Lucknow Dated March 13,2018 The following regulations which the Uttar Pradesh Board of Secondary Sanskrit Education has made in exercise of the powers under scetion 21 read with scction 25 and section 26 of the Uttar Pradesh Board of Sccondary Sanskrit Education Act, 2000(U.P. Act no. 32 of 2000) and section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no 10 of 1904) after obtaining the previous approval of the State Government with a view to amending the Uttar Pradesh Board of Secondary Sanskrit Fducation (Appointment and Conditions of Service of Heads of Institutions, Teachers and Other Employecs of the Institutions) Regulations, 2009:- THE UTTAR PRADESH BOARD OF SECONDARY SANSKRIT EDUCATION (APPOINTMENT AND CONDITIONS OF SERVICE OF HEADS OF INSTITUTION, TEACHERS AND OTHER EMPLOYEES OF THE INSTITUTIONS) (SECOND AMENDMENT) REGULATIONS, 2018

1.(1) These regulations may be called the Uttar Pradesh Board of Secondary ~ Short title and Sanskrit Education (Appointment and Conditions of Service of Heads of Institution, Teachers and Other Employees of the Institutions) (Second Amendment) Regulations,

2018.

(2) They shall come into force with effect from the date of their publication in the Gazerte.

2. In the Uttar Pradesh Board of Secondary Sanskrit Education (Appointment and Conditions of Service of Heads of Institution, Teachers and Other Employees of the Institutions) Regulations, 2009 hercinafter referred to as the said Regulations, for regulation 9 set out in column I below, the regulation as set out in column 2 shall be substituted, namely:- Amendment of Regulation 9 COLUMN - 1 COLUMN -2 Existing regulation Regulation as hereby substituted

9. The procedure for filling up the vacancy of the Head of Institution and teachers by direct recruitment if any recognized institution shall be as follows :- After the Committee of Management (a) has determined the number of vacancies to be filled by direct recruitment shall send for prior approval the proposal of recruitment to Inspector Sanskrit Schools, Uttzr Pradesh Allahabad, including :- After the Committee of Management has determined the number of vacancies to be filled by direct recruitment, it shall send for prior approval the proposal of recruitment to Regional Deputy Inspector of Sanskrit Schools including :-

(i) total number of sanctioned posts to (i) total number of sanctioned posts which appointment is to be made; to which appointment is to be made;

(i1) number of vacancies that have (i) number of vacancies that have been kept for reservation; been kept for reservation;

(iii) number of vacancies unreserved; (i) number of vacancies

(iv) statement of teachers (grade wise) unreserved;

(b) On the receipt of proposal under clause

(a), Inspector Sanskrit Schools. Uttar Pradesh, after the determination of working strength in the institution shall send his recommendation to the Dircctor of Education (Secondary). Uttar Pradesh for approval.

(c) On the receipt of information under clause (b) the Dircctor of Lducation (Secondary). Uttar Pradesh shall communicate his decision.

(d) The Committee of Management on the receipt of no objection under clause (c) shall send the same to Regional Deputy Inspector of Sanskrit Schools who shall send to Regional Joint Director of Education.

(¢) Regional Deputy Inspector of Sanskrit Schools shall the vacancy advertised in at least on Hindi and one English newspaper having adequate circulation in the State: giving particulars as to the nature (i.c. whether temporary or permanent) and number of vacancies, description of post (i.e. Head of Institution, lLecture or L.T. grade teacher, including the subject or subjects in which the lecturer or teacher minimum qualifications and minimum age, if and, for the post, and prescribing the last date (which should not ordinarily be less than two weeks from the date of advertisement) by which applications in the prescribed form duly completed by the candidates shall be received in the office of Regional Deputy Inspector of Sanskrit Schools.

The advertisement shall also state that the prescribed application Forms can be had from the office of Regional Deputy Inspector of Sanskrit Schools on payment of Rs. 25 per form by a Crossed Postal Order or Bank Draft or through Treasury Challan by depositing the amount in the State Bank of India under the head indicated by Regional Deputy Inspector of Sanskrit Schools. In no case the payment shall be accepted in cash in the office of the Regional Deputy Inspector of Sanskrit Schools.

Note :-

(1) All vacancies in the post of teachers and the Head of Institution existing ay the time of advertisement shall be advertised.

(2) No new post shall be advenised unless sam‘(‘inncd of the appropriate authority for creation thercofl has been received.

(c) Management shall determine the aumber of basic vacant post. of Heads & Tcachers in Prathma, Purv Madhyar.nn and Uttar Madhyama schools which are aided by the Uttar Pradesh Board of Secondary Sanskrit [Education and requisition of such vacant post shall be sent to Utar Pradesh Secondary Education Service Selection Board by Regional Deputy Inspector of Sankrit Schools.

Uttar Pradesh ~ Secondary Education Service Selection Board, Allahabad shall advertise the requisitioned posts of recruitment for written examination In the advertisement, for the post, of head /teacher of the institution, the name and place of the institution shall also be mentioned and the candidate shall be required to give the choice of the maximum three institution in the order of preference and if he wishes to be considered for any particular institute or institutions and for no other institution, he may mention the fact in his application.

The amount of fee as decided by the government for different categories of candidates in the manner prescribed by the government, Regula The Board shall prepare a list for each category of post, in the sequence of most suitable obtained marks. If the total awarded to two are more candidate are equal then the seniormost in age shall be preferred.

Where a selected candidate cannot be al]o_cntcd any of the institutions of his preference on the ground that the candidate placed higher in the list have already been allocated such institutions and there remains no vacancy in them, the Board may allocate any institution to him as it may decm'fil. ’ ) The Board shall forward the list along with the name of the Institution allocated I:

() An application by a person employed in an institution and applying for a post elsewhere or in the same institution shall not be withheld by his employer but shall be forwarded to the Regional Deputy Inspector of Sanskrit Schools.

(h) Applications received shall be serially numbered and entered in a register in the Form approved by the Director in the office of the Regional Deputy Inspector of Sanskrit Schools and particulars of the candidates noted under appropriate column along with quality-pointmarks obtained by each candidate. The quality point-marks will be awarded to each candidate according to the criteria laid down in Appendix ‘D' preferably by the local retired Gazetted Officer or retired Principals of teachers of Degree College or University or retired heads of Institutions engaged for the purpose by the Regional Deputy Inspector of Sanskrit Schools and checked by the Regional Deputy Inspector of Sanskrit Schools. The candidates to be called for interview shall be selected in the order of quality-point-marks obtained by them.

The number of candidates called for interview shall be seven for each post (the number of applicants permitting) provided that this number may be increased to accommodate candidates who get equal number of qualitypoint-marks in the first seven places. The Regional Joint Director of Education shall decide the date, time and place for selection as may be fixed by him at least two weeks before such date.

(i) The Regional Deputy Inspector of Sanskrit Schools shall send intimation to the members of the Selection Committee and issue interview cards to all the candidates selected for interview by régistered post specifying therein the date, time and place for holding selection, al least ten days before such selection. The Selection Committee shall hold its sitting for making the selection accordingly.

The Selection Committee shall consist of:- () The Regional Joint Director of Education - Chairperson

(ii) The Regional Deputy Inspector Sanskrit School- Member Secretary sureshf uo 1 COLUMN -2 Regulation as hereby substituted Education and it shall be notified on the notice board.

According to recommendation of Ut}ar Pradesh Secondary Education Service Selection Board, Allahabad the selected candidates will be appointed by the Appointing Authority.

(iii) Two Sanskrit Experts nominated by the Director of Education (Secondary) Uttar Pradesh- Member

(iv) Two nominated Gazetted officers which one shall be belonging to Scheduled Castes and the other shall be from minority community nominated by the Dircctor of Education (Secondary), Uttar Pradesh- Member

(v) The District Inspector of Schools and Finance & Account Officer to the Office of District Inspector of Schools of ‘respective district-Member

(j) A statement (i}\ cight copies) showing the names, qualifications and other particular in respect of every candidate called for the interview shall be got prepared by the Regional Deputy Inspector of Sanskrit Schools in the Form given in Appendix 'C' and the same shall be places before each member of Selection Committee at the time of the interview.

(k) Selection shall be made by the Selection Committee on the basis of the total of qualitypoint-marks and the marks awarded in the interview. The total of marks for this purpose shall be arrived at by addition of the qualitypoint-marks as obtained by a candidate under Clause (h) and the average of marks awarded by the members of the Selection Committee out of 50. In addition, each expert shall also note down in the statement referred to in clause (j) whether he agrees to the selection of the candidate or not. In case of disagreement, he will state reason in brief thereof. After all the candidates for any post are interviewed, the Chairperson of the Selection Comniittee shall either himself or by any other member thereof get a note prepared in duplicate on the proceedings of the selection held indicating therein the names of the selected candidates along with two other candidates on the waiting list drawn up in order of merit and also the names of at least two Experts who have agreed to the gelection of such candidates. The note so prepared® shall be signed by the Chairperson and other members of the Selection Committee giving their full names, designation and addresses and date. One copy of this note along with one copy of the statement referred to in clause (j) shall be immediately forwarded by the Chairman to the Management through the 1007_RIPH_2018_Data 4 §hiksha Folder 43 @Td, 2018 QLUMN COLUMN == Regulation as hereby substituted TR YA IR THE, 13 7, 2018 1 COLUMN - 1 Existing regulation Manager and the other copy shall be forwarded to the District Inspector of Schools concerned.

(1) Notwithstanding anything contained in clause (k), if the total marks awarded to two or more candidate are equal then the seniormost in age shall be preferred.

3. In the said regulations, the following regulations shall be omitted :-

All applications, papers and registers relating to selection shall be preserved by the Regional Deputy Inspector of Schools till such period as may be prescribed by the Director and shall be furnished to the District Inspector of Schools, Regional Joint Director of Education or the Director of Education (Secondary), Uttar Pradesh as and when the same may be summoned.

11. The Regional Joint Director of Education may fix one or more selection of one or more institutions at such place, time and date as may be found convenient.

12. The Director of Education (Secondary), Uttar Pradesh shall nominate Experts for each region separately for the sclection of Heads of Institutions and for the teachers, afier obtaining their consent in writing to act as an Expert.

13. Every expent attending a meeting of the Selection Committee and every person engaged for awarding quality-point-marks shall be entitled 10 be paid remuneration at such rates as may be sanctioned by the State Government from time to time. In addition, the experts shall be paid travelling allowance at such rate as may be sanctioned by the State Government.

4. In the said regulation, for regulation 14 set out in column-1 below, the regulation as set out in column-2 shall be substituted, namely:- COLUMN-1 Existing regulation

Within fificen days of the receipt of the recommendation of Sclection Committee under clause (i) of Regulation-9 the approval of authority therein, the manager shall on specified authorization under resolution of the Commitiee of Management issue an order of appointment by suresh/ uo-1 Regulation as hereby substituted Omission of regulations 10, 11, 12and 13 Amendment of regulation 14 COLUMN-2 Regulation as hereby substituted

14. Within fifieen days of the receipt of the recommendation of the Uttar Pradesh Secondary Education Service Selection Board and the approval of authority specified therein, the manager shall on authorization under resolution of the Committee of Management issuc an order of - AN R IR e, 13 776, 2018 COLUMN-1 Existing regulation registered post to the candidate in the Form given in Appendix 'E’ requiring the candidate 1o join duty within ten days of the receipt of such order failing which the appointment of the candidate will be liable to cancellation. A copy of the same shall be sent to the Regional Joint Director of Education.
