Notification Commissioner of Sales Tax, Maharashtra State, Vikrikar Bhavan, Mazgaon, Mumbai. Dated the 6™ October 2005 Maharashtra Value Added Tax Act, 2002. No. JC(HQ)1/VAT/2005/195. - In exercise of the powers delegated under sub-section (3) of section 10 of the Maharashtra Value Added Tax Act, 2002 (Mah. IX of 2005), the Commissioner of Sales Tax, Maharashtra State, Mumbai hereby specifies the entire area comprised within the State or, as the case may be, the local areas, specified in column (3) of the Schedule hereto, to be the areas over which the different authorities, holding for the time being the respective posts specified in Column (2) against the said areas, shall have jurisdiction
2. The Commissioner of Sales Tax, further specifies that where under the provisions of Rule 19 of the Maharashtra Value Added Tax Rules, 2005 consolidated returns are to be furnished by a registered dealer to any Sales Tax Authority and such dealer is registered within the jurisdiction of that Authority and also within the jurisdiction of any other Sales Tax Authority then such Authority to whom the consolidated returns are to be furnished shall, without prejudice to anything contained in paragraph 1, also have jurisdiction over the local area in which the place or places of business of the dealer in respect of which such consolidated returns are to be furnished, is or are situated.
3. The Commissioner of Sales Tax also specifies that where any dealer registered in respect of any place of business has places of business within the jurisdiction of different registering authorities and such dealer is not a registered dealer in respect of any such place or places of business, then the Sales Tax Authority within whose jurisdiction any place of business in respect of which the dealer is registered, is situated, shall, without prejudice to anything contained in paragraphs 1 and 2, also have jurisdiction over the local area containing the place or places of business in respect of which the said dealer has not obtained a certificate or certificates of registration.
