Section 7: Compliance with covenants, bye-laws and administrative provisions

The Tamil Nadu Apartment Ownership Act, 1994.State Act of Tamil Nadu · Act 7 of 1995

(1) Every apartment owner shall comply strictly with the bye-laws and with the covenants, conditions and restrictions set forth in the Deed of Apartment in relation to his apartment.

(2) Where any apartment owner fails to comply with any of the bye-laws or covenants, conditions or restrictions referred to in sub-section (1), such failure shall be a ground for an action against such apartment owner to recover sums due, for damages or injunctive relief or both maintainable by the society or the Association of Apartment owners or, in a proper case, by the aggrieved apartment owner.
