RULES SUPPLEMENT TO PART I OF THE FORT ST. GEORGE GAZETTE No.23, MADRAS, WEDNESDAY, JUNE 11, 1958 (JYAISTHA 21, 1880) DEPARTMENT OF INDUSTRIES, LABOUR AND CO-OPERATION Madras Silkworm Seed (Production, Supply and Distribution) Rules, 1958.

In exercise of the powers conferred by sub-sections (1) and (2) of section 19 of the Madras Silkworm Seed (Production, Supply and Distribution ) Act, 1956 (Madras Act XXIII of 1956), the Governor of Madras hereby makes the following rules under the said Act, the same having been previously published as required under sub-section 1(3) of the said section 19 :- RULES.
1.These rules may be called the Madras Silkworm Seed (Production, Supply and Distribution) Rules, 1958.
2.In these rules, unless there is anything repugnant in the subject or context –
(a) “ Act ” means the Madras Silkworm Seed (Production, Supply and Distribu -tion) Act, 1956 (Madras Act XXIII of 1956) ;
(b) “ Chawki ” means young silkworms hatched from the silkworm eggs and reared until the worms pass the second moult ;
(c) “ Chawki rearer ” means a person rearing Chawkie for distribution to sericulturists :
(d) “ Cocoon market ” means the cocoon market under the Committee established under section 10 of the Act and notified as such in the Fort St. George Gazette ;
(e) “ disease –free laying ” means disease-free silkworm eggs ;
(f) “ Disease–free silkworm seed ” means silkworm eggs which are free from pebrine disease;
(g) “ grainage ” means a place where disease-free silkworm seed is prepared ;
(h) “ graineur ” means a person who is engaged in the manufacture, distribution or disposal of silk worm eggs used for purposes of rearing silkworms and who holds a licence under the Act:
(i) “ licensing authority ” means the Director of Industries and Commerce, Madras, and includes any other officer authorized by the Government in this behalf ;
(j) “ market officer ” means an officer of the Sericultural Section of the Department of Industries and Commerce appointed to conduct the affairs of the cocoon market as Chairman.

3. (1)The licensing authority may, after satisfying itself as to the eligibility of the applicant and to the needs of the locality or area in which the applicant seeks to be permitted to carry on his silkworm seed operations, grant the license which shall be in Form B. The licensing authority may refuse to grant a licence, if it is not satisfied as to the eligibility of the applicants or if, in its opinion, the area is adequately served by the existing grainages.
(2) An applicant for a license under sub-rule (1) for carrying on silkworm seed operations should possess the following qualifications :-
(a) He should have undergone training for six months in a Government grainage in grainage technique and studied upto III Forms at least to the able to take up microscope examination and maintenance of accounts. He should hold a certificate granted by the Director .
(b) He should have a sufficient experience of rearing pure foreign races of worms and possess adequate facilities for getting a continuous supply of foreign race seed cocoons.
(3) If the licensing authority is an officer other than the Director, an appeal against is order under sub- rule (1) shall lie to the Director and if the licensing authority is the Director, an appeal against his orders under sub – rule( 1) shall lie to the Government. The decision of the appellate authority on such appeals shall be final.
4. Every person licensed under rule 3 shall comply with the following conditions :-
(a) He shall prepare disease –free silkworm seed only from silkworm seed cocoons approved by and secured through an officer of the Sericulture Section in the silkworm seed area. In token of his having purchased approved seed cocoons the graineur shall obtain a certificate in Form C from the officer through whom the seed cocoons are procured and this certificate shall also entitle the graineur to transport the seed cocoons from the source of supply to the graineur’s grainage.
(b) He shall prepare disease –free silk worm seed according to “ Pasteur “ method of microscopic examination, or by any other advanced method and process specified by the Government by notification in the Gazette, from time to time.
(c) The graineur shall sell the disease – free layings to sericulturists in the Jurisdiction prescribed for him by the Director, at the rates approved by the Director from time to time.
(d) He shall abide by such other conditions as may be specified by the Government in regard to the working of the grainage.
(e) He shall maintain a record of the results of the rearings from the seed issued from his grainage, frequently inspect the rearing from the seed distributed by him, record the results of such inspections and furnish such information at such time and to such officer of the Sericultural Section of Department of Industries and Commerce, as the licensing authority may specify, about the conditions of the crops and yields.
(f) He shall maintain regular accounts and record in such forms as may be specified by the Director and they shall be open for inspection by the officers of the Department of Industries and Commerce. He shall also send to the Sericultural Officer specified by the Director in this behalf such returns within such time as the Director may by order specify.
(g) He shall give a bill to the person to whom seeds are sold with reference to the date of preparation.
(h) He shall give due intimation to the Sericultural Officer specified by the Director in this behalf, of the time of each grainage operation and issue the disease free silkworm seed to the silkworm rearer after they are inspected and passed by the Officer of the Department of Industries and Commerce authorized by the Director.
(i) Whenever the graineur expects a lot of seed cocoons in his grainage, he shall send intimation to the nearest Government Grainage Officer or to such other Officer of the Sericultural Section as the officer - incharge of the nearest Government grainage directs. The dates on which the seed cocoons would be received and the probable date of emergence of the moths from the seed cocoons shall be intimated in advance.
Intimation shall also be given as soon as the moths emerge
(j) The location of the any grainage shall not be changed except with the approval of the Director or any other officer authorized by him in this behalf.
(k) A list of foreign race seed cocoons rearers employed by the graineur shall be furnished to the officer of the Department of Industries and Commerce specified by the Director in this behalf.
(l) Only such foreign race seed cocoons as are certified and recommended by them Director to suit the locality and season shall be used by the graineur.

(m) The graineur shall be responsible for any misuse of the foreign race seed cocoons reared by him.
(n) (i) The graineur shall get 5 per cent of moths examined by an officer of the Department of the Industries and Commence not lower in rank than a Sericultural Demonstrator or Moth Testor and only such layings as are certified by the said officer disease - free shall be distributed by the graineur
(ii) If the graineur is aggrieved by any finding under sub – clause (i), he may appeal to the officer superior to the officer who conducted the moth examination under sub – clause (i) to cross – check the results and thereupon an officer of the Sericultural Section not below the rank of an Inspector shall conduct an independent test of the moth and record this findings . The findings of the said second officer shall be final and shall be binding up the graineur
(iii) Layings which are not certified as free from pebrine shall not be distributed and shall be destroyed in presence of the officer of the Sericultural Section. The graineur shall not claim any compensation for the loss.
(b) Every chawkie rearer shall be bound by the following conditions :-
(i) He shall use only disease - free layings prepared by a licensed graineur, and shall produce evidence for having done so on demand by an officer of the Department of Industries and Commence not below the rank of a Sericultural Demonstrator.
(ii) He shall maintain a registered in the Form F which shall be open for inspection of the officers of the Sericulture Section.
(5) In proof of his having used only silkworm seed obtained from a licensed graineur, the rearer shall preserve the bill issued in respect of the silkworm seed supplied by the graineur, produce it before the Inspecting Officer when called upon to do so.
(6) An application for the license shall be made to the licensing authority in Form A. The license shall exhibit such licence in a prominent place, in the place where rearings are carried on.
(7) The following conditions shall be complied with by every person licensed under rule 6 :-
(a) The silkworm rearer must know all the essential details of silkworm rearing.
(b) Every licensed rearer shall be in possession of a well - maintained mulberry garden, a disinfectable rearing apartment and rearing appliances, namely, stands, trays, cocoonage and chopping knives.
(c) The silk worm seed rearer shall rear the silk worm seed obtainable from Government grainages or any other grainage approved by the Director. The egg sheets of each lot of disease - free layings supplied to the rearer shall be preserved by the rearers after brushing the worm till the crop of that particular lot is completed and cocoons are disposed off.
(d) The silkworm rearer shall not transfer the worms during the course of rearing from one place to another or from one person to another without the permission of the local officer of the Sericultural Section.
(e) The silkworm rearer shall comply with the written instructions given from time to time by the officers of the Sericultural Section in the rearing silkworms and permit them to inspect the rearings and take worms for testing at every stage.
(f) The silkworm rearer shall allow the silk worm to spin for three days on the mountages between March – September and four days between October – Feburary and harvest the cocoons on the next day after the days allowed for spinning. He shall on no account retain the cocoons for more than four days after harvest without the written permission of the officer of the Sericultural Section.
(g) The silkworm rearer shall allow the officer of the Sericultural Section to disinfect the rearing apartments and the appliances it found necessary, and afford all facilities for disinfection.
8. (1) The licensing authority may withdraw or cancel the license granted under rule 3 and 6, If it is satisfied that the licensee has failed to conform to the conditions governing the licence.
(2) If the licensing authority is an officer other than the Director, an appeal against its order under sub - rule (1) shall lie to the Director and if the licensing authority is the Director, an appeal against his orders under sub - rule (1) shall lie to the Government. The decision of the appellate authority on such appeals shall be final.
9. (1) The Government shall, by notification in the Fort. St.George Gazette, constitute the Market Committee and the representatives of rearers and charka reelers and filatures on such committee shall be elected.

(2) The term of the Market Committee shall be one year from the date of its constitution.
(3) There shall be two members elected from licensed silkworm rearers and one member each elected by the charka reelers and filatures. If there is no filature or charka establishment, the number of members will be proportionately reduced. The System of election will be direct and conducted at a meeting to be presided over by Chairman notified at least fifteen days prior to the date of such meeting. The member to stand for election shall be proposed and seconded by at least three of the electorates and a written statement will have to be filed before the Chairman at least three working days prior to the meeting. Licensees under section 3 and 4 of the Act alone are eligible for electing representatives of silkworm rearers and licensees under sections 5 and 7 for electing representatives of charka reelers and filatures.
(4) If in the opinion of the Government a Market committee or any member thereof is not competent to perform or persistently makes default in the performance of the duties imposed on it or him, the Government may by notifications in the Fort.St.George Gazette dissolve such market committee or remove such member and may reconstitute the Market Committee in accordance with sub-rule (1) or get elected a new member as the case may be.
10. The following rules are laid down for the working of the cocoon markets :-
(a) The Market Officer shall receive all the cocoons brought by the rearers to the market and arrange them it lots giving separate lot number for each lot.
(b) He shall arrange for grading of each of lot of cocoons received and submit them to the committee for fixing the rate.
(c) The time of transaction in each market shall be from 10 a.m to 1 p.m and 2 p.m to 5 p.m except on Sundays and general holidays. The cocoons will be received up to 4 p.m on all working days for transaction.
(d) The transaction of the day shall be closed and completed before 5 p.m each day.
(e) If cocoons received an any day cannot be sold before the close of that day,they may be permitted to be stored in the market, provided there is accommodation. Such cocoons shall be weighed before storage and a receipt delivered to the rearer recording the weight of the cocoons. They shall be taken up for sale on the succeeding day. Due provision shall be made by the Director for the dryage and consequent shortage in the weight of such cocoons as are stored in the market. The rearer shall accept the weight registered on the subsequent day, subject to the dryage conforming to the schedule approved by the Director.
(f) The Market Officer shall, in consultation with the members of the Market Committee, if any, present at that time, decide whether to approve or not to approve any transaction.
(g) The Market Officer, shall maintain a register in Form G and such other registers as may be prescribed by the Government from time to time and record in them the transactions of the market.
(h) A fee of 2 naye paise for every pound of cocoons transacted in the market shall be recovered from the licensed buyer. The fee realised shall be credited to the head “XXXII Industries – Sericultural receipts “ in the State Budget.
11. (1) An application for the grant of licence for carrying on reeling shall be made to the licensing authority in Form D.
(2) The licensing authority shall grant the licence in Form E on being satisfied of the availability of cocoons for reeling. The licensing authority may withdraw or cancel the licence, if it is satisfied that the license has failed to conform to the conditions governing the licence.
(3) The licensing authority may grant a permit in any silkworm rearer or purchaser for exporting his cocoons to an area outside the notified area, if it is satisfied that such quantities are in excess of requirements in the said notified area,.
12. Every licence shall be renewed before the commencement of each official year.
13. (1) The following fee shall be payable for the grant or renewal of licences of different catagories :-
(a) Graineur – Rs.10 per annum
(b) Charka – Rs. 2 each per annum
(c) Reeling unit – Rs. 5 each per annum per basin.

(d) Temporary licence granted to a rearer whose cocoons cannot be sold for want of buyer – Re.1 per basin (valid for fifteen days from the date of issue).
(2) The fee payable for a duplicate licence shall be Rs.2
(3) No fee is charged for a licence granted to a person for rearing silkworms.
(4) The fee realized shall be credited to the head “Sericultural Receipts” in the State Budget.
14. (1) The amount payable for compounding offences which are contravention under several sections of the Act shall be as follows :-
(i) A sum of Rs. 25 in the case of any rearer who offends against section 5 or 6 of the Act.
(ii) A sum of Rs.200 in all other cases.
(2) The composition amount realized shall be credited to the head “Sericultural Receipts” in the State Budget.
15. Appeals under these rules shall be filed with the appellate authority not later than one month from the date of communication of orders to the party preferring an appeal.

Section 6 – Regulation of sale or purchase of silkworm cocoons for reeling – No rearer shall sell or agree to sell, and no licensed buyer shall purchase or agree to purchase silkworm cocoons for reeling, except in cocoon markets or cocoons market yards established under this Act; and at prices other than those fixed from time to time by notification by the Director.
Regulation of reeling Section 7 – Regulation of reeling – No person shall carry on the business of reeling silk from silk worm cocoons unless he holds a licence issued under this Act.
Rule 12:- Every licence shall be renewed before the commencement of each official year.
Rule 13:- (1) The following fee shall be payable for the grant or renewal of licences of different categories :-
