(2) They shall come into force with immediate cilcci.
2. la these regulations, unless the context other wise requires,—
(a) 'Act* means the Indian Veterinary Council Act, 1984 (52 of 19#4).
t b) 'Council' means ths Versrinary Council of India constituted under the Act;
HV "Employees oC the Counc/I' means persons tppomled under sub-section (I ) of section 11 of the Act to carry out '.he purposes of the Act;
(d) 'Executive Commiitee1 or 'Committee' means the Executive Committee or Com mittee constituted under sub-section (I) of section 12 of the Act ;
(c) 'Group X> st&ff includes the Daftries, Jamadars. Teons, Chow-kidars and Sweepers appointed uader suh-secion (1) of section II of the Act;
(f) 'Inspector1 means a veterinary inspector appointed under sub-section (I) of section 19 of the Act;
(g) 'Member' means a member elected or nomi nated under section 5 of the Act;
(h) 'Ministerial Staff means Superintendent, Head Qerir Accotintaat, Accounts Assis tant, Cashier. Receptionist, Computer Operator. Clerks, Stenographers Typists, Gestetner Operafor, Staff Car Driver appointed under sub-section (1) of section i l of the Act;
fi) 'President1 means the President of, the Vete rinary Council of Ijidia elected under sub section (4) of section 3 of the Act;
(j) 'Vice-President' means _ the Vice-President of the Council elected • uoder sub-section
(4) of section 3 of the Act;
(k) 'Secretary' means the Secretary of the Coun cil appointed under -sub-section (!) of section 11 of the Act; t (J) "VisUor* means a visitor appointed under sub-section (1) of section 20 of the Ac* ;

4. (1) Meetlusi of the Council shall nrcMnarily be \\-M 'at Delhi or at such other places and en such dates and time as may be specified by the Council :

5. At meetings specified in tbe. proviso to clause
(1) of regulation 4. only the subject or subjects for the consideration of which the meeting has been cal led shall be discussed.
NOTICE OF MEETINGS
6. 0 ) Notice of every meeting other than a spe cial meeting called under the proviso to clause (1) of regulation & or under the first proviso to sub-clause
(b) of clause (1) of regulation S shall be despat ched by the Secretary to each member of the Coun cil not bss than thirty days before the date of the meeting- (2; NoJics of every meeting of the Council shall be rVcspa:ehetf under certificate of posting and noQ-receMit of any notice shall not however, invali date the proceedings of any meeting, AGENDA PAPERS
7. (1) The Secretary shall issue with tha notice of the meeting a preliminary agenda paper specifying the business to be brought heforc the meeting, the terras of all ir,ofions to be moved of which notice in writing has previously reached him and the names of the movers.
(2) A mc-mher who wkhes t.n move any motion not included in the preliminary agenda paper or an amendment to any item so included shall give notice thereof to lb? Secretary not less than fifteen clear 'days before the dst- flsed for the meeting.

(3) The Secretary shall, not less than fifteen clear days before the date fixed for the meeting and in the case of a special meeting with the notice of the meet ing issue a complete agenda paper specifying business to be brought before the meeting.
(4) A member who wishes to move r,n amendment to any item included in the complete agenda paper, •VA-. no: mck'ded in the mcliminary agenda paper, shall give notice thereof to the Secretary not less ihan three clear days before the date fixed for the meeting.
(5) The Secretary shall, if time permits, cause a iisi; oi ail amendment oi which notice has been given under clause (4) to be made available for the use of every member :
Provided that nothing in this regulation shall pre vent under special circumstances the reference by the Exe"cutiv2 Committee of any matter to the Council at a meeting following immediately or soon after the meeting of the Executive Committee to permit the notice required under this regulation.
ADMISSION OF MOTION S. (1) The President shall disallow any motiou,—
(a) if the matter to which it relates is not with in the scope of the Council's functions;
(b) if it raises substantially the same question as a motion cr amendment which has been moved or withdrawn with the leave of the Council, within one year of the date of the meeting at which it i* to be moved :
Provided that such a motion may be admitted at a special mee'ing of the Council convened for the pur pose on the requisition of not less than two thirds of the member.? of the Council :
Provided further that nothing in these regulations shall prohibit the further discussion of any master re ferred to the Council by the Central Government in the exercise cf any of its i'unc'ions under the Act;
(c) unless it raises substantially one definite issue;
(d) if it con'aios arguments.- inferences, ironical .<• expressions, imputations or defamatory statemen 1s:
Provided that if a motion can be rendered admissi ble by amendment, the President may in lieu of dis allowing the motion admit it in an amended roni":
(2) When the President disallows or amends a motion the Secret aiy shall inform the member who gave the notice of the motion of the order of dis~ cliatvance or, as the cass may bs, of ihe form in which the motion has been admitted.

(2) All references in this pari to the President shall be read as referring to the person for the time being presiding over a msermg, 1C- Ti>2 quorum accessary for transaction of busi ness at a meeting of the Council shall be Nine. If, at the time appointed for a meeting, the quorum is not present, and if the quorum is not present, on the ex piration of thirty minutes from .the rime appointed for the meeting or during the course of any meeting; the meeiJnsr shall stand adjourned to such future tims and date as the President may appoint.
IT (X) Every matter to bs determined - by the Council shall be moved by a member and put to the Council fey the President and shall be decided by a majority of the members present and voting.
(2) Votes shall be taken by show of hands or by division or hy "ballot, as the President may direct:
Provided that votes shall be taken tiy ballot, if three members so desire and ask for it : f
Provided further that, if voting has been by show of hands, a decision shall be taken, if at least one member asks for it.
(3) The President shall .determine the method of takm,!* votes by division.
(4) The result of the vote shall be announced by the President which shall be final. i
(5) In the event of as equality of votes the Presi dent shall have a casting vote,
12. When motions identical in purport stand m the names of two or mcr;e members, the President shall decide whose motion shall be moved and the other motion or motions shall thereupon be deem ed to have been withdrawn.
13. (3) Every motion or amendment shall be seconded and-if not seconded shall be deemed to have been withdrawn.
(2) When a motion has been seconded, it shall be stated by the President.
C3> When a motion has been thus stated, it may be discussed as a question to be resolved either in the affirmative or in the negative, or any member may subject to regulations 14 and 15, move an amendment to the motion:
Provided that the President shail not allow an amendment to be moved which, if it has been a sub stantive motion, would have been inadmissible under regulation 5.
14. (1) An amendment must be relevant to and within the scope of the motion to which it is propos ed,
(2) An amendment may not be moved which has Merely the effect of a negative vote,
(3) The President may refuse to put to the Council an amendment which in his opinion is frivolous.
15. A motion may be amended b y - fa) the omission, insertion or addition of word or words;
(bj the- substitution of words for any of the ori ginal words.
16, (1) When a^motion or amendment is ui debate, no proposal with reference thereto shall Be made other than,—
(a) an amendment of the motion or of the amendment %$ the case may be, as propos ed in regulation 13;
(b) a motion for the adjournment of the debate on the motion or amendment either to a specified date and hour or sine die;
(c) a motion for the closure* namely, a motion that the question be now put;
(d) a motion that the Council instead of pro ceeding to deal with the motion, do pass to the next item on the programme ot busi ness ;
Provided Jhat no such motion of amendment shall be moved so as fa interrupt a spteech :
Provided further that no motion of the nature specified in sub-clauses (b;, (c) and (d)f shall be moved or seconded by a member who has "already spoken on the question at the meeting:
Provided that no snch motion or amendment shall :;es fe) and (d) shall be moved without a speech.
(2) Jt shall be in the discretion of the President to put or refuse to pet to tht Council a proposal of the nature specified in sub-clause (b) of clause (1),
(3) Unless the President is of the opinion that a motion for closure is an abuse of the right of reason able dsbne he shall forthwith put a motion .that the question be now put and if that motion is carried the substantive motion or amendment under debate shall be put forthwith:
Provided that the President may allow the mover of the substantive motion to exercise his right of reply before the substantive motion under debate is put.
17. A motion or an amendment which has been moved end zzccndsd shall not be withdrawn save with the leave of the Council which shall not be deemed to be granted, if any member dissents from the grantin (j of lesv?

Provided that the seconder of a motion or of an amendment may, with the permission of* the President, confine himself to seconding the motion or amend ment, as the case may be, and speak thereon at aay subsequent stags of Ous debate.
19. During she meeting, the President may, at any time tasks aay objections or suggestions or give in formation to elucidate any point to help the members in the discussion.
20. (1) The mover of an original motion, and if permitted by the President, the mover of any amend ment, shall bs entitled to a right of final reply; no other member shall speak more'than once to any dehate except with pexmission of- the President, for the purpose of making a personal explanation or of putting a question to the member than addressing the Council:
Provided that any member at any stage or ih£ debate may rise to a point of order, but no speech shall be allowed on that point :
Provided further that a member who has spoken on a motion may $>eak again on the amendment subse quently moved to the motion,
(2) No member shall, save with the permission of the President, speak for more than five minutes.
Provided that the mover of a motion when, moving the same may speak for not more than ten minutes,
(3) A speech shall be strictly confined to the subject matter of the motion or amendment on which it is made.
(4) Any motion or amendment standing m the name of a member who is absent from the meeting or unwilling to move it, may be .brought forward by an other member with the permission of the President.
21. (1) A member desiring to make any observation on the matter before the Council, shall rise in his place and address the President.
(2) If at any time the President rises to speak any member speaking shall immediately resume his seat.
22. No member shall be heard at a meeting except upon t}\e business before the Council.
23. f 1) When an amendment to any motion is mov ed and seconded or when two or more such amend ments are mnved and seconded, the President shall, before taking the sense of the Council thereon, state or read to the Council the terms of the original motion and of the amendment or amendments proposed.
(2) An amendment to a motion shall be put to the vote first,

24. When any motion involving several points has been discussed, it shall be in the discretion of the President to divide the motion and put each or any point separately to the vote as he may think fit.
25. (1) The President may, if he deems necessary QUA to exigencies, at any tmie, adjourn any meeting to aay future day or to any hour of the same day snd state'the reasons therefor.
(2) Whenever, a meeting is adjourned to a future day, the Secretary .shall, send notice of the adjourn ment to every member who was not present at such meeting.
(3) When a meeting has been adjourned to a future day the President may change such day to any other day fox compelling reasons and the Secretary shall send written notice of the change to each member.
(4) At 3 meeting adjourned to a future day any motion standing over from the previous day shall, unless the President otherwise directs, take precedence over other matters on the agenda,
(5) The President or a member may suggest a change in the order of business on the agenda, either at the beginning of the meeting or after the conclusion of the debate on a particular item during the meeting and If the Council agrees, such a change shall be made.
(6) No matter which nad not been on the agenda of the original meeting shall be discussed at an ad journed meeting.
(7) The same quorum shall be necessary for an adjourned meeting as for ah ordinary meeting.
26. (1) The President shall decide all points of order which -may arise, and his decision shall he final.
(2) Jf any question, arises with reference to pro cedure in respect of a matter for which these regula tion make no provision, the President shall decide the, same and .his decision thereon shall be .final,
(3) The President shall direct any business, which may be necessary for the Council or the Executive Committee to discuss and decide, to be transacted by circulation among the members of the Council or the Executive Committee as the case may be :
Provided that if ten members of the Council or three members of the Executive Committee, as the case may be, desire that any particular subject shall be decided at a meeting instead of by circulation, it shall be placed before a meeting of the Council or the Executive Committee,
(4) Any resolution or report which is circulated as stated above and approved by a majority of the mem bers signing shall be binding as a resolution adopted, as if, in a meeting of the Council or the Executive Committee.
27. Four representatives of the Press at the discre tion of the^ President. and other invitees, not exceeding four at a time, may be admitted to a meeting on pro duction of permits from the Secretary, The representa tive s chs!! be required to obtain the previous approval h 12 THE GAZETTE OF INDIA:
of the Secrs;ary to the publication of their report uf the proceeding. The President at any time may hold the meeting in camera in which case all invitees sbail be required to withdraw.
PART 111 MINUTES OF THE COUNCIL 28, The proceedings of the meetings of the Counc0 shall be preserved in tne form of printed minutes which snail be authenticated, after coiifrrmaiion, by the signa ture of the President, 29, A copy of the minutes of each meeting shall be submitted to the President within ten days of the meeting and attested by him and they shall then be sent to each member within thirty days of the meet ing- 30, The minutes of each meeting shall contain such motions and amendments as have been moved and adopted or negatived with the name of the mover and the seconder, but without any ccmrnem and. without any record of observations made by any member at the meeting- 31, If any objection regarding the correctness of the minutes is received within thirty days of the despatch of the minutes by the Secretary such objection toge ther with the minutes as recorded and attested shall be put before the next meeting of the Council for confir mation. At this meeting no question shall be raised excet as the con'ec'ness of the records of the meeting-.
Provided that if no objection regarding a decision taken by the Council at a meeting is received within thirty days of the despatch by the Secretary of the minutes of that particular meeting, such decision may, if expedient, be put into effect before the confirmation of tbe minutes at the next meeting : i
Provided further that the President may direct that action may be taken on a decision of the Council be fore' tbe expiry of the period of thirty days specified above.

33. A report shall be kept of the .observations and of 'he discussions at the meetings of the Council in an accurate manner as far fis possible: for perusal by the members of the Council. The detailed proceedings of the meetings which shall be treated as 'Confidential1 shah be kept ia the -office and shall be opcu to mem bers for inspection, A copy of the proceedings in full or in part shall be supplied to any member, who mayapply for it. Such copy shall be 'Confidential' and sup plied on '.he payment of fee fixed by die President and such fee shall not exceed the cosi of copying. EXTRAORDINARY {PART II—SEC. T^S '
PART IV POWERS AND DUTIES OP THE PRESIDENT AND VICE-PRESIDENT 34, (1) The Presided! shall exercise such powers and perform such duties as are contained in the' provisions of she Act, the regulations, and standing orders of the Council. Ke shall do such acts as he considers neces sary in furtherance of tbe objects fo? which the Council is established.
(2) In the case of urgency, the President may take the necessary action and intimate the fact to -he Exe cutive Commit:ee and She Cmmeil provided that n.c such action shall be taken in anticipation of approval in matters of policy involving an expenditure exceeding Rs. 10,000 from the sanctioned budget. •.
35, If the office of the President is vacant or if tbe President for any reason is unable to exercise the powers or perform the duties of his office, the Vice- President shall act in his place and shall exercise the powers and perform the duties of the President.
PART V RESIGNATION AND FILLING OF CASUAL VACANCIES
56. A member desiring to resign hts seat on the Council shall send his resignation in writing to the President and his resignation shall take effect from the date on which it is accepted by the President or on the expiry of ninety days from the date of receipt of his letter to President, whichever is earlier, after con firmation from tbe member concerned.
37, When a casual vacancy by reason of death, resignation of a member or cessation of membership in accordance with section 6 of the Act, a report shall be made forthwith by the President to the Central Go vernment for necessary action to fill up the vacancy, subject to proviso of section 7 of the Act.
PART VI THE EXECUTIVE COMMITTEE-MEMBERSHIP, FUNCTIONS, MEETINGS ETC.
33. The Executive Commit:..,; shall have Nine mem bers including the President, the Vice-President and the Secretary of the Council who shall act as Presi dent, Vice-P'resiuent rmd Secretary respec'ivefy.
39, The meetings of the Executive Committee shall te generally governed by the regulations applicable to the meetings of the Council.
40. If at the time appointed for a meeting of the Executive Committee a quorum is not present the meeting shall not commence until a quorum is present, and if a quorum is not pre^-nt en the expiration of an hour from, the time appointed for the meeting or bring the course of any meeting, the meeting shall stand ad journed to such future date and time as the President mav- annoint J '3 of the tote!! members of the HxecufiW C^nsirtee ?A?M f.lrm :. quorum.

42. When a meeting of the Executive Committee is adjourned lor want of quorum, no quorum shall bs necesary for the adjourned meeting.
43. (1) The term of office of an elected member of the Executive Committee shall be for three years from the date cf his election or till the next Executive Committee takes over after its appointment which ever is later:
Notwithstanding anything contained herein, the Executive Committee shall cease to function with the -termination of the Council that appoints :he Commit tee, irrespective of the reasons fcr termination of the Council.
(2) A member of the .Executive Committee shall be eligible for re-appointment,
44. The Executive Committee may invite a member of the Council who is not a member of the Executive Committee to attend any meeting of the Executive Committee, Any member so invited shall be fre? to participate in the discussions if the Executive Com mittee but shall not have the right to vote.
\45. Within one week before the meeting of the.
Council, the Executive Cnmmittee shall ordinarily meet at die same place &s of the Council meeting. The other meetings of the-Executive Committee may take place at such other times and places as the President may determine. Notice and agenda of such meetings of the Executive Committee shall ordinarily he given not less than 12 days before the meeting. J?
46. The- Executive Committee shall take iuio consi deration the reports on the course of study, facilities for reaching and examinations, submitted by inspec tors) visitors and shall thereupon prepare a report fori, submission to the Council.
4?- The Executive Committee shall exercise all the powers of the Council in the implementation of the decisions of the Council and shall Jsave the power "o take decisions on behalf, of the Council in all matT ters except these falling in the sphere of other Com- • mittees. It shall also perform all the functions of the Council that are of administrative nature : i •̂ "HProvided that this shall not appJy to matters of policy involving an expenditure exceeding Rs. 25.000 per annum from out of the sanctioned budget provi sion of the Council that are of administrative nature.
45. A copy of the minutes of each meeting of the Executive. Committee, shall be admitted to the Presi dent withjji fifteen days cf the meeting, and after hav ing bee;v attested by him shall be seat to each member of the Executive Committee within twenty days of the meeting.

PART VH COMMITTEES
49. (1) The Council may at any time on the adop tion of a motion to this effect, constitute any or all of the following Committees, namely :—
(a) Education Committee;
(b) Regulations Committee;
(c) Finance Committee; •

(e) Liaison Committee.
(2) The powers and functions of each Committee and the number of its members snail be determined at the time of the constitution of the Com mittee and unless the Council otherwise specifies, each Committee sliyJJ have full power, within the sphere of the functions assigned to it, to take decisions :
Provided, however, that its decisions shall be sub ject to ratification by the Council in the following cases, namely:— (_i) where matters of policy are involved;
(ti) where the Committee's decision involves an expenditure on items exceeding Rs. 1,000- per annum from out of the sanctioned bud get; and
(iii) where according to the provisions of the Act, regulations :or standing orders of tlw Coun cil, order's of the Council are necessary.
(3) The Chairman -of each of these Committees shall be elected by respective members of the Com mittee.
(4) ]f a motion for appointment of a Committee is adopted, the mover shall name the members to be appointed as members of the Committee and any mem ber may then moves amendments proposing the addi tion of oilier nam6s.
(5) If the number of members proposed as mem bers of the Committee does not 'exceed the total number of members to form 'the Committee, the "* members ô proposed shall be appointed as member of the Committee. If the number of members so pro posed exceeds, the total number of members to form the C'omsrdt'e;, ballot shall" be held and the requisite number of members, who obtain the largest Dumber of votes shall be appointed.
50. (1) The Council may at any time, on the ddoptior. of a motion to this effect, appoint any other Committee.

61. The Bankers of the Council snail be the local branch of State Bank of India. All funds of the Coun cil shall 03 paid into the. Thc cheque books shall remain in the personal custody of the Secretary.

(i) in promissory notes, stock or other securities of any State or Central Government;
fii) in stock or debentures or shares in com panies, interests* which have been guaranteed by the Government of India; and
(ili) in debentures or ether" securties for money issued under the authorities of an Act or on twshalf of any Municipal Body, Port Trust' or City Improvement Trust,
63. An investment of five funds of the Council shall be mad© m the name of the Council. The safe custody of receipts shall remain in the personal charge of the Secretary end shall be verified once in six months with the register of securities maintained under regula tion 71 and a certificate of verification shall be record ed by the Secretary on the register apd countersigned by the President.
64. The Finance Committee shall prepare- detailed estimate of receipts and expenditure for fhe next finan cial year and shall submit'the same for approval by the Executive Committee at its nest meeting to be held for the mirpose before the first tf November every year. One copy of the approved estimates shall be submitted to the Council and another to the Secretary Department of Animal Husbandry- and Dairying, Government of India, &y the first of November every year, ?
65. The funds of the Council shall not be appronriared for expenditure on any i*e® which has.'nof .
bees duly sanctioned by the. Council or by the Presi dent Gr Secretary as the case may be.
ai npto Tm President shall have power to re appropriate funds from one unit of appropriation to another with in the total sanctioned estimate. Copies, of orders sanc tioning such reappropfiatioh shall be communicated to fhe Executive Committee.
68. The Secretary shall have p6wsi to sanctlc-i penditure on miscellaneous and contingent nature an amount net exceeding lis. 500 in each case, .ex penditure in excess of thai amount shall recmirs the sanction of t!re President.
69. A permanent advailcs of Rs. 500 shall be made to the Secretary.
70. The Secretary 'shall be the certifying officer" fat travelling baiting and other allowances to Members, Inspectors, Visitors and/ o'her employees of the Coun cil and the president for those of the Secretary.
71. The following register's shall be maintained by the Council, namely,-™
(1) The Cash Book,
(2) the Classified Abstract.
(3) The Register.of Securities, (4-) The Register of Stoclc and Furniture,
(5) The Register of Stock of Cheque Books,
(6) The (Register of leave, Provident Fund and pension eon fribuf iocs',
(7) The Register a? permanent advances.
(8) Animal Accounts, and
(9) Any other account Register".
72. The monthly accounts shall be compiled in the classified abstract according to the primary units of appropriation. Suitable secondary units may be open ed at the discretion of the Secretary, who shall be responsible for the due preparation and maintenance of ail accounts.
73. (1) The Accounts of the Council shall be- audit ed annually by the Comptroller and Auditor-General of India or any person appointed by him in Utis behalf.
Any expenditure incurred by hinr'.or any person's© appointed k connection with such audit shall be pay able by the Council.
