GOVERNMENT OF TRIPURA DEPARTMENT OF SCIENCE, TECHNOLOGY & ENVIRONMENT ***** No.F.11 (81)/DSTE/CC/Pt-I1 ~~'O --:;z-l, Agartala, the Dated 1.9./~pril, 2017 NOTIFICATION Whereas, Article 48-A of the Constitution of India inter-alia envisages that the State shall endeavor to protect and improve the natural environment for safeguarding human beings, wildlife including all living creatures, forests, lakes, rivers etc. AND Whereas, the Nylon thread called 'Chinese Dori' or 'Chinese Manjha' and other synthetic/cotton threads coated with glass and such other harmful substances used for kite flying are causing serious threat to human health, birds and equally disadvantageous to the environment. AND Whereas, the Nylon thread [Chinese Dori] used for kite flying are non-biodegradable in nature and after hundreds of years breaks into toxic plastic particles polluting soil; produces toxic gases and ash on its' burning. AND Whereas, in accordance with the Order dated 14th December, 2016 of Honble National Green Tribunal, Principal Bench, New Delhi in Original Application No.384 of 2016 in the matter of Khalid Ashraf Vrs. Union of India & Others and in Original Application NoA42 of 2016 (M.A.No.1247 of 2016), the State Government shall impose complete prohibition on procuring, stocking, sale & use of Nylon thread which is also called 'Chinese Dori' or 'Chinese Manjha' and other synthetic/cotton threads coated with glass and such other harmful substances using for kite flying. NOW, Therefore, in compliance with the Order dat·ed 14th December, 2016 of the Hon'ble National Green Tribunal, Principal Bench, New Delhi and in exercise of the powers conferred by section 5 of the Environment (Protection) Act, 1986 (29 of 1986), and also the powers conferred to this State vide Notification No.S.OA 79 (E) dated the zs" July,1991 under Section 23 of the Environment (Protection) Act, 1986, the State Government issues this Notification to impose ban/prohibition on procuring, stocking, sale & use of Nylon thread which is also called 'Chinese Dori ' or 'Chinese Manjha' and other synthetic/cotton threads coated with glass and such other harmful substances using for kite flying in the whole State. In this context, the Government hereby issues the following directions:- Directions:-

1. No person including a shopkeeper, vendor, wholesaler or retailer, trader, hawker or fehriwala etc. shall sell or store or use any kind of Nylon thread which is also called 1 I U-.._I 'Chinese Dori' or 'Chinese Manjha' and other synthetic/cotton threads coated with glass and such other harmful substances using for kite flying in the whole of State of Tripura.

2. No person shall manufacture, import, store, sell or transport any kinds of Nylon thread which is also called 'Chinese Dori' or 'Chinese Manjha' and other synthetic/cotton threads coated with glass and such other harmful substances using for kite flying in the whole of State of Tripura. Authorized Officers:- The following officers are hereby authorized to implement this Notification In their respective jurisdiction viz. a. Member Secretary, Tripura State Pollution Control Board (TSPCB) and officers at the level of Junior Environmental Engineer/Junior Scientist and above, b. Director, Science, Technology & Environment and officers at the level of Scientific Officer and above, c. CEO, AMC and other officers nominated by him, d. CEO, TTAADC and other officers nominated by him, e. DMs & Collectors, f. Superintendent of Police and officers at the level of SI and above, g. Director, Industries & Commerce and other officer nominated by him, h. Director, Health & Family Welfare or other officers nominated by him,

1. Commissioner, Taxes & Excise and officers at the level of Inspector or above, J. Labour Commissioner and officers at the level of Inspector or above, k. Sub-Divisional Magistrates,

1. Block Development Officers, m. Executive Officers of Nagar Panchayat. In case of violation of the aforementioned directions, the above mentioned authorized officers, shall in accordance with the procedure and powers conferred under Section 19 of the Environment (Protection) Act, 1986, initiate legal action.
