! • / 2 Application of the Act ·-- This Act shall apply to all the EducatiC1na1 Institutions situated in the State of Tripura whether or nottncy are Governntent or private Institutions.

3. Definition- In this Act, unless .th ~.: context otherwise requires, Ragging will mean the foll(Jwing kind of offence .- V/hoever, bein.g a student in any Educarional Institution, causes a fellow s!udent to suffer physically or mentally by way of assault, intimidarion, insult, cease, rormenl or any other form of torture. lle it enacted by The Tripura L_egis._lative Assembly in the Forty first Y-.:ur of the Republic of India as follows :--- S Short title, extent and comtnenceznu-:nt——

1. ( l l This Act may be called the Tripura Educational Institution (Prevention ot Rztggging) Act, 1990.

(2) lt extends to the whole of Tripurzz.

2 Application of the Act --— _ This Act shall upply to all the Educational Institutions situated in the State tit Tripura whether or not tnuy are Government or private Institutions.

3. Definition— _ In this Act, unless the context otherwise requires, Ragging will mean the following kind of offence .— Whoever, being a stutlent in any Educational Institution, causes a fellow student to stiffer physically or mentally by way of assault, intimidation, insult, tease, torment or any other form oftortt-n"e commits ragging.

6. Establishment of courts ---..

The State G overnment may establish one pr more spec ial courts exclusi vely for trial of the n se:; under this Act and such courts may be presidt:d over by 11 .ludiciaJ Mag.ist1 .1te or a special Judicial Magistrate appoimed under sectio~ 13 of the Criminal .r: rocedure Code.

7. Di~q ua lifie,a tion for r emai uing as a s tud{mt- WtJ.c ev~r, : .• ;ing a stude·!·~ r in any Educational Institution, has tu:er.

convicfeJ under : 1!-ction 5, shall ct~ase to be a student of that Institution and he shall be deemed to have been cxpelled-fr_om the Institution ·with effect from the date of his conviction. ·

8. Eviction frhm host.£1-- During any investigatic·n or trial of offence u nder this Act an accused, who has been living in any ho~;te l of the Institution, shall be entitled to·continue his stay in that hostel,

9. On a prayer made in this behalf by the Investigating Officer the Special Court shall iss~.ot' a direction to evict the acc.used from ttie hostel if he does not leave the hostel voluntarily at the commencement of tile irrvestigation or u·ial. . .

6. Establislnneut ofcourts ----» The State Government may establish one or more special courts exclusively for trial of the cases under this Act and such courts may be presided over by a Judicial Magjsti ate or :1 special Judicial Magistrate appointed under sectioh I3 of the Criminal procedure Code.

8. Eviction ftom hostel——- During any investigation or trial of offence under this Act an acctisfid.

who has been living in any hostel of the Institution, shall be entitled to continue his stay in that hostel,
