with the procedure as may be laid down in the Ordinances.

(4) The Director shall have the power to appropriate funds with respect to different items constituting the recurring budget up to a limit specified for the Head of Department in the Central Government for each item:

Provided that such appropriation shall not involve any increase in the budget and any liability in future years:

Provided further that every such appropriation shall, as soon as possible, be reported to the Board.

(5) The Director shall have the power to write off irrecoverable losses up to a limit of ten thousand rupees and of irrecoverable value of store items lost or rendered unserviceable due to normal wear and tear or obsolete up to a limit of twenty five thousand rupee subject to such stipulations as may be made by the Board from time to time.

(6) The Director shall have the power to donate obsolete equipment or store items as identified by a Committee constituted for this purpose by the Director, to any department, School or Centre in the vicinity of the Institute up to such limits as may be decided by the Board from time to time.

(7) Where the Director is the appointing authority, he or she shall have the power to fix, on the recommendations of the Selection Committee, the initial pay of an incumbent at a stage higher than the minimum of the scale, but not involving more than five increments, in respects of posts to which appointment can be made by him or her under the powers vested in him or her by the provision of the Act or these Statutes.

(8) The Director shall have the power to employ Teaching Supporting Staff in the Laboratories, Technicians or Technical Instructors and Skilled Workmen, paid from contingencies from time to time, for not more than one year on such remuneration as may be decided by the Board.

(9) The director shall have the power to send members of the staff for training or to attend course of instruction inside India subject to such terms and conditions as may be specified by the Ordinances.

(10) The Director shall have the power to sanction temporary allocation of any building for any purpose other than that for which it was constructed.

(11) If for any reason the Registrar is absent for a period not exceeding one month, the Director may take over or assign to any faculty member or member of staff of the Institute, any of the functions of the Registrar as he or she deems fit :

Provided that if at any time the absence of the Registrar exceeds one month, the Board may, if it thinks fit, authorise the Director to take over or assign the function of the Registrar.

(12) All contracts for and on behalf of the Institute except a contract between the Institute and the Director shall, when authorised by a resolution of the Board passed in that behalf, be in writing and be expressed to be made in the name of the Institute and every such contact shall be executed on behalf of the Institute by the Director, but the Director shall not be personally liable in respect of anything under such contract.

(13) The Director may, during his or her absence from headquarters authorise in writing the Deputy Director or in his or her absence, one of the Deans or the senior most Professor present to sanction 30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] advances for traveling allowance, contingencies and medical treatment of the staff and sign and counter-sign bills on his or her behalf.

(14) The Director may, at his or her discretion, constitute such committees, as he or she may consider appropriate for smooth functioning of the Institute.

(15) In the event of the occurrence of any vacancy in the office of the Chairperson by reason of his or her death, resignation or otherwise or in the event of the Chairperson being unable to discharge his or her functions owing to absence, illness or any other cause, the Director may discharge the functions assigned to the Chairperson under section 16 of the Act.

(16) The Director may, with the approval of the Board delegate any of his powers, authorities or responsibilities vested in him by virtue of the Act and Statutes to one or more members of Academic or Administrative Staff of the Institute.

18. Deputy Director—

(1) The appointment of the Deputy Director shall be made by the Board on the recommendations of the Selection Committee from among the senior faculty members.

(2) The Deputy Director shall hold office for a period of three years which may be extended for an another period of two years or one year each on the recommendation of the Board.

(3) The Deputy Director shall be governed by the terms and conditions of the contract of service entered into between the Institute and the Deputy Director in the form specified in Schedule ‘B’.

(4) The Deputy Director shall have all the powers of the Director during the absence of Director or its vacancy.

(5) The Deputy Director shall assist the Director in academic and administrative work and in maintaining liaison with other institutions of higher learning and research, and also with industrial undertakings and other employers.

19. Deans.—(1) The Institute shall establish not more than seven Deanships.

(2) The Director shall appoint the Deans with the approval of the Chairperson of the Board.

(3) The Dean shall hold his office for a period of two years which may be extended for another one year.

(4) The Dean shall be appointed from amongst the Professors or Associate Professors.

(5) Broad functions of Deans are enumerated in the Schedule ‘C’.

20. Head of the Departments, Schools or Centres—

(1) Each Department or School or Centre of the Institute shall be placed in charge of a Head who shall be selected by the Director, from amongst the Professors and Associate Professors of that Department, School or Centre :

Provided that if a Department, School or Centre has no Professor or Associate Professor, the Director may appoint an Assistant Professor of that Department, School or Centre as Head of the Department, School or Centre.

(2) The Head of a Department, School or Centre shall hold his or her post for a term of two years :

Provided that the Head of a Department after the expiry of his or her term of office shall continue to hold office till the appointment of his or her successor:

Provided further that no person shall head a Department, School or Centre continuously for a period exceeding three years, unless such person is specially appointed at least for a second term.

(3) The Director may himself take temporary charge of a Department, School or Centre or hand it over in the charge of the Deputy Director or a Professor from another Department for a period not exceeding six months.

(4) The Head of Department shall be responsible for the entire work of the Department, School or Centre subject to the general control and supervision of the Director.

(5) The Head of Department shall be duty bound to see that the decisions of the authorities of the Institute and of Director are properly carried out and the Head of the Department shall perform such other duties as may be assigned to him or her by the Director.

(6) Before appointing a person to the post of Head of Department, School or Centre, the Director shall ascertain the willingness, of the persons to be appointed as Head and shall select a person by rotation from among eligible and willing persons.

(7) Whenever it is proposed to deviate from the principle of rotation, such appointment shall be made only with prior approval of the Chairperson, Board of Governors and for reasons to recorded in writing and shall also be reported to the Senate and the Board along with reasons for deviation, in their next meeting.

21. Registrar.—(1) The Registrar shall be appointed for a fixed term of five years on deputation or contract basis.

(2) The review of performance of the Registrar upon completion of one year of service may be carried out by the Committee to be constituted by the Board for the purpose of continuation for the remaining period of contract and thereafter, Board may carry review of the performance of Registrar as and when it may wish.

(3) The Registrar shall act as Secretary of the Board, Senate and such other Committees to which he may be required by the Statutes to act as such.

(4) The Registrar shall report to the Director of the Institute for all his functions including of Secretary to the Board.

22. Classification of the Members of the Staff—

(1) Except in the case of employees paid from contingencies, the members of staff of the Institute shall be classified as under :-

(i) Academic staff : Director, Deputy Director, Professor, Associate Professor, Assistant Professor, Professor Training and Placement, and such other academic posts as may be decided by the Board from time to time;

(ii) Technical staff : System Manager, Workshop Superintendent, Librarian, Scientific Officers, Research Engineers, Deputy Librarian, Assistant Workshop Superintendent, System Analyst, Programmer, Foreman, Technician, Instructor, Laboratory Assistant, Mechanic, Overseer, Technical Assistant, Draftsman, and such other technical posts as may be decided by the Board from time to time; and

(iii) Administrative and others staff : Registrar, Deputy Registrar and Assistant Registrar, Accounts Officer, Audit Officer, Estate Officer, Executive Engineer, Assistant Engineer, Junior Engineer, Medical Officer, Medical Assistant, Horticultural Assistant or Officer, Office Superintendent, Security Officer, Stores Officer, Store Keeper, Office Assistants, Data Entry Operators and such other Administrative and other staff as may be decided by the Board from time to time.

(2) The posts of Academic Staff shall be vacation posts only.

23. Appointments.—(1) The posts at the Institute shall be filled by advertisement on all India basis:

Provided that the ratio between the direct recruitment and promotion posts other than the post of Director or the Deputy Director shall be filled up as per the recruitment rules.

(2) The reservation of posts shall be in accordance with the rules and instructions of the Central Government.

(3) For the purposes of appointments, the rules as may be applicable to the Central Government employees shall apply.

(4) The Selection Committees, for filling posts of the Institute (other than the posts on contract basis) by direct recruitment or by promotion from amongst the members of staff of the Institute, shall be constituted in the manner as laid down by the Ministry of Human Resource Development, Department of Higher Education, Government of India or Board from time to time by Ordinances.

(5) The Selection Committees for filling up of posts under the Institute (other than on contract basis) by direct recruitment or by promotion from amongst the members of staff of the Institute shall be constituted in the following manner, namely :- 32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]

(a) The Selection Committee for recruitment to the posts of Academic Staff (excluding the Director), or for promotion shall be as under:—

(i) Director or Deputy Director Chairman

(ii) Visitor’s Nominee Member

(iii) Two nominee of the Board one being an expert, but other than a member of the Board Member

(iv) One expert nominee of Senate from outside the Institute Member

(v) Head of Department concerned (for other than the post of Professor) Member a. The Selection Committee for recruitment of Technical posts shall be as under:

(i) Director or Deputy Director Chairman

(ii) One expert from outside the Institute Member

(iii) Nominee of Ministry of Human Resource Development Member

(iv) Concerned Head of Department Member

(v) Registrar Member

(b) The Selection Committee for recruitment of Administrative and Ministerial Staff shall be as under:

(i) Director or Deputy Director Chairman

(ii) One expert from outside the Institute Member

(iii) Nominee of Ministry of Human Resource Development Member

(iv) Registrar Member

(c) The Selection Committee for Senior Administrative and other equivalent post carrying the pay scale of Assistant Professor and above shall be as under:

(i) Director or Deputy Director Chairman

(ii) One expert from outside the Institute Member

(iii) Nominee of Ministry of Human Resource Development Member

(iv) Nominee of the Board Member

(v) Registrar Member

(6) In case the Selection is made for the Registrar or the equivalent post, the Board shall nominate a person as member of the Selection Committee and the Registrar shall not sit as member thereon.

(7) In the absence of the Deputy Director, the Director may nominate any member of the staff of the Institute to be the member of the Selection Committees in his place.

(8) Where a post is to be filled on contract basis or by invitation, the Board may, constitute such Adhoc Selection Committee, as may be necessary.

(9) Where a post is to be filled by promotion from amongst the members of the Institute or temporarily for a period not exceeding twelve months, the procedure for such appointment shall be as specified by Ordinances.

(10) Notwithstanding anything contained in these Statutes, the Board shall have the power to make appointments of persons having special skill or knowledge to suit the emergent need of a Department, School or Centre.

(11) If the post is to be filled by advertisement, the terms and conditions of the post shall be mentioned in the advertisement and the Screening Committee for the purpose of short listing the eligible and most desirable candidates shall screen all applications received within the date specified in the advertisement.

(12) Some of the posts may be exempted from the interview which may be decided by the Board. In case, where the interview is compulsory, the Selection Committee shall examine credentials of all candidates who have been called for the interview, interview the eligible candidates and recommend the appointment of the most suitable candidates to the competent authority for approval.

(13) The recommendations of the Selection Committee shall remain valid for a period of one year from the date of interview and if for any reason the recommendations are not approved by the competent authority or appointment orders not issued after the approval of recommendations within the said period of one year, the recommendations shall lapse and fresh advertisement shall be issued.

(14) No act or proceeding of any Selection Committee shall be called in question on the ground merely of the absence of any member or members of the Selection Committee.

(15) Unless otherwise provided for under these Statutes, the Selection Committee constituted for the purpose of making recommendations for appointment to a post shall continue to exercise its functions in relation to that post till the appointment is made against that post.

(16) All appointments made at the Institute shall be reported to the Board at its next meeting.

(17) The applications of the employees eligible for promotion under Assured Career Progression shall be considered by the Departmental Promotion Committees before any promotion or up-gradation is recommended.
