20.02.2006, 3RT f^TT W I MINISTRY OF COMMERCE AND INDUSTRY (Department of Commerce) NOTIFICATION New Delhi, the 25th October, 2016 G.S.R. 1007(E).—Whereas certain draft rules further to amend the Tea Rules, 1954 were published, as required by sub-section (1) of section 49 of the Tea Act, 1953 (29 of 1953) in the Gazette of India vide notification of the Ministry of Commerce and Industry (Department of Commerce) number G.S.R. 465(E), dated the 3rd August, 2016, inviting objections or suggestions from all persons likely to be affected thereby, within a period of thirty days from the date on which the Gazette in which the said notification was published were made available to the public;

And Whereas the copies of the said Gazette were made available to the public on the 5th August. 2016:

And Whereas no objections or suggestions were received from the public by the Central Government;

Now, Therefore, in exercise of the powers conferred by sub-section (2) of section 49 of the Tea Act, 1953, the Central Government hereby makes the following rules, namely:-

1. (1) These rules may be called the Tea (Amendment) Rules, 2016.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Tea Rules, 1954 (hereinafter referred to as the principal rules), in rule 4, in sub-rule (1), after clause (a), the following clause shall be inserted, namely:- "(aa) Deputy Chairman of Tea Board-e^-o/f/do;".

3. In principal rules, in rule 12,- (A) in sub-rule (2), for clause (a), the following clause shall be substituted, namely:- "(a) The Deputy Chairman who shall be the ex-officio Chairman thereof; and";

(B) in sub-rule (2), clause (b) shall be omitted;

(C) in sub-rule (3), for clause (i), the following clause shall be substituted, namely:- "(i) The Deputy Chairman who shall be the ex-qfficio Chairman thereof; and";

4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (D) in sub-rule (4A). for clause (i), the following clause shall be substituted, naniely:- "(i) The Deputy Chairman who shall be the ex-officio Chairman thereof; and";

(E) in sub-rule (4B), for clause (i), the following clause shall be substituted, namely:- "(i) The Deputy Chairman who shall be the ex-officio Chairman thereof; and";

(F) in sub-rule (4C), for clause (a), the following clause shall be substituted, namely:- "(a) The Deputy Chairman who shall be the ex-officio chairman thereof; and".

4. In the principal rules, for rule 20A, the following rule shall be substituted, namely:- "20A. An advance for building a new house (including purchase of land) or for the purchase of a ready built house or for enlarging living accommodation of an existing house owned by an employee of the Board shall be granted by the Deputy Chairman of the Board at such rates and such conditions applicable to the Central Government employees from time to time.".

5. In the principal rules, in rule 36, in sub-rule (1), for the words, "may delegate to the Standing Committee or to the Chairman, Deputy Chairman, Secretary or any other officer of the Board specially authorized in this behalf by the Chairman, such financial powers as it may consider expedient:", the words "may delegate to the Standing Committee or to the Deputy Chairman.

6. In the principal rules, in rule 38,- (A) in sub-rules (2) and (4), for the word "Chairman", wherever it occurs, the words "Deputy Chairman" shall be substituted;

(B) for sub-rule (3), the following sub-rule shall be substituted, namely:- "(3) Contracts shall not be binding on the Board unless they are executed by the Deputy Chairman or the Secretary and the common seal of the Board is affixed thereto.".

7. In the principal rules, in rule 40,- (A) for the word "Chairman", the words "Deputy Chairman" shall be substituted;

(B) after the second proviso, the following proviso shall be inserted, namely:- "Provided also that the Central Government shall be the competent authority to approve tour programme of the Chairman and Deputy Chairman for visiting foreign countries.".
