Section 85: Notice of closure

~ 19 ~ If an employer intends to close down and undertaking under section 25 PFA, he shall give notice of such closure in Form Y to the State Government, Labour Commissioner/ Chief Labour Officer, Labour Officer and the Employment Exchange concern by registered post.

86. Notice of and application for permission for closure.

(1) Notice under sub section (1) of Section 250 of intended closure shall be given in Form 7 and served on the Stale Government-either personally or by registered post with acknowledgement due,

(2) The notice shall be made in triplicate.

(3) The employer concerned shall furnish to the State Government to whom the notice of intended closure has been given such further information as the State Government considers necessary for arriving at a decision on the notice as and when called for from such employer.

87. Maintenance of seniority list of workmen:

The employer shall prepare a list of all workmen in the particular category from which retrenchment is contenplated arranged according to the seniority of their services in that category and cause a copy thereof to be pasted on a notice-board in a conspicuous place in the premises of the industrial establishment at least seven days before the actual date of retrenchment..
