LABOUR WELFARE AND SKILL DEVELOPMENT DEPARTMENT Amendments to the Tamil Nadu Manual Workers Social Security and Welfare Board Scheme, 2006 & 15 other Welfare Boards Scheme under the Tamil Nadu Manual Workers (Regulation of Employment and Conditions of Work) Act.

No. II(2)/LWSD/471/2022.—In exercise of the powers conferred by Section 4 of the Tamil Nadu Manual Workers (Regulation of Employment and Conditions of Work) Act, 1982 (Tamil Nadu Act 33 of 1982), the Governor of Tamil Nadu, after consultation with the Advisory Committee, hereby makes the following amendments to the Tamil Nadu Manual Workers Social Security and Welfare Scheme, 2006:- Aඕඍඖඌඕඍඖගඛ.

In the said Scheme,-

1. in clause 9,-

(a) for sub-clause (2), the following sub-clause shall be substituted, namely:- “(2) Application for such registration shall be made through online to the Assistant Commissioner of Labour (Social Security Scheme) of the respective district in Form-I appended to this Scheme together with a certifi cate of employment issued by any of the persons or offi cers specifi ed below:-”

(b) in sub-clause (3) for item (a), the following item shall be substituted, namely:- “(a) The registration of the name of the manual worker with the Board shall be made by the Assistant Commissioner of Labour (Social Security Scheme) of the respective district after due online verifi cation by the respective Village Administrative Offi cer and for Chennai district, by the Revenue Inspector concerned”.

2. in clause 14, for sub-clause (1), the following sub-clause shall be substituted, namely:- “(1) Every manual worker whose name has been registered under clause 9, shall renew his registration through online before the expiry of the period of fi ve years specifi ed in that clause”.

3. for clause 15, the following clause shall be substituted, namely:- “15. Every registered manual worker who leaves or changes his service under an employer, or changes his scheduled employment to another, or migrates from one place to another place shall, within thirty days of such change intimate the Assistant Commissioner of Labour (Social Security Scheme) of the respective district through online”.

4. in clause 17, in sub-clause (3) for item (b), the following item shall be substituted, namely:- “(b) In the case of injury or loss of limbs or loss of eyesight specifi ed in items (b) to (e) of sub-clause (2), the claim shall be made through online by the registered manual workers concerned. In the event of death of a registered manual worker, the claim shall be made through online by his nominee in Form VII”.

5. in clause 18, in sub-clause (2) for item (a), the following item shall be substituted, namely:- “(a) Every registered manual worker who is eligible for pension under sub-clause (1) shall apply through online to the Assistant Commissioner of Labour (Social Security Scheme) of the respective district in form VIII & VIII-A as applicable:

Provided that a disabled manual worker who is eligible for pension under the proviso to sub-clause (1) shall produce to the Assistant Commissioner of Labour (Social Security Scheme) of the respective district a certifi cate of proof of his disability issued by a Medical Offi cer, not below the rank of a Civil Surgeon.”.

6. in clause 19, for sub-clause (2), the following sub-clause shall be substituted, namely:- “(2) The application for claiming the amount specifi ed in sub-clause (1) shall be made through online in Form IX and shall be accompanied by the death certifi cate of the deceased registered manual worker and the original identity card issued to the deceased worker.”.

7. in clause 20, for sub-clause (2), the following sub-clause shall be substituted, namely:- “(2) The application for claiming the amount specifi ed in sub-clause (1) shall be made through online in Form-IX and shall be accompanied by the death certifi cate of the deceased registered manual worker and the original identity card issued to the deceased worker.”.

8. in clause 21, after sub-clause (4), the following sub-clause shall be added, namely:-

(5) The application for claiming the amount specifi ed in sub-clause (1), shall be made through online.

9. in clause 22, for sub-clause (4), the following sub-clause shall be substituted, namely:- “(4) The application for assistance under this clause shall be made through online in Form-XIII.”.

10. in clause 23, for sub-clause (3), the following sub-clause shall be substituted, namely:- “(3) The application for claiming the amount specifi ed in sub-clause (1) shall be made through online in Form XIV.”.

11. in clause 24, after sub-clause (3), the following sub-clause shall be added, namely:-

(4) The application for assistance specifi ed in sub-clause (1), shall be made through online.

8. in clause 21, after sub-clause (4), the following sub-clause shall be added, namely:- “(5) The application for claiming the amount specifi ed in sub-clause (1), shall be made through online.

9. in clause 22, for sub-clause (4), the following sub-clause shall be substituted, namely.”.

“(4) The application for assistance under this clause shall be made through online in Form-XIV.

10. in clause 23, for sub-clause (3), the following sub-clause shall be substituted, namely:- “(3) The application for claiming the amount specifi ed in sub-clause (1) shall be made through online in Form XV.”.

11. in clause 24, after sub-clause (3), thefollowing sub-clause shall be added, namely:-

NOTIFICATION-III No. II(2)/LWSD/473/2022.—In exercise of the powers conferred by Section 4 of the Tamil Nadu Manual Workers (Regulation of Employment and Conditions of Work) Act, 1982 (Tamil Nadu Act 33 of 1982), the Governor of Tamil Nadu, after consultation with the Advisory Committee, hereby makes the following amendments to the Tamil Nadu Washermen Social Security and Welfare Scheme, 2006:- Aඕඍඖඌඕඍඖගඛ.

In the said Scheme,-

1. in clause 9,-

(a) for sub clause (2), the following sub-clause shall be substituted, namely:- “(2) Application for such registration shall be made through online to the Assistant Commissioner of Labour (Social Security Scheme) of the respective district in Form-I appended to this Scheme together with a certifi cate of employment issued by any of the persons or offi cers specifi ed below:-”

1. in clause 9,-

(a) for sub-clause (2), the following sub-clause shall be substituted, namely:- “(2) Application for such registration shall be made through online to the Assistant Commissioner of Labour (Social Security Scheme) of the respective district in Form-I appended to this Scheme together with a certifi cate of employment issued by any of the persons or offi cers specifi ed below:-”

No. II(2)/LWSD/476/2022.—In exercise of the powers conferred by Section 4 of the Tamil Nadu Manual Workers (Regulation of Employment and Conditions of Work) Act, 1982 (Tamil Nadu Act 33 of 1982), the Governor of Tamil Nadu, after consultation with the Advisory Committee, hereby makes the following amendments to the Tamil Nadu Handicraft Workers Social Security and Welfare Scheme, 2006:- Aඕඍඖඌඕඍඖගඛ In the said Scheme,-

1. in clause 9,-

(a) for sub-clause (2), the following sub-clause shall be substituted, namely:- “(2) Application for such registration shall be made through online to the Assistant Commissioner of Labour (Social Security Scheme) of the respective district in Form-I appended to this Scheme together with a certifi cate of employment issued by any of the persons or offi cers specifi ed below:-”

(b) in sub-clause (3), for item (a), the following item shall be substituted, namely:- “(a) The registration of the name of the manual worker with the Board shall be made by the Assistant Commissioner of Labour (Social Security Scheme) of the respective district after due online verifi cation by the respective Village Administrative Offi cer and for Chennai district, by the Revenue Inspector concerned.

2. in clause 14, for sub clause (1) the following sub-clause shall be substituted, namely:- “(1) Every manual worker whose name has been registered under clause 9, shall renew his registration through online before the expiry of the period of fi ve years specifi ed in that clause”

3. for clause 15, the following clause shall be substituted, namely:- “15. Every registered manual worker who leaves or changes his service under an employer, or changes his scheduled employment to another, or migrates from one place to another place shall, within thirty days of such change intimate the Assistant Commissioner of Labour (Social Security Scheme) of the respective district through online”.

4. in clause 17, in sub-clause (3), for item (b), the following item shall be substituted, namely:- “(b) In the case of injury or loss of limbs or loss of eyesight specifi ed in items (b) to (e) of sub-clause (2), the claim shall be made through online by the registered manual workers concerned. In the event of death of a registered manual worker, the claim shall be made through online by his nominee in Form VII.

5. in clause 18, in sub clause (2), for item (a), the following item shall be substituted, namely:- “(a) Every registered manual worker who is eligible for pension under sub-clause (1) shall apply to the Assistant Commissioner of Labour (Social Security Scheme) of the respective district through online in Form VIII & VIII-A as applicable:

Provided, that a disabled manual worker who is eligible for pension under the proviso to sub-clause (1) shall produce to the Assistant Commissioner of Labour (Social Security Scheme) of the respective district a certifi cate of proof of his disability issued by a Medical Offi cer not below the rank of a Civil Surgeon.”.

6. in clause 19, for sub-clause (2), the following sub-clause shall be substituted, namely:- “(2) The application for claiming the amount specifi ed in sub-clause (1) shall be made through online in Form IX and shall be accompanied by the death certifi cate of the deceased registered manual worker and the original identity card issued to the deceased worker.”.

7. in clause 20, for sub-clause (2), the following subclause shall be substituted, namely:- “(2) The application for claiming the amount specifi ed in sub-clause (1) shall be made through online in Form-IX and shall be accompanied by the death certifi cate of the deceased registered manual worker and the original identity card issued to the deceased worker.”.

8. in clause 21, after sub clause (4), the following sub-clause shall be added, namely:-

(5) The application for claiming the amount specifi ed in sub-clause (1), shall be made through online.

9. in clause 22, for sub-clause (4), the following sub-clause shall be substituted, namely:- “(4) The application for assistance under this clause shall be made through online in Form-XIII.”.

10. in clause 23, for sub-clause (3), the following sub-clause shall be substituted, namely:- “(3) The application for claiming the amount specifi ed in sub-clause (1) shall be made through online in Form XIV.”.

11. in clause 24, after sub-clause (3), the following sub-clause shall be added, namely:-

(4) The application for assistance specifi ed in sub clause (1), shall be made through online.

NOTIFICATION-VII No. II(2)/LWSD/477/2022.—In exercise of the powers conferred by Section 4 of the Tamil Nadu Manual Workers (Regulation of Employment and Conditions of Work) Act, 1982 (Tamil Nadu Act 33 of 1982), the Governor of Tamil Nadu, after consultation with the Advisory Committee, hereby makes the following amendments to the Tamil Nadu Palm Tree Workers Social Security and Welfare Scheme, 2006:- Aඕඍඖඌඕඍඖගඛ In the said Scheme,-

4. in clause 17, in sub-clause (3), for item (b), the following sub-clause shall be substituted namely:- “(b) In the case of injury or loss of limbs or loss of eyesight specifi ed in items (b) to (e) of sub-clause

6. in clause 19, for sub-clause (2) the following sub-clause shall be substituted, namely:- “(2) The application for claiming the amount specifi ed in sub-clause (1) shall be made through online in Form IX and shall be accompanied by the death certifi cate of the deceased registered manual worker and the original identity card issued to the deceased worker.

Explanation.- (1) Classifi cation of Zones:- Zones A, B and C shall comprise the following areas:

(1) Zone - A - Corporations.

(2) Dearness Allowance : In addition to the above minimum rates of basic wages, the employees shall be paid dearness allowance as follows:-

(i) The dearness allowance is linked to the Average Chennai City Consumer Price Index for the year 2010, that is, 161 points (with base 2001=100) and for every raise of one point over and above 161 points, Rs.38.45 (Rupees thirty eight and paise forty fi ve only) per month shall be paid as dearness allowance.

(ii) The dearness allowance shall be calculated from the fi rst April of every year on the basis of the average of the consumer price indices of the preceding twelve months, that is, from January to December.

(iii) The fi rst calculation of dearness allowance shall be eff ective from the date of publication of this Notifi cation in the Tamil Nadu Government Gazette based on the Average Chennai City Consumer Price Index Number of the previous year.

(3) Where the nature of work is the same, no distinction in the payment of wages shall be made in the case of men and women employees.

(4) (i) To arrive at daily wages, the monthly wages shall be divided by 26.

(ii) To arrive at monthly wages, the daily wages shall be multiplied by 30.

Explanations.- (1) Classifi cation of Zones.- Zones A, B, C and D shall comprise of the following areas:- Zone A -- Municipal Corporations.

(2) Dearness Allowance.- In addition to the minimum rates of basic wages fi xed above, the employees shall be paid dearness allowance as indicated below:-

(i) The dearness allowance shall be linked to the average Chennai City Consumer Price Index Number for the year 2010 (that is, 161 points with base 2001=100) and for every raise of one point over and above 161 points, an increase of Rs.1.25 (Rupee one and paise twenty fi ve only) per day shall be paid as dearness allowance.

(ii) The dearness allowance shall be calculated every year on the fi rst April, on the basis of the average of the consumer price indices for the preceding twelve months, that is, from January to December.

(iii) The fi rst calculation of the dearness allowance shall be eff ective from the date of publication of this Notifi cation in the Tamil Nadu Government Gazette, based on the Average Consumer Price Index Number of the previous year.

(3) Where the same work or work of a similar nature is performed by women, no distinction in the payment of wages shall be made between men and women employees.

(4) To arrive at monthly wages, the daily wages shall be multiplied by 30.

(5) Wherever the existing wages are higher than the minimum wages fi xed herein, the same shall be continued to be paid.

1. The Revenue Settlement work (hereinafter, “the work”) shall be undertaken by the Revenue Divisional Offi cer, Virudhachalam, specially appointed for the purpose of conducting this work under the supervision of the Settlement Offi cer/Director of Survey and Settlement, Chennai. The main object of the work is to class the lands as Ryoti or Government; classify the soil, determine Taram and levy assessment; and issue patta to actual and lawful cultivators/ occupants on ryoti lands, in the area specifi ed in Annexure-I to this notifi cation, on par with other parts of this Village and adjoining revenue Villages after conducting a detailed fi eld inspection and adopting settlement processes by Revenue Divisional Offi cer, Virudhachalam, subject to the modifi cations explained below. Simultaneously, the Settlement Records will be prepared and handed over for District Administration for maintenance.

II. SETTLEMENT PROCESSES

2. All the lands at the disposal of the Government which are now used or required for Communal/Public or Government purpose shall be registered as Porambokes.

The un-occupied lands at the disposal of the Government shall be registered as ‘Government-Waste/Tarisu’ or ‘Government-Vacant site’. These un-occupied lands may be assigned as per Assignment rules/RSO and any other rules in force, subject to the levy of revisable rates of assessment/ground rent.

3. All the lands now used for cultivation purposes shall be classed as Wet or Dry or Manavari, as per their irrigation sources and levied assessment. Before determining such classes, the wishes of the ayacutudarars enjoyers of the respective fi elds, villagers shall ordinarily be ascertained and considered. The lands allotted by the District Administration to the displaced people have to be considered for determining the classifi cation as ‘Ryoti’.

4. The lands used for dwelling purposes will be settled as per the Natham settlement notifi cation published in G.O.1971, Revenue department, dated 14.10.1988 and the amendments thereon. Also, the Ground rent will be levied as laid down in that notifi cation. If the natham settlement work has been completed by following the due procedures, such records will be considered and taken into account.

5. When the agricultural lands are converted into building sites or used for non-agricultural purposes, they shall be subject to the levy of permanent non revisable manai rates as laid down in the Natham settlement notifi cation published in G.O.1971 Revenue Department dated 14.10.1988 or at the prevailing rates, with eff ect from the fasli year in which such conversions take place.

6. Channels, path and other similar porambokes, not exceeding 20 links in width, will be shown as ‘Details’, except in special cases such as building sites or Assigned/ Alienated lands. The inclusion of poramboke land in such registered holdings does not alter the tenure of such land or confer any right over such land on the registered holders in whose fi elds the poramboke land is included and the Government do not forego or abandon any of their rights in such land.

7. The Classifi cation of soils (such as regar, ferruginous, arenaceous etc), sub-division of soils into Series (such as clay, loam and sand etc), Grading of soil series into Sorts (such as best, good, ordinary, inferior and worst), determination of Taram according to the yield of standard crops or productive capacity of soils, Classifi cation of irrigation sources, Grouping of lands and the determination of Money Rates based on Taram & Grouping had already been settled in the main part of this Village. Hence, the same principles for classifi cation of sort-soil, determining Taram and Money rates shall be followed. The same Arabic numerals following the Roman numerals shall be used to denote the sort of soil and Tarams. In the absence of any such information, the Money Rates followed in neighbouring Villages of same Taram and Group standard will be considered and decided appropriately.

8. Water-cess on dry and Manavari lands, irrigated from Government sources will be levied as per RSO and other applicable rules in force. The right to charge ordinary or enhanced water-cess, on the use of water from a well or pond used for communal purposes is however reserved.

The Government also reserve to themselves the right to impose at any time during the period of settlement, whatever additional assessment they may deem necessary on the dry land on which wet crops are or may hereafter be raised, as per the opinion of the district authorities.

9. The lands remain as Forest or notifi ed under sec.4 of the Indian Forest Act for conversion into Reserved Forest, should not be considered for this work.

10. Lands irrigated solely from private wells situated in the holdings of ryot will remain free from extra charge and all such lands will be classed as dry.

11. Fishery rights vesting in Government will be dealt with in accordance with the orders or rules in force.

III. PREPARATION OF ROUGH ACCOUNTS/RECORDS AND FINAL SETTLEMENT ENQUIRY 12 (a) Settlement process, as above, will be performed by inspecting each and every survey fi eld. In this process, Settlement Accounts/Records such as Settlement Forms (S.F-1 to S.F-10), Rough Accounts such as Rough Adangal, Rough Chitta, Manai Register; and Rough Survey and Settlement Land Register will be prepared.
