1. (1) इस आदिे का संजक्षप् त नाम जम् मू-कश् मीर संघ राज् य क्षेत्र पुनगगठन (केन्द रीय जिजधयों का अनुकूलन) तीसरा आदिे 2020 ह।ै
(2) यह तुरंत प्रभाि से प्रिृत् त होगा।
2. साधारण खंड अजधजनयम, 1897 इस आदिे के जनिगचन के जलए िैसे ही लागू होगा जैसे यह भारत राज् य क्षेत्र में प्रिृत् त जिजधयों के जनिगचन के जलए लागू होता ह।ै
3. तत्काल प्रभाि स,े इस आदिे की अनुसचूी में उजल्लजखत अजधजनयम, जब तक सक्षम जिधानमंडल या अन्दय सक्षम प्राजधकारी द्वारा जनरजसत या संिोजधत नहीं दकए जाते हैं, उि आदिे की अनुसूची द्वारा जनदजेित स.ं 3377] नई ददल्ली, सोमिार, अक् तबूर 26, 2020/कार्ततक 4, 1942 No. 3377] NEW DELHI, MONDAY, OCTOBER 26, 2020/ KARTIKA 4, 1942 सी.जी.-डी.एल.-अ.-26102020-222750 CG-DL-E-26102020-222750 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] अनुकूलनों र उपांतरणों के अधीन रहते हुए प्रभािी होंगे या यदद इस प्रकार जनदजेित दकया गया ह,ै तो जनरजसत हो जाएगें।
4. जहां इस आदिे में ऐसा अपेजक्षत ह ैदक दकसी अजधजनयम की दकसी जिजनर्ददष्ट धारा या अन्दय भाग में, कजतपय अन्द य ि्दों के स्ट् थान पर कजतपय ि्द प्रजतस्ट् थाजपत दकए जाएगें या कजतपय ि् दों का लोप दकया जाएगा िहां, यथाजस्ट्थजत, ऐसा प्रजतस्ट्थापन या लोप, िहां के जसिाय जहां अन्द यथा अजभ् यक् त रूप स ेउपबंजधत ह,ै जहा ं कहीं जिर्तनष् ट ि् द उस धारा या उसके भाग में आते हैं दकया जाएगा।
5. इस आदिे के ऐसे उपबंध, जो दकसी जिजध का अनुकूलन करते हैं, या उसका उपातंरण करते हैं जजसस े उसे ऐसी रीजत में पररिर्ततत दकया जा सके जजसमें ऐसा प्राजधकार जजसके द्वारा या ऐसी जिजध जजसके अधीन या जजसके अनसुार ऐसी कोई िजियां प्रयोक् त् य हों, 31 अक् तूबर, 2019 से पहले सम् यक रूप से जारी की गई दकसी अजधसूचना, दकए गए आदिे, की गई प्रजतबद्धता, कुकी, बनाई गई उपजिजध, बनाए गए जनयम या जिजनयम को या सम् यक रूप स ेकी गई दकसी बात को अजिजधमान्द य नहीं बनाएगें; र ऐसी दकसी अजधसूचना, आदिे, प्रजतबद्धता, कुकी, उपजिजध, जनयम या जिजनयम या दकसी बात का िैसी ही रीजत में, िैसे ही जिस्ट् तार तक, र िैसी ही पररजस्ट्थजतयों में प्रजतसंहरण, फेरफार या अकृत दकया जा सकेगा मानों िह सक्षम प्राजधकारी द्वारा इस आदिे के प्रारंभ के पश् चात र ऐसे मामले को उस समय लागू उपबंधों के अनसुार बनाया गया हो, जारी दकया गया हो या दकया गया हो।
6. इस आदिे की अनुसूची में जिजनर्ददष्ट दकसी भी जिजध का जनरसन या संिोधन — (क) इस प्रकार जनरजसत दकसी जिजध के पूिगिती प्रितगन या उसके अधीन सम्यक रुप से की गई या सहन की गई दकसी बात को;
(ख) इस प्रकार जनरजसत दकसी जिजध के अधीन अर्तजत, प्रोद्भूत या उपगत दकसी अजधकार, जििेषाजधकार, बाध्यता या दाजयत्ि को;
(ग) इस प्रकार जनरजसत दकसी जिजध के जिरुद्ध काररत दकसी अपराध के संबंध में उपगत दकसी िाजस्ट्त, समपहरण या दडं को;
(घ) यथापूिोि दकसी ऐसे अजधकार, जििेषाजधकार, बाध्यता , दाजयत्ि िाजस्ट्त, समपहरण या दडं के संबंध में कोई अन्दिेषण, जिजधक कायगिाही या उपचार को, प्रभाजित नहीं करेगा र ऐसे दकसी अन्दिेषण, जिजधक कायगिाही या उपचार को िैस ेही संजस्ट्थत, जारी या प्रिर्ततत दकया जा सकेगा र ऐसी दकसी िाजस्ट्त, समपहरण या दडं को िैस े ही अजधरोजपत दकया जा सकेगा मानो जम्मू-कश्मीर पनुगगठन अजधजनयम, 2019 या यह आदिे पाररत या जारी नहीं दकया गया हो ।
(2) उप पैरा (1) के उपबंधों के अधीन रहते हुए दकसी ऐसी जिजध के अधीन की गई कोई बात या दकसी कारगिाई को (जजसके अंतगगत की गई कोई जनयुजि या प्रत् यायोजन जारी अजधसचूना अनुदिे या जनदिे जिरजचत प्रारूप उप-जिजध या स्ट् कीम अजभप्राप् त प्रमाण पत्र ददया गया परजमट या अनुज्ञजि या दकया गया रजजस्ट् रीकरण [भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 3 या जनष् पाददत करार भी ह)ै जम् मू-कश् मीर संघ राज् य क्षेत्र को अब जिस्ट् ताररत र लागू केन्द रीय जिजध के तत् स्ट् थानी उपबंधों के अधीन की गई समझी जाएगी र तदनसुार तब तक प्रिृत् त बनी रहगेी जब तक अब जम् मू-कश् मीर संघ राज् य क्षेत्र पर जिस्ट् ताररत केन्द रीय जिजधयों के अधीन की गई दकसी बात या कारगिाई द्वारा उसे अजधंांत नहीं कर ददया जाता ह।ै ********** अनसुचूी (परैा 3 दखेें) केन्द रीय जिजध
1. भ-ूसपंदा (जिजनजयमन र जिकास) अजधजनयम 2016 (2016 का 16) धारा 86.— उप-धारा (2) में दोनों स्ट् थानों पर आए ‘‘पुडुचेरी संघ राज् य क्षेत्र सरकार’’ ि् दों के स्ट् थान पर ‘‘पुडुचेरी संघ राज् य क्षेत्र सरकार र जम् मू-कश् मीर संघ राज् य क्षेत्र सरकार ” ि् द रखें। *******
2. जित् तीय आजस्ट्तयों का प्रजतभजूतकरण र पनुगगठन तथा प्रजतभजूत जहत का प्रितगन अजधजनयम 2002 (2002 का 54) धारा 13.- उप-धारा (3क) में इसके परंतुक में ‘‘या धारा 17क के अधीन जजला न्द यायाधीि के न्द यायालय’’ ि् दों का लोप करें; र धारा 18(ग).- (i) उप-धारा (1) में ‘‘या धारा 17क’’ ‘‘ या धारा 18ख’’ ‘‘ या जजला न्द यायाधीि के न्द यायालय’’ र ‘‘अथिा उच् च न्द यायालय’’ ि् दों का लोप करें; र
(ii) उप-धारा (3) में ‘‘ या जजला न्द यायाधीि के न्द यायालय’’ र ‘‘ या उच् च न्द यायालय’’ ि् दों का लोप करें। धारा 19 में.-
(i) दोनों स्ट् थानों पर आने िाले ‘‘ या जजला न्द यायाधीि का न्द यायालय’’ ि् दों का लोप करें;
(ii) ‘‘या धारा 17क’’ ि् दों का लोप करें;
(iii) ‘‘ या उच् च न्द यायालय’’ ि् दों का लोप करें;
(iv) ‘‘या धारा 18क’’ ि् दों का लोप करें।

3. दडं प्रदंया सजंहता 1973 (1974 का 2) धारा 24.— उप-धारा (7) में ‘‘उप-धारा (6) ” ि् दों के स्ट् थान पर ‘‘उप-धारा (6) अथिा उप-धारा (6क)’’ ि् द रखें। धारा 25क.— उप-धारा (4) में ‘‘संयुक् त जनदिेक’’ ि् दों के स्ट् थान पर ‘‘अजभयोजन जनदिेक’’ ि् द रखें। ******* [फा. स.ं11012/21/2020-एसआरए] अजय कुमार भल् ला गृह सजचि MINISTRY OF HOME AFFAIRS (Department of Jammu, Kashmir and Ladakh Affairs) ORDER New Delhi, the 26th October, 2020 S.O. 3807(E).—In exercise of the powers conferred by section 96 of the Jammu and Kashmir Reorganisation Act, 2019 (34 of 2019), and of all other powers enabling it in that behalf, the Central Government hereby makes the following Order in respect of the Union territory of Jammu and Kashmir, namely: –
1. (1) This Order may be called the Union Territory of Jammu and Kashmir Reorganisation (Adaptation of Central Laws) Third Order, 2020.
(2) It shall come into force with immediate effect.
2. The General Clauses Act, 1897 applies for the interpretation of this Order as it applies for interpretation of laws in force in the territory of India.
3. With immediate effect, the Acts mentioned in the Schedule to this Order shall, until repealed or amended by a competent Legislature or other competent authority, have effect, subject to the adaptations and modifications directed by the Schedule to this Order, or if it is so directed, shall stand repealed.
4. Where this Order requires that in any specified section or other portion of an Act, certain words shall be substituted for certain other words, or certain words shall be omitted, such substitution or omission, as the case may be, shall, except where it is otherwise expressly provided, be made wherever the words referred to occur in that section or portion.
5. The provisions of this Order which adapt or modify any law so as to alter the manner in which, the authority by which or the law under or in accordance with which, any powers are exercisable, shall not [भाग II—खण् ड 3(ii)] भारत का राजपत्र : असाधारण 5 render invalid any notification, order, commitment, attachment, bye-law, rule or regulation duly made or issued, or anything duly done before the 31 st day of October, 2019; and any such notification, order commitment, attachment, bye-law, rule, regulation or anything may be revoked, varied or undone in the like manner, to the like extent and in the like circumstances as if it had been made, issued or done after the commencement of this Order by the competent authority and in accordance with the provisions then applicable to such case.
6. (1) The repeal or amendment of any law specified in the Schedule to this Order shall not affect—
(a) the previous operation of any law so repealed or anything duly done or suffered thereunder;
(b) any right, privilege, obligation or liability acquired, accrued or incurred under any law so repealed;
(c) any penalty, forfeiture or punishment incurred in respect of any offence committed against any law so repealed; or
(d) any investigation, legal proceeding or remedy in respect of any such right, privilege, obligation, liability, penalty, forfeiture or punishment as aforesaid, and any such investigation, legal proceeding or remedy may be instituted, continued or enforced, and any such penalty, forfeiture or punishment may be imposed, as if the Jammu and Kashmir Reorganisation Act, 2019 or this Order had not been passed or issued.
(2) Subject to the provisions of sub-paragraph (1), anything done or any action taken (including any appointment or delegation made, notification, instruction or direction issued, form, bye-law or scheme framed, certificate obtained, permit or licence granted or registration effected or agreement executed) under any such law shall be deemed to have been done or taken under the corresponding provisions of the Central Laws now extended and applicable to the Union territory of Jammu and Kashmir and shall continue to be in force accordingly unless and until superseded by anything done or any action taken under the Central Laws now extended to the Union territory of Jammu and Kashmir.
********** THE SCHEDULE (See Paragraph 3) CENTRAL LAW
1. THE REAL ESTATE (REGULATION AND DEVELOPMENT) ACT, 2016 ( 16 of 2016) Section 86.— In sub-section (2), for ― the Union territory Government of Puducherry‖ occurring at both the places, substitute, ―the Union territory Government of Puducherry or the Union territory Government of Jammu and Kashmir. ‖ *******
2. THE SECURITIZATION AND RECONSTRUCTION OF FINANCIAL ASSETS AND ENFORCEMENT OF SECURITY INTEREST ACT, 2002 (54 of 2002) Section 13.- In sub-section (3A), in proviso thereto, omit ―or the Court of District Judge under section 17 A‖.
Section 18(C).- (i) in sub-section (1), omit ―or section 17 A‖, ―or section 18 B‖, ―or the court of District Judge‖ and ―or the High Court‖; and
(ii) in sub-section (3), omit ―or the court of District Judge‖ and ―or the High Court‖.

(i) Omit ―or the Court of District Judge‖, occurring at both the places;
(ii) Omit ―or section 17 A‖ occurring at both the places;

(iv) Omit ―or section 18A‖ occurring at both the places; and
(v) Omit ―or the High Court referred to in section 18B‘ occurring at the end.
Insertion of new section:- After section 19, insert- Transfer of Pending Applications.
―19A.- All the pending applications before the court of District Judge and the High Court under sections 17A and 18 B respectively, shall stand transferred to the Tribunal and the Appellate Tribunal, as the case may be.‖.
