Section 21: Restrictions on licensees and generating companies

The Uttar Pradesh Electricity Reforms Act, 1999State Act of Uttar Pradesh · Act 24 of 1999

(1) No licensee or generating company shall unless it has applied for and obtained the consent in writing of the Commission acquire the licence or the undertaking of or associate with any other licensee or any other person generating transmitting supplying or intending to generate transmit or supply electricity.

Provided that the Commission shall hear such person or authority as it considers proper before giving the consent under this section.

(2) The Commission shall dispose of an application received under sub-section (1), within two months of receiving such application, after taking into account the objection, if any of the concerned person or authority.

(3) The licensee shall not assign his licence or transfer his undertaking or any part thereof, by sale, mortgage, lease exchange or otherwise without the previous consent in writing of the Commission.

(4) Any person to whom the provisions of section 44 of the Electricity (Supply) Act, 1948 are applicable shall obtain the consent of the Commission under that section in place of that of the Board.
