2. 109 GOVERNMENT OF TRIPURA FOOD AND CIVIL SUPPLIES DEPARTMENT No. F. 12(19)-FSD/71 . Agartala, the 10th December, 1971. ORDER In exercise of the powers conferred by Sub-section (1) of section :1 of the Essential Commodities Act, 1955 (10 of 1955) , read with notifi­ cation No. G.S.R. IIlI dated the 24th July, 1967 issued by the Govern­ ment of India, late Ministry of Food, Agriculture, Community Develop­ ment & Cooperation (Department of Food) and notification No. S.O. 1844 dated the 18th June 1966 issued by the Government of India, late Ministry of Commerce , the Administrator is pleased to issue the follow­ ing Order, namely :- Short title, extent and commencement.

1. (a) This Order may be called the Tripura Essential Commodities (Display of stock & Sale Price) Order, 1971.

(b) It shall extend to the whole of the Union Territory of Tripura.

(c) It shall come into force at once. Definitions. In this Order, unless the context otherwise requires.

(a) "Administrator" means the Administrator of Tripura appoin­ ted under article 239 of the Constitution;

(b) "baby food" means any of the following baby foods, namely, lactodex , lactozen, glaxo, ostermilk, horlicks, amul, amul­ spray, lever, parag, viva and astra.

(c) "dealer" means a person who sells or stocks for sale any of the essential commodities in retail ;

(d) "essential commodities" mean the essential commodity mentioned in the schedule appended to this Order;

(e) "paper" means writing papers of all varieties and includes exercise books and registers.

(f) "torch cell" .includcs any dry cell used for torches or transis­ tors. Display of stock and sale price by the dealer.

3. All dealers shall display prominently in some conspicuous place of their shops or show-rooms,- .,,,

(a) a list indica ling th e opening stock of each of the essential commodities available with them each day , and uo

(b) a list containing the retail selling price of each of the essen­ tial commodities sold by them Dealers to indicate the price of essential commodities on each article. .

4. Each dealer shall indicate the sale price of each Hem of essen­ tial commodities sold by him by having the same either printed on the relevant article or on the container or by affixing a rubber stamp or by sticking a label on it in such manner that th e customer can have a clear idea about the price of the commodity concerned at the time of pur­ chase of the same. Dealer to issue cash memo to customers.

5. Each dealer shall, on demand from the customer, issue a cash memo to him against th e sal e of each item of essential commodi­ ties. Power of entry ond search. c-.

6. Any person authorised in this behalf by the Administrator shall have power to enter and search any premises and vehicles and seize any essential commodities in respect of which he has ' reason to believe that a contravention of this Order has been or is being or is about to be commitled and any books of account and document which, in his opinion, would be useful for or relevant to any proceeding under the Essential Commodities Act. 1955. . , .! - t, t .l.;,

2. All Sub-divisional Officers.

3 . All Officers of the Food and Civil Supplies not below the rank of Inspector. B) . By notification No. F. 12 (10)-FSD/ 71 dated 13th May, 1974 all police officers of and above the rank of Assistant Sub-Inspector have been authorised to exercise th e powers & perform the duties speci­ fied in clause 6 of the Order within th eir resp ective jurisdiction .
