Section 48: Right to vote

The Tamil Nadu Panchayats (Elections) Rules, 1995State Rules of Tamil Nadu · 1994

(1) No person whose name is not entered in the electoral roll of any Ward shall be entitled to vote.

(2) No person shall vote at an election if he is subject to any of the disqualifications referred to in Section 16 of the Representation of the Peoples Act, 1950 or Section 35 or 36 of the Tamil Nadu Panchayats Act, 1994.

(3) No person shall vote in more than one Ward in a Panchayat notwithstanding the facts that his name may have been registered in the electoral roll of more than one Ward of the Panchayat and if a person votes in more than one Ward, his votes in all such Wards shall be void.

(4) No person shall at any election vote in the same Ward more than once, notwithstanding the fact that his name may have been registered in the electoral roll for that Ward more than once and if he does vote more than once, all his votes in the Ward shall be void.

(5) No person shall vote at any election if he is confined in a prison whether under a sentence of imprisonment or otherwise :

Provided that nothing in this sub-rule shall apply to a person subject to preventive detention under any law for the time being in force.

17[48-A. Special procedure for preventing personation of electors.- With a view to prevent personation of electors and facilitating their identification at the time of poll, every elector shall produce documentary evidence establishing his identity as may be specified and in the manner directed by the State Election Commission in this behalf from time to time.]
