1 NOTIFICATION In exercise of the powers under section 41 of the United Provinces Excise Act, 1910 (U.P. Act no IV of 1910) read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no 1 of 1904) the Excise Commissioner, Uttar Pradesh with the previous sanction of the State Government hereby makes the following rules with a view to amend the Uttar Pradesh Excise (Settlement of Licenses for Foreign Liquor Bonded Warehouses) Rules, 2011 for the grant of licenses of Foreign Liquor Bonded Warehouse under clause(d) of section 18 of the aforesaid Act of 1910 on fixed license fee, namely.
THE UTTAR PRADESH EXCISE (SETTLEMENT OF LICENSES FOR FOREIGN LIQUOR BONDED WAREHOUSE) RULES, 2011 1- 2 Short title and Commencement 1.(1)These rules may be called the Uttar Pradesh Excise (Settlement of Licenses for Foreign Liquor Bonded Warehouse) (Tenth Amendment) Rules, 2024. (2)They shall be deemed to have come into force with effect from 1 st April,2024.

2. Definition In these rules unless there is anything repugnant in the subject or context:-
(i) "Act" means the United Provinces Excise Act, 1910 as amended from time to time;
(ii) "District Excise Officer" means an officer of the Excise Department not below the rank of an Assistant Excise Commissioner or an officer of the Revenue Department not below the rank of Sub-Divisional Magistrate, duly appointed and vested with the powers under clause (b) of sub-section (2) of section-10 of the Act.
(iii) "Excise Year"means the period of 12 months commencing from 1st day of April of a calendar year;
(iv) "Form" means form appended to these rules;
(v) "Foreign Liquor" means Indian Made Foreign Liquor (IMFL), beer, wine and Low strength Alcoholic Beverages (LAB).
(vi) "Licensee" means a Distillery, Brewery , Vintinery or Bottling Unit of other State to whom a License in Form BWFL-2A, BWFL-2AA, BWFL-2B, BWFL-2C & BWFL-2D has been granted for running a Bonded Warehouse of Foreign Liquor.
(vii) "Licensing Authority" means the Excise Commissioner.
(viii) "License fee" means the consideration for the grant of License for exclusive privilege of wholesale of Foreign Liquor under section-24A of the Act, which shall be paid through epayment in Government Treasury by the licensee before the License is granted to him, on 1 Published in The Uttar Pradesh Excise (Settlement of Licenses for Foreign Liquor Bonded Warehouse) Rules, 2011 2 the Uttar Pradesh Excise (Settlement of Licenses for Foreign Liquor Bonded Warehouse) (Tenth Amendment) Rules, 2024 3 the Uttar Pradesh Excise (Settlement of Licenses for Foreign Liquor Bonded Warehouse) (Tenth Amendment) Rules, 2024 3 such rates as may be fixed from time to time by the Excise Commissioner, with the previous sanction of the State Government.
(ix) "Officer in-charge" means an officer of the Excise Department nominated by the Excise Commissioner not below the rank of Excise Inspector.
(x) "Security amount" means the amount fixed by the Excise Commissioner which is to be deposited through Fixed Deposit Receipt pledged in favour of Excise commissioner Uttar Pradesh, or through e-payment and shall be refundable after final settlement of Licenses under consideration of entire claims and dues of State Government.
(xi) "Consideration Fee" means a fee for foreign liquor, wine, beer and low alcoholic beverages as fixed by the State Government under section 30 of the Excise Act, which shall be deposited in treasury by the licensee prior to supply.
(xii) "Additional Consideration Fee" means difference amount obtained as a result of rounding off the maximum retail price of foreign liquor, wine ,beer and low alcoholic beverages to the next multiple of ten, which shall be payable at licenced bonded warehouse level and recoverable by the licencee of the bonded ware house from wholesale supplier in addition to Ex-Distillery/Ex-Brewery Price and which in turn could be recovered by wholesale supplier from retail licensee in addition to maximum wholesale price.
(xiii) "Import permit fees" means fee imposed on foreign liquor, wine, beer and low alcoholic beverages imported from overseas or any state or union territory outside the Uttar Pradesh.
3 4 . Grant of License-
(1) The licenses for Foreign liquor bonded warehouse on a defined format of annexed (BWFL-2A, BWFL-2AA BWFL-2B, BWFL-2C and BWFL-2D) for issue of Foreign liquor in wholesale shall be granted/renewed by Excise Commissioner or an Officer authorized by him, not below the rank of Joint Excise Commissioner on payment of License fee, deposit of the security amount and execution of general bond in form BWFL-3 in favour of the Excise Commissioner:
Provided that for the sale of Scotch and single malt brands of India-made foreign liquor having MRP(per bottle) of more than rupees three thousand,BWFL-2AA license will be issued on depositing the license fee as fixed by the State Government. This license will be given to such individuals/firms/ companies, which have authorization letters of the concerned producers. In this type of license, sale of maximum ten brands including all variants will be allowed.
(2) License for Foreign liquor Bonded warehouse for wholesale of Foreign liquor, beer, wine and low strength alcoholic beverages shall be given to the licensed Distilleries, Brewery, Vintineries of other State. License holder of the bottling plant of other State shall also be eligible for the license provided bottling unit of such license holder fulfills the following criteria- (I)Bottling unit has annual turnover of business income (including revenue/excise duty) not less than Rs. 100 Crore.
(II)Annual production capacity of bottling unit not less than five lakh cases.
4 the Uttar Pradesh Excise (Settlement of Licenses for Foreign Liquor Bonded Warehouse) (Tenth Amendment) Rules, 2024 4 (III)Bottling unit has its business at least in three states with minimum one Crore population.
(3) Application for grant of license shall be made in the Form BWFL-1.If any out of State unit desires to obtain bond licenses in various districts, then for each separate license fee for every district shall be charged.
(4) Security amount shall be prescribed by the Excise Commissioner with the prior approval of the State Government, which shall be in the form of Fixed Deposit Receipt pledged in favour of Excise Commissioner Uttar Pradesh, or through e-payment.
(5) License fee shall be deposited by the licencee through e-payment in Government Treasury.
(6) The period of license shall be for an excise year or part thereof for which the license has been granted.
(7) The license shall not be permitted to transfer or sublet the license to any other person.
(8) Any out of state unit having multiple units in other states ,desirous of selling IMFL/ Beer /Wine/LAB manufactured in its different units including FL-1 and FL-1A licences situated in the state from a master warehouse on same premises after obtaining bond licenses in Uttar Pradesh, may be allowed so after charging prescribed license fee for every unit:
“Provided that consignment from various units shall be stored separately in that premises:
Provided further that any wholesale licensee holding license in Form FL-2 and FL-2B may procure supply of different brands of Indian made foreign liquor/Beer/ Wine/ Low Strength Alcoholic Beverage under a single indent from such a master warehouse.
License in Form BWFL-2A, BWFL-2AA, BWFL-2B,BWFL-2C and BWFL-2D and master warehouse may be renewed by Excise Commissioner or an officer authorized by him, subject to the terms and conditions prescribed by the State Government.
(9) In case of renewal security deposited prior in cash or through National Saving Certificate/Pledged fixed deposit receipt/Bank Guarantee shall be acceptable till it is not refunded.
(10) Any unit outside the state, which has many units/bottling units in other states, through which bond licenses have been obtained in one district/various districts of Uttar Pradesh, the brands, their labels and Approval of MRP will be done bond wise by the producer/bottling unit.

5 Licence fee-The licence in Form BWFL-2A, BWFL-2AA for IMFL manufactured and bottled out side Uttar Pradesh, licence in Form BWFL-2B for Beer manufactured and bottled out side Uttar Pradesh, the licence in Form BWFL-2C for wine manufactured and bottled out side Uttar Pradesh, the licence in Form BWFL-2D for the low strength alcoholic beverages. Manufactured and bottled outside Uttar Pradesh can be granted or renewed on payment of licence fee as fixed by the Excise Commissioner from time to time with the previous sanc 6 tion of the State Government for the period not exceeding one year and ending on 31st March following the date of grant.
5 the Uttar Pradesh Excise (Settlement of Licenses for Foreign Liquor Bonded Warehouse) (Tenth Amendment) Rules, 2024 6 the Uttar Pradesh Excise (Settlement of Licenses for Foreign Liquor Bonded Warehouse) (Tenth Amendment) Rules, 2024 5 7 5- How to obtain Foreign liquor:- Foreign liquor, beer, wine and low strength alcoholic beverages may be obtained by license holder of bond from his own Distillery, Brewery, Ventinery or Bottling Unit outside Uttar Pradesh on a permit in define format of annexed FL-22 Form issued by the District Excise Officer or Deputy Excise Commissioner, Charge belonging to the district/ charge of license holder under rules.

6. Import of Foreign Liquor into bonded warehouse-
(1) Any person holding a licence in the Form of BWFL-2A, BWFL-2AA BWFL-2B, BWFL-2C or BWFL- 2D shall present an application to the Collector of the importing district specifying:-
(i) The quantity and brand wise description of the Indian Made Foreign Liquor, Beer, Wine and low strength alcoholic Beverages to be imported.
(ii) The registration number and maximum retail price of Foreign Liquor, Beer, Wine and low strength alcoholic Beverages of every brand approved by the Excise Commissioner and also produce the label approval certificate of the Excise Commissioner Uttar Pradesh.
(iii) The name of the distillery, Brewery, Vintinery or Bottling Unit from which the Foreign liquor, beer, wine and low strength alcoholic beverages is to be imported in terms of bottles/cans and Bulk litres of each brand and category.
(iv) Proof of import permit fee and all types of dues along with consideration fees etc, deposited by the licence holder with original challan of depositor's copy.
(v) The route of consignment and name of concerning entry points of Uttar Pradesh and also the date by which the consignment shall reach the Bonded Warehouse.
(2) The Collector or the District Excise Officer shall, unless there is any reason to the contrary, prepare the import permit in Form FL-22 in quadruplets. One copy of the permit shall be made over to the importer licensee, the second copy shall be sent immediately to the Excise Officer of the concerned distillery, Brewery, Vintinery, or Bonded Warehouse of export, third copy shall be sent to the District Excise Officer of the concerned entry points of districts and fourth copy shall be kept for record and verification of the consignment on arrival. The permit shall also be entered into the register of import and the permit shall be in force upto the date specified in the permit.
7- 9 Receipt of liquor - No liquor shall be received in the bonded warehouse unless accompanied by a pass from the office-incharge of the distillery, Brewery, Vintinery or bottling unit from where it has been imported or transported.

10 Verification of liquor--Immediately on arrival of any consignment at a Bonded Warehouse the Officer-in-charge shall be informed and consignment shall not be stored in bonded warehouse until the same has been examined and verified with the pass by the Officer-in-charge who shall also note the result and endorse his remark in the Register BWFL-4 maintained for the purpose and also on the import pass covering the consignment. One copy of the pass with entries relating to receipt of the consignment and bearing the initial of Officer-in-charge shall be immediately returned to the officer, who issued the pass, and the second copy with entries thereon shall be kept at bonded warehouse for record.
Entries related to consignment will be filled on the portal as prescribed by Uttar Pradesh Excise department.
9- Loss in transit or storage – 7 THE UTTAR PRADESH EXCISE (SETTLEMENT OF LICENSES FOR FOREIGN LIQUOR BONDED WAREHOUSE) (NINTH AMENDMENT) RULES, 2023 8 THE UTTAR PRADESH EXCISE (SETTLEMENT OF LICENSES FOR FOREIGN LIQUOR BONDED WAREHOUSE) (NINTH AMENDMENT) RULES, 2023 9 THE UTTAR PRADESH EXCISE (SETTLEMENT OF LICENSES FOR FOREIGN LIQUOR BONDED WAREHOUSE) (NINTH AMENDMENT) RULES, 2023 10 THE UTTAR PRADESH EXCISE (SETTLEMENT OF LICENSES FOR FOREIGN LIQUOR BONDED WAREHOUSE) (NINTH AMENDMENT) RULES, 2023 6 10- 11 Storage of liquor- All liquor shall be stored in the bonded warehouse in sealed bottles unless the Excise Commissioner orders otherwise:
Provided that permission may be granted by the Excise Commissioner to grant temporary warehouse premises on bond licenses for advance storage of foreign liquor, beer, wine and low alcoholic beverages for sale in the next year on depositing the fee as prescribed by the state government.

12 Issues from Warehouse.
(1)- No liquor shall be removed from the Bonded Warehouse unless the consideration fee has been paid on it at the prescribed rate and the security codes approved by the Excise Department has been affixed on the bottles/boxes of liquor category wise and capacity wise.
(2) Foreign liquor may be issued in bond to any other Bonded Warehouse in the State in accordance with the rules governing the transport using G.P.S.(Global Positioning System) vehicles.
(3) Issues from the Bonded warehouse on payment of consideration fee through e-payment shall be made only to the FL-2 and FL-2B wholesale vendors of the State. An account of issue of liquor from the Bonded Warehouse shall be maintained in Register in form BWFL-6 and uploaded on the portal of excise department. All issues shall be made only on an application in Form BWFL-5 accompanied with treasury challan showing payment of prescribed consideration fee according to the category of the liquor.
(4) No liquor shall be removed from the Bonded Warehouse until security codes affixed on it, has been checked by the Officer-in-charge and a pass in Form BWFL-7 has been issued by him. The pass shall be prepared in triplicate. One copy of the pass shall be made over to the wholesale vendor of the foreign liquor, second copy shall be forwarded to the District Excise Officer of the district where wholesale shop is situated and the third copy shall be kept for record.
(5) Consignment of one category of liquor will be allowed from the bond licenses to more than one wholesale licenses of any one district through one vehicle.
12. Building of Bonded Warehouse-
(1) The licensee shall provide building and all articles concerned with the supply. storage, handling and issue of foreign liquor in the Bonded Warehouse. The premises of Bonded Warehouse shall be approved by the Collector of the District in which it is situated.
(2) The building or rooms of the Bonded Warehouse shall be constructed of masonry of brick work. The windows of the building or room shall be fitted with malleable iron bars not less than 20 millimeters in thickness and not more than 110 millimeter apart and fixed in the masonry or brickwork to a depth of at least 50 millimeters at each end. On the inside of each window, there shall be securely fast- end to the bars a spout wire netting the apertures which shall not exceed 25 millimeters in diameter. There shall be only one entrance to the building or main room of the warehouse and to each store room respectively which must open into the warehouse enclosure and the door of each shall be secured with a lock of Excise department. Provided that the Excise Commissioner may, 11 THE UTTAR PRADESH EXCISE (SETTLEMENT OF LICENSES FOR FOREIGN LIQUOR BONDED WAREHOUSE) (NINTH AMENDMENT) RULES, 2023 12 THE UTTAR PRADESH EXCISE (SETTLEMENT OF LICENSES FOR FOREIGN LIQUOR BONDED WAREHOUSE) (NINTH AMENDMENT) RULES, 2023 7 in special case relax any of the requirements laid down in rule on such conditions and to such extent as he may specify.
13. Hours of Attendance- The hours of attendance of the Officer In-charge deputed to look after the work of Bonded Warehouse shall be fixed by the Deputy Excise Commissioner of the Charge.
14.
13 Control of Bonded Warehouse-.
(1) No one except officer of the Excise Department, with the permission of the licensing authority, Superior Officers of the land Revenue Department, Licensee, his agents or approved servants shall be allowed to enter the Bonded Warehouse.
(2) The licensee may appoint a competent person as his Agent, whose appointment shall be subject to the approval of Deputy Excise Commissioner of the Charge. Other employees shall be employed on the recommendation of the officer-in-charge of the bonded warehouse, issued by the District Excise Officer on payment of such fees as may be prescribed by the State Government from time to time.
(3) The licensee shall furnish to the Officer In-charge a list of Agent and all the employees whose duties require them to enter the Bonded Warehouse.
(4) The Officer In-charge shall maintain a list in Form BWFL-8 containing the particulars of all employees in the warehouse as furnished by the licensee and shall forward a copy thereof to the Deputy Excise Commissioner of the charge.
(5) All person entering or going out of the bonded warehouse shall be subject to search under the direction of the Officer In-charge.
(6) If it comes to the knowledge of a licencee that any person employed by him has committed any such breach of the provisions of the Act, and the Rules made there under or of the agreements entered into by him, it shall be his duty to report the matter to the concerned Deputy Excise Commissioner through the officer in-charge and to comply with the directions of the latter Officer regarding the continued employment of such person.
(7) If any employee or agent of licencee commits any breach of provisions of the Act or of rules made there under, he shall be discontinued as employee or agent of the concerned licencee.
(8) The Officer In-charge of a Bonded Warehouse may reject and exclude from the premises any person who has committed or is about to commit any breach of the provisions of the Act and the rules made there under or who is intoxicated or disorderly, All actions under this rule shall forthwith be recorded by him in writing in his official diary for the information to his superiors.
(9) The Licencee shall be bound by all general or special instructions given by Excise Commissioner for managing affair of Bonded Warehouse in reference to issue of foreign liquor Beer/Wine/Low alcoholic beverages from Bonded Warehouse under the prior or existing Excise laws or under any law which may hereinafter be enacted, and shall cause all persons employed by him to obey all such rules for the storage and issue of liquor.

15. Price of liquor- The licensee shall not charge from whole salers more than the ex-bond price declared by him before the Excise Commissioner at the time of determining M.R.P. He will also charge consideration fee and other taxes if any from wholesaler.
16.
14Suspension, Cancellation and Penalties
(1) Licensing Authority may suspend or cancel the license and forfeit the security money and imposed fine,-
(a) if any bottle or container of liquor which does not carry security code as approved by the Excise Department, is found to be sold from the licensed premises.
(b) if any other kind of liquor or intoxicating drug for which license is not granted, is found in the licensed premises.
(c) if licensee charges from wholesaler more than the ex-bond price declared at the time of brand registration before the Excise Commissioner, except consideration fee and other taxes and duties if any.
(d) if any unauthorized security code equipment, spirit, colour, essence etc. is found in the licensed premises.
(e) if licensee has made incorrect or fraudulent entries in records which resulted in loss of revenue.
(f) if any liquor or intoxicating drug is found in the possession of the licensee against the provision of the Act or rules.
(g) if licensee fails to supply the liquor within 48 hours of the receipt of the indent for supply of same alongwith price including taxes if any.
(h) if the licencee violates any condition of the licence form.
(i) If any Adulteration with water or any other substance/dilution of liquor mixing of low category liquor with high category liquor is found in licensed premises.
Action under other relevant provisions of law shall also be taken.
(2) In case irregularities mentioned in sub-clause (1) are found, the Licensing Authority shall immediately suspend the license and issue a show cause notice for cancellation of license and forfeiture of security amount. The licensee shall submit his explanation within 7 days of the receipt of notice. Thereafter the Licensing Authority shall pass suitable orders as he deems fit.
(3) The Licensing Authority shall also recover the loss of excise revenue caused due to incorrect entries or irregularities committed by the Licensee or his salesman from the licensee after adopting the procedure of sub-rule(2).

17 15 . Stock taking and wastage- On the last working day of every month, after all the transaction for that day are made, the Officer In-charge shall take the stock of the foreign liquor stored in the Bonded Warehouse and enter into the prescribed register BWFL-9. Abstract of register of warehouse in respect of 15 the Uttar Pradesh Excise (Settlement of licences for Foreign Liquor Bonded Warehouse) (Second Amendment) Rules, 2018 10 transactions shall be submitted monthly to the concerned Deputy Excise Commissioner of the charge on the first day of every next month in Form BWFL-10. Licencee shall upload the related information through MIS (Management Information System) on the prescribed portal at fixed intervals.

16 Approval of Maximum Retail Price, Brand Registration and Label Approval-- The licensee shall furnish an exhaustive list of all the brands, its labels and the exbond rates to the Excise Commissioner for approval of Brand Registration, Label approval, MWP and MRP. No change in wholesale price and maximum retail price shall be allowed during the year unless specially permitted by the Excise Commissioner. The maximum retail price approved by the Excise Commissioner shall be printed on the labels of bottles.
On all the six faces of the cartons of foreign liquor to be imported in Uttar Pradesh, "For Sale in U.P.", embedded on the bottles itself, shall be printed in the minimum size of one inch black letters on a red strip of one and a half inch broad.
Provided that if any out of state unit desires to obtain bond licenses in various districts, approval of Brand, Label, MWP and MRP shall be done only once and no separate approvals are required for each such bond.
19. Rescission-The rules published vide Government notification no. 192/XIII-60 Dated April 5, 1929 (amended from time to time) shall be deemed to be modified upto the above extent.

CONDITIONS 1- Issue of foreign liquor from the said Bonded Warehouse shall be made to any other bonded warehouse of the State under bond or to any wholesaler FL-2 licensee of State on prepayment of consideration fee and other charges.
2- Issue of foreign liquor from the said Bonded Warehouse shall be made at such strength only as may be fixed from time to time by the Excise Commissioner, Uttar Pradesh.
3- The Officer In-charge of the Bonded Warehouse is empowered to stop with the prior sanction of the Deputy Excise Commissioner of the charge concerned, pending the orders of the Excise Commissioner, the issues of foreign liquor which he considers doubtful for consumption and is required to send samples of such foreign liquor for analysis without delay.
4- The licensee shall maintain such minimum stock of such brand at the warehouse keeping in view the demands and requirements of the particular brands by the wholesale vendors.
5- The licensee shall be responsible for the proper upkeep and storage of foreign liquor at the Warehouse. The licensee shall provide adequate number of racks, almirahs, boxes and other equipments as may be necessary for storing stocks and may also put his own lock thereon along with the lock of officer in-charge.
6- The licensee shall supply foreign liquor in bottles/flasks/cans/ aseptic brick pack of capacities as may be determined by Excise Commissioner from time to time.
7- The labels affixed to the bottles shall contain all essential printed requirements prescribed in the U.P. Bottling of Foreign Liquor Rules, 1969 as amended from time to time. The licensee shall make proper arrangement for applying the security code as approved by the Excise Department in the bond premises. No bottles/ aseptic brick pack of liquor shall be sold on which the security code approved by the Excise Department is not affixed.
8- The licensee shall be required to post his authorized Agent duly approved by the Deputy Excise Commissioner of the charge and shall arrange for the loading and unloading of the incoming consignments of foreign liquor and issues from the Bonded Warehouse. The warehouse shall be fitted with a camera having a I.P. address and should be equipped with fire fighting equipments.
9- The licensee shall keep a true and correct account of the quantity of foreign liquor received, issued and held in balance at such bonded warehouse. The account shall be correctly maintained up to date daily in a register in prescribed form. Pages of the Account Register shall be numbered and sealed with a rubber seal of concerned District Excise Officer. Pages and counterfoils of the passes covering the receipt and issues of foreign liquor shall be properly kept and shall at all times be open to inspection by the authorities of Excise Department. 10- Licensee shall be bound by all the general rules for the management of the Bonded Warehouse and for issues of foreign liquor there from.
11- Licensee shall furnish to the Excise Commissioner an exhaustive list of brands ex-bond price, maximum wholesale and maximum retail rates for approval along with registration fee for brands registration as directed by the Excise Commissioner from time to time. Licensee shall also before bringing any label into use, submit exact copies thereof in quadruplet every year with the e-treasury challan copy of approved fee of every label capacity wise as prescribed by the Excise Commissioner from time to time to the District Excise Officer of the concerned district who will forward them to the Excise Commissioner for his approval . No change in the MRP shall be allowed during the year of operation unless especially permitted by the Excise Commissioner.
12- On all the six faces of the cartons of foreign liquor to be imported in Uttar Pradesh, "For Sale in U.P." shall be printed in the minimum size of one inch black letters on a red strip of one and a half inch broad.
13- The licensee shall abide by the conditions of this licence and provisions of the United Provinces Excise Act, 1910 (U.P. Act no. IV of 1910) and the rules and orders made there under.
12 14- In case the licence is cancelled during the currency of the period of licence or is not renewed on its expiry, the licensee shall forthwith intimate the whole stock of foreign liquor held in balance at the Bonded Warehouse to the Officer In-charge and dispose off the balance stock only under directions given by the Excise Commissioner.
15- The license premises shall remain open for sale on all days from 9.00 am. to 8.00 pm by evening, except on 14th April (Ambedkar Jayanti), 15th August (Independence Day), 2nd October (Gandhi Jayanti), 26 January (Republic Day) and upto 3 more days as notified by the Collector. The Licensing Authority/ Collector may also order for closure of shop in account of law and order or General Election related activity etc. under the provisions of relevant laws. The Licensing Authority/Collector may also order for closure of shop in account of law and order or General Election related activity etc. under the provisions of relevant laws. 15. On receiving demand for wholesale supply of wine from Fl-2 licensees of the districts, the supply may be ensured on the principle of "first come and first served " failing which penal action may be taken against the licensees.
16. The labels affixed to the bottles shall carry the maximum retail price in visible words of 1x1 centimeter fixed for every brand of liquors issued from the bond. Without printed M.R.P. on the labels no sale is allowed.
17. Licencee shall ensure lifting of liquor from his godown premises in sealed cartons after scanning of security code affixed on them.
18. On all the six faces of the cartons of wine to be imported in Uttar Pradesh, "For Sale in U.P." shall be printed in the minimum size of one inch black letters on a red strip of one and a half inch broad.
19. The licensee shall submit the list of sellers to the Excise Commissioner/officer authorised by Excise Commissioner for sale of liquor at his wholesale shop. He will issue Naukarnama in prescribed form accordingly.

CONDITIONS 1- Issue of low strength alcoholic beverage from the said Bonded Warehouse shall be made to any other bonded warehouse of the State under bond or to any wholesaler FL-2B licensee of State on prepayment of consideration fee and other charges.
2- Issue of low strength alcoholic beverage from the said Bonded Warehouse shall be made at such strength only as may be fixed from time to time by the Excise Commissioner, Uttar Pradesh.
3- The Officer In-charge of the Bonded Warehouse is empowered to stop with the prior sanction of the Deputy Excise Commissioner of the charge concerned, pending the orders of the Excise Commissioner, the issues of low strength alcoholic beverage which he considers doubtful for consumption and is required to send samples of such low strength alcoholic beverage for analysis without delay.
4- The licensee shall maintain such minimum stock of such brand at the warehouse keeping in view the demands and requirements of the particular brands by the wholesale vendors.
5- The licensee shall be responsible for the proper upkeep and storage of low strength alcoholic beverage at the Warehouse. The licensee shall provide adequate number of racks, almirahs, boxes and other equipments as may be necessary for storing stocks and may also put his own lock thereon along with the lock of officer in-charge.
6- The licensee shall supply low strength alcoholic beverage in bottles/flasks/cans of capacities as may be determined by Excise Commissioner from time to time.
7- The labels affixed to the bottles shall contain all essential printed requirements prescribed in the U.P. Bottling of low strength alcoholic beverage Rules, 1969 as amended from time to time. The licensee shall make proper Photo of Applicant Photo of warehouse 20 arrangement for applying the security code as approved by the Excise Department in the bond premises. No bottles of low strength alcoholic beverages shall be sold on which the security code approved by the Excise Department is not affixed.
8- The licensee shall be required to post his authorized Agent duly approved by the Deputy Excise Commissioner of the charge and shall arrange for the loading and unloading of the incoming consignments of low strength alcoholic beverage and issues from the Bonded Warehouse. The warehouse shall be fitted with a camera having an I.P. address. The warehouse should be equipped with fire fighting equipments.
9- The licensee shall keep a true and correct account of the quantity of low strength alcoholic beverage received, issued and held in balance at such bonded warehouse. The account shall be correctly maintained upto date daily in a register in prescribed form. Pages of the Account Register shall be numbered and sealed with a rubber seal of concerned District Excise Officer . Pages and counterfoils of the passes covering the receipt and issues of low strength alcoholic beverage shall be properly kept and shall at all times be open to inspection by the authorities of Excise Department. MIS (Management Information System) of related details shall be uploaded on the prescribed portal at fixed intervals.
10- Licensee shall be bound by all the general rules for the management of the Bonded Warehouse and for issues of low strength alcoholic beverage there from.
11- Licensee shall furnish to the Excise Commissioner an exhaustive list of brands ex-bond price, maximum wholesale and maximum retail rates for approval along with registration fee for brands registration as directed by the Excise Commissioner from time to time. Licensee shall also before bringing any label into use, submit exact copies thereof in quadruplet every year with the treasury e-challan copy of approval fee of every label capacity wise as prescribed by the Excise Commissioner from time to time to the District Excise Officer of the concerned district who will forward them to the Excise Commissioner for his approval . No change in the MRP shall be allowed during the year of operation unless especially permitted by the Excise Commissioner.
12- The licensee shall abide by the conditions of this licence and provisions of the United Provinces Excise Act, 1910 (U.P.Act no. IV of 1910) and the rules and orders made there under.
13- In case the licence is cancelled during the currency of the period of licence or is not renewed on its expiry, the licensee shall forthwith intimate the whole stock of low strength alcoholic beverage held in balance at the Bonded Warehouse to the Officer In-charge and dispose off the balance stock only under directions given by the Excise Commissioner.
14- The license premises shall remain open for sale on all days from 9.00 am. to 8.00 pm by evening, except on 14th April (Ambedkar Jayanti), 15th August (Independence Day), 2nd October (Gandhi Jayanti), 26 January (Republic Day) and upto 3 more days as notified by the Collector.
