Section 88: Suits and legal proceedings.

The Uttar Pradesh Avas Evam Vikas Parishad Adhiniyam, 1965State Act of Uttar Pradesh · Act 1 of 1966

(1) The Housing Commissioner may, on behalf of the Board and subject to its control,- (a) institute, defend, or withdraw from any legal proceedings; and (b) admit, compromise or withdraw any claim.

(2) No suit be instituted against the Board, the Adhyaksh, the Housing Commissioner, the Tribunal, the prescribed authority or any member, officer or servant of the Board, in respect of any act done or purported or intended to be done under this Act or any rule or regulation until the expiration of two months next after notice in writing has been delivered to, or lift at the office of, the Board, the Adhyaksh, the Housing Commissioner, the Tribunal, the prescribed authority, or such officer or servant, as the case may be, stating the cause of action, the name and place of abode of the intending plaintiff, and the relief which he claims, and the plaint shall contain a statement that such notice has been so delivered or left.
