ShoTt title and collunencement.--(l) These rules may be called the Tamil Nod ... 5.dmini' traJ"e Tribunal (Procedure) Rules, 1988.

, . (2) They shall come in'" force on the date of their publication in the official gazette.

2. Dcfinitions.-In th\!~e rules, unIes.;; ~he context otherwise requires .

(a) "Act" means th" Administrni'.·, Trib"".ls Act, 1985 (13 of 1995) ;

(b) "Agent" means a per'l"n duly authorised by a party to pres~nt an application or a writ­ ten reply on its behalf beroro tile Tribu­ nal ;

(c) "Applicant" m~ar.s a penon making an ap­ p1'catioo to the Tribunal under section 19;

(d) "Form" means a form annoxed to these rules ;

(e) "Legal Praciitioller" shall have the same meaning as j~ a~sig:ncd in the Advoca­ te, Act, 1961 (25 of 1961) ;

(f) "Legal repre<enta!ivo" mean, a person who in law represents the estate of the deceas­ cd~

(g) "Registrar" means th~ Registrar of the Tri­ bunal and includes any officer to whom the powers and fUllct,,,,lS of the Registrar milY be delegated under clauses (2) and (3) of , rule 28;

(h) "Registry" means tlie Regh(ry of the Tribu­ nal or of the Bench 0 fthe Tribunal. as the case may be ; .

(i) "Sectioll" means a section · of the Act;

(j) "Transferred application" means the suit or other proceeding which has been transfer­ red to the Tribunal under sub-section (I) or .

sub-section (2) of section 29; :

(k) ':Tribunal" means the Tamil Nadu Adminis­ trative Tribunal established under sub-sec­ tion (2) of section (4);

(I) The words and expressions used and not de­ fined in thes~ rule, but defined in the Act shall have tne same meanings respectively assigned to th,m in the Act.

3. Language of the Tribullal.-(I) The language of the Tribunal shall be English

(b) The Bench, hearing the matter, may in its dis­ cretion, direct English tran5latio~ of pleadings and documents to be filed.

(4) Procedure for filing applic<ltions.-.

(1) An application to the Tribunal shaH be pre­ sented in Form 1 by th~ applicant in persall or by an • agent or by a duly authorised legal practitioner to the Registrar or any other officer authOrised In wfltmg by the Registrar to receive th·, same or be sent by registered post with acknowledgement due addressed to the Registrar.

(2) The application under ,ub-rule (1) shall be presented in tnpIica'e in a paper-hook form along­ with one unuoed file ,ile envelope ·bearing full add­ ,,~ss of the respoadent.

(3) Where the number of respondent i, more than one, as many extra copies of the application in paprr­ hook fortll as there are resp0ndent; together with unu,ed file size envelope bearing the full address of each respondent shall be ~urni'hod by the appltcant ;

Provided that where the m..:mber o~ re .. pondents is more than five, the Registrar l1l~y permit the appli­ cant to file the extra, copies of the application at the rime of issue of l1otiC~ hJ the" re~pondents.

(4) The applicant nlaY attach to and present with his application a receipt slip in Form II "hich shall be silled by the Registrar or th", officer receiving the application on behalf of. lile Registrar ill ac1mowled­ gement of the receipt of the application.

(5) (a) Notwithstanding anything contained in sub· rules (I) to 3), the fClbunai may permit mOre than one person to join together and file 3 single applica­ tion if it is satisfied, having regard to (he cause of action and the nature of relief prayed for, that they Imve a common interest in lh~ matt~r.

(b) Such pertllission may also he granted (0 an as­ ~ociation representing the person.; det;irOlls of joining in a single application . ProVided, however. that the npplicatiol1 shaIl disclose t.ile class/grade/categories of persons on whose behal~ it has been filed.

5. Presentation :md scrutiryy of applications.­

(1) The Registrar, or the officer authorised by him . under rule 4, shaIl endorse on every application the date on which it is presented or deemed to have beell presented under that rule and shall 'ign the em!orse­ ment.

(2) If, on scrutiny, the application i, found to be in order, it shall be duly registered and given a serial number. , • ['T1'T 11- -crv;- 3 (i) 1 'lml ;iT UJr<I.: ~ J I

(3) If the applcutiGn, on scrutiny, is found to be defective and the defect noi.iced is formal in nature, the Registrar may allow the party to rcct;fy the same in his presence, and if the said defect is not fOllnal in nature, the Registrar nJay allow the applicant mch time to rectify the defect as he mdY deem fit.

(4) If the applicant fails to rectify the defect within the time allowed under sub-rlile (3!, the Re­ gistrar may, by order and for reasons to be recOlued in writing, declfue to register the application and in­ form the applicant accordingly,

(5) An appeal against the order of the Registrar under sub-rule (4) may be preferred by the person agrieved within fifteen days from the date of such order of the Tribunal whose deei,ion thereon shall be tinal.

(6) Place of filing appEcati'lns.--The .pplicatioll shall. ordinarily be filed by the applicant with the Registrar of the Bench within whose juri<diction

(i) the applicant is po,teu for the time being, or

(ii) Ille cause of action has arisen, Or ( iii) the respondent or any of the against whom relit·f i .~ sOug})t, resides :

Provided that the application may be filed with the Registrar of the Principal Bench and, subject to section 25 of the Act, ,uch application may be trans­ mitted, to be heard and disposed of by a Bench which has jurisdiction over the maUer.

7. Application fec.--E\'~ry appcication filed With the Rel'i,tcr shal' be accompanied by a fee of rupees fIfty to be remitted either in the form ot. cro<sed de­ nland draft on a nationali>ed bank in favour of th,' Registrar, payable at the main Bronch of that Bank at the station where the Tribllnal is situate, Or remit~ ted through a cro,sed Indian Po~ta! Ordec drawn in favour of the Registrar payabl~ at the po,t office of the station where the Tribunal is situate :

Provided that where tllC Tribunal permits a single application to be filed, either by more than one per­ son or by an Association, the fee payable shall be ru pees lift y.

Provided further Ihat where the Tribunal is satis­ fied that an applicant i, unable to pay the prescribed fee on ground of indigence, i: may exe,mpt such an· applicant from the payment of fee.

8. Contents of application.-(l) Evcry application filed under rule 4 shall set forth concisely under dis­ tinct heads the grounds ror such application. Such grounds shall be numbered Conseculively. Every ap­ l'lication, including any miscellaneous application ;hall be typed by doul>'e ~pace on one side on thick paper of good quality.

(2) It shall not be nece>sary to present a separate application to seek an intUlm order for direction if in original application th~ same is prayed for.

(3) An applicant may, subsequent to the filing of .an application under sectiG~ 19 of the Act, aj1ply. for an inte-rim order or dlrectlOn. Such an applJcauon shall, as far as possible, be in form Ill.

9. Documents to accompany ~he appllcauon.­ .(1) Every application shall be accompanied by a paper book containing :-

(i) an attested true copy of tbe order against which the apjiicauc;a is filed ;

(ii) Copies of the document~ relied upon by the.

applicant and rderr~d to in the application;

(iii) an index of the documents.

(2) The documents ref~rred to in sub-rule (1) may be attested by a legal pra~titiollcr or by a Gazetted Officer belonging to Grou;> 'N or Group 'R' under the Government and each document shall be 'marked .erially as Annexure At, A2, A3 ane! so on.

(3) Where an application is filed by an agent, documents authorising him to act as such agent shall also be appended to the appiic.tion :

Provided that where an aprlicati,;!' is filed by a legal practitioner, it shall be acoompanied by a duly executed 'Vakalatnama'.

10. Plural remedies.--An application shall be based upon a single caLse of action and may seck one or more reliefs crovideJ that they are COllSC­ equential to one another,

11. Service of notices and processes issues by the Tribunal.- (I) Any notice or process to be issued by the Tri­ bunal may be served by 31],/ of the follolVing modes directed by the Tribunal '-

(i) service by the party himself ;

(ii) by hand delivery (D"ti) through a process server ;

(iii) by regist!<red post with acknowledgement due;

or

(iv) through the head of the Department concern­ ed by anyone of the above modes. .

(2) Where notice issued by the Tribunal is ,erved by the party himself by 'hand delivery' (Da;ti), he shall file with the Registry of the Tribuna!, the ac­ knowledgement, together with an affidavit of 'crvicc.

(3) Notwithstanding anything contained in s'lb-rule (I) the Tribunal may, taking into account the nllln­ her of respondents and their places of residence or work and other drcumstances, direct that notice of the application shall be served upon the respondents in any other manner, incllJding any manner of sub­ stituted service, as it appears to the Tribunal Ju,t allJ convenient.

(4) Notwithstanding anything done under sub-rule

(1), the Tribuna' may in its db,_ -otion, having re­ gard to the nature and urgency or the ca,e, direct the service of the notice on the Standing Coun"cls "ppointed as such by the State Government or any T'epRdtment -V ·1Ie State Government.

(5) Every notice issued by the Tribunal shall, un­ less otherwise ordered, by accompanied by a copy of the application alongwitn a ,opy of the paper-book.

(6) Every applicant shall pay a fee for the service or execution or processes, in respect of an application wbere the number of respondents exceed. five, as under :-

(i) a sum of rupees five for each respondent in excess of five re~,pll'1dei!t'. or

(ii) Where the service is in such a manner as the Tribunal may direct under sub-mle (3) such a sum, not c. ceeding the actual char~ gcs incurred in effecting the service as may be detennined by the Tribuna!.

(7) The fee for the service or execution of proces­ ses under sub-rule (3) shall be remitted in the man­ ner prescribed in rule 7 within one week of tt;e date of the order determining the fee or within such ex­ tended time 1,)S the Registrar may permil.

(8) Notwithstanding anything contained in sub-rule (I) to (4) if the Tribunal i, satisfied that it is not reasonablY' practicable to serv..! notice of l'l,pplic8tion upon all the respondepts, it may, for reasons to be recorded in writing. direct that the applIcaton 'hall be hearJ. notwiths!andi!1g that some 0f the ~espoll­ de1ts have nOI been served with notice of the ,.ppli­ cation :

Prmided that no applbtion shall be heard un­ lcss,-

(i) notice of the application ha, bec:n served on the Stato Govern",e"t. i~ such 'Gowrnment is a respondent :

( ii) ( iii) notice of the al'pllcation has bee11 served on the authority which passed the order again't which the application has been filtd; and tho Tribun,l is satisfied tl,at tne interests of the resiX'nde ts on whom notice of the ap­ plication has not been sorved are adequately and sufficielltly represented by the res­ pondents on whom notice of the application has been servod.

12. FiFn:; of reply and other documents by the respondents.- (I) Each respondent intending to contest the application, shall file in triplicate the reply to the applicat'un and the documents reJied upon in paper book form with the Registry within one month of tbe service of notice of the application on hi111.

(2) In the reply filed under sub-rule (I), the respondent shull specifically admit, deny or explain the facts stated by the applicant in his application and may also ,tate such ad­ ditional facts as Dlay be found necessary f'Or the just decision of the case. It shall be signed and vrrified as a written statement by tr.e respondent or any other pe,rson du Iy authorised by him in writing in the same manner as provided for in order VI, rule 15 of the Code of Civil Procedure, 1908 (5 of 1908).

(4) The respondent .hall aIm serve a copy of the reply alongwith documents as mentioned in sub-f11le (J) on the applicant or his legal practitioner. if 'ny, and file proof of such service in the Registry.

(S) The Tribunal may allow filIng of the reply after the expirv of the prescribed period.

13. Date and place of hearing to be notified.-The Tribunal sl;an notify to the parties the date and the place hcoring of the applic~tion in such manner as Ihe Chairman may by general or special ord~r direct.

14. Calender of cases.-(I) Each Bench shall draw up a calender for the hearing of transferred ca,e> and as far as possible, hear and decided the Ci:.ISCS according to the Calender.

(2) E\ery applicalion shail be heard and decided, as far as possible, within six months from the dale of i~s registration.

(3) Th" Tribunal shall ha.e the power to decline :m adjournment and also to limit the time for oral arguments.

15. Action on application for applicant's default.-

(l) Where on the date fixed for hearing of Ir.e dpplication or on any oth .. date to which such hearing may be adjourned, the· apji­ can! docs not appear when the application is called for hearing, the fribunal may, in its discr "don either di:miss the applica­ tion for delault or hear and decide it on merit.

(2) Where an appUcation has b""n dismissed for default and t,ito applicant files an ap­ plication within thirty days from the date of dismissal 3nd satisfied the T cibunal that there was sufficient caUSe for his non-ap­ pearance when the application was called for hearing, the Tribunal shall make an o,der setting aside the order dismissing the application and restore the same.

16. Ex-Parte hearing and disl'".al of application .. -

(6) Wherever a kgal practitioner cease, to em­ ploy a registered clerk, he shall notify the fact at Once to the Registrar by means of a lettcr enclosing therewith the identity card issued to his clerk by the registry, and on receipt of such letter the name of hiC said registered clerk shall be ,truck off from the register.

26. Working hours of the Tribunal.-Except on Saturdays, Sundays and other public holidays, the ollice of the Tribunal shall, subject to allY order made by the Chairman remain open from 9.30 A.M. to

6.00 P.M.

27. Sitting hours of the Tribunal.-:-The sitting hours of the Tribunal (including a vacatIOn Bench) shall ordinarily be (rom 10.30 A.M. to 1.30 P.M. and 2 .30 P.M. to 5.00 P.M. subject to aJ)Y general or special order made by the Chairman, or by Vice­ Chairman concerned with the p~iu[ approval of the Chajrman.

28. Powers and funct iOllS of the Registrar.-The Registrar shall have the custody of the records of the Tribunal and shall exercise such other functions .as are assigned to him un del these rules or by tne Chairman or the Vice-Chairman of the 1 rlbunal by separate order.

(2) The Registrar m.y, with the approval of the Chairman or the Vice-Chairman delegate to the Do?uty Rigistrar any function or power required by these rules to be perfonn<'d or exercised by lbe Re­ gistrar.

(3) In the absence of the Registrar, the Deputy Registrar may exercise all the powers and functIons of the Registrar.

(4) The official seal shall be kept in the custody of lbe Registrar.

(5) -Subject to any general or ,;pecial direction by the Chairman, the seal of the Tnbunnl shall not be atlixed to any order, summons or other process save under the authority in writing of the Registrar or the Deputy Registrar.

(6) The seal of the Tribunal shall not. be affixed to any certified copy issued by the TJC1bunal save under the authority in writing of the Registrar or the.

Deputy Registrar.

29. Additional powers and duties of Registrar.-:­ In addi(ion to the power> conferred elsewhcre . In these rules, the Registrar shall I'ave the followl~g powers and duties subject to any general or speCIal order of the Chairman or the Vice-Chairman of thc Tribunal, nameh' :-

(i) to receive alI applkations and other docu­ ments inclaJing transferre-d applicalion.;;;

(ll) to decide all questi()ns arising out of lbe scrutiny of the ,>pplic3tions before (hey ar~ registered;

(iii) to require any application presented to the Tribwlal to be amended in accordance with the Act end the rules;

(iv) subject to the direction of the Tribunal to fix the date .of first hearing of tie applica­ tions or other proceedings and issue notices thereof;

(v) to elirect allY formal amendment of records;

(vi) to order grant of copi~s of documents to parties to the proceedings;

(vii) to grant leave to inspect the records of the Tribunal;

(viii) to dispose of all matters relating to the . service of notices or other processes, appli­ cations for the issue of freSh notices and for extending the time for filing such appli­ cations and to ~rant time not exceeding 15 day~ for filing a reply Or rejoinder if any, and to place the matter before the Bench for appropriate orders after the expiry of the aforesaid period;

(ix) to requisition records from the custody of any court or other authority;

(x) to receive applications within thirty days from the date of death for substitution of legal represent.tives of tne deceased parties during the pendency of the al1Plication;

(xi) 'to receive and dispose of applications for :;ubstitution, except where the ~substitution would involve setting aside an order of abatement.

(xii) to receive and dispose of applications by parties for return of documents.

30. Seal and emblem.- The official seal and em­ blem of the Tribu",1 shall be such "' the State Government may s'jlCCify.

31. Dress of the Members and staff of the Tribu­ nal.-The dress for the Members of the Tribunal (including Chairmiln and Vice-Chairman) and Mem­ beu; of the staff of the Tribunal shal! be such as the e ,airman may specify.

32. Dress of the parties.-A legal practitioner or, as the caSe may be, a pre>enting officer shall appear before the Tribunal in his professional dress, if a~y and if there is no such dress:~

(i) if a male, in a closed collared coat and Irousers or in lounge suit;

1. Short title and commenoement.-(I) 'TI,ese rules may be called the Tamil Nadu Administrative Tribunal (Salaries and Allowances and conditions of service of Chairman, Vice-Chairman and Members) Rules, 1988. .

(2) They shall come into force on the dale of their publication in the Oificiul Gaulte.

2. Definitions.-In these rules, un!e~3 til.: contC'xl otherwise requires.-

(a) "Act" means the Administrative Tribl1llals Act 1985 (13 of 1985) ;

(b) "Government" means the Government or Tamil Nadu;

(c) "Tribunal" means tbe Tamil Nadu Adminis­ trative Tribunal;

(d) the w~)f(ls al'd expressions used in these rules and not defined, but defined in the Act sball have the meanings respectively assigned to them in tile Act.

3, Pay,-(1) The Chairman shall receive a pay of rupees eight thousand plus a special pay of rupees five hundred per ll]e'1Sem. A Vice-Chairman shall receive a pay of rupees eight thousand per meJlSem.

A Member shall receive a P"y in the scale of Rs. 7300-100-7600 per memcm ;

Provided that in the case of an appointment as Chairman, a Vice-Chairman or a Member of a person who has retired as a iudgc of a High Court or who has retired from service under the Central Govern­ ment or a State Government and who is in receipt of or has received or has become entitled to receive any ~etirement ~nefits ~v ~ay of pension andlorl gratUIty. employer s contnblltton to the Contributory Provident Fund or other forms of retirement benefits the aforementioned pay shall be Teduced by th~ 'IIl'TU--_ 3(i)] "R<f "" "U'I'lif ; """,,,.~ 21 ~ gross amount of pension and pension equivalent of gratuity or employer's contribution to the Contribu­ tory iProvident Fund or any other form of retirement benefits, if any, drawn or to be drawn by him.

4. Dearness allowance and city compensatory allowance.-The Chairman, a Vice-Chairman and a Member shall receive dearness allowance and cit"~ compensatory allowance appropriate to their pav at the rates admissible to Grollp 'A' Officers of the Central Government drawing a pay in the scale of Rs. 7300-100-7600 Or above.

5. Ret.irement from parent service on appointment "-, Member.-The Chairman, a Vice-Cha:rman or a Member who, on the date of his appointment to the Tribunal, was in service under the Central Govefll­ ment or a State Government, shall seek retirement from such service before his appointment to the Tribuoal. In the case of a sitting Judge of a High Court who is appointed as Chairman or a Vice­ Chairman, his service in the Tribunal shall be trea­ ted as actual service within the meoning of pnf3 Jl (b) (i) of Part '0' of the Second Schedule to the Constitution.

(2) On slIch retirement as is provided for in sub­ rule (J), the Chairman, a Vice-Chairman Or 3 Member:

(i) shall be eJ\titlerl to 'ere1ve 'pondnn and gratuity in accordance with the rules relat­ ing to the retirement benefits applicable to him, .

(ti) shall not be allowed to carry forward eamed leave but shall be entitled to rcceil e C" .;.

equivalent to leave salarv, if an\'. in accor­ dance with the . rules applicable to him prior to his retirement.

6. Leave.-(1) A person. cn appointment to the Tribunal as Chairman, a Vice-Chairman or a Ml.!rnber shal! be entitled to leave as follows :_

(i) earned leave at the rate of fifteen days for every completed year of service or a port thereof;

(ii) half pay leave on medical certificate Or on private affairs at the Tate of twenty days in respect of each completed year of service.

The leave salary for half pay leave shaIJ be equivalent to half of the leave salary admbsible during the earned !e~ve :

Explanation.-For the purpose of this sub-rule, "Vacation" means vacation of thirty days in each calender year observed by the Tribunal.

(3) On the expiry of his term of office in the Tribunal, the Chairman, a Vice-Chairman or a Member shall be entitled to receive cash equivalent of leave salary in respect of the earned leave standing to Itis credit provided that the quantum of leave encashed under this sub-rule and sub-rule (2) (ii) of rule 5 shall not exceed 240 days.

(4) The Chairinan, a Vice-Chairman and Member shall be entitled to receive the dearness allowance on the \caye salar~ under slIb-rule (3) as admissible at the rates in force on the date of the relinquishment of the office in the Tribunal:

Provided that he shall not be entitled for the city compensatory allowance or any other allowance 011 SlI<'O leave salary.

7 Leave sanctioning authcrity.-The Chairman .haJJ be the authority competent to sanction lea ... e to the Member and the Vic~ ·Chuirm:ln. The Governor shall be the cuth~ritv cori:tp~tcn: to sanction- leave to the Chairman.

8. Pension.-(J) Every p"r<on "r!',,;ntp,I t" t".

Tribunal as the Chairman or a Member shall be 'ntitled to pension .provided that no wch pen­ ,jO,1 shall be payable:

(ii) if he has been removod froin an office in the Tribunal under sut.-section (2) of Sec­ tion 9 of the Act.

Provided that the aggregate amount of pension payable under this rule together with the amount of any pension including commuted portion of pen,;on fir any) drawn or entitled to be drown while holding olliee in the Tribuna! shall not exceed the maximum 'Imount of pension prescribed for a judge of the P:<:'h Court.
