Section 30: Prohibition on contesting more than one seat and withdrawal of Candidature

(1) (a) Under Section 10 of the Tamil Nadu Panchayats Act, 1994, no person shall be eligible to be elected as a member of more than one Village Panchayat.

(b) No member of a Village Panchayat or no person who stands for election as a member of a Village Panchayat shall be eligible to stand for election as a President of a Village Panchayat, or a member of a Panchayat Union Council or a member of a District Panchayat.

(c) No member of a Panchayat Union Council or no person who stands for election as a member of a Panchayat Union Council shall be eligible to stand for election as a member of a Village Panchayat, or President of a Village Panchayat or a member of a District Panchayat.

(d) No member of a District Panchayat or no person who stands for election as a member of a District Panchayat shall be eligible to stand for election as a member of a Village Panchayat, or President of a Village Panchayat or a member of a Panchayat Union Council.

(e) No President or no person who stands for election 2[as a President of a Village Panchayat] shall be eligible to stand for election as a member of a Village Panchayat, or member of a Panchayat Union Council or a member of a District Panchayat.

(2) (a) Any Candidate may withdraw his Candidature by a notice in Form 7 and subscribed by him and delivered to the Returning Officer before the time fixed for the purpose. The notice may be delivered either by such Candidate in person or by his proposer, who has been authorized in this behalf in writing, by such Candidate.

(b) On receipt of such notice, the Returning Officer shall note thereon the date and time at which it was delivered to him.

(c) No person who has given notice of withdrawal of his Candidature shall be allowed to cancel the notice.

(d) The Returning Officer shall, on being satisfied as to the genuineness of the notice of withdrawal and the identity of the person delivering it, cause a notice showing the list of Candidates who have withdrawn their Candidature in Form 8 to be affixed in the notice board of his office.

15[(3) If a person who has filed nomination in violation of sub-rule (1) fails or refuses to withdraw nomination for all other elections filed in violation before the time fixed for withdrawal of Candidature, the Returning Officer shall, immediately after the expiry of such time determine by lot drawn in the presence of the available Candidates, the election to which such person shall contest. The Returning Officer shall include the name of such persons in the list of contesting Candidates for the election determined by lot and his nominations shall be deemed to have been withdrawn in respect of other elections].
