Section 2: In the Jammu and Kashmir Reservation Act, 2004 (hereinafter referred to as the principal Act), in section 3, in sub-section (1), for the first proviso, the following proviso shall be substituted, namely

“Provided that the total percentage of reservation shall in no case exceed 85%, excluding reservation for Economically Weaker Sections:”.

3. In the principal Act, in section 5,—

(a) in sub-section (1), the second proviso shall be omitted;

(b) after sub-section (4), the following sub-section shall be inserted, namely:— “(5) Nothing contained in this section shall apply to Economically Weaker Sections and filling up of vacancies for such Sections shall be in such manner as may be prescribed.”.
