The Hon’ble Minister (SW&NNMP) among others have made the following announcement on the fl oor of the House on 06-06-2018:- ñ£ŸÁˆ Føù£OèŸ eyåš äFªj m¡fiw bfh©l Ϫj muR ñ£ŸÁˆ Føù£OèÀ¡è£ù àK¬ñèœ ê†ì‹, 2016-¡ð® ñ£ŸÁˆ Føù£OèÀ¡° Üó²Š ðEèO™ 4% Þì嶡W´ õöƒè ãŸèù«õ ݬí õöƒA»œ÷¶. Þ‰î Þì嶡W†®¬ù ªêò™ð´ˆ¶‹ Mîñ£è ªî£°F ‘A’ ñŸÁ‹ ‘B’ HK¾, «ïó® GòñùƒèO™ ñ£ŸÁˆ Føù£OèÀ¡° àè‰î ðâæl§fŸ è‡ìPòŠð†´, M¬óM™ Ý¬í ªõOJìŠð´‹.
2. As per Section 33(i) of the Rights of Persons with Disabilities Act, 2016 (Central Act 49 of 2016) “the appropriate Government shall identify posts in the establishments which can be held by respective category of persons with benchmark disabilities in respect of the vacancies reserved in accordance with the provisions of Section 34” of the said Act.
3. In the Government order second read above, 263 posts under group A & B category were identifi ed as suitable for differently abled persons under 3% reservation. In the Government Order third read above Government have issued orders for increasing the percentage of reservation of differently abled persons in employment from 3% to 4%.
4. In the Government Order fi fth read above, an Expert Committee for identifying Groups ‘A’, ‘B’, ‘C’ and ‘D’ posts have been constituted as per Section 33(i) of the Rights of Persons with Disabilities Act, 2016.
5. In the Government Order fourth read above, in Group ‘A’ and ‘B’ categories three posts like Civil Judge and District Judge (entry level), Post Graduate Teacher and Physical Director (Grade-I) were identifi ed, in the Government Order sixth read above certain amendment was made for the Civil Judge and District Judge (entry level) and in the Government Order seventh read above, Personal Assistant to Hon’ble High Court Judge, Interpreter and Senior system analyst were identifi ed for most suitable for differently abled persons.
6. In the letter eight read above, the State Commissioner for the Differently Abled has sent proposals for identifying posts suitable for differently abled persons under Group ‘A’ and ‘B’ categories based on the opinion of the Expert Committee for consideration.
7. The Government after careful examination of the proposal of the State Commissioner for the Differently Abled, in consultation with all the concerned departments have decided to approve 229 posts under ‘A’ and ‘B’ categories and six posts already identifi ed in Government orders 5th , 6th and 7th read above. Totally 235 posts under Group ‘A’ and ‘B’ categories are most suitable for differently abled persons. In respect of posts comes under other departments, boards and corporations will be identifi ed and issue orders separately.
8. The Government also direct that 4% of the vacancies in direct recruitment for the identifi ed posts in ‘A’ and ‘B’ Groups, where the rule of reservation is applicable for the SCs / STs / BCs and other communities, shall be reserved for the Differently Abled Persons. If only one post is available for recruitment in these categories, the usual procedure for recruitment will be followed. The Government has also directed that,
(i) The reservation of 4% vacancies earmarked for the differently abled persons will be applicable to indentifi ed posts in respect of ‘A’ and ‘B’ categories for direct recruitment posts only.
(ii) The reservation of 4% vacancies for differently abled persons need not be made applicable in the case of recruitment by transfer/promotion as it would amount to giving double preference to these candidates.
(iii) If any department / establishment is of the view that any particular post in ‘A’ and ‘B’ category is not suitable for differently abled persons, in such case, it may specifi cally request the Government for exemption. The administrative department in consultation with the State Commissioner for the Differently Abled and the Government shall issue appropriate orders.
(iv) The individuals selected for ‘A’ and ‘B’ categories of posts should be asked to produce certifi cate of physical fi tness and the disability certifi cate as stated in Section 3(oo) of Tamil Nadu Government Servants (Conditions of Service) Act, 2017.
9. The list of 235 categories of posts identifi ed as most suitable for the different categories of the Differently Abled Persons for 4% reservation in ‘A’ and ‘B’ groups is given in the Annexure to this order.
10. Government also direct that the effect of the Government Order will be from the date of notifi cation.
