Act no. 1 of 19044, and in suppression of all existing rules, fon stalutary niatilicatians or ordces issued im this behalf, the Governor is pleased to make the following rules with a view to’ regulating the allotment of Houses under control of the Estate Department:- T HE ALLOTMENT OF HOUSES UNDER CONTROL OF THE ESTA’ te DEPARTMENT RULES, 2016 Short title and 1.01) These Rules may be called the Allotment of Houses under the control of commencemenl ie Estate Department Rules, 2014. , . Dctinitigns 2. (1) io these rules, untess the context otherwise requires,
(a) ‘Act’ means The Allotment of Houses Under Control of the Estate Department Act, 2016 (Act ne. 23 of 2016), {b) ‘Allotice’ méans an cligible person under section- 4 in whose favour allotment is to be made or has been made under the provisions éfthe Act;

(3) “Director of Estates” “means the Director of Estates to the Government of Uttar Pradesh and includes the Jom Director, Deputy . Director and Assistant Director : : :
(c) “House "moans a house and ils premises under control of the Fstate Department; / ~ (A) ‘Pay’ means the monthly amount drawn by an officerfemployes as pay and includes substantive pay, officiating pay, personal pay and addilional pay bul does not include Dearness Allowance, Compensating Allowance or allowances of any other nature:
Explanation—In the case ofan officer wha is under suspensign the pay drawn by hint on the frist day of the allotment year-in which he is placed unde? suspension, or if he is placed under suspension on the first day of the allotment year, the pay draws by him immedtately | before that date shall be taken as pay;
(2) ‘family’ means ihe wife or husband, as the case muy be of a person ‘to whom house is allowed and children, step-children, legally adopted - children, parents, brothers and sisters thereof who ordinarily reside with and are dependent on allottee: : .
(h) ‘Government’ means the Gaverment of UiLar Pradesh;
(F) ‘Temporary translcr” means a transfer which involves an absence for a period not exceeding fiur months; * ‘
(2) Words and, expressions used but not defined in these rules shall have the meanings respectively assiened to thenr’in the Act.
3A person eligible for allotment undér seclion 4 of the Act shall make an application to the Estale Officer,
(1) An employeerofficer joining duty and in need of a house at Lucknow may submit his/her application to the Estate Officer within 30 days from the date he/she assumes charge of his/her office at Lucknow. [n case of-journalists/senior journatits, aocicty, cinployee associations, trusts, Chairman/Member of various statutory » commissions alsa may submit application te the Estate Officer for the purpose of allotment of hause.
(2) Applications of the officers teecived under sub fule-{1} shal! be serutinised by the Estate Olficer and separate lists in respect of each type of house shall be prepared according to ihe date of recdipt of applications.
(3) Applications received from the jourmalists/senior journalists under subrule-{]) shall be scrutinised by the Estate Officer and a list shall be prepared ‘according to the date wise receipt of application. A screening conumitiee shall be constituted . as follows to consider such applications :— :

(3} In case of applications received from the trnsts established for social work - in the name of renowned persons with its head nffice at Lucknow or trusts working for frtherance of ideals, prinsiples and their social works regi istered under the indian Trust Act, 1882, the Trusts have to produce documents regarding registration, bye-laws, audit report of CA, proof of activities in previous years of Trusts, and certificate of accomplishment and activities in n he: fi field ‘of social, cultural, educational, sports and literature.
(6) The einplogers’ associations/unions with its head olfice at Lucknow will , produce the recognition document issued by the State Government along with the written application before the Estate Officer for the purpase of allotment af house.
(7)-A Society registercd under the Societies Registration Act, i860 with ils head office al Lucknow and working in the field of social welfare and public interest with their specific contribution in the figtd of social, culural, educational, sports, science and Hierature will produrd registration certificate, certified bye-laws, audit report of CA, proof of activities in previous years while applying for the purposc of allotment of house.
(8) All cligible applicants except Members of Legistative Assembly/Council as defined in section 2 of the Act, have lo submit affidavit along with the app! lication that they have nat taken house building advance from the Government or housing four from any bank or financial institutions aad aise fave not been allowed. any house. of plot from Housing and Develypment Doard or Lacknow Development Authority and alsa have not any house of own or in the namie of hisfher family member or ihe house of any Department of Government of India or Government, or any Local badics.
(oy Applications received on the 20" day of a calender niongh shall be considered for allotment in the succeeding meath:

(5) Now withstanding anything contained in sub-rules (2), (3), or (4) when an alficer is dismissed or removed from service or when his services have buon lerminated and ihe [lead of the Department in respect of the office in which such officer was employed immediately before such dismissal, removal or termination is satistiad that it is necessary or expedicnt in the public interest so to do, after recording the reasons in writing he may tequice the Estate officer to cancet the allotment of the “house made to such officer cither forthwith or wilh effect from such date prior to the expiry of the period of one month referred to in item (3) of the Tali 4 in sut-rule (3) as he may sgecifly and the estate Olficer shall act accordingly,

(3) Except trusts allatment of houses to the societies and Jourhalieia aries journalists will be made for a period of tow years. Renewal will be done only when ‘the allatiee hes not.violaled any terms and condition of ihe allotment drder durin ie the period of allotment and there are ng dues remaining against ihe’ allotiee, after the recommendation of the said screening committee for a further, poriad of one year.
(4) Thé allotment made ‘in favour of Trusts, Employees, anions. and Societies would be under the following terms and conditions :-
(i) The attottee of the premises wil! be liable to pay rent very month and also be fiable to pay waler tax, sewer lax and electricity bill, In case of arrears: of rent for twee months, the allotment will be decmed to be automatically ” cancelled, tn ease of arruars ‘of rent for two months, ihe Estate Directorate will send a Ictlcr to the alktee informing the above position.

(4) The rent of the houses alfotted to the Teusts and Societies shall by charged at the market rate per month.
