(1) Any person who, whether at his own instance or at the instance of any other person or anybody including a department of the Government, undertakes, or carries out development of any land in contravention of the Master Plan or Zonal Development Plan or without the permission, approval or sanction referred to in section 13 or in contravention of any condition subject to which such permission, approval or sanction has been granted 48[shall be punishable with imprisonment for a term which may extend to three years or with fine which may extend to 49[twenty percent of the value of the land in question as fixed by the Registration Department at the time of undertaking development of any land] or with both,] and in the case of a continuing offence, with further fine which may extend to 50[one percent of the value of the land in question as fixed by the Registration Department at the time of using the land or building,] for every day during which such offence

Penalties.

[Act No.1 of 1975] 49 continues after conviction for the first commission of the offence.

(2) Any person who uses any land or building in contravention of the provisions of section 15 or in contravention of any terms and conditions determined by regulations under the proviso to that section 51[shall be punishable with imprisonment for a term which may extend to three years or with fine which may extend to 52[ten percent of the value of the land or building in question as fixed by the Registration Department at the time of using the land or building] or with both,] and in the case of a continuing offence with further fine which may extend to 53[one percent of the value of the land or building in question as fixed by the Registration Department at the time of using the land or building] for every day during which such offence continues after conviction for the first commission of the offence.

(3) Any person who obstructs the entry of a person authorised under section 40 to enter into or upon any land or building or molests such person after such entry, shall be punished with imprisonment for a term which may extend to six months or with fine which may extend to one thousand rupees, or with both.

54[(4) Any person who deals with the development of land or building by way of sale or otherwise to enable or facilitate the construction of group of houses or colony in contravention or without compliance of the provisions of the Act or Rules and Regulations made thereunder shall be

50 [Act No. 1 of 1975] punishable with a fine equivalent to twenty percent of the value of the land in question as fixed by the Registration Department at the time of undertaking development of any land and in the case of continuing offences with further fine which may extend to fine equivalent to one percent of the value of the land in question as fixed by the Registration Department at the time of undertaking development of any land for every day during which such offence continues after conviction for the first commission of the offence:

Provided that the fine imposed shall in no case be less than fifty percent of the fine prescribed under the above subsection.]
