Section 44: Cognizance of offences

Tamil Nadu Handloom Workers (Conditions of Employment and Miscellaneous Provisions) Act, 1981State Act of Tamil Nadu · Act 61 of 1981

(1) No Court shall take cognizance of any offence punishable under this Act except upon a complaint made by or with the previous sanction in writing of the Chief Inspector or an Inspector within three months of the date on which the alleged commission of the offence came to the knowledge of the Inspector:

Provided that where the offence consists of disobeying a written order made by the competent authority, appellate authority, the Chief Inspector or an Inspector, complaint thereof may be made within six months from the date on which the offence is alleged to have been committed.

(2) No Court inferior to that of a Metropolitan Magistrate or Judicial Magistrate of the first class shall try any offence punishable under this Act.
