(1) Every Municipality shall take measures for securing- Cleaning of street and removal of
(a) daily surff e-cleansing of all streets within a Minicipal solid area and removal of sweeping therefrom :
(b) removal of the contents of all receptacles and depots and of the accumulations at all places provided to the Municipality ; and
(c) removal of special and hazardous wastes and other solid wastes from premises.
(2) The Municipality shall make adequate provision for preventing receptacles, depots. places, vehicles and vessels referred to in this chapter from becoming sources of nuisance.
173. All matters deposited in receptacles, depots and places provided by the Solid waste to Municipality and all solid wastes collected shall be the Municipal property. be lnunicipal property.
174. The Municipality may, if it thinks fit,- Removal of solid waste
(a) by written notice, require the owner or the occupier of from "Onresidential any premises used- premises.
(i) as factoly, works-shop or for carrying on any manufachire, or ( i i ) as a trade pse~nises or shop or as a market or slaughter house, or
(iii) as a hotel, eating house or restuarant, or
(iv) as a hospital or nursing home, or
(v) as a warehouse or godown, or
(vi) as a place to which large number of persons take resort, or
(vii) in any other way, where rubbish, offensive matter, filth, refuse special wastes, hazardous wastes, or excrementitious and polluted matters are accumulated in large quantities, to collect such matters and remove the same at such time and in such manner and by such routes as may be specified in the notice to a depot or place provided by the Municipality, or
(b) after giving the owner or the occupier of any premises notice of its intention so to do cause all rubbish, including building rubbish, offensive matter, trade refuse, special wastes, hazardous wastes, or excrementitious and polluted matters accumulated in such premises to be removed, and charge the said owner or the occupier as the case may be, determined by the Municipality and specified in such notice.
Desposal of 175. (1) The Municipality may, for the purpose of receiving storing, "lid was'e. treating processing and disposing solid wastes or converting such solid wastes into compost or other matter, construct, acqqire, opertate,rnaintain, develop and manage any work within or outside the Municipal area and run i t on a commercial basis.
( 2 ) The Municipality may cause to be utilised solid wastes for filling up any well, tank or low land on a commercial basis within or out side the Municipal area.
sanitation 176. ( 1) The Municipality may make such special arrangements, whether of special permanent or temporary, as it considers adequate for maintaining sanitation occasion.
in the vicinity 01- any place of religious worship or institutions or places to which large number of persons take resort on particular occasions or in any place used festipolling fairs, fasestivals, sports or cultural or social events.
( 2 ) The Municipality may require any person having control over any such place to pay to the Municipality fees at such rates as the Municipality may, fromtime to time, determine.
Prolii bit ion 177. ( 1 ) No person shall deposit or cause or permit to be deposited or against deposit throw upon or along any public street, public place, land belonging to the of solid waste. Municipality or any land on the bank of a water-course solid wastes.
( 2 ) Without prejudice to the generality of the foregoing provisions of this section, no person shall deposit or cause or permit to be deposited any building rubbish of scraps in or along any street, public place or land except with the prior permission of the Municipality :
Provided that no such permission shall be given until an advance payment of a fee for the removal of such rubbish or scraps has been made in accordance with such rates as may be determined by the Municipality from time to time.
178. If any rubbish, offensive matter, trade refuse, special wastes, hazardous Presumption as wastes or excrementitious and polluted matter accumulating on any premises to commission is deposited in any place in contravention of the provisions of this Act, it of offence.

179. Whoever deposits or throws or causes or permits to be deposited or Penalty.
thrown any solid wastes on any place in contravention of the provisions of this Act shall, subject to such rules and regulations as may be made in this behalf, be punishble with fine which shall not be less than five hundred rupees or more than five thousand rupees for each of such offences.
180. If any street or public place under the control of Government or any Power to statutory body is not properly or regularly scavenged or is in the opinion of enforce seathe Municipality, in a filthy and unwholesome condition, the Municipality venging or deanshg work may, by written notice, require the owner or the occupier to do the scavenging or, cleansing or may scavenging or deansing to be done and the cost of such scavenging or cleansing to be recovered from the owner or the occupier thereof as the case may be.
