If any person who has been convicted of any offence punishable under this Act is again found guilty of an offence involving a contravention of the same provision, he shall be punishable on a subsequent conviction with imprisonment for a term which shall not be fess than one month, but which may exterid to six months and with fine which shall not be less than five hundred rupees, but which may extend to two thousand rupees <
Provided that for the purpose of this section , no cognizance shall be taken of airy conviction, made more than five years before the Commission. of the offence which is being punished.
25. ‘Offences by compantes,—(1) Where an offence under this Act has been. committed. by a company, every person who at the time the offence was committed, was in charge of, and was responsible to the Company for the conduct of the business of Company, as well as the Company, shall be deemed to be guilty of the offence and shall be liable to be proceeded against and punished accordingly :
Provided that nothing, contained in, this stib-section, shall render any such person liable to any punishment if he proves that the offence was committed _without his knowledge or that he exercised afl due diligence to prevent the ‘Commission of such offence.
(2) Notwithstanding anything contained in sub-section (1) where an offence under this Act has been committed by a company and it is proved that : the offence has been committed with the consent or connivance of or is aitri- , butable to any neglect om the part of, any director, ninager, Secretary or other officer shall aiso be deemed to be guilty of that offence and shall be liable ‘to be proceedéd against and punished accordingly.

Explanation,—For the purpose of this section,—
(a) “company” means any body corporate and includes a frm or other association of individuals ; and
(b) “Director”, in relation to a firm, means a partner in the firm.
26. Cognizance of offences,—No court shall take cognizance of offence punishable under this Act, except on complaint made by, or with the previous sanction in writing of, the Government or an. officer authorised by the Government in this behalf by notification in the official Gazette, and no Court inferior to that of a Judicial Magistrate of the First Class shall try any offence punishable under this Act.
27. Limitation of prosechtions,-—No Court shall take cognizance of an offence punishable under this ‘Act unless complaint thereof is made within three months from the date on which alleged Commission of the offence comes to the knowledge of the Government or the officer authorised under section 26.
CHAPTER VII Miscellaneous
28. Register of agricultural workers,--(1) The executive authority of every local authority shall prepare a register of agricultural workers residing within the jurisdiction of that local authority.
(2} The register shall contain such particulars as may prescribed.
QG) The register shall be maintained by the executive authority in such manner as may be prescribed.
Explanation— For the purpose of this section “Local authority’ in relation to 2n agricultural worker means a municipality or a Notified Area Authority established under the Bengal Municipality Act, 1932 as adopted in Tripura or a Gaon Panchayat established under the Tripura Panchayats Act, 1983 under the local jurisdiction of which such agricultural worker resides.
