Section 5: Powers and functions of the State Election Commission

(1) The preparation of electoral roll and the conduct of all elections to the panchayats at all levels shall be held under the superintendence and control of the State Election Commission and for this purpose it shall have power to give such directions as it may deem necessary to the District Collector or any officer or servant of the Government/local bodies/Government undertakings/co-operative institutions, so as to ensure efficient conduct of the elections.

(2) The State Election Commission may, subject to control and revision, delegate its powers to such officers as it may deem necessary.

(3) The District Election Officer, Panchayat Electoral Registration Officer, Returning Officer, Assistant Returning Officer, Presiding Officer, Polling Officer and any other officer appointed under these rules, any police officer designated for the time being by the State Government for the conduct of any elections, shall be deemed to be on deputation to the State Election Commission for the period commencing on and from the date of preparation of electoral rolls till its completion and from the date of notification calling for such elections and ending with the date of completion of such elections and such officer shall, during that period, be subject to the control, superintendence and discipline of the State Election Commission.

(4) It shall be the duty of the District Election Officer to report the vacancies within a week to the State Election Commission.
