Section 5: Constitution of Special Courts

The Uttar Pradesh Dacoity Affected Areas Act, 1983State Act of Uttar Pradesh · Act 31 of 1983

(1) For the purposes of speedy trial of scheduled offences committed in a dacoity affected area, the State Government may, in consultation with the High Court, constitute, by notification as many special courts as may be necessary in or in relation to such dacoity affected area or areas as may be specified in such notification.

(2) A Special Court shall consist of a single judge who shall be appointed by the High Court from amongst the serving Sessions Judge or additional Session Judges.

Explanation — In this sub-section, the words “appoint” shall have the meaning assigned to it in the Explanation to section 9 of the Code of Criminal Procedure, 1973.
