ऐसा कोई ?ि%, जो �ा�प अिधसूचना म@ अंत5व�A �+ताव& के संबंध म@ कोई आपि# या सझुाव दनेे का इDछुक ह,ै वह िविनFद�A अविध के भीतर, के��ीय सरकार "ारा िवचार �कए जाने के िलए, अपनी आपि# या सुझाव सिचव, पया�वरण, वन और जलवायु प रवत�न मं8ालय, इं�दरा पया�वरण भवन, जोर बाग रोड, अलीगंज, नई �द�ली-110003 को या ई-मेल esz-mef@nic.in पर िलिखत �प म@ भेज सकता ह।ै �ा�प�ा�प�ा�प�ा�प अिधसूचनाअिधसूचनाअिधसूचनाअिधसूचना मेगामलाई व�यजीव अभयारIय तिमलनाडु राJ य के थेनी और मदरुई के राज+व िजल& के अंतग�त दि�णी पिKमी घाट& म@ अ�ांश 090 37’से 090 57’ उ और दशेांतर 770 11’ से 770 42’ पू म@ ि+थत ह।ै राज+व िवभाग अिधकारी उपामापलायान, कुकु ब पंचायत के अNय� वाली सिमित "ारा पा रत संक�प के अनुसार, मेगामलाई व�यजीव अभयारIय को घोिषत कुल 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] �े8फल 269.10 वग� �कलोमीटर (26910.815 हPेटेयर) और पा रि+थितक� संवेदी जोन के 116.73 वग� �कलोमीटर �े8 को घोिषत �कया गया ह ैतथा एक पा रि+थितक� िवRानी म@ �दनांक 04.01.2013 को लोक िहत म@ और वन संर�ण के िलए कुकु ब फारे+ट रे+ट हाउस म@ संक�प पा रत �कया (संक�प क� �ित संलS ह)ै तथा �दनांक 13.01.2013 को पुन: सभी 21 व+तुT सिहत पुन: संक�प पा रत �कया 19.01.2013 को राज+व िवभाग अिधकारी,,,, उसीलापUी और अNय�,,,, इलूमलाई नगर पंचायत और नगरपािलका के अNय�, , , , उसीलापUी ने 20 व+तुT का संक�प पा रत �कया। और,,,, गंडामनूर पूव� खंड के िलए, , , , सिमित क� बैठक �दनाकं 21.01.2013 को राज+व िवभाग अिधकारी पे रयाकुलम क� अNय�ता म@ िजला िपछड़ा क�याण काया�लय के क� म@ )ई थी और व�यजीव वाड�न और पा रि+थितक� िवRानी के साथ +थानीय िनकाय&, , , , अNय�, , , , गंडमनयकानूर, , , , थेXप पाUी, , , , पलायककोUई और कदमािलकंुड के िनवा�िचत सद+य& ने भाग िलया था। सकं�प पा रत करने के बाद, , , , राज+व िवभाग अिधकारी पे रयाकुलम ने यह कहते )ए इस �+ताव पर ह+ता�र नहY �कये �क उ�ह े�दशािनदZश& और �े8ीय िनरी�ण का अNययन करने के िलए समय चािहए। अिधकाशं के अनुमोदन के अनुसार सकं�प पा रत �कया गया था। और, मेगामलाई व�यजीव अभयारIय [ी िब�लीपूथूर ि\Jलड िगलहरी व�यजीव अभयारIय और पे रयर बाघ रजव� से िघरा )आ ह।ै इस अभयारIय म@ अि"तीय जैव िविवधता ह ैऔर पिKमी घाट& के दि�णी भाग म@ कई स]ूम पया�वास ह;। िवशेषकर तिमलनाडु और केरल के िविशA जैव िविवधता भ-ूद>ृय के भौगोिलक +थान ह;। और, यह पे रयर हाथी रजव� म@ हाथी संर�ण काय�̀ म के िलए महaवपूण� भ-ूद>ृ य ह;। यहां बृहत सटे वन और समीपवतb �े8& स ेस पक� ता होने के कारण इस व�यजीव अभयारIय म@ संकटापc �जाितय& जसेै सफेद िगलहरी, हाथी, बाघ, त@दआु, नीलिगरी तहर, गौर, dसंह पुDछ वानर क� ?ापक िविवधता ह।ै पया�वास क� िविवधता म@ दलु�भ पौध&, इनवटZeेfस, मछिलय&, उभयचर& और सरीसृप& क� कई �जाितय& का संयोजन होता ह।ै मेगामलाई व�यजीव अभयारIय म@ +थािनक वन+पितT और जीवजंतुT क� कई �जाितयां ह।ै अभयारIय म@ वन+पितT और जीवजतुंT क� िविवधता ह।ै संरि�त �े8 म@ वन+पित के उदारण कुल�य अबुसन [[[[अबुसन करी पुम ((((एल.) .) .) .) मेडीकुस]]]], , , , बली टेर करेपेर (कारदीओ पेरममु हिेलकबबुम एल.),बुUेरgली बीअन (कलीटो�रया टेमटेियया एल.),.),.),.), लो�लीपोप कली बेर [दी�लो�यलोस पलमाटुस (एल.) सी. जgफरेय] आ�द; ; ; ; जीवजंतु के उदारण नीलिगरी लंगूर (तेराचयपीथे�स जोह�ी), तुफटेड े लंगूर (से ोिपथेकुस प रअम), बाघ- टइलेड मकाPयू (मकाका िसलेनुस),बो�ेट मका�यू (मकाका रदीअटेपू), े सल"डरे लो रस (लो रस लयदhेेरनुस),बाघ (प$थरेा टाइग�रस), तेदआु (पे'थेरा ()ूस), जंगली िब�ली (फेिलस चाउस) आ+द पाए जाते ह$। और, अभयार.य म" पि/ य0, िततिल य0, क1ड़-ेमकोड़े सरीसृप0 क1 िविवधता ह$। पि/य0 के उदाहरण ओ रएटल हनी बजड� (पेरिनस पटीलोरहनचुस), जेरदोन बजा (अिवकेदा जेरदोनी),4लाक - शॉ�डरेड काइट (इलानसु के5लेउस),सोट7-टोइड सॉप-ईगल (+करकैटूस ग9लीकुस ), लॉग-िब�लेड वालचेर (गयपस इंिडकुस) आ�द ह;ै उभयचर0 के उदाहरण म@ढक (बुफो कबेर), सामा'य इंिडयन टोड (द<ुाफरयनुस मलेानू टीकटुस),वाटर ि क�पर और ि क�पर फरोग (इयफ9यि�टस चयनोफ9यक�टस), इंिडयन प0ड और ीन फरोग (इयफ9यक�टस ह�ेदकटयलसु) आ�द ह;ै अभयार.य म" थािनक (जाितयाँ रोज (अटरोफनेउरा प"दीयना), दि�णी बड�dवंग (टरोइदसे िमनोस),वाइट िड+क हजे 9लू (केलाटो�या अि9बदीसका),नीलिगरी टाइगर (परा�ंटका िनि9गAरंिसस) आ�द पाई जाती ह।ै और, �े8 क� महaवपूण� अथ�?व+था मुlय �प से कृिष ह।ै पा रि+थितक संवेदी जोन का 85% से अिधक �े8 कृिष उपयोग म@ ह।ै शेष �े8 का �योग पशुपालन और अ�य सबंंिधत �`याकलाप& के िलए �कया जाता ह।ै अतः अब, के��ीय सरकार, पया�वरण (संर�ण) अिधिनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प ठत पया�वरण (सरं�ण) अिधिनयम, 1986 (1986 का 29) क� उपधारा (1) तथा धारा 3 क� उपधारा (2) एवं उपधारा (3) के खंड (v) ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 और खंड (xiv) "ारा �द# शि%य& का �योग करते )ए, तिमलनाडु राJय म@ मेगामलाई व�यजीव अभयारIय क� सीमा के चार& ओर 0 �कलोमीटर स े 1.7 �कलोमीटर तक िव+ता रत �े8 को मेगामलाई व�यजीव अभयारIय पा रि+थितक� संवेदी जोन (िजसे इसम@ इसके प> चात् पा रि+थितक� संवेदी जोन कहा गया ह)ै के �प म@ अिधसूिचत करती ह,ै िजसका िववरण िन ानुसार है, अथा�त् :-- 1. पा�रि�थितक�पा�रि�थितक�पा�रि�थितक�पा�रि�थितक� संवेदीसंवेदीसंवेदीसंवेदी जोनजोनजोनजोन काकाकाका िव�तारिव�तारिव�तारिव�तार औरऔरऔरऔर सीमासीमासीमासीमा—(1) पा रि+थितक� संवेदी जोन का िव+तार मेगामलाई व�यजीव अभयारIय के चार& ओर शू�य �कलोमीटर स े1.7 �कलोमीटर तक फैला )आ ह।ै पा रि+थितक� संवेदी जोन का �े8 116.73 वग� �कलोमीटर ह।ै (2) पा रि+थितक� संवेदी जोन क� सीमा का वण�न उपाबंधउपाबंधउपाबंधउपाबंध----IIII के �प म@ सलंS ह।ै (3) पा रि+थितक� संवेदी जोन सीमा के संरि�त �े8 का मानिच8 उपाबंधउपाबंधउपाबंधउपाबंध----IIIIIIII कककक----डडडड.... म@ �दया गया ह।ै (4) पा रि+थितक� संवेदी जोन और संरि�त �े8 क� सीमा के भ-ूिनदZशाकं& क� सूची `मश: उपाबंधउपाबंधउपाबंधउपाबंध----III (III (III (III (कककक) ) ) ) और ((((खखखख)))) म@ दी गई ह।ै (5) मुlय dबंदTु के भ-ूिनदZशांक& के साथ पा रि+थितक� संवेदी जोन के अंतग�त आने वाले \ाम& क� सूची उपाबंधउपाबंधउपाबंधउपाबंध----IVIVIVIV के �प म@ संलS ह।ै 2. पा�रि�थितक�पा�रि�थितक�पा�रि�थितक�पा�रि�थितक� संवेदीसंवेदीसंवेदीसंवेदी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आंचिलकआंचिलकआंचिलकआंचिलक महायोजनामहायोजनामहायोजनामहायोजना....————(1) राJय सरकार, पा रि+थितक� संवेदी जोन के �योजन के िलए, राजप8 म@ अंितम अिधसूचना के �काशन क� तारीख स ेदो वष� क� अविध के भीतर, +थानीय ?ि%य& के परामश� से और इस अिधसूचना म@ �दए गए अनुबंध& का पालन करते )ए, राJय सरकार के स�म �ािधकारी के अनुमोदनाथ� एक आंचिलक महायोजना बनायेगी। (2) राJ य सरकार "ारा पा रि+थितक� संवेदी जोन के िलए आचंिलक महायोजना इस अिधसूचना म@ िविनFद�6 ट रीित से तथा �ासंिगक क@ �ीय और राJ य िविधय& के अनु�प तथा क@ �ीय सरकार "ारा जारी �दशा िनदZश&, य�द कोई ह&, के अनुसार बनायी जाएगी। (3) आंचिलक महायोजना म@ पा रि+थितक� और पया�वरण संबंधी सरोकार& को शािमल करने के िलए इसे राJ य सरकार के िन िलिखत िवभाग& के परामश� से बनाया जाएगा, अथा�त्:—

(i) पया�वरण;

(ii) वन और व�यजीव;

(iii) कृिष;

(iv) राज+ व;

(v) शहरी िवकास;

(vi) पय�टन;

(vii) \ामीण िवकास;

(viii) dसंचाई और बाढ़ िनयं8ण;

(ix) नगरपािलक;

(x) पंचायती राज;

(xi) लोक िन मा�ण िव भाग;

(xii) राजमाग�;

(xiii) तिमलनाडु राJय �दषूण िनयं8ण बोड�। 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (4) जब तक इस अिधसूचना म@ िविनFद�A न हो, आंचिलक महायोजना म@ वत�मान म@ अनुमो�दत भ-ूउपयोग, अवसंरचना और �`याकलाप& पर कोई �ितबंध नहY लगाया जाएगा तथा आचंिलक महायोजना म@ सभी अवसंरचनाT और �`याकलाप& म@ सुधार करके उ�ह ेअिधक द� और पा रि+थितक�-अनुकूल बनाने क� ?व+था क� जाएगी। (5) आंचिलक महायोजना म@ वनरिहत और अव`िमत �े8& क� बहाली, िवsमान जल िनकाय& के संर�ण, आवाह �े8& के �बंधन, जल-संभर& के �बंधन, भ-ूजल के �बंधन, मृदा और नमी के संर�ण, +थानीय जनता क� आव>यकताT तथा पा रि+थितक� एव ंपया�वरण के ऐसे अ�य पहलTु क� ?व+था क� जाएगी िजन पर Nयान �दया जाना आव>यक ह।ै (6) आंचिलक महायोजना म@ सभी िवsमान पूजा + थल&, \ाम& एवं शहरी बि+तय&, वन& क� [ेिणय& एवं �क+ म&, कृिष �े8&, ऊपजाऊ भिूम, उsान& एवं उsान& क� तरह के ह रत �े8&, बागवानी �े8&, बगीच&, झील& और अ�य जल िनकाय& क� सीमा का िनधा�रण �कया जाएगा तथा सहायक मानिच8 भी �दया जाएगा। इस महायोजना म@ िवsमान और �+तािवत भ-ू उपयोग क� िवशेषताT का 9यौरा दनेे वाले मानिच8 भी �दए जाएंगे। (7) आंचिलक महायोजना म@ पा रि+थितक� संवेदी जोन म@ होने वाले िवकास का िविनयमन �कया जाएगा और सारणी म@ यथासूचीबv �ितिषv एवं िविनयिमत �`याकलाप& का पालन �कया जाएगा। इसम@ + थानीय जनता क� आजीिवका क� सुर�ा के िलए पा रि+थितक�-अनुकूल िवकास का भी सुिनKय एवं संवध�न �कया जाएगा। (8) आंचिलक महायोजना, �े8ीय िवकास योजना क� सह-कािलक होगी । (9) अनुमो�दत आंचिलक महायोजना, िनगरानी सिमित के िलए एक संदभ� द+तावेज होगी ता�क वह इस अिधसूचना के उपबंध& के अनुसार िनगरानी के अपने कत�?& का िनव�हन कर सके । 3. रा�यरा�यरा�यरा�य सरकारसरकारसरकारसरकार �ारा�ारा�ारा�ारा �कए�कए�कए�कए जानेजानेजानेजाने वालेवालेवालेवाले उपायउपायउपायउपाय————राJय सरकार इस अिधसूचना के उपबंध& को �भावी बनाने के िलए िन िलिखत उपाय करेगी, अथा�त्:-- (1) भूभभूूभू----उपयोउपयोउपयोउपयोग ग ग ग –––– (क) पा रि+थितक� संवेदी जोन म@ वन&, बागवानी �े8&, कृिष �े8&, मनोरंजन के िलए िचि�हत उsान& और खुले +थान& का वृहद वािणिJयक या आवासीय प रसर& या औsोिगक �`याकलाप& के िलए �योग या संप रवत�न अनुRात नहY �कया जाएगा। (ख) परंतु पा रि+थितक� संवेदी जोन के भीतर भाग (क) म@ िविनFद�A �योजन स ेिभc �योजन के िलए कृिष और अ�य भिूम का संप रवत�न, िनगरानी सिमित क� िसफा रश पर और स�म �ािधकारी के पूव� अनुमोदन से �े8ीय नगर योजना अिधिनयम तथा यथा लागू के��ीय/राJय सरकार के अ�य िनयम& एवं िविनयम& के अधीन तथा इस अिधसूचना के उपबंध& के अनुसार +थानीय िनवािसय& क� िन िलिखत आवासीय ज�रत& को पूरा करने के िलए अनुRात �कया जाएगा: (i) िवsमान सड़क& को चौड़ा करना, उ�ह@ सुदढृ करना और नई सड़क& का सिंनमा�ण; (ii) बुिनयादी ढांच& और नाग रक सुिवधाT का संिनमा�ण और नवीकरण; (iii) �दषूण उxपc न करने वाले लघ ुउsोग; (iv) कुटीर उsोग एवं \ाम उsोग; पा रि+थितक� पय�टन म@ सहायक सुिवधा भIडार, +थानीय सिुवधाएं तथा \ह वास; और (v) बढ़ावा �दए गए और पैरा-4 म@ उि�लिखत �`याकलाप। (ग) परंतु यह भी �क �े8ीय शहरी िनयोजन अिधिनयम के अधीन स�म �ािधकारी के पूव� अनुमोदन के िबना तथा राJय सरकार के अ�य िनयम& एवं िविनयम& एवं संिवधान के अनुDछेद 244 के उपबंध& तथा तxसमय �वृ# िविध, िजसके अंतग�त अनुसूिचत जनजाित और अ�य परंपरागत वन िनवासी (वन अिधकार& क� मा�यता) अिधिनयम, 2006 (2007 का 2) भी आता ह,ै का अनुपालन �कए िबना वािणिJयक या औsोिगक िवकास �`याकलाप& के िलए जनजातीय भिूम का �योग अनुRात नहY होगा। ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 5 (घ) परंतु यह भी �क पा रि+ थितक� संवेदी जोन के अंतग�त आने वाली भिूम के अिभलखे& म@ )ई �कसी 8ु ट को, िनगरानी सिमित के िवचार �ा= करने के पKात्, राJय सरकार "ारा �xयेक मामल ेम@ एक बार सुधारा जाएगा और उ% 8ु ट को सुधारने क� सूचना क@ �ीय सरकार के पया�वरण, वन और जलवायु प रवत�न मं8ालय को दी जाएगी । (ड.) परंतु यह भी �क उपयु�% 8ु ट को सुधारने म@, इस उप-पैरा म@ यथा उपबंिधत के िसवाय, �कसी भी दशा म@ भ-ूउपयोग का प रवत�न शािमल नहY होगा । (च) अनु�युP त या अनुx पादक कृिष �े8& म@ पुन: वनीकरण तथा पया�वास& और जैव-िविवधता क� बहाली के �यास �कए जाएंगे । (2) �ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत�ाकृितक जल �ोत—आंचिलक महायोजना म@ सभी �ाकृितक जल |ोत&/न�दय&/जलमाग} के आवाह �े8& क� पहचान क� जाएगी और आंचिलक महायोजना म@ उनके संर�ण और बहाली क� योजना सि मिलत क� जाएगी और राJ य सरकार "ारा जल आवाह �बंधन योजना इस रीित से बनाई जाएगी �क उसम@ इन �े8& या इनके िनकटवतb �े8& म@ िवकास �`याकलाप& को �ितिषv और िनब~िधत �कया गया हो । (3) पय�टन/पा�रि�थितक� पय�टन पय�टन/पा�रि�थितक� पय�टन पय�टन/पा�रि�थितक� पय�टन पय�टन/पा�रि�थितक� पय�टन ————(क) पा रि+थितक� संवेदी जोन म@ सभी नए पा रि+थितक� पय�टन �`याकलाप या िवsमान पय�टन �`याकलाप& का िव+तार पा रि+थितक� संवेदी जोन स बंधी पय�टन महायोजना के अनुसार अनुRात होगा । (ख) पा रि+थितक� पय�टन महायोजना राJय सरकार के पया�वरण और वन िवभाग के परामश� से पय�टन िवभाग "ारा बनायी जाएगी । (ग) पय�टन महायोजना आंचिलक महायोजना का घटक होगी । (घ) पा रि+थितक� पय�टन संबंधी �`याकलाप िन नानुसार िविनयिमत �कए जाएंगे, अथा�त् :— (i) संरि�त �े8 क� सीमा से एक �कलोमीटर के भीतर या पा रि+थितक� संवेदी जोन क� सीमा तक, इनम@ जो भी अिधक िनकट हो, �कसी होटल या रजॉट� का नया सिcमा�ण अनुRात नहY �कया जाएगा। तथािप, पा रि+थितक� पय�टन सुिवधाT के िलए संरि�त �े8 क� सीमा से एक �कलोमीटर क� दरूी से परे पा रि+थितक� संवेदी जोन क� सीमा तक पूव� प रभािषत और अभीिहत �े8& म@ पय�टन महायोजना के अनुसार, नए होटल& और रजॉट� क� +थापना अनुRात नहY होगा। (ii) पा रि+थितक� संवेदी जोन के अ�दर सभी नए पय�टन �`या-कलाप& या िवsमान पय�टन �`याकलाप& का िव+तार, के��ीय सरकार के पया�वरण, वन और जलवायु प रवत�न मं8ालय "ारा जारी �दशािनदZश& तथा पा रि+थितक� पय�टन पर बल दनेे वाले रा�ीय ?ा� संर�ण �ािधकरण "ारा जारी पा रि+थितक� पय�टन संबंधी �दशािनदZश& (समय-समय पर यथा संशोिधत) के अनुसार होगा । (iii) आंचिलक महायोजना का अनुमोदन होने तक, पय�टन के िवकास और िवsमान पय�टन �`याकलाप& के िव+तार को वा+तिवक +थल-िविशA संवी�ा तथा िनगरानी सिमित क� िसफा रश के आधार पर संबंिधत िविनयामक �ािधकरण& "ारा अनुRात �कया जाएगा और पा रि+थितक� संवेदी जोन म@ �कसी नए होटल/ रजॉट� या वािणिJयक �ित�ान का सिंcमा�ण अनुRात नहY होगा। (4) �ाकृितक िवरासत�ाकृितक िवरासत�ाकृितक िवरासत�ाकृितक िवरासत–––– पा रि+थितक� संवेदी जोन के अंतग�त आने वाले ब)मू�य �ाकृितक िवरासत के सभी +थल& जैस े�क जीन पूल रजव� �े8, शैल संरचना, जल �पात, झरने, दरZ, उपवन, गुफाएं, +थल, वनपथ, पया�वरण (संर�ण) अिधिनयम, 1986 और उसके अधीन बनाए गए िनयम& के अ�तग�त शािमल �कए गए पया�वरणीय �दषूण के िन+सारण संबंधी साधारण मानक& या राJय सरकार "ारा िनयत मानक&, इनम@ जो भी अिधक कठोर ह&, के अनुसार �कया Qीय या संबंिधत रा�य के अिधिनयम� और उनके अधीन बनाए गए िनयम� के उपबंध� के अनुसार िविनयिमत होगी । 12. वन उ3पाद� और गैर काd वन उ3पाद� (एनटीएफपी) का सं_ह । लागू िविधय� के अधीन िविनयिमत होगा । 13. फमe, उपाय� के साथ क� जाएगी। 16. िवFमान सड़क� को चौड़ा करना, उ'ह! सुदढृ बनाना और नई सड़क� का िनमा�ण करना। ये काय� लागू िविधय�, िनयम�, िविनयम� और मौजूदा �दशािनदTश� के अनुसार उपशमन उपाय� के साथ �कये जाएंगे। 17. पय�टन से संबंिधत अ'य ��याकलाप जैसे �क पा<रि�थितक� संवेदी जोन XेR के ऊपर से गम� वायु के गुiबारे, हेलीकाjटर, kोन, माइ�ोलाइlस उडाना आ�द। लागू िविधय� के अधीन िविनयिमत होगा । 18. पहाड़ी ढलान� और नदी तट� का संरXण । लागू िविधय� के अधीन िविनयिमत होगा । 19. रािR म! सड़क यातायात का संचलन । लागू िविधय� के अधीन वािणि�यक 6योजन के िलए िविनयिमत होगा । 20. �थानीय जनता Sारा अपनायी जा रही वत�मान कृिष और बागवानी प8ितय� के साथ डये<रयां, दmुध उ3पादन, जल कृिष और म3�य पालन। �थानीय जनता के 6योग के िलए लागू िविधय� के अधीन अनुGात ह�गे। 21. 6ाकृितक जल िनकाय� या भू XेR म! उपचा<रत अपिशK जल/बिहYा�व का िन�सारण । Total area of Megamalai Wildlife Sanctuary declared is 269.10 sq km (26910.815 ha) and Eco–Sensitive Zone is 116.73 sq km. Declared also as per Resolution passed by the committee formed with Revenue Deparment officer Uthamapalayam, Panchayat Union Chairman of Cumbum, Wildlife Warden and an Ecologist on 04.01.2013 passed the Resolution (Resolution copy enclosed), at Cumbum Forest Rest House for the Public interest and to conserve the Forest and again re-resolution passed on 13.01.2013 including for all 21 items. Revenue Deparment officer Usilampatti and Chairman Elumalai Town Panchayat and Municipal Chairman, Usilampatti on 19.01.2013 passed resolution of 20 items. AND WHEREAS, for Gandamanur East block, the committee sat on 21.01.2013 in the chamber of District Backward welfare office under the chairmanship of Revenue Deparment officer Periyakulam and attended by elected members of local bodies, Presidents Gandamanayakanur, Theppampatti, Palayakottai and Kadamalaikundu along with Wildlife Warden and Ecologist. After passing resolution, the Revenue Deparment officer Periyakulam did not sign the resolution stating that he needed time for studying the guidelines and field inspection. As per majority approval the resolution is passed. AND WHEREAS, the Megamalai Wildlife Sanctuary is the surrounded by the Srivilliputhur Grizzled Squirrel Wildlife Sanctuary and Periyar Tiger Reserve. This sanctuary has unique habitat of harboring biodiversity and several microhabitats in southern part of Western Ghats. Especially the place of two distinct geographical regions of bio diversity landscape Western Ghats of Tamil Nadu and Kerala. AND WHEREAS, it is an important landscape for elephant conservation programme in Periyar Elephant Reserve. Owing to its large contiguous forests and connectivity with adjoining protected areas, this wildlife sanctuary has wide varieties of endangered species such as Grizzled Squirrel, Elephant, Tiger, Leopard, Nilgiritahr, Gaur, Lion Tailed Macaque etc. The diversity of habitat has got an assemblage of several species of rare plants, invertebrates, fishes, amphibians, and reptiles. AND WHEREAS, the Megamalai Wildlife Sanctuary has several species of endemic flora and fauna. The sanctuary has diversity of flora and fauna. Examples of flora found in the protected area are Curly abutilon (Abutilon crispum (L.) Medikus), Blister creeper (Cardiospermum helicababum L.), Butterfly Bean (Clitoria ternatea L.), Lollipop Climber (Diplocyclos palmatus (L.) C. Jeffrey) etc.; examples of fauna are Nilgiri Langur (Semnopithecus johnii), Tufted Grey Langur (Semnopithecus priam), Lion-tailed Macaque ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 21 (Macaca silenus), Bonnet Macaque (Macaca radiate), Grey Slender Loris (Loris lydekkerianus), Tiger (Panthera tigris), Leopard (Panthera pardus), Jungle Cat (Felis chaus) etc. AND WHEREAS, the sanctuary has variety of birds, butterflies, insects, reptiles. Examples of birds are Oriental Honey-Buzzard (Pernis ptilorhynchus), Jerdon's Baza (Aviceda jerdoni), Black-shouldered Kite (Elanus caeruleus), Short-toed Snake-Eagle (Circaetus gallicus ), Long-billed Vulture (Gyps indicus) etc; examples of amphibians are Ferguson's Toad (Bufo scaber), Common Indian Toad (Duttaphrynus melanostictus), Water Skipper or Skipper Frog (Euphlyctis cyanophlyctis), Indian Pond or Green Frog (Euphlyctis hexadactylus) etc. Endemic species found in the sanctuary are Malabar Rose (Atrophaneura pandiyana), Southern Birdwing (Troides minos), White Disc Hege Blue (Celatoxia albidisca), Nilgiri Tiger (Parantica nilgiriensis) etc. AND WHEREAS, the important economy of the area is primarily agriculture. More than 85% of the Eco-Sensitive Zone area is in agricultural use. Remaining areas are used for animal husbandry and other related activities. NOW THEREFORE, in exercise of the power conferred by sub-section(1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area with an extent varying from zero kilometre to 1.7 kilometre around the boundary of Megamalai Wildlife sanctuary in the State of Tamil Nadu as the Megamalai Wildlife sanctuary (herein after referred to as the Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and boundaries of Eco-sensitive Zone. - (1) The extent of Eco-sensitive Zone varies from zero kilometer to 1.7 kilometer around the Megamalai Wildlife sanctuary. The area of the Eco-Sensitive Zone is

116.73 square kilometers.

(2) The boundary description of the Eco Sensitive Zone is appended at Annexure I.

(3) The map of the Protected Area demarcating the Eco-sensitive Zone boundary is at Annexure IIA-E.

(4) List of geo co-ordinates of the boundary of the Protected Area and the Eco-Sensitive Zone is at Annexure III (A) and (B) respectively.

(5) The list of villages falling within the Eco-sensitive Zone along with their geo co-ordinates at prominent points is appended as Annexure IV.

2. Zonal Master Plan for the Eco-sensitive Zone. - (1) The State Government shall, for the purpose of effective management of the Eco-Sensitive Zone, prepare a Zonal Master Plan within a period of two years from the date of publication of Final Notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this Notification for approval of Competent Authority in the State Government.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for integrating environmental and ecological considerations into the said plan:

(i) Environment;

(ii) Forest and Wildlife;

(iii) Agriculture;

(iv) Revenue;

(v) Urban Development;

(vi) Tourism;

(vii) Rural Development ;

(viii) Irrigation and Flood Control; 22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(ix) Municipal;

(x) Panjayati Raj;

(xi) Public Works Department;

(xii) Highways;

(xiii) Tamil Nadu State Pollution Control Board.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded and degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps. The Plan shall be supported by Maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited, regulated activities listed in table and also ensure and promote eco-friendly development for livelihood security of local communities.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by State Government.-The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use. –

(a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities.

(b) Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part (a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of Central/State Government as applicable and vide provisions of this Notification, to meet the residential needs of the local residents such as:

(i) Widening and strengthening of existing roads and construction of new roads;

(ii) Construction and renovation of infrastructure and civic amenities;

(iii) Small scale industries not causing pollution;

(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) Promoted activities and given in paragraph 4;

(c) Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007): ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 23

(d) Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

(e) Provided also that the above correction of error shall not include change of land use in any case except as provided under this sub-paragraph.

(f) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural water bodies. - The catchment areas of all natural springs/rivers/channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3)Tourism/ Eco-tourism

(a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-Sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone.

(b) The Eco-Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests.

(c) The Tourism Master Plan shall form a component of the Zonal Master Plan.

(d) The activities of eco-tourism shall be regulated as under, namely:-

(i) No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the protected area or upto the extent of the ESZ whichever is nearer. However, beyond the distance of 1 km from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism;

(iii) Until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel /resort or commercial establishment construction is permitted within ESZ area.

(4) Natural Heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artifacts, areas and precincts of historical, architectural, aesthetic and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.

(6) Noise pollution. - The Environment Department of the State Government or Tamil Nadu State Pollution Control Board shall implement the regulations for control of noise pollution in the Eco-sensitive Zone in accordance with the provisions stipulated of The Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986 and amendments thereto.

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and rules made there under and amendments thereto.

(8) Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the 24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Environmental (Protection) Act, 1986 and rules made there under or standards stipulated by State Government whichever is more stringent.

(9) Solid wastes. - Disposal and Management of solid wastes shall be as under:

(a) the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated 8th April, 2016 as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;

(b) Safe and Environmentally Sound Management (ESM) of Solid wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.

(10) Bio-medical waste. - Bio-medical waste management shall be as under:

(a) The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio- Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification Number GSR 343 (E), dated the 28th March,2016 as amended from time to time.

(b) Safe and Environmentally Sound Management (ESM) of biomedical wastes in conformity with the existing rules and regulations using identified technologies may be allowed within Eco-Sensitive Zone.

(11) Plastic Waste Management.- The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.

(12) Construction and Demolition Waste Management. - The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.

(13) E-waste. - The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.

(14) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made there under.

(15) Vehicular Pollution. - Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws. Efforts to be made for use of cleaner fuel for example CNG, LPG, etc.

(16) Industrial Units.- (i) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone.

(ii) Only non-polluting industries shall be allowed within ESZ as per classification of Industries in the Guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.

(17) Protection of Hill Slopes: The protection of hill slopes shall be as under:

(a) The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted.

(b) No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.

(18) The Central Government and the State Government shall specify other additional measures, if it considers necessary, in giving effect to the provisions of this notification.

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone: ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 25 All activities in the Eco sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and the rules made there under including the Coastal Regulation Zone (CRZ), 2011 and the Environmental Impact Assessment (EIA) Notification, 2006 and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927) the Wildlife(Protection) Act 1972 (53 of 1972) and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE Sl.No. Activity Description A. Prohibited Activities

1. Commercial Mining. (a) All new and existing (minor and major minerals) stone quarrying and crushing units are prohibited with immediate effect except for meeting the domestic needs of bonafide local residents including digging of earth for construction or repair of houses and for manufacture of country tiles or bricks for housing and for other activities.

(b) The mining operations shall be carried out in accordance with the order of the Hon’ble Supreme Court dated 04.08.2006 in the matter of T.N. Godavarman Thirumalpd Vz. UOI in W.P. (C) No. 202 of 1995 and dated 21.04.2014 in the matter of Goa Foundation z. UOI in W.P. (C) No. 435 of 2012.

2. Setting of industries causing pollution (Water, Air, Soil, Noise, etc). No new industries and expansion of existing polluting industries in the Eco-sensitive zone shall be permitted. Only non-polluting industries shall be allowed within Eco- Sensitive Zone as per classification of Industries in the guidelines issued by Central Pollution Control Board in February 2016, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.

3. Establishment of major hydroelectric project. Prohibited (except as otherwise provided) as per applicable laws.

4. Use or production or processing of any hazardous substances. Prohibited (except as otherwise provided) as per applicable laws.

5. Discharge of untreated effluents in natural water bodies or land area. Prohibited (except as otherwise provided) as per applicable laws.

6. Setting of new saw mills. No new or expansion of existing saw mills shall be permitted within the Eco-sensitive Zone.

7. Setting up of brick kilns. Prohibited (except as otherwise provided) as per applicable laws. B. Regulated Activities

8. Commercial establishment of hotels and resorts. No new commercial hotels and resorts shall be permitted within one kilometre of the boundary of the Protected Area or up to the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-tourism activities.

Provided that, beyond one kilometre from the boundary of the protected Area or up to the extent of Eco-sensitive zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism 26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Master Plan and guidelines as applicable.

9. Construction activities.

(a) No new commercial construction of any kind shall be permitted within one Kilometre from the boundary of the Protected Area or upto extent of the Eco-sensitive Zone whichever is nearer:

(b) Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub paragraph (1) of paragraph 6 as per building byelaws to meet the residential needs of the local residents such as:

(i) Widening and strengthening of existing roads and construction of new road.

(ii) Construction and renovation of infrastructure and civic amenities;

(iii) Small scale industries not causing pollution termed as per Classification done by Central Pollution Control Board of February 2016;

(iv) Cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stays; and

(v) Promoted activities listed in this Notification.

(c) Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations if any.

(d) Beyond one kilometre it shall be regulated as per the Zonal Master Plan.

10. Small scale non-polluting industries. Non-polluting industries as per classification of industries issued by the central Pollution Control Board in February 2016 and non-hazardous, small scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco- Sensitive Zone shall be permitted by the competent authority.

11. Felling of Trees. (a) There shall be no felling of trees on the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under.

12. Collection of Forest produce or Non-Timber Forest Produce (NTFP). Regulated under applicable laws.

13. Establishment of large scale commercial live stock and poultry farms by firms, corporate, companies. Regulated under applicable laws.

14. Erection of electrical and communication towers and laying of cables and other Regulated under applicable laws. Underground cabling may be promoted. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 27 infrastructures.

15. Infrastructure civic amenities. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.

16. Widening and strengthening of existing roads and construction of new roads. Shall be done with mitigation measures, as per applicable laws, rules and regulation and available guidelines.

17. Undertaking other activities related to tourism like over flying the ESZ area by hot air balloon, helicopter, drones, Microlites, etc. Regulated under applicable law.

18. Protection of hill slopes and river banks. Regulated under applicable laws.

19. Movement of vehicular traffic at night. Regulated for commercial purpose under applicable laws.

20. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries. Permitted under applicable laws for use of locals.

21. Discharge of treated waste water/effluents in natural water bodies or land area. The discharge of treated waste water/effluents shall be avoided to enter into the water bodies. Efforts to be made for recycle and reuse of treated waste water. Otherwise the discharge of treated waste water/effluent shall be regulated as per applicable laws.

22. Commercial extraction of surface and ground water. Regulated under applicable law.

23. Open Well, Bore Well etc. for agriculture or other usage. Regulated and the activity should be strictly monitored by the appropriate authority.

24. Solid Waste Management. Regulated under applicable laws.

25. Introduction of Exotic species. Regulated under applicable laws.

26. Eco-tourism. Regulated under applicable laws.

27. Use of polythene bags. Regulated under applicable laws.

28. Commercial sign boards and hoardings. Regulated under applicable laws. C. Promoted Activities

29. Rain water harvesting. Shall be actively promoted.

30. Organic farming. Shall be actively promoted.

31. Adoption of green technology for all activities. Shall be actively promoted.

32. Cottage industries including village artisans, etc . Shall be actively promoted.

34. Agro-Forestry. Shall be actively promoted.

35. Use of eco-friendly transport. Shall be actively promoted.

36. Skill Development. Shall be actively promoted.

37. Restoration of Degraded Land/Forests/Habitats. Shall be actively promoted.

38. Environmental awareness. Shall be actively promoted.

5. Monitoring Committee.—The Central Government hereby constitutes a Monitoring Committee, for effective monitoring of the provisions of this notification under sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), comprising of the following namely:—

1. District Collector, Theni District, Theni Chairman;

2. A representative of Non-government Organisation working in the field of wildlife conservation to be nominated by State Government Member;

3. An expert in Biodiversity nominated by the State Government Member;

4. An expert in Ecology and Environment to be nominated by the State Government Member;

5. A representative from State Public Works Department Member;

6. A representative from State Pollution Control Board Member;

7. Wildlife Warden, Megamalai Wildlife Division, Theni Member Secretary.

6. Terms of Reference. —

(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2) The tenure of the Monitoring committee shall be for three years or till the re-constitution of the new Committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533 (E), dated the 14 th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual sitespecific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment, Forest and Climate Change number S.O. 1533 (E), dated the 14 th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(5) The Member Secretary of the Monitoring Committee or the concerned Deputy Commissioner(s) shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden in the State as per Performa given in Annexure V. ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 29

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. The provisions of this notification are subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal. [F. GARKOTI, Scientist 'G' ANNEXURE- I BOUNDARY DESCRIPTION OF ECO-SENSITIVE ZONE OF THE PROTECTED AREA North In northern part of Megamalai wildlife sanctuary boundary Started from Gandamanur east RF towards east to Andipatty, Elummalai and Doddappanayakanur South RF Joint. It is extended about 10m distance along to the RF Gandamanur East RF and Elumalai RF. In northern boundary of this sanctuary which is Consisting of 4.2 km extended along the Elumalai RF and

5.8 km extented along with Gandamanur East RF. North East In the north-east part of sanctuary consisting in very less portion of Gandmanur range. Here The boundary started with Andipatti and Elumalai RF Joints on the norther portion of the sanctuary end. Towards eastern side extending to 3.2km. East In the Eastern boundary of sanctuary extended 18.75km in gandamanur range. This part is consisting of Elumalai and Sulapuram RF. And these RF boundary adjacent to the Village boundary of mudurai district. In other part of the sanctuary boundary extended about 35km from Kerala Boundary of Southern side. And it starts towards northern side and enough in chinnamanur range. There was Vannathiprai RF, Koothanachi RF and Erasakkanayakanur RF consisting the eastern boundary of sanctuary in Cumbu East range and Chinnamanur Range. South East The South east portion boundary is not elongated which part of gandamanur east RF from Mayiladumparai village to Sirangikal mottai and another bit of mulakadai village to Aruguveli village. It runs through adjacent renee and village boundary of Gandamanur east RF South Thence the boundary runs generally towards North west Direction along the southern boundary of Soolapuram Reserved Forests and meets the south east corner of Elumalai Reserved Forests which is also the common boundary between Andipatty and Usilampatty Taluks. Thence boundary runs, through the 19 km, along the Kerala state boundary till it meet trijunction point of interstate lines and southern point of Peermedu Ghat road. South West In South west part consisting about 25km distance from Mayiladimparai village to paluthu village. It is running towards from south to northern side of the gandamanur east RF of Gandamanur Range. West Thence boundary runs towards northern-eastern direction along the Peermedu Ghat road and thence along the northern boundary of Melagudalur Reserved Forests and thence the boundary runs in northern-eastern and western sides along the peak 425 near 520, near Pandarathurai 404, near 712, 430, 498, 521 runs generally north along the eastern notified boundary of Cumbum Valley east Reserved Forests (Dhonikaradu Block) notified under section 16 of the Tamilnadu Forest Act 1882 till to meet the starting point. Thence it is running towards erasakkanayakanur RF till the thenpalani or Alagapuri village. This is extened about 75 km distance going through from south to northern wards.
