In supersession of this Department Notification No.F.I-3(5)-EX/2007 dated 19-06-2010, the Govemor is pleased to issue following guidelines for invitation of Notice Inviting Tender (in short NIT) for settlement of retail vend of Foreign Liquor and Country Liquor shops of the State as per provisions of Tripura Excise Act, 1987 and rules made thereunder, which are as follows: - 2). The sites for Foreign Liquor (FL) and Country Liquor (CL) shops shall be selected after following the procedures laid down in the Tripura Excise Act & Rules .
3) . The Excise Commissioner shall fix the Minimum Reserve Fee (MRF) for each .shops. He shall notify the MRF for each retail shops.
4). The Collector of Excise shall invite tender allowing at least lS(fifteen) days' time for submission of tender by the interested tenderer.
5). The NIT should be published in three numbers of 'A' Category local leading ne'Wspaper through the ICA Department and the said notice shall also be displayed in the Office of the · Excise Commissioner; Collector of Excise & Office of the SDMs.
6). The tender shall be submitted by the interested tenderer addressed to the Collector of Excise in a ·sealed cover by registered ·post. The tender submitted to the Collector should be accompanied by the following documents.
I. Attested copy of Citizenship Certificate/Permanent Residential Tripura Certificate/Voter I-Card/ PAN Card of the tenderer.
II . A statement of immovable property alongwith supporting document(s) and current Bank balance mentioning name of Bank and Account No.
to prove his/her financial ability to carry on the business. A certificate from the concemed Bank Manager about the present bank balance of the bidder mentioning the account No. should also be given.
III. The area of the proposed premises should not be less than 100 square feet and the details of the location & description of the building (owned or hired) including all required document(s) of Tripura Gazette , Extraordinary Issue, February 20, 20 15 A. D.
the building i.e. Khatian/Touzi/Registered sale deed and in case of hire-d building a no objection certificate from the owner of the building alongv;ith supporting document(s) duly attested by the Notary Public should be submitted.
IV. Copies of the duly authenticated I1,1come Tax Return, Sales Tax and Professional Tax Clearance Certificate.
V. The tenderer shall declare that he/she has never been convicted by a criminal court for committing any offence which has to be duly attested by the Notary Public.
VI. Tenderer shall declare that he/she shall comply with the provisions of Tripura Excise Act, 1987 and Rules, Order, Notification, Executive Instruction etc. issued there under which has to be duly attested by the Notary, Public.
VII. In case of existing licensee, tenderer shall declare that he/she is former licensee but not in any arrears to the Government and his/her conduct has not been found to be unsatisfactory and that he/she never been found guilty of any breach of conditions of license which has to be duly attested by the Notary Public.
VIII. The tenderer shall submit a declaration stating that he/she shall be bound to obey the direction of the Collector of Excise of the concerned district in the arising circumstances of the disposal under Rule 153(2) of the Tripura Excise Rules, 1990 which has to be duly attesteQ. by the Notary Public.
IX. Tenderer shall enclose a security deposit of 50 % of tendered value being security deposit against the period mentioned in the NIT in favor of the Collector of Excise of the concerned district in the form of security Deposit-at-Call/Demand Draft either from any Nationalized Banks or from TGB or TSCB or any Schedule Bank.
7). After receipt of the tend,ers for different retail foreign liquor and country liquor shops from the_ i1,1tet1din.g tenderers, the Collector of Excise shall examine the · •·' ·· documents of the tender submitted by the tenderer. In case of tenders which are ... -found to be' 1n order . and qUoted higher' than the- notified MRF, the Collector shall get the verification of proposed building/pr~mises done regarding its suitability as per guideline stipulated in Rule 26 of the Tripura Excise Rules, 1990. He shall also get enquiry done to verify the particulars and the certificates furnished by the tenderer.

if · 8-)-:- The Collector of Excise shall thereafter send the consolidated list of all ten.Qers and particulars of the highest bidders with his specific recommendation for all the retail foreign liquor and country liquor shops of the district to the Excise Commissioner fo~ obtctinin~ app!_~y_al -~~~~--~!~~-e GoY.C:~II_l~n t_ 9) . A Register shall be maintained in the 0/o the Collector of Excise of the concerned district for obtaining attendance of the interested bidder or his/her representative during course of opening of tender. Every tenderer/representative shall authenticate his/her documents produced alongwith tender petition.
10). No request for accepting envelope other than original tendered envelope would be entertained by the Collector of Excise of the concerned district.
11). Tender petition received without security deposit shall not be entertained in any situation and summarily rejected on the spot.
12). No withdrawal of tender shall be made after opening 9f tender by any tenderer. In case of any kind of surrender/withdrawal of tender is made after opening of tender in such a situation a sum of rupees- equivalent of 10% of the MRF of the concerned shop shall be deducted and forfeited by the Collector of Excise from the amount deposited by the tenderer alongwith his tender petition as security deposit.
13). The Excise Commissioner shall after examination of the list of the tenders as received from the Collector of Excise refer the matter to the Government in the Financ.e Department which will select the licensees for each of the sites and accord necessary approval. However, the· Government shall have the powers to accept or reject any tender without assigning any reason.
14). After receipt of the approval of the Government, the Collector oi Excise shall ask the successful tenderer to deposit the rest amount 50% of tendered value within seven days from the date of issuance of direction. In case of failure of the direction the concerned shop shall be put to re-tender within a period of one month after obtaining necessary approval of the Government.
15). The persons in whose favour the license to be granted shall execute a contract with the Collector before issue of the license.
16). The license may be granted for a period of l(one) year or for any shorter/ longer period thereof.
17).The prescribed format of the NIT for settlement of retail vends of foreign liquor and country liquor shops is enclosed.

It is hereby notified for general information that licences are proposed to be offered for retail vend of Foreign Liquor and Country Liquor shoos in Tripura State through tender method for the financial year . . . . . . . . . . . . . . . . . . . . under the provisions of Rule 154 read with Rule 29A and Rule 22 of the Tripura Excise Rules, 1990.
2. Intending tenderers shall send their tenders addressed to the Collector of Excise, ---------District in plain paper in sealed cover. The bids shall be sent by the bidders through registered post/registered courier service so as to reach the office of the undersigned within 15(fifteen) days from the date of publication of this notification in an extra ordinary issue of Tripura Gazette. The registered sealed cover should indicate the following heading " Tender for the settlement ·of retail Foreign Liquor /Country Liquor shop and Notice Inviting Tender (N .I.T. ) No ------------------- & date".

4. If any of the listed documents are found missing I wanting or the bid is found informal, the bid will be summarily rejected and if any bidder conceals any of material fact and if subsequently it is proved that the bidder concealed the relevant facts, the licence will be cancelled automatically by the licensing authority.

5. The retail Foreign Liquor and Country Liquor shops will be settled through tender in and around existing sites/locations under the provision of Rule 29A of the Tripura Excise Rules, 1990 for the years ............................................ subject to fulfillment of terms and condition as required under the Tripura Excise Act, 1987 and Rules made there under.
6. The successful tenderer shall have to deposit licence fee(s) before issue of licence as determined by the Collector of Excise.
7. The licensee shall be required to obtain necessary liquor permit from the Collector ·of Excise after fulfilling the requirements prescribed in the Tripura Excise Act, 1987 and Rules made there under.
8. The last date of receiving of tender is on ____ upto ____ P.M .

10. The Collector of Excise District reserves the right to accept or cancel any bid including the highest one without assigning any reason thereof.
