7.16 Tamil Nadu Panchayats (Resignation of Chairman, Vice Chairman and Members of District Panchayats, Chairman, Vice Chairman and Members of Panchayat Union Council and President, Vice President and Members of Village Panchayats) Rules,1999 (G.O. (Ms) No. 35 Rural Development (C3) Department, dated 22nd February, 1999) In exercise of the powers conferred by clause (iv) of sub-section (2) of Section 242 of the Tamil Nadu Panchayats Act, 1994 (Tamil Nadu Act No.21 of 1994) and in supersession of the Rules relating to Resignation of Chairman, Vice-Chairman, and Members of Panchayat Union Councils and the Tamil Nadu Panchayats (Resignation of Presidents, Vice-Presidents and Member of Panchayats) Rules, 1969, the Governor of Tamil Nadu hereby makes the following Rules:— RULES
1. Short title —These Rules may be called the Tamil Nadu Panchayats (Resignation of Chairman, Vice-Chairman and Members of District Panchayats, Chairman, Vice-Chairman and Members of Panchayat Union Council and of the President, Vice-President and Members of Village Panchayat) Rules, 1999.
2. Procedure for resignation of Chairman and President of Panchayat —A Chairman of a District Panchayat or of a Panchayat Union Council or a President of a Village Panchayat may resign his office by giving notice in writing addressed to the Inspector and deliver it in person or by post under acknowledgement.
3. Placing of the resignation of Chairman and President before the Panchayat —The Inspector shall convene a special meeting of the District Panchayat or Panchayat Union Council or Village Panchayat, as the case may be and place the resignation notice for information within fifteen days from the date of receipt of resignation notice before the District Panchayat or Panchayat Union Council or Village Panchayat as the case may be. If the concerned Chairman or President does not content the validity of his resignation, his resignation shall be deemed to have come into effect from the date of the meeting. The Secretary in the case of District Panchayat, the Commissioner in the case of Panchayat Union and President in-charge of Village Panchayat shall send a report to the Inspector and Tamil Nadu State Election Commissioner intimating the vacancy:

Resignation of Members, Vice-Chairman and Vice-President of Panchayat—Any Member or Vice-Chairman of a District Panchayat or of a Panchayat Union Council or any member or Vice-President of Village Panchayat may resign his office by giving notice in writing addressed to the Chairman of the District Panchayat or Panchayat Union Council or the President of Village Panchayat, as the case may be, and deliver it in person or by post under acknowledgement with a copy marked to the Inspector.
5. Placing of resignation of Members, Vice-Chairman and Vice-President of Panchayat—It shall be the duty of the Chairman of the District Panchayat, the Chairman of Panchayat Union Council, the President of Village Panchayat, as the case may be, to place the resignation notice at a special meeting of the District Panchayat or Panchayat Union Council or Village Panchayat as the case may be, for its information, within fifteen days of the receipt of notice of resignation. If the Chairman of District Panchayat or Panchayat Union Council or President of Village Panchayat does not for any reason, convene the special meeting, then the Inspector shall convene the same immediately. The notice for such meeting shall also be served on the person who tendered the resignation. If the member concerned or Vice-Chairman or Vice- President does not contest the validity of his resignation or does not raise any objection at such a meeting, his resignation shall be deemed to have come into effect from the date of the meeting.
The Chairman of District Panchayat or Panchayat Union Council or the President of Village Panchayat, as the case may be, shall send a copy of minutes of such meeting to the Inspector and Tamil Nadu State Election Commissioner alongwith a report intimating the vacancy.
