CHAPTER – I PRELIMINARY Act – Section 2 – Definitions.

In these Laws, unless a different intention appears from the subject or context – (a) ―The Laws‖ of the University means the provisions of the act, the statutes, the ordinances and the regulations.

(b) ―The Act‖ means the Madurai Kamaraj University Act, 1965 and ―Section‖ means a section of the Act.

(c) ―The University‖ means the Madurai Kamaraj University as constituted under the Act.

(d) ―Officers, Authorities, Professors, Readers, Lecturers, Teachers, Servants and Registered graduates mean respectively, Officers, Authorities, Professors, Readers, Lecturers, Teachers, Servants and Registered Graduates of the University.

(e) ―The Gazette‖ means the Fort St. George Gazette.

(f) ―Clear days‖ means that the time is to be reckoned exclusive of both the first and the last days.

(g) ―Resolution‖ means substantive proposition originally moved or finally adopted.

(h) ―Motion‖ means anything moved either by way of resolution or amendment.

All words and expressions used herein and defined in the Act shall have the meanings so defined.

2. Subject to the provisions of the Act, Statutes are made by the Senate, Ordinances by the Syndicate and Regulations by the Academic Council Notices.

3. (a) Any notice, intimation or information required to be given and any paper, minutes or proceedings required to be sent to any person by the Laws shall be sent by messenger or post to the address of the person.

Addresses..

(b) Every officer of the University and every member of a University / authority or body appointed under the laws shall, if required by the Registrar, give an address to which communications may be sent; and the posting of communications to that address shall be sufficient compliance with the requirements of the laws as to notice or despatch of papers.

Validity of acts done on the day following Dies Non.

4. Where, by any Law, any act or meeting or proceeding is directed or allowed to be done or taken in the office of the Registrar on a certain day, or within a prescribed period or the office is closed on that day or the last day of the prescribed period, the act or proceeding shall be considered as done or taken in due time, if it is done or taken on the day on which the office reopens.

Hours of business.

5. The office of the Registrar, University Departments and the Directorate of Distance Education shall be open for transaction of business between the hours

10.00 a.m. and 5.45 p.m. on all days except Saturdays and Sundays and Gazetted holidays, and such other local holidays as may be declared. The office, and the departments and the Directorate of Distance Education may be closed for a day or part of a day on particular occasions at the discretion of the Vice-Chancellor, provided that the arrangements are made for the transaction of the urgent business.

The hours of work for the members of the teaching staff shall be from

10.00 a.m. to 5.45 p.m. except in the case of those who have classes in the evenings or mornings. In the case of teachers who have definite class work in connection with any of the classes conducted, the hours may be suitably modified in each case with the approval of the Vice-Chancellor”.

CHAPTER – II THE UNIVERSITY Act S. 3. The University.

1. The Madurai Kamaraj University shall be a body corporate, shall have perpetual succession and a common seal and shall sue and be sued by the name of the Madurai Kamaraj University.

2. The headquarters of the University shall be located within the town limits of Madurai or in any place within a radius of twenty-five kilometers around the town limits of Madurai.

Act S. 4. Powers of the University.

3. The University shall have the following objects and powers namely:- 1. to provide for instruction and training in such branches of learning as it may determine;

2. to provide for research and for the advancement and dissemination of knowledge;

3. to institute degrees, titles, diplomas and other academic distinctions;

4. to hold examination and to confer degrees, titles, diplomas and other academic distinctions on persons who :- a. shall have pursued an approved course of study in a University college or laboratory or in an affiliated or approved college, unless exempted there from in the manner prescribed by the statutes and shall have passed the prescribed examinations of the University; or b. shall have carried on research under conditions prescribed;

(4-A) to confer degrees, titles, diplomas and other academic distinctions on persons who shall have pursued an approved course of study and qualified for the same, in an autonomous college.

5. to confer honorary degrees or other distinctions under conditions prescribed;

6. to institute, maintain and manage institutes of research, University colleges and laboratories, libraries, museums and other institutions necessary to carry out the objects of the University.

7. to affiliate colleges to the University as affiliated, professional or post-graduate colleges under conditions prescribed and to withdraw affiliation from colleges;

8. to approve colleges providing courses of study for admission to the examinations for titles and diplomas and Pre-University examination of the University under conditions prescribed and to withdraw such approval;

(8-A) to designate any college as an autonomous college with the concurrence of the Government and the University Grants Commission, to prescribe the condition for such conferment of designation and to cancel such designation.

9. to institute lectureships, readerships, professorships and any other teaching post required by the University and to appoint persons to such lectureships, readerships, professorships and other teaching posts;

10. to institute and award fellowships, travelling fellowships, scholarships, studentships, bursaries, exhibitions, medals and prizes;

11. to establish, maintain and manage hostels, to recognize hostels not maintained by the University and to withdraw recognition therefrom;

12. to exercise such control over the students of the University through the as will secure their health and well-being and discipline;

13. to hold and manage endowments and other properties and funds of the University and to raise loans required for the purposes of this Act;

14. to fix fees and to demand and receive such fees as may be prescribed;

15. to make grants from the funds of the University for the maintenance of a National Cadet Crops;

16. to institute and maintain a University Extension Board;

17. to institute and provide funds for the maintenance of :- a. a publication bureau;

b. an employment bureau;

c. Student‘s unions;

d. University athletic clubs; and e. Other similar associations;

18. to encourage co-operation among the colleges, laboratories and institutes in the University and co-operate with other Universities and other authorities in such manner and for such purposes as the University may determine;

19. to recommend to the Government the recognition of any area within the University area as a University Centre; and

20. generally to do all such other acts and things as may be necessary or desirable to further the objects of the University.

Act S. 5. Colleges not to be affiliated to any other University.

4. 1. No college within the University area shall be affiliated to any University other than the Madurai Kamaraj University.

2. No institution affiliated to, or associated with, or maintained by any other University established by or under any law in force shall be recognized by the University for any purpose except with the prior approval of the Government and the concerned University.

3. Notwithstanding anything contained in any other law for the time being in force, any affiliation or recognition granted by any other University established by, or under any law in force, to any institution within the University area, prior to 19th August, 1983 shall be deemed to be withdrawn on and from the said date.

Act S. 6. Disqualification for membership.

5. (1) No person shall be qualified for election as a member of any of the authorities of the University, if on the date of nomination or election, he is:- a. of unsound mind, a deaf-mute or suffering from leprosy;

b. an applicant to be adjudicated insolvent or an undischarged insolvent;

c. sentenced by a criminal court to imprisonment for any offence involving moral turpitude.

(2) In case of dispute or doubt the Syndicate shall determine whether a person is disqualified under subsection (1) and its decision shall be final.

CHAPTER – III VISITATION Act S. 7. Visitation.

1. The Government shall have the right to cause an inspection to be made, by such person or persons as they may direct, of the University, its buildings, laboratories, libraries, museums, work shops and equipment, and of any institutions maintained, recognized or approved by, or affiliated to the University and also of the examinations, teaching and other work conducted or done by the University, and to cause an inquiry to be made in respect of any matter connected with the University. The Government shall in every case give notice to the University of their intention to cause such inspection or inquiry to be made and the University shall be entitled to be represented thereat.

2. The Government shall communicate to the Senate and to the Syndicate their views with reference to the results of such inspection or inquiry and may, after ascertaining the opinion of the Senate and the Syndicate thereon, advise the University upon the action to be taken.

3. The Syndicate shall report to the Government the action if any, which is proposed to be taken, or has been taken, upon the results of such inspection or inquiry. Such report shall be submitted with the opinion of the Senate thereon the within such time as the Government may direct.

4. Where the Senate or the Syndicate does not within a reasonable time take action to the satisfaction of the Government, the Government may, after considering any explanation furnished or representation made by the Senate or the Syndicate, issue such directions as they may think fit and the Senate and the Syndicate shall comply with such directions. In the event of the Senate or the Syndicate or both not complying with such directions within such time as may be fixed in that behalf by the Government, the Government shall have power to appoint any person or body to comply with such directions and make such orders as may be necessary for the expenses thereof.

CHAPTER – IV THE CHANCELLOR Act S. 9. The Chancellor.

1. The Governor of Tamil Nadu shall be the Chancellor of the University.

He shall by virtue of his office, be the head of the University and the President of the Senate and shall when present, preside at meetings of the Senate and at any convocation of the University.

2. The Chancellor shall exercise powers as may be conferred on him under the provisions of this Act.

3. Where power is conferred upon the Chancellor to nominate persons to authorities, the Chancellor shall, to the extent necessary, nominate persons to represent interests not otherwise adequately represented.

THE PRO–CHANCELLOR Act. S. 10. The Pro-Chancellor.

4. The Minister in charge of the portfolio of education in state of Tamil Nadu for the time being shall be the Pro-Chancellor of the University.

5. In the absence of the Chancellor, or during the Chancellor‘s inability to act, the Pro-Chancellor shall exercise all the powers of the Chancellor.

CHAPTER – V THE VICE–CHANCELLOR Act S. 11. The Vice–Chancellor.

1. The Vice-Chancellor shall be appointed by the Chancellor from out of a panel of 3 names recommended by the Committee referred to in statute 5 hereunder. Such panel shall not contain the name of any member of the said committee.

Provided that if the Chancellor does not approve any of the persons in the panel so recommended by the Committee, he may take steps to constitute another Committee, in accordance with Statute 5, to give a fresh panel of three different names and shall appoint one of the persons named in the fresh panel as the Vice-Chancellor.

Act S. 12. Powers and duties of the Vice-Chancellor.

2. (1) The Vice-Chancellor shall be a whole–time Officer of the University.

He shall be the academic head and Principal executive officer of the University.

(2) The Vice-Chancellor shall in the absence of the Chancellor and the Pro-Chancellor preside at the meetings of the Senate, and at any Convocation of the University.

(3) The Vice-Chancellor shall be a member ex-officio and Chairman of the Syndicate, the Academic Council and the Finance Committee of the University and shall be entitled to be present at and address any meeting of any authority of the University but shall not be entitled to vote thereat unless he is a member of the authorities concerned.

(4) The Vice-Chancellor shall have power to convene the meetings of the Senate, the Syndicate, the Academic Council and the Finance Committee of the University.

(5) The Vice-Chancellor shall exercise a general control over all the affairs of the University.

(6) It shall be the duty of the Vice-Chancellor to ensure that the provisions of the act, the Statutes, Ordinances and Regulations of the University are faithfully 65 observed and carried on. He shall exercise such powers as are necessary for the said purpose.

(7) The Vice-Chancellor shall give effect to the resolutions and the orders of the Senate, the Syndicate and the Academic Council.

(8) (a) In case of any emergency, which in the opinion of the Vice-Chancellor requires that immediate action should be taken, he may take such action with the sanction of the Chancellor or the Pro-Chancellor. But he shall as soon as may be thereafter report his action to the officer or authority who or which would have ordinarily dealt with them.

(b) any person in the service of the University aggrieved or affected by the action of the Vice-Chancellor taken under Statute 8 (a) shall be entitled to prefer an appeal to the Syndicate within 30 days from the date on which he has notice of such action.

(9) The Vice-Chancellor shall exercise such other powers and perform such other duties as may be prescribed.

(10) The Vice-Chancellor shall also exercise all such powers not expressly mentioned herein which are necessary for or incidental to the carrying on of the administration of the University and its affairs.

Act S. 11(4). Temporary vacancy.

3. When any temporary vacancy occurs in the office of the Vice-Chancellor, the Syndicate shall, as soon as possible, subject to the approval of the Chancellor, make the requisite arrangements for exercising the powers and performing the duties of the Vice-Chancellor.

Statute. Permanent vacancy.

4. When a permanent vacancy occurs or is about to occur in the office of the Vice-Chancellor, the Registrar shall under direction of the Syndicate cause a notification of the fact to be published in the Gazette and take immediate steps for the constitution of the committee referred in the statute 1 mentioning the date and hour of the last date for filing nominations and the place, date and hour for the scrutiny of the nomination papers. The date for filing nominations must be at least 14 clear days after the date of publication of the notification. A copy of the said notification shall be sent to the Chancellor and to each of the members of the Senate and the Syndicate and placed at the next meeting of the Syndicate immediately after the publication of the notification.

5. The Committee referred to in Statute 1shall consist of persons of whom one shall be nominated by the Senate of the University, one by the Syndicate of the University and one by the Chancellor, provided that the person nominated shall not be a member of any of the authorities of the University.

Procedure for nomination and election of a member by the Senate to the Committee referred to in Statute 5.

6. 1. Each member of the Senate shall have a right to nominate not more than one person who is not a member of any of the authorities of the University, to the committee referred to in statute 5. Similarly each member of the Syndicate shall have a right to nominate not more than one person who is not a member of any of the authorities of the University to the said Committee.

2. The Registrar shall call for nominations for election of one person by the members of the Senate and one person by the members of the Syndicate to the said Committee.

3. Every nomination shall be in writing signed by the proposer who shall be a member of the Senate and seconded in writing by another member of the Senate called the seconder in the form prescribed (Vide Appendix). No nomination shall be valid unless it contains the signature of both the proposer and the seconder.

4. The nomination form shall also be signed by the person proposed expressing his consent to be nominated.

5. Every nomination must be presented before the Registrar either by the proposer or the seconder or the person proposed, before 3 p.m. on the date notified as the date for filing nomination under Statute 4.

6. Soon after the expiry of the last date and hour for receipt of nominations, the Registrar shall scrutinize the nomination papers at the place, date and hour notified under Statute (4). The proposer or the seconder or the proposed nominees are entitled to be present at the time of the scrutiny. A list of persons whose nominations have been declared valid by the Registrar shall be published on the notice board of the office of the University. A copy of the list shall be sent to the persons nominated for election if he or they were not present at the time of scrutiny.

67 Withdrawal of nominations.

7. Any person whose nomination had been declared valid may withdraw his nomination by a letter in writing and presented to the Registrar in person not later than 7 clear days after the date of publication of valid nominations or by a letter in writing and attested by any other member of the Senate and sent by registered post to the registrar so as to reach him not later than the above said 7 clear days after the date of publication of the above said nominations. Such withdrawal once made shall be final.

Selection of Members.

8. (a) If the number of persons validly nominated and who have not withdrawn is only one that person shall be deemed to have been duly elected and nominated by the Senate to the Committee referred to in Statute 5 and shall be so declared by the Registrar.

(b) If the number of persons validly nominated and who have not withdrawn is more than one each member of the Senate shall be informed of the date and hour fixed by the Vice-Chancellor for the meeting and a list of such persons shall be sent to each member of the Senate not less than ten clear days fixed for the meeting.

(c) The election shall be held at the next ordinary meeting of the Senate immediately preceding the date when the office of the Vice-Chancellor shall fall vacant, provided that the Vice-Chancellor shall convene a special meeting of the Senate for election of the nominee if he thinks it necessary.

(d) The election shall be conducted by secret ballot at the place specifically set apart for the purpose and the ballot box properly locked and sealed shall be provided to receive the votes of the nominees.

(e) All members present at the meeting shall be entitled to vote. No vote can be given by proxy. Members present shall sign in the nominal electoral roll kept for the purpose as a record of voting at the election.

(f) Before a member is ready to vote, the Registrar shall ascertain and satisfy himself that the person desiring to vote is a member who has not already voted.

The Registrar shall then enter his name upon the counterfoil of the ballot paper in the ballot paper book which shall be provided for the purpose of the election and shall then tear out the ballot paper corresponding to the counterfoil and having initialed the ballot paper on the back thereof shall hand it over to the member.

Every ballot paper, shall contain the names of all nominees arranged in alphabetical order.

(g) when a member has received a ballot paper, he shall proceed to the place arranged for marking the vote and shall mark thereon by ―X‖ against the name for whom he intends to vote. The number of nominees for whom each elector may vote shall be only one. The member shall then fold the ballot paper and drop it in the ballot box placed in front of the returning officer.

(h) If a member inadvertently spoils a ballot paper, he may return it to the Registrar, who shall if satisfied of such inadvertence, give him another paper, and retain the spoiled paper; and this spoiled paper shall be immediately cancelled and the fact of such cancellation shall be noted on the counterfoil.

(i) Two scrutinizers shall be selected by the Chairman of the meeting of the Senate to count the votes polled. The counting shall be done in the presence of the members of the Senate present and the Chairman. Persons securing the highest number of votes shall be declared by the Chairman of the meeting to have been duly elected and nominated by the Senate to the Committee referred to in Statute 5.

9. Chairman of the meeting held for the purpose of the election under Statute 5, shall conduct other items of business, if any, but the business of electing a member to the committee shall precede all other business and shall be disposed of before the meeting is adjourned or before any other item, if any, on the agenda is considered.

Procedure for nomination and election of a member by the Syndicate to the Committee referred to in Statute 5.

10. (1) The Statutes in this Chapter relating to the procedure for nomination and election of a person by the Senate to the Committee referred to in statute 5 shall as far as may be necessary apply to the nomination and election of a person by the Syndicate to the committee mentioned in Statute 5, the word ―Syndicate‖ being read in substitution of the word ―Senate‖ wherever necessary.

(2) Notwithstanding anything contained herein it shall be competent for the Syndicate to elect such nominee to the Committee by a resolution assented to by the majority of the members of the Syndicate after obtaining the consent of the concerned nominee to serve on the committee.

Publication of the members of the committee for submitting the panel of 3 persons for Vice-Chancellorship.

11. The Registrar shall report to the Chancellor of the names of the persons elected by the Senate and the Syndicate to the Committee. After the Chancellor nominates the third member to the committee, the names of the members of the 69 committee shall be published in the gazette. The member nominated by the Chancellor shall be the convener of the committee.

12. The Committee shall meet soon after the names of 3 members are published and submit to the Chancellor a panel containing the names of 3 persons suitable for holding the office of the Vice-Chancellor. While submitting the panel to the Chancellor the Committee shall also send a statement showing the age, educational qualification, academic and administrative experienced and other distinctions of each of the 3 persons whose names are included in the panel.

The panel shall be in alphabetical order.

Educational Qualification and Experience for the post of Vice-Chancellor.

12-A. In exercise of powers conferred by clause (ii) of sub-section (2-A) of Section 11of the Madurai Kamaraj University Act, 1965 (Tamil Nadu Act 33 of 1965), the Government of Tamil Nadu in consultation with the Chancellor of the Madurai Kamaraj University, hereby specifies that every person recommended by the Committee, referred to in sub-section (2) of the said Section 11, for appointment as Vice-Chancellor shall possess the following educational qualifications and experience, namely:

1. A Ph.D. Degree in any discipline;

2. Not less than twenty years of experience in teaching and research in Universities or post graduate colleges or publicly funded research institutions or in all taken together.

or Not less than ten years of experience as Professor in a University system;

3. Not less than six years of administrative experience in Universities or post graduate colleges or publicly funded research institutions in positions such as Dean, Head of the Department or any other such administration positions of equal or higher degree of responsibility or in all taken together;

4. Must have published not less than five research papers in University Grants Commission listed journals after acquiring Ph. D. or authored not less than two books (non edited books) if adequate number of such University Grants Commission listed journals are not available; and

5. Must have presented not less than two papers in international level academic or research events and possess experience of having conducted not less than one such academic or research event.

Guidelines for the Search Committee for Selection of Vice-Chancellor.

12-B. The Search Committee may choose to adopt some or all of the following suggestions with appropriate modifications as deemed fit: 1. The Search Committee will be formed at least four months before the expiry of the incumbent‘s term to eliminate the need for action / in charge Vice-Chancellors or any alternate arrangements in the form of Convener‘s Committee.

2. The Governor of Tamil Nadu and the Chancellor of the Universities may brief the members of the Search Committee as early as possible preferably within ten days of the formation of the Search Committee.

3. Nodal Officer: The Search Committee will identify one External Nodal Officer who will be from the institute with which the Chairperson or Member is associated. If this is not feasible for any reason, the Committee may nominate a Nodal Officer from any other institute. Further, one Liaison Officer from the University for which the Search Committee has been constituted will be nominated by the University.

Letter of appointment if Nodal Officer and Liaison Officer detailing out the tasks to be performed by them will be issued by the Governor‘s Secretariat with a clear indication that in so far as tasks pertaining to the Search Committee, both these officers will work under the direction and superintendence of the Chairperson of the Search Committee. This letter will be accompanied by a copy of the Guidelines. This will insulate the selection process from State Government, Governor‘s Secretariat and the concerned University and minimize interference from interested parties.

Tasks to be performed by the Nodal Officer:

a. To receive applications / nominations in electronic and other formats.

Applications / nominations received over electronic mail need to be printed.

b. To scrutinize the applications/nominations and compile information in the specified format.

c. To submit information so compiled along with the applications / nominations to the Committee during the meeting (s) of the Committee.

d. To communicate with the candidates as per the directions of the Search Committee.

71 e. To prepare Minutes of the meeting (s) and any other document (s) as per the directions of the Search Committee.

f. To provide information to the concerned Public Information Officer and to assist the concerned authority in handling litigation(s), if any.

g. To forward all the applications/nominations and other documents to the Governor‘s Secretariat for retention there.

Tasks to be performed by the Liaison Officer from the University:

a. To arrange travel and hospitality for the Chairperson and the Members of the Search Committee, Nodal Officer and staff and candidates.

b. To arrange venue (s) for Meeting(s) of the Committee.

4. The Search Committee will maximize the pool of candidates by:

a. Notification of the vacancy through newspapers and internet;

b. Inviting nominations from distinguished academicians; and c. Inviting suitable candidates.

5. The Nodal Officer will forward the advertisement, approved by the Search Committee, within 7 days of the briefing meeting with the Governor and forward it to the Registrar of the concerned University for publication, along with the direction to the names of the newspapers wherein it has to be published.

The notification should be published at least in one national English daily newspaper and one Tamil newspaper with maximum circulation in the general area of the concerned University and no more than a total of four newspapers.

6. The Chairperson and the Committee members will write letters distinguished individuals and heads of renowned institutions and Universities in India and abroad requesting them to nominate suitable candidates. In the letter there shall be a clear indication of the last date for receipt of application which shall not be at variance with the last date indicated in the advertisement.

7. The Registrar of the University will post the notification as well as the relevant sections with latest amendments of the University Act, Rules and Regulations, Statutes, Ordinances and other relevant directions / guidelines and eligibility conditions on the website of the University before the notification appears in the newspapers. The last date for receipt of applications will also be posted on the website for information of the candidates. The Registrar will also 72 ensure that the website of the University is updated and has current information about the University such as a brief history, objectives and mission statement, jurisdictions, number of affiliated colleges / institutions, student strength, major achievements, etc.

8. All the applications have to be in the format prescribed by the MHRD.

Nominated and invited candidates as well as those have responded to the notification must sent their CV in the prescribed format, so as to reach the Nodal Officer within the timeframe notified. Applications / nominations received after the stipulated last date will not be considered.

9. The Search Committee, after careful study of the documents mentioned above, will shortlist not less than six (6) and not more than ten (10) candidates, subject to fulfillment of essential qualifications and experience for interactions (s) with the Committee. The Committee shall ensure that those selected for interaction with the Committee fulfill all the essential eligibility criteria mentioned in the notification in this regard.

10. Each of the candidates called for interactions with the Search Committee / Chancellor will be provided economy class airfare and one day‘s stay in the guest house of the University/related institutions. The Nodal Officer / concerned University, as the case may be, will arrange payment of economy class airfare and one day‘s stay in the guest house of the University / related institutions.

11. These candidates will be given atleast ten (10) days‘ notice. They are expected to submit a write-up in two pages about their suitability for the position, two pages about their vision for the University and names of three referees along with reference letter and make a presentation of not more than 10 minutes duration, before the Search Committee highlighting their achievements and their vision for the University. The Search Committee may provide time of about 10 minutes to each candidate for interaction after the presentation.

12. The Search Committee will then prepare a panel of three candidates who fulfill all the essential qualifications and experience in alphabetical order with a brief write-up of their suitability and submit it to the Chancellor.

13. While submitting the recommendation along with a brief write-up, the Committee shall mention that all the persons in the panel possess all essential qualifications‘ and experience prescribed under the Act of the University and rules and regulations framed thereunder.

14. The cost for travel and stay of the member of the Search Committee during their meetings, publishing notification, interaction / meeting with the candidates (their TA / DA), cost of other help, if any, will be borne by the concerned University. The members of the Search Committee may use IT tools and optimize the cost required to select the candidates for the post of Vice-Chancellor.

Suggested Timelines:

 First meeting with the Chancellor to brief the Search Committee: Within 10 days from the date of appointment of the Search Commitment  Publication of advertisement: Within 10 days from the date of briefing meeting.

 Last date for receipt of applications / nominations: Within one month from the date of publication of the advertisement. Within this time the Convenor and Members are expected to send the letters to individuals and institutes requesting nominations.

 Scrutiny of applications and preparation of summary: 10 days from the last date for receipt of applications.

 Shortlisting of candidates for interaction with the Search Committee:

30 days from the last date for receipt of applications.

 Interaction of short-listed candidates with the Search Committee: Within 45 days from the last date for receipt of applications.

 Submission of Panel of recommended candidates to the Chancellor:

Preferably on the last date of the interaction with the candidates and in any case not later than four months from the date of constitution of the Search Committee.

Honorarium:

1. The Convener and Members of the Search Committee are entitled for air travel, lodging, boarding and transportation. The expenses on this account will be borne by the concerned University.

2. The Convener of the Search Committee will be paid an honorarium of Rs.25,000/- and Members will be paid an honorarium of Rs.20,000/- each.

This honorarium is apart from the travel fare, lodging, boarding and transportation cost.

3. An all-inclusive remuneration of Rs.75,000/- will be paid to the Nodal Officer of the Search Committee (including supporting staff) for rendering secretarial assistance to the Search Committee.

13. The Chancellor shall appoint one of the persons whose names are given in the panel as the Vice-Chancellor.

Salary of the Vice-Chancellor.

14. There shall be paid to the Vice-Chancellor a fixed salary as prescribed by the University Grants Commission, from time to time and approved by the State Government and he shall be entitled, without payment of rent to the use of the furnished residence throughout his term of office, and no charge shall fall on the Vice-Chancellor personally in respect of the maintenance of such residence.

Travelling Allowance.

15. The Vice-Chancellor shall be entitled to travelling allowances at such rates as may be fixed by the Syndicate.

16. (i) The Vice-Chancellor shall be entitled to such terminal benefits and allowances as may be fixed by the Syndicate with the approval of the Chancellor from time to time:

Provided that, where an employee of –

(a) the University; or

(b) any other University or college or institution maintained by, or affiliated to that university is appointed as Vice-Chancellor, he shall be allowed to continue to contribute to the Provident Fund to which he is a subscriber, and the contribution of the university shall be limited to what he had been contributing immediately before his appointment as Vice-Chancellor;

(ii) The Vice-Chancellor shall be entitled to earned leave on full pay at one-eleventh of the periods spent by him on active service:

Provided that when the earned leave applied for by the Vice-Chancellor, in sufficient time before the date of expiry of the term of his office, is refused by the Chancellor in the interest of the University and if he does not avail of the leave 75 before the date of expiry of the term of his office, he shall be entitled to draw cash equivalent to leave salary after relinquishment of his office in respect of earned leave at his credit subject to a maximum of two hundred and forty days;

(iii) The Vice-Chancellor shall be entitled, on medical grounds or otherwise, to leave without pay for a period not exceeding three months during the term of his office:

Provided that such leave may be converted into leave on full pay to the extent to which he is entitled to earned leave under clause (iii).

(iv) The Chancellor shall sanction all leave except casual leave to the Vice-Chancellor.

Arrangements during absence.

17. The Syndicate shall have power, subject to the approval of the Chancellor, to make such arrangements as may be necessary for exercising the powers and performing the duties of the Vice-Chancellor during his absence on leave.

Deputation of Vice-Chancellor.

18. The Vice-Chancellor may be deputed by the Syndicate on University business or at the request of the Government on Government business or in the public interest to any part of India or outside India. The period of deputation outside the Madurai Kamaraj University area shall not exceed one month. It shall be competent for the Syndicate to make the requisite arrangements for exercising the powers and performing the duties of the Vice-Chancellor during the period of deputation, provided that the arrangements made shall be such as not to entail any additional expenditure to the University.

CHAPTER – VI THE REGISTRAR, THE CONTROLLER OF EXAMINATIONS, THE SENIOR DEPUTY REGISTRARS, DEPUTY REGISTRARS, ASSISTANT REGISTRARS AND THE PUBLIC RELATIONS OFFICER.

Appointment of Registrar.

1. The Registrar shall be appointed by the Syndicate subject to the confirmation of the Senate.

(a) The selection of the Registrar shall be done by a Committee.

The Selection Committee should have the following composition:

i. The Vice-Chancellor to be the Chairperson of the Selection Committee.

ii. An academician who is the nominee of the Chancellor.

iii. Three experts out of the list recommended by the Vice-Chancellor and approved by the Syndicate.

iv. Dean Faculty v. Chairperson / Professor of the Department.

Atleast four members including two outside experts must constitute the quorum.

A representative of SC/ST, women and physically handicapped persons, shall be in the Selection Committee whenever a candidate from any of these categories appears for the interview.

Tenure of office and re-appointment.

2. The Registrar shall hold office for a period of three years. He shall be eligible for reappointment for another term. However, the Registrar shall not continue to hold office after the attainment of fifty-eight years.

Power of Syndicate to dispense with Registrar’s services. Notice of Resignation.

3. It shall be in the power of the Syndicate to dispense with the services of the Registrar at any time after giving him six months notice or on payment to him of six months‘ salary in lieu of notice and it may at any time discharge him from its service without notice or compensation in the event of misconduct on his part or of a breach by him of any of the conditions on which he was engaged.

78 In case the Registrar should wish to resign his office, he shall give six months‘ notice of his intention to resign.

Limit of service.

4. The Registrar shall not continue to hold the office after the attainment of fifty eight years of age unless on the recommendation of the Syndicate, the Senate shall have extended his tenure of office for a specified period beyond 58 years.

That the existing Statute 4 of Chapter VI be deleted.

Salary and Allowances.

5. The Registrar shall be paid a salary in the scale of pay applicable to the University Professor from time to time.

The Registrar shall be entitled, without payment of rent to the use of the furnished residence throughout his term of office, and no charge shall fall on the Registrar personally in respect of the maintenance of such residence. He shall not be eligible for House Rent Allowance.

Conditions of service.

6. The Registrar shall devote his whole time to the duties of his office, and shall not absent himself from his duties without the permission of the Syndicate.

Leave.

7. The Syndicate may grant to the Registrar leave of absence according to the rules (Fundamental rules and Madras Leave rules) Governing leave and leave allowances to the State Government Officers.

Duties of Registrar.

8. It shall be the duty of the Registrar - (a) to be the custodian of the records, common seal, and such other property of the University as the Syndicate shall commit to his charge.

(b) to act as Secretary to the Syndicate and to attend all meetings of the Senate, Academic Council, Faculties, Syndicate and any Committees appointed by these authorities and to keep minutes thereof.

(c) to conduct the official correspondence of the Syndicate and the Senate.

(d) to issue all notices convening meetings of the Senate, Academic Council, Faculties, Syndicate, Finance Committee, Boards of Studies, and any Committees appointed by these authorities;

(e) to perform such other work as may be form time to time prescribed by the Syndicate and generally to render such assistance as may be desired by the Vice-Chancellor in the performance of his official duties.

(f) To call for quotations and tenders wherever necessary and prepare comparative statements, scrutinize the quotations and tenders and place it before the Vice-Chancellor.

(g) To sign contracts and other agreements on behalf of the University under the direction of the Vice-Chancellor or Syndicate, as the case may be.

(h) To order for the transfer of non-teaching in inferior service; and in respect of the superior service staff he shall place the transfer list before the Vice-Chancellor for approval.

(i) When the office of the Registrar is vacant or when the Registrar is, by reason of illness, absence or any other cause, unable to perform the duties of his office, the duties of the office of the Registrar shall be performed by such person as the Vice-Chancellor may appoint for the purpose with the approval of the Syndicate. (as per Governor's office letter dated 09.11.2010).

Gratuity or pension.

9. The Syndicate may grant to the Registrar Gratuity and / or pension as laid down in the scheme for teachers of the University incorporated in Chapter VIII of the Laws of the University.

10. Notwithstanding anything in the foregoing statutes, when an officer of Government is appointed as the Registrar on foreign service terms, his salary and allowances shall be such as may be fixed by the Syndicate from time to time.

Access to University Records.

11. The Registrar shall, on application previously made for the purpose of fixing a convenient hour, arrange that any member of the Senate, of the Academic Council, of the Syndicate, or of a faculty, shall have access to the proceedings of the Senate, Syndicate, Academic Council or faculty, respectively, and to any documents connected with such proceedings.

80 Controller of Examinations.

12. It shall be competent for the Syndicate to appoint a Controller of Examinations on the recommendations of the Committee constituted for the purpose and the composition of the Committee shall be as mentioned in Chapter VIII for the post of the Professor and the salary of the Controller of Examinations shall be as prescribed by the University Grants Commission, from time to time and approved by the Government. His term of appointment shall be for a period of three years. He shall be eligible for reappointment for another term of three years. However, he shall not continue to hold the office after the attainment of fifty-eight years of age. He shall be in charge of conduct of examination of the University and matters relating thereto and shall perform such other duties as may be prescribed by the Statutes or as required by the Vice-Chancellor. He shall route all papers having a bearing on the University Administration or on the decisions of any of the bodies of the University through the Registrar. It shall be the duty of the Controller of Examinations to be the custodian of the records pertaining to examinations and to issue all notices convening meetings of the Boards of question paper setters and Boards of Examiners and any committees appointed by the authorities in connection with the examinations.

He shall perform such other work as may be from time to time prescribed by the Syndicate and generally render such assistance as may be desired by the Vice-Chancellor in the performance of his official duties.

Senior Deputy Registrars.

12 (a). It shall be competent for the Syndicate to appoint Senior Deputy Registrars in the scale of pay prescribed by the Syndicate from time to time.

He shall devote his whole time to the duties of his office, and shall perform such work as may from time to time be laid down by the Syndicate and generally render such assistance as may be desired by the Registrar in the performance of his official duties.

Additional Controller of Examinations.

12 (b). It shall be competent for the Syndicate to appoint an Additional Controller of Examinations in the grade of the Professor of the University. He shall hold office for a period of three years. He shall be eligible for reappointment for another term of three years. However, he shall not continue to hold the office after the attainment of fifty-eight years of age.

81 Deputy Registrars.

13. It shall be competent for the Syndicate to appoint Deputy Registrars in the scale of pay prescribed by the Syndicate from time to time. They shall devote their whole time to the duties of their office, and shall perform such work as may from time to time be laid down by the Syndicate and generally render such assistance as may be desired by the Registrar in the performance of his official duties.

Assistant Registrars.

14. It shall be competent for the Syndicate to appoint Assistant Registrars in the scale of pay prescribed by the Syndicate from time to time. They shall devote their whole time to the duties of their office and shall perform such work as may from time to time be laid down by the Syndicate, and generally render such assistance as may be desired by the Registrar in the performance of his official duties.

Public Relations Officer.

15. It shall be competent for the Syndicate to appoint a Public Relations officer in the cadre of the Assistant Registrar and above. He shall devote his whole time to the duties of his office and shall perform such work as may from time to time be laid down by the Syndicate and generally render such assistance as may be desired by the Registrar in the performance of his official duties.

16. The Controller of Examinations, the Additional Controller of Examinations, the Senior Deputy Registrars, Deputy Registrars, Assistant Registrars and the Public Relations Officer shall be governed as regards leave, Provident Fund, gratuity, pension and retirement by the Statutes and Ordinances governing conditions of service of the establishment of the University contained in Chapter XXIV of the Laws of the University, Volume I in so far as they apply.

CHAPTER – VII UNIVERSITY DEPARTMENTS Statute. University Departments of Study and Research.

1. A University Department of Study and Research is one established by Statute and under the direct control of the University and /or such associate department run by other institutions which are recognized by the Syndicate without causing any financial commitment to the University.

Statute. Subjects - Provision of Schools / Departments.

2. There shall be in the University, the following Schools comprising the relevant departments of study, research and / or teaching in the following branches of knowledge: (1) School of Biological Sciences comprising the departments of Bio-chemistry, Immunology, Microbial Technology, Genetics, Plant Sciences, Animal Behaviour and Physiology, Molecular Biology, and Plant Morphology and Algology.

(2) School of Biotechnology comprising the departments of Genetic Engineering, Molecular Microbiology and Plant Biotechnology.

(3) School of Chemistry comprising the departments of Organic Chemistry, Inorganic Chemistry, Physical Chemistry, Natural Products Chemistry and Materials Science.

(4) School of Energy, Environment and Natural Resources comprising the departments of Solar Energy, Environmental Studies, Bio-Energy, Natural Resources and Waste Recycling and Futures Studies and Marine and Coastal Studies.

(5) School of Earth and Atmospheric Sciences comprising the departments of Geography, Environmental Remote Sensing and Cartography and Futures Studies.

(6) School of Mathematics comprising the departments of Mathematics, and Applied Mathematics.

(7) School of Physics comprising the departments of Physics, Theoretical Physics, Computational Physics and Laser Studies.

CHAPTER – VIII UNIVERSITY PROFESSORSHIPS, EMERITUS PROFESSORSHIPS / SENIOR PROFESSORSHIPS, READERSHIPS AND LECTURERSHIPS;

UNIVERSITY LECTURES.

Power to institute Professorships, etc.,

1. The Senate shall have power to determine from time to time, after considering the recommendations of the Academic Council and the Syndicate, the subjects for which Professorships, Readership, Lectureships, or other teaching posts should be instituted and the several terms and the several terms and the conditions subject to which such Professorships, Readerships, Lectureships or other Teaching posts should be instituted.

Abolition or suspension of Professorships, etc.,

2. The Senate shall have power to suspend or abolish an Professorships, Readerships, Lectureships or other teaching posts after report from the Syndicate and the Academic Council thereon.

Classes of Teachers.

3. Teachers of the University shall be of three classes: Professors, Readers and Lecturers. The duties of Readers and Lecturers shall be (a) to teach and

(b) to engage in research. The duties of Professors shall include in addition to teaching and research the guidance and co-ordination of studies in their subjects in consultation and co-operation with the colleges.

The post of Research Assistant / Research Associate in Madurai Kamaraj University shall be treated as Academic posts.

Emeritus Professor.

3-A. Notwithstanding anything contained in the Statutes, it shall be competent for the Syndicate to appoint distinguished Professors of repute who have retired from the services of this or of any other University or an affiliated college of this or of other University as Emeritus Professors on such terms as may be decided upon by the Syndicate.

85 University Senior Professorships.

3-B. a. it shall be competent for the Syndicate to appoint Senior Professors from among the Professors in the University departments on the basis of the following criteria:

i. A minimum of 10 years of service as Professor in a University:

ii. A distinguished record or research both nationally and internationally:

iii. Recognised capacity for competence in teaching:

iv. General contribution to the life of the University.

b. In making Senior Professor appointments, the Syndicate shall adhere to a ceiling of 33 1/3 percent of all professors posts existing and occupied at any one time.

Note: Senior Professor‘s scale of pay will be Rs.1,600-100-1,800 or as may be fixed from time to time.

Honorary Teachers.

4. It shall be open to the Syndicate to appoint Teachers of the University without Salary to take part in University work in their respective Subjects.

Power to suspend Teachers.

5. The Syndicate shall have power, upon sufficient cause shown and after due investigation, by a resolution approved by not less than two-thirds of the members of the Syndicate, to suspend any Teacher of the University from office and from the emoluments thereof in whole or in part for any period not exceeding one year, or to require him to retire, or to deprive him of office and during the suspension of any Teacher to make provision for his work; provided no such sentence of suspension, etc., shall have effect until approved by the Chancellor.

FULL-TIME TEACHERS OF THE UNIVERSITY Committee to appoint Teachers.

6. Full time teachers of the University shall be selected for appointment by a Committee with the following composition:

For Selection of Lecturer:

1. The Vice-Chancellor to be the Chairperson of the Selection Committee.

2. Three experts in the concerned subject, to be invited on the basis of the list recommended by the Vice-Chancellor and approved by the Syndicate.

3. Dean of the concerned Faculty / Head / Chairperson of the Department.

4. An academician nominated by the Chancellor.

The quorum should be four out of which at least two outside subject-experts must be present.

For Selection of Reader:

The process of selection should involve inviting the bio-data and reprints of three major publications of the candidate before interview and getting them assessed by the same three external experts, who are to be invited to interview the candidate. The Selection Committee should have the following composition:

1. The Vice-Chancellor to be the Chairperson of the Selection Committee.

2. An academician who is the nominee of the Chancellor.

3. Three experts in the concerned subject/field, out of the list recommended by the Vice-Chancellor and approved by the Syndicate.

4. Dean of the Faculty.

5. Head/Chairperson of the Department.

Atleast four members including two outside experts, must constitute the quorum.

For Selection of Professor:

The process of selection should involve inviting the bio-data and reprints of three major publications of which one could be book or a research report, before the interview, and getting them assessed by the same three external experts who are to be invited for the interview. The assessment report must be placed before the Selection Committee. The composition of the Selection Committee for the post of a Professor shall be the same as for the post of a Reader.

Selection Committees for the posts of Directors, Deputy Directors, Assistant Director of Physical Education, Registrars, Deputy Registrars, Assistant Registrars, Librarians, Deputy Librarians and Assistant Librarians shall be the same as that of Professor, Reader and Lecturer respectively, except that the concerned expert in 87 Physical Education or Administration of Library Science, as the case may be, shall be associated with the Selection Committee.

A representative of SC/ST, women and physically handicapped persons, shall be in the Selection Committee whenever a candidate from any of these categories appears for the interview.

Notwithstanding anything contained in the foregoing, it shall be competent for the Syndicate to promote on a subsequent date to the higher grade of Professor any person who was originally appointed in the grade of Reader and Head of the Department under the above procedure, provided that the original appointment of Reader as Head of the Department was made in exercise of the discretion left to the Syndicate to appoint any person either in the grade of Reader or in the grade of Professor.

Notwithstanding anything contained in the foregoing, it shall also be competent for the Syndicate to promote on a subsequent date to the higher grade of Professor or Reader, any one who was originally appointed in a lower grade, provided such Professorships or Readerships have been instituted by the Senate after consulting the Academic Council, in order to be available for promotion of Teachers belonging to a specified category of University Departments.

Term of Office.

7. Except in the case of experienced men who have already gained distinction in their subject and who are being appointed as Professors, appointment shall be in the first instance for a term of one year and shall be subject to confirmation at the end of that period. Thereafter the appointment shall be permanent, subject to an age limit which shall be 60 years subject to the provisions of Law 5 of Chapter VIII.

A member of the teaching staff may be permitted to retire after attaining the age of 55 on proportionate pension.

‗Any member of the teaching staff who attains the age of 60 years in the middle of an academic year may be permitted to continue till the end of that academic year‘.

7-A. All appointments in the University departments either as professors, readers or lecturers shall be on probation for a period of two years and shall be subject to confirmation at the end of that period.

‗Provided that a teacher who has satisfactorily completed his probation in a lower teaching post and has been confirmed in the post shall not be required to put 88 in a further period of probation if he is appointed to a higher teaching post subsequently‘.

Short term appointments.

8. Nothing in Statute 7 shall prevent the establishment in special cases of short term appointments with special arrangements as regards salary.

Conditions of service.

9. A paid teacher of the University shall not engage in remunerative work other than that of his office without the express permission of the Syndicate.

‗Provided that any member of teaching staff of the University who applies for positions in other institutions and Universities and who seeks relief, after getting selected, should give three months notice to the University or pay three months salary in lieu of such notice‘.

Pension – cum Provident fund cum - Gratuity cum – Insurance.

10. The rules followed by the Government of Tamil Nadu in the Tamil Nadu Pension rules as amended from time to time are made applicable to the teachers of the University, w.e.f. 1.4.1976 for the payment of retirement benefits.

Provided this will not affect the existing cases of pension granted before the implementation of these rules.

Gratuity–cum–Pension–cum–Insurance Scheme for Teachers of the University.

Gratuity–cum–Pension–cum–Insurance Scheme for Teachers of the University who have served in Aided / Govt. Colleges in Tamil Nadu prior to their appointment in this University: 1. A separate pension fund shall be constituted by the University if it is not already in existence with (a) Contribution from the University and (b) from other sources as may be deemed necessary by the University from time to time and it shall pay in respect of each of its employee eligible for pension at such rates as may be prescribed by the Government on behalf of their employees on foreign service.

2. Pensioners who retire from University service shall be paid only from out of this pension fund.

3. The surplus under pension fund which are not required for immediate disbursement of pension shall be invested in various nationalized banks as is being done in case of surplus funds under other University accounts.

4. In respect of teachers who get themselves appointed in this University after having served in some other Aided / Government colleges shall have the pension funds accumulated in other colleges for the period of their services transferred to this University. In case of colleges from where the teachers come to this University does not have pension scheme, the pensioner may himself / herself pay such amount that would have accumulated in the pension fund if the college where he / she has previously serving, has pension scheme and has maintained pension fund.

5. The University shall bear the pensionary liabilities for the entire qualifying service rendered in the Government Colleges and aided colleges by both Teaching and Non-Teaching staff. This provision shall be applicable to those employees who were on University service as on 6.10.1993 and to those who take up appointment in the University thereafter.

6. The University shall bear the pensionary liability for the entire qualifying service including the services rendered in Government and also to the past services of teachers in Aided Colleges who take up appointment in the University and the pensionary liability for the past services shall be taken over by the University.

7. Gratuity-cum-Pension-cum-Insurance Scheme for Teachers of the University who have served in Aided / Govt. / Schools in Tamil Nadu prior to their appointment in the university:

The services rendered by University Teachers in Schools for retirement benefits will be taken as qualifying service subject to the condition that pensionary contribution together with interest should be paid by the individual or institution.

8. The audit objections pending against a deceased employee shall be deemed to have been settled on the date of his death, and disciplinary proceeding pending or contemplated with reference to the audit objections shall on the date of his death be deemed to have been dropped.

9. The Death-cum-Retirement-cum-Gratuity and other retirement benefits due to the family of a deceased employee shall not be withheld on the ground that audit objections involving financial loss or irregularities pending against him and that audit objections have to be settled and that disciplinary action is pending or contemplated against him.

With effect from 30.11.1993 90

10. A new contributory pension introduced as in G.O. in No.259 Finance (Pension) Dept. dated 6.8.2003 shall apply to the employees appointed / newly recruited on or after 1.4.2003 in the University.

Teachers who are elected / nominated to Parliament or State Legislature will be required to take leave of absence during their term as member. However, in this process they will not be losing their seniority or increments.

This will come into effect from the academic year 1987-88.

10-A. In cases where a teacher serving in one University is appointed in another University, and if the appointment is temporary and considered as deputation, the latter University, or the individual himself, shall pay the contribution to the parent University and thereby count his/her service for retirement benefits and the parent University shall settle the retirement benefits on his/her retirement.

10-B. The adoption of the G. O. Ms. No. 404 Finance (BPE) Dept.

dated 06.06.1991 in this University, regarding terminal benefits and counting of service for pension of the employee of Central Govt. / Central Autonomous Bodies absorbed in the State Govt. / State Autonomous Bodies and vice-versa.

Teacher to remain in Madurai during term time.

11. Teachers of the University shall be required to live in Madurai except during the vacation time and during ordinary or combined leave. Permission to leave Madurai during term time may be granted by the Syndicate or in a case of urgency by the Vice-Chancellor.

Holidays and Vacation.

12. Full-time Teachers of the University shall be entitled to a summer vacation of two months from the 1 st of May to the 30 th June (both days inclusive) and all gazette holidays in addition to those fixed by the Syndicate.

Power to grant leave.

13. The Syndicate shall have power to grant leave to Teachers of the University and to pay leave allowances, in accordance with such rules as may be prescribed.

Leave and leave allowances.

14. Leave cannot be claimed as of right; and when the exigencies of the University so require, discretion to the refuse or revoke leave of any description is reserved to authority empowered to grant it viz., the Syndicate.

15. a) Casual leave may be granted upto a limit of 12 days in a Calendar year;

but absence on casual leave shall be treated as duty for the purpose of calculation of other leave. The maximum period for which a University teacher may absent himself continuously on casual leave (including holidays) shall not exceed ten days.

b) In addition a Special Casual Leave of 15 days in a Calendar year be granted by the Vice-Chancellor for academic work, either, the work is remunerative or non-remunerative.

c) The teachers may be deputed with or without financial assistance from the University for the purposes of attending Seminars, Symposiums and Conferences or acting as members of Committees constituted by the University Grants Commission, State and Central Governments, and for presenting project reports, attending refresher courses, orientation courses and advanced colleges etc., and the period of absence may be treated as on ―Other Duty‖ d) In addition, a special casual leave not exceeding 8 days to married men teachers who undergo sterilization operation and not exceeding 20 days to married women teachers who undergo non-puerperal sterilization operation be granted by the Vice-Chancellor in the case of Head of Departments and others by the Registrar.

e) In addition to the casual leave mentioned in (a), the teachers are also eligible for two days of restricted holidays.

NOTE:

1. The teachers should produce the invitation / selection letter in their names. Teachers must either be an evaluator of the Seminar of Chairman of the panel or President/Moderator of the session or paper presenter or a discussant participant etc.

2. A teacher can attend seminar / conferences / symposium / workshops / refresher courses / orientation courses / advanced colleges, all of this disciplines or related areas conducted by the agencies recognized by the Universities / UGC and by other reputed agencies at Local, National and International level.

3. Deputation can be granted to the teachers after alternative arrangements are made by the Head of the Department and concerned staff.

4. The participation in the Seminars etc., is limited to one of Regional / National in a year if the teacher is availing of University funds. Priority should be given to those who have not attended the seminars during the current and 92 or proceeding academic years. This restriction does not apply to those who do not depend on University funds.

16. Ordinary leave on half salary will be earned by a Teacher of the University at the rate of one month for every academic year, including the summer vacation, with the privilege of accumulating such leave upto a maximum period of sixteen months.

16-A. University teacher will be allowed to surrender 15 days of ordinary leave on full pay (30 days ordinary leave on half pay commuted into full pay) once in 12 months and 30 days of ordinary leave on full pay (60 days of ordinary leave on half pay commuted into full pay) once in 24 months without actually going on leave.

*17. Ordinary leave on half salary earned by a Teacher of the University be converted into ordinary leave on full salary for half the period at the option of the Teacher; and ordinary leave on half salary or on full salary may be combined with the vacation, provided that the combined leave does not exceed six months.

17-A. The University teachers shall be permitted to encash the ordinary leave to their credit at the time of retirement or death, while in service subject to a maximum of sixteen months ordinary leave on half pay commuted into eight months ordinary leave on full pay.

17-B. Teachers who are elected / nominated to Parliament or State Legislature will be required to take leave of absence during their term as member. However, in this process they will not be losing their seniority or increments.

Leave on Private Affairs.

17-C. (a) The unearned leave on private affairs shall be granted to permanent University teachers for a period of 3 months for the first 10 years of service which may be carried forward beyond 10 years when alone the University teachers shall be made eligible for full period of 6 months.

(b) The leave on private affairs may be combined with ordinary leave but the total amount of leave so combined, admissible at any one time, shall be limited to six months.

(c) Fifty per cent of leave on private affairs standing to the credit on the retirement of University teachers shall be encashed by the teachers subject to a maximum of 90 days.

18. The Syndicate shall grant Study leave and Sabbatical leave / academic leave etc. to the permanent whole-time teachers as per the following norms laid down by the University Grants Commission.

Study Leave:

(i) Study leave may be granted after a minimum of 3 years of continuous service, to pursue a special line of study or research directly related to his / her work in the university or to make a special study of the various aspects of university organization and methods of education. The paid period of study leave should be for 3 years, but 2 years may be given in the first instance, extendable by one more year, if there is adequate progress as reported by the Research Guide.

Provided that the Syndicate may, in the special circumstances of a case, waive the condition of three years service; being continuous.

Explanation: In computing the length of service, the time during which a person was on probation or engaged as a research assistant may be reckoned provided – (a) the person is a teacher on the date of the application; and

(b) there is no break in service.

(ii) Study leave shall be granted by the Syndicate on the recommendation of the concerned Head of the Department. The leave shall not be granted for more than three years in one spell, save in very exceptional cases in which the Syndicate is satisfied that such extension is unavoidable on academic grounds and necessary in the interest of the university.

(iii) Study leave shall not be granted to a teacher who is due to retire within five years of the date on which he/she is expected to return to duty after the expiry of study leave.

(iv) Study leave may be granted not more than twice during one‘s career.

However, the maximum of study leave admissible during the entire service should not exceed five years.

(v) No teacher who has been granted study leave shall be permitted to alter substantially the course of study or the programme of research without the permission of the Syndicate. When the course of study falls short of study leave sanctioned, the teacher shall resume duty on the conclusion of the course of study unless the previous approval of the Syndicate to treat the period of shortfall as ordinary leave has been obtained.

(vi) (a) Subject to the provisions of sub-clauses (vii) and (viii) below, study leave may be granted on full pay upto two years extendable by one year at the discretion of the university.

(vii) The amount of scholarship, fellowship or other financial assistance that a teacher, granted study leave, has been awarded will not preclude his / her being granted study leave with pay and allowances but the scholarship, etc., so received shall be taken into account in determining the pay and allowance on which the study leave may be granted. The Foreign scholarship / fellowship would be offset against pay only if the fellowship is above a specified amount, which is to be determined from time to time, based on the cost of living for a family in the country in which the study is to be undertaken. In the case of an Indian fellowship, which exceeds the salary of the teacher, the salary would be forfeited.

(viii) Subject to the maximum period of absence from duty on leave not exceeding three years, study leave may be combined with earned leave, half-pay leave, extraordinary leave or vacation, provided that the earned leave at the credit of the teacher shall be availed of at the discretion of the teacher. A teacher who is selected to a higher post during study leave, will be placed in that position and get the higher scale only after joining the post.

(ix) A teacher granted study leave shall on his / her return and rejoining the service of the university may be eligible to the benefit of the annual increment(s) which he / she would have earned in the course of time if he / she had not proceeded on study leave. No teacher shall however, be eligible to receive arrears of increments.

(x) Study leave shall count as service for pension / contributory provided fund, provided the teacher joins the university on the expiry of his / her study leave.

(xi) Study leave granted to a teacher shall be deemed to be cancelled in case it is not availed of within 12 months of its sanction.

Provided that where study leave granted has been so cancelled, the teacher may apply again for such leave.

(xii) A teacher availing himself / herself of study leave shall undertake that he/she shall serve the university for a continuous period of at least three years to be calculated from the date of his / her resuming duty after expiry of the study leave.

(xiii) After the leave has been sanctioned, the teacher shall, before availing himself / herself of the leave, execute a bond in favour of the university, binding himself / herself for the due fulfillment of the conditions laid down in sub-clause

(xiii) and (xiv) and give security of immovable property to the satisfaction of the Syndicate or a fidelity bond of an insurance company or a guarantee by a scheduled bank or furnish security of two permanent teachers for the amount which might become refundable to the university in accordance with sub-clause (xiv).

(xiv) The teacher shall submit to the Registrar, six monthly reports of progress in his / her studies from his / her supervisor or the Head of the Institution.

This report shall reach the Registrar within one month of the expiry of every six months of the study leave. If the report does not reach the Registrar within the specified time, the payment of leave salary may be deferred till the receipt of such report.

Sabbatical Leave:

(i) Permanent, whole-time teachers of the University who have completed seven years of service as Lecturer Selection Grade / Reader or Professor, may be granted sabbatical leave to undertake study or research or other academic pursuit solely for the object of increasing their proficiency and usefulness to the university and higher education system.

(ii) The duration of leave shall not exceed one year at a time and two years in the entire career of a teacher.

(iii) A teacher who has availed himself/herself of study leave, would not be entitled to the sabbatical leave.

Provided further that sabbatical leave shall not be granted until after the expiry of five years from the date of the teacher‘s return from previous study leave or any other kind of training programme.

(iv) A teacher shall, during the period of sabbatical leave, be paid full pay and allowances (subject to the prescribed conditions being fulfilled) at the rates applicable to him / her immediately prior to his / her proceeding on sabbatical leave.

(v) A teacher on sabbatical leave shall not take up during the period of that leave, any regular appointment under another organization in India or abroad.

He / she may, however, be allowed to accept a fellowship or a research scholarship or adhoc teaching and research assignment with honorarium or any other form of assistance, other than regular employment in an institution of advanced studies, provided that in such cases the Syndicate may, if it so desires, sanction sabbatical leave on reduced pay and allowances.

(vi) During the period of sabbatical leave, the teacher shall be allowed to draw the increment on the due date. The period of leave shall also count as service for purposes of pension/contributory provided fund, provided that the teacher rejoins the university on the expiry of his / her leave.

96 Note –1: The programme to be followed during sabbatical leave shall be submitted to the university for approval along with the application for grant of leave.

Note – 2: On return from leave, the teacher shall report to the University the nature of studies, research or other work undertaken during the period of leave.

Maternity Leave:

(i) Maternity leave on full pay may be granted to a woman teacher for a period not exceeding 135 days, to be availed of twice in the entire career. Maternity leave may also be granted in case of miscarriage including abortion, subject to the condition that the total leave granted in respect of this to a woman teacher in her career is not more than 45 days, and the application for leave is supported by a medical certificate.

(ii) Maternity leave may be combined with earned leave, half pay leave or extraordinary leave but any leave applied for in continuation of maternity leave may be granted if the request is supported by a medical certificate.

Paternity Leave.

Paternity leave of 15 days may be granted to male teachers during the confinement of their wives, provided, the limit is upto two children.

Adoption leave.

Adoption leave may be provided as per the rules of the Central Government.

Duty leave.

Duty leave should be given also for attending meetings in the UGC, DST etc.

Where a teacher invited to share expertise with academic bodies, government or NGO.

19. Salary during leave will be paid in rupees in India, or at the current rate of exchange in London when the leave is taken out of India.

20. Leave not earned may be granted to a Teacher subject to the following conditions:

1. The Un-Earned Leave on Medical Certificate to the teaching staff be enhanced from 12 months to 18 months with full pay;

2. The 18 months of Un-Earned Leave on Medical Certificate to the teaching staff be regulate proportionately according to the length of service as follows:

Service Period Leave Eligible Upto 5 years …… 90 days More than 5 years but Less than 10 years ……. 180 days More than 10 years but Less than 15 years …… 270 days More than 15 years but Less than 20 years …… 360 days More than 20 years …… 540 days PROFESSORS Duties.

21. It shall be the duty of a University Professor, as the Syndicate may direct, to deliver lectures, to conduct classes, to engage in research and do any other academical work related to the subject of his chair.

The Registrar shall request the Boards of Studies to submit to the Syndicate by the 31 st March each year recommendations as to any course of lectures to be delivered by University Professors.

22. It shall be the duty of a University Professor to direct and supervise the work of research students in branches of knowledge related to the subject of his chair.

23. A University Professor shall, if so required, advise the Academic Council or the Syndicate with regard to any University course of study or examination or on other matters relating to the subject connected with the chair.

READERS AND LECTURERS Readers and Lecturers Duties.

24. In a department in which there is a University Professor, Readers and Lecturers shall work under the direction of the Professor concerned with the subject, and shall assist him in the performance of his duties as defined in Laws 21, 22 and 23 of this chapter. In a department if there is more than one professor, one of them shall be designated by the Syndicate as the head of the department.

The other professors, readers and lecturers shall work under the direction of the head of the department. In departments in which there is no Professor, a Reader 98 shall be the Head of the department and the Lecturers if any, shall assist him and work under his direction. In departments in which there is no Professor or Reader, the Lecturer, or the Senior Lecturer, if there are more lecturers than one shall be the Head of the Department.

It shall be obligatory on the part of the University teachers to do invigilation, supervision or any other work connected with the University examination conducted by the University which he is required to do so by the Vice-Chancellor or Registrar as the case may be.

Duties – holders of particular Posts.

25. The special duties of the holders of particular posts shall be such as may be prescribed.

PART TIME TEACHERS

26. Part-time Teachers of the University shall be appointed only for special reasons, shall ordinarily be chosen from amongst the members of the staff of the affiliated colleges and shall perform such duties as may be assigned to them.

27. They shall be appointed for such periods and paid such salaries as may be fixed in each case regard being had to the grade of the teacher and to the amount of time he is to devote to the work of the University. They shall be entitled to a summer vacation of two months from the 1 st of May to 30 th of June (both days inclusive) and all Gazetted holidays in addition to those fixed by the Syndicate.

UNIVERSITY LECTURES

28. The Syndicate shall have the power in consultation with the Boards of Studies to make from time to time arrangements for lectures or courses of lectures on such subjects as the Syndicate may select.

29. Notwithstanding anything contained in the foregoing Statutes, in the absence of any specific rules in existence in the University Statutes, the rules / orders of the Government of Tamil Nadu as applicable to the Government employees be followed in the case of University employees in similar circumstances.

Note: In the above Laws, wherever the words ―Department‖ or ―Departments‖ occur, they shall be taken to mean the University Departments of Study and Research.

CHAPTER – IX THE AUTHORITIES OF THE UNIVERSITY General Act S. 14. Authorities of the University.

1. The following shall be the authorities of the University:

(1) the Senate,

(2) the Syndicate,

(3) the Academic Council,

(4) the Faculties,

(5) the Finance Committee,

(6) the Boards of Studies, and

(7) such other bodies as may be declared by the Statutes to be authorities of the University.

Act S. 41. Filling of casual vacancies.

2. All casual vacancies among the members (other than ex-officio members) of any authority or other body of the University shall be filled as soon as conveniently may be, by the person or body who or which nominated or elected the member whose place has become vacant and the person nominated or elected to a casual vacancy shall be a member of such authority or body for the residue of the term for which the person whose place he fills would have been a member:

Provided that vacancies arising by efflux of time among elected members of any authority or other body of the University may be filled at elections which may be fixed by the Vice-Chancellor to take place on such days not earlier than two months from the date on which the vacancies arise, as he thinks fit;

Provided further that no casual vacancy shall be filled if such vacancy occurs within six months before the date of the expiry of the term of the members of any authority or other body of the University.

100 Act. S. 42. Proceedings of the University authorities and bodies not invalidated by vacancies etc.,

3. No act or proceeding of any authority or other body of the University shall be invalidated merely by reason of the existence of a vacancy or of any defect or irregularity in the election or appointment of a member of any authority or other body of the University or of any defect or irregularity in such act or proceeding not affecting the merits of the case or on the ground only that the Senate did not meet twice in any year.

Act. S. 43. Removal from Membership of The University.

4. (1) The Senate may, - (a) on the recommendation of not less than two-thirds of the members of the Syndicate, remove by an order in writing made in this behalf the name of any person from the register of graduates;

or

(b) remove by an order in writing made in this behalf any person from membership of any authority of the University by a resolution passed by a majority of the total membership of the Senate and by a majority of not less than two thirds of the members of the Senate present and voting at the meeting, if such person has been convicted by a criminal court for an offence which in the opinion of the Senate involves moral turpitude or if he has been guilty of gross misconduct and for the same reason may withdraw any degree or diploma conferred on or granted to that person by the University.

(2) The Senate may also by an order in writing made in this behalf remove any person from the membership of any authority of the University if he becomes of unsound mind or deaf-mute or suffers from leprosy or has applied to b
