1 OFFICE OF THE EXCISE COMMISSIONER, UTTAR PRADESH, PRAYAGRAJ NOTIFICATION In exercise of powers conferred under sections 24A and 40 of the United Provinces Excise Act,1910 (U.P. Act no. 4 of 1910) read with section 21 of the Uttar Pradesh General Clauses Act, 1904 (U.P. Act no.1 of 1904), the Governor is pleased to make the following rules with a view to amend the Uttar Pradesh Excise (Grant of Bar Licenses) Rules, 2020, published vide notification no. 2759/E-2/Terah-2020-413/1987 dated Lucknow, December 15, 2020 :

THE UTTAR PRADESH EXCISE (GRANT OF BAR LICENSES) RULES, 2020

1. Short title and commencement–-(1) These rules may be called The Uttar Pradesh Excise (Grant of Bar Licenses) (Second Amendment) Rules, 2024.

(2) They shall be deemed to have come into force with effect from 1st April,2024.

2. Amendment of rule-2--In the Uttar Pradesh Excise (Grant of Bar Licenses) Rules, 2021, hereinafter referred to as the “said rules”, for existing rule 2 set out in Column-I below, the rule as set out in 21- In these rules, unless there is anything repugnant in the subject or context: -

(a) "Act" means the United Provinces Excise Act, 1910 as amended from time to time;

(b) "Bar" means the privilege granted under these rules to an establishment where food is served, for sale of Indian Made Foreign Liquor and Foreign Liquor, in loose or in sealed bottles/Can for consumption on the licensed premises;

(c) "Civil Club" means an association of persons for social and recreational purpose or for the promotion of some common object on joint expenses without motive to gain profit and duly registered under the Indian Companies Act, 1956 or Uttar Pradesh Cooperative Societies Act, 1965 or Societies Registration Act, 1860 as amended from time to time;

(d) "Commercial Club" means a duly registered company, firm, any other organization or association of persons for social and recreational purpose for the promotion of some commercial object with motive to gain profit and duly registered under the Indian Companies Act, 1956 or U.P.

Cooperative Societies Act, 1965 or Societies Registration Act, 1860 as amended from time to time;

(e) "Excise Year" means the financial year commencing from 1st April and ending with 31st March of a calendar year;

(f) "Family" means and includes spouse (husband or wife), dependent son (s), unmarried daughter

(s) and dependent parents;

(g) "Foreign liquor" means and includes beer and spirit, wines and liquors imported into India or spirits or liquors made in India, and sophisticated or coloured so as to resemble in flavour or colour as liquor imported into India and includes Malt Spirit, Whisky, Rum, Brandy, Gin, Vodka and Liqueurs. It also includes beer brewed in India or abroad, packed draught beer, porter cider, ale, wine and low alcoholic beverages (LAB);

(h) "Form" means a form appended to these rules; (i) "Food" means any substance, whether processed, partially processed or unprocessed, which is intended for human consumption;

(j) "Government" means the Government of Uttar Pradesh;

(k) "Highway" means national highway or state highway as notified by the competent authority;

(l) "Hotel" means all tourist bungalows and hotels run by the Uttar Pradesh State Tourism Development Corporation and India Tourism Development Corporation and shall also include starred hotel or any other hotel;

(m) "Hotel Bar License" means a retail license for the sale of foreign liquor granted to a hotel which makes sales to foreign and Indian tourists and visitors staying or residing in it for consumption in up to five places earmarked for serving liquor and at more than one places on deposition of an additional fee, as may be approved by the State Government;

(n) "Importing unit" means either a brand owner or principal importer or any person or entity authorized to import liquor into the country.

(o) "Individual" means a person who is the citizen of India not below the age of twenty-one years;

(p) "License" means license granted under these rules;

(q) "Licensing Authority" means the District Collector who may grant licenses of Bar with the previous sanction of the Excise Commissioner;

(r) "License fee" means an annual sum fixed in consideration to grant of the licence for exclusive privilege of retail sale of foreign liquor for consumption in Hotels, Restaurants, Clubs, Airport Transit Lounge Licence and Micro-breweries;

(s) "Proprietor" means the proprietor of a restaurant/hotel and includes any manager or occupier thereof;

(t) "Personal Home License" means the privilege granted under these rules to an individual within his/her residential premises for consumption of Indian Made Foreign Liquor and Overseas Imported Liquor by his/her own family members, relatives, guests and friends who are not below the age of 21 years.

(u) "Restaurant" means any place or premises to which public are admitted for the consumption of food or drink in lieu of consideration and includes cafe, shopping mall restaurant, restaurants run by U.P. State Tourism Development Corporation and ITDC as well as any other place where edibles are sold or consumed;

(v) "Security Amount" means the amount equal to one-fourth of the amount of license fee, to be deposited through F.D.R pledged in favour of District Excise Officer or through e-payment within 15 days of grant of license and is liable to be forfeited in case of any default committed by the licensee in the operation of bar license;

(w) "Starred Hotel" means all category of hotels which are adjudged and approved by the Hotel and Restaurant Approval and Classification Committee (HRACC) of the Department of Tourism Government of India or any other authority authorized specially for this purpose by the Government of India; Additional fee, as may be approved by the State Government.

(x) "Transport permit" means a permit issued for transport of IMFL and FL from the wholesale license such as FL-2, FL-2B, BIO-1 license having custom bond and allocation of space;

(2) Words and expressions used but not defined in these rules shall have the meanings respectively assigned to them in the Act.

31. Licenses-

(i) License in Form-F.L. 6 (Hotel Bar License) may be granted to a hotel, for the sale of foreign liquor in glasses, pegs or in sealed bottles/Can for consumption within the licensed premises but not for removing it out of the licensed premises.

(ii) License in Form-F. L 7 (Restaurant Bar License) may be granted to a restaurant, for the sale of foreign liquor in glasses, pegs or in sealed bottles/Can for consumption within the licensed premises but not for removing it out of the licensed premises.

(iii) License in Form-F. L 7 A (Club Bar License) for a civil club or a commercial club may be granted, for the purpose of supplying / serving of foreign liquor to its members including their bonafide guests in glasses, pegs or in sealed bottles/Can for consumption within the licensed premises but not for removing it out of the licensed premises.

(iv) License in Form-F.L 11 (Event Bar License) may be granted to an individual or an establishment, to sell or serve Foreign liquor in glasses or pegs for consumption within the licensed premises in the fairs, festivals or on other specified occasions of purely temporary nature, but shall not sell the liquor for removing it out of the licensed premises at such places.

(v) License in Form – F.L:AL-1 (Airport Bar Licence) may be granted to sell foreign liquor in glasses, pegs or in sealed bottles within the Airport intended for the consumption of the air passengers transiting the Airport to the extent of their eligibility under the Baggage Rules, 1978 made under the Customs Act, 1962.

(vi)License in Form – F.L:8 may be granted, to sell foreign liquor in dining cars of special purpose trains maintained by or under the supervision and control of railway administration or cruises approved by competent authority, for the purpose of supplying / serving of foreign liquor to its bona fide guests in glasses, pegs or in sealed bottles for consumption within the licensed premises but not for removing it out of the licensed premises.

(vii) License in Form PH-1 may be granted to eligible persons for purchase, transport and possession of the various category of Indian Made Foreign Liquor and Overseas Imported Liquor within their residential premises up to the quantities as prescribed by State Government time to time for the purpose of consumption by the family members, relatives, guests and friends who are no below the age of 21 years.

41. The following persons are not eligible for grant of licences:- a. persons below the age of twenty one years, b. persons who are undischarged insolvents or who have been convicted of offences under the provisions of the Act or Narcotics Drugs and Psychotropic Substances Act, 1985 (Central Act 61 of 1985) or convicted of non-bailable offences or habitual offenders.

c. persons who are in arrear of any Public or Government dues.

d. holder of any liquor bottling license or producer / manufacturer of alcohol.

e. an advocate registered with bar council or a company secretary or a chartered accountant.

f. a government servant.

52- Eligibility of Applicant of bar licence-

(i) Applicant for bar license must:-

(a) be a citizen of India: or

(b) be a company registered under the Companies Act, 1956:or

(c) be a company established under Companies Act, 2013: or

(d) be a partnership firm registered under the Partnership Act, 1932; whose partner shall be residents of India: or

(e) be a registered sole proprietorship firm: or

(f) be a Limited Liability Partnership (LLP) firm: or

(g) be a society registered under Societies Registration Act, 1860:or

(h) be a owner/proprietor/ manager/ occupier/ lessee of a hotel/restaurant:

or

(i) be above 21 years of age, if an individual: or

(j) be a registered club.

(ii) Applicant for Personal Home Licence must: -

(a) be a citizen of India;

(b) be above 21 years of age;

(¢) be the owner of proposed premises, building, house or flat wherein he/she along - with his/her family members resides; or

(d) have relevant papers regarding rent of building, house or flat wherein he/she along with his/her family members reside;

(e) be an income tax payee for the last five assessment years;

(f) have paid income tax under the tax slab of 20% for at least three assessment years out of preceding five assessment years;

62. Restrictions on the grant of licence:-

(1) A bar licence shall not be granted.

(i)If the application has not been signed by the competent person or is incomplete.

(ii)Unless the premises have :- a. Minimum capacity for seating at least 30 people.

b.A minimum plinth area of 100 Sq. Meters.

c. Sanitary equipment like wash basins and washrooms separately for ladies and gents.

d. Facility of cooking and serving complete meals of good quality to the consumers by providing of kitchen with a minimum corporate area of 15 sq metres.

f. Adequate vehicle parking arrangement (either own / valet parking / public or private parking) within 500 meters of the premises.

71- Application for grant of license-

(i) The application shall be signed:-

(a) by the individual if it is made in an individual capacity;

(b) by each partner if the applicant is partnership firm, the name with parentage and correct address of each partner shall be mentioned in the application;

(c) by the managing director or manager authorized by managing director if the applicant is a company, the registered name and address of the company shall be clearly mentioned in the application along with the names of directors, managers and managing agents;

(d) by duly elected president or secretary, if the application is made for or on behalf of a club. The application shall bear the registration number and the address of the club along with the name and address of its president and secretary.

(ii) Hotel / Restaurant / Club Bar /Airport Bar Licence:-Application for license shall be made online in Form "A” and accompanied by:- a. Non-refundable application fee;

b. Two recent passport size photographs;

c. Self-attested copies of PAN Card & Aadhar Card;

d. Proof of parking place;

e.Copy of an approved layout plan of the proposed premises;

f. If the proposed premises is being utilized by person/ institution, other than the owner of the property and building, on the basis of lease and agreement, copy of such registered agreement deed/lease/contract;

g. Omitted h. a certificate issued by competent authority for proper arrangement to fire safety in restaurant / hotel premises;

i. copy of registration issued by Food Safety and Standard Authority of India under Food Safety and Standard Act, 2006 ;

j. Character certificate issued by the District Collector or Superintendent of Police/Senior Superintendent of Police of the concerned district or an officer not below the rank of assistant commissioner of police nominated by the police commissioner of the concerning police Commissioner ate ;

k. List of five places and such additional places on payment of additional fee, earmarked for serving of liquor within the premises of a hotel;

l. In case of applicant being for Club Bar License, the application shall be accompanied with: - i. Copy of the rules for membership of the club.

ii. List of the president and other office-bearers.

iii. Memorandum of association.

iv. Articles of association.

v. A No Objection Certificate obtained from the District Collector of the place, where the club is situated, shall be produced;

m. In case of applicant being Partnership firm/ Company or LLP firm, the application shall be accompanied with: - i. Memorandum of association.

ii. Articles of association.

iii. Registration certificate of firm.

iv. List of directors/ partner.

v. Partnership deed.

vi. PAN Card.

vii. TAN Number.

viii. Aadhar Card of partners /directors.

ix. Authorisation letter to apply;

(i) An attested copy or self attested download copy from the prescribed portal , of map of the building of proposed premises approved by the concerned development Authority or local body, or any other relevant document in this regard.

(ii) Only the complete map of the building of the proposed premises will be required to be approved by the concerned Development Authority or the local body. In relation to the construction in addition to or in violation of the approved map , action will be taken as per the extant rules of the concerned Development Authority or the local body.

(iii) (a) Event Bar License: An application shall be made online in Form "B" accompanied by a non- refundable application fee.

(b) Personal Home License: An application shall be made online to Collector of the concerned district where the applicant and his/her family members reside in Form "C" accompanied by:-

(i) Two recent passport size photographs;

(ii) Self attested copy of Pan Card and Aadhar Card;

(iii) Copy of the address proof of proposed premise, building, house or flat being used for residential purpose by the applicant and his/her family members;

(iv) Copy of the proof for ownership/rent agreement of proposed premises, building, house or flat;

(v) Affidavits of adult family members (if any) in Form"PH-2" to the effect that they reside in the proposed premises along with the applicant and have no objection for grant of Personal Home License in favour of the applicant;

(vi) Affidavit of the applicant in form "PH-3" to the effect that he/she and his/her family members, residing in the proposed premises, bear good moral character and have no criminal history whatsoever and neither any case under United Provinces Excise Act, 1910(Act no. 4 of 1910 or Narcotic Drugs and Psychotropic Substances Act, 1985(Act no. 61 of 1985) is pending against any of the family members nor they have been convicted for any criminal charges by any court of India. He/she shall not allow any unauthorized person and minor to enter the Licensed Premises and also he/she shall not keep any illegal/illicit liquor or intoxicating item in the licensed premises except foreign liquor and overseas liquor allowed for sale in Uttar Pradesh within the prescribed limit.

(vii) Copy of the character certificate issued by the District Collector / Superintendent of Police/Senior Superintendent of Police or Police Officer authorized by the Police Commissioner of the concerned district.

(iv) Applicant shall furnish an affidavit duly verified by notary public:- a. that he is owner or lessee of Hotel/ Restaurant/Club or he has lease deed or consent letter of owner of the premises in accordance with the provisions of Uttar Pradesh Number and Location of Excise Shop Rules, 1968 as amended from time to time;

b. that he and his family members possess good moral character and have no criminal background and have not been convicted forany offence punishable under United Provinces Excise Act, 1910 or Narcotics Drugs and Psychotropic Substances Act, 1985 or any other cognizable and non-bailable offence;

c. that he shall produce Character certificate issued by District Collector or Superintendent of Police/Senior Superintendent of Police of the concerned district or an officer not below the rank of assistant commissioner of police nominated by the police commissioner of the concerning police Commissionerate of which he is the resident, showing that he as well as his family members possess good moral character and have no criminal background or criminal record, in case of applicant being partnership firm/company, every partner of the firm/director or manager or managing agent or a managing director of the company has a Character certificate issued by District Collector or Superintendent of Police/Senior Superintendent of Police of the concerned district or an officer not below the rank ofassistant commissioner of police nominated by the police commissioner of the concerning police Commissionerate of which he is the resident, showing that he as well as his family members possess good moral character and have no criminal background or criminal record;

d. that he shall not employ salesman or representative who has criminal back ground or has infectious diseases or is below 21 years of age or a woman;

e. that he is not in arrear of any Public or Government dues;

f. that he is solvent and has the necessary funds or has made arrangements for the necessary funds for conducting the business, the details of which shall be made available to licensing authority if required;

g. that he is neither holder of any liquor bottling license nor producer / manufacturer of Alcohol;

6 h. that he is not an advocate registered with Bar Council or a company secretary or a chartered accountant. if he is found any above after getting the license, then the licence shall be cancelled;

i. that he is not a Government servant. In case of being found Government servant, his license shall be cancelled;

j. that the premises of his establishment does not fall within purview of buffer zone/ prohibited zone of National/State Highway;

k. that he has proper and sufficient space for parking of vehicles and shall not cause traffic nuisance and in case of being found, his license shall be cancelled;

l. that he shall provide certificate issued by competent authority for proper arrangement to fire safety in restaurant / hotel premises: Provided that the above mentioned affidavit will not be required in case of event bar license.

81-District Level Bar Committee- A District Level Bar Committee constituted as below, shall examine the applications for bar licenses referred to it by the District Excise Officer and after taking into consideration the parameters laid down in rule 7 shall make recommendation to the Excise Commissioner.

92. Procedure for the grant of licence-

(1) Hotel/Restaurant/Club~ Bar/ Airport Bar Licence— a. Any person/firm/company eligible for a licence and desiring to obtain bar ficense shall apply online to the District Excise Officer in prescribed Form "A" along with prescribed fee.

b. The District Excise Officer, after making such enquiry as he may consider necessary, shall ascertain the bonafides of the applicant and verify the particulars furnished in’ the application and also examine the suitability of the premises for establishing bar and there after refer the matter to the District Level Bar committee along with his report.

c. The recommendation made by the District Level Bar committee shall be forwarded by the District Collector to the Excise Commissioner for sanction of licence to the applicant.

d. The Excise Commissioner having due regard to requirement~ and other factors as he deems fit and subject to the directions of the Government as may be issued from time to time in this regard, may approve the grant of the bar license.

(2) Event Bar Licence— a. Any person or establishment desiring to obtain an Event Bar licence shall apply online to the District Excise Officer in prescribed Form "B". along with prescribed fee.

b. The District Excise Officer, after making such enquiry as he may think necessary, to ascertain the bonafides of the applicant and verify the particulars furnished in the application and also examine the suitability of the premises and forward the same to the District Collector along with his report.

c. The District- Collector having due regard to requirement and other factors as he may deem fit and subject to the directions of the Excise Commissioner and the state Government as may be issued from time to time in this regard may grant the bar licence in form FL-11

(3) FL -8 License— a. Any person/firm/company eligible for a licence and desiring to obtain FL-8 license shall apply to the Excise Commissioner along with prescribed fee b. The District Excise Officer, after making such enquiry as he may think necessary, to ascertain the bonafides of the applicant and verify the particulars furnished in the application and also examine the suitability of the premises and forward the same through the District Collector along with his report to the Excise Commissioner.

c. The Excise Commissioner having due regard to requirement and other factors as he deems fit and subject to the directions of the Government as_may be issued from time to time in this regard, may approve the grant of the bar license.

4. Personal Home License (PH-1)— a. Any person eligible for a licence and desiring to obtain PH-1 licence shall apply online to the District Collector, b. The District Excise Officer, after making such enquify as he may think necessary shall ascertain the bonafides of the applicant and verify the particulars furnished in the application, and also examine the suitability of the premises for Personal Home ' Licence and forward the application 'to the District Collector along with his report.

c. The District Collector, having due regard to requirement and other factors as he deems fit and subject to the directions. of the Excise Commissioner and the State Government as' may be issued from time to time in this regard, may grant the Personal Home License.

d. After ‘approval of the District: Collector, the applicant shall deposit licence fee online and upload the.copy of F.D.R. as security money. District Excise Officer of the concerned district may generate Personal Home Licence in Form PH-1 with his digital signature on deposition of original F.D.R. in his office.

e. The licence holder shall be required to submit a self declaration after every six months that he is not storing liquor beyond the prescribed limits in his licenced premises . f. The licenced premises of PH-1 licence shall be inspected only with the permission of the Excise Commissioner.

10- Payment of Licence Fee- 10. Within seven days of receipt of information of sanction of licence, the applicant shall deposit the licence fee prescribed by the State Government from time to time. A security amount, shall be deposited through F.D.R or e-payment, within fifteen working days. However, if any license is granted after the commencement of the excise year then the license fee shall be charged for number of quarters remaining in the excise year including the quarter in which the licence is sanctioned. Quarterly licence fee shall be in proportion to annual licence fee determined for the excise year.

11- Issue of Bar Licence- 11. Upon approval by the Excise Commissioner, the District Excise Officer concerned, after satisfying himself that the licence fee and security has been deposited and after ensuring that the restaurant is in running condition, shall submit his report to the Collector who will issue the licence, under the signature and the seal of his office.

12- Cancellation of sanction of Ticence for default of the applicant- .(1) Where a person in whose favour licence has been sanctioned does not deposit the licence fee and security. amount as prescribed under these rules within the stipulated period of the receipt of the sanction, the Excise Commissioner upon receipt of recommendation of licensing authority may cancel the sanction issued in his favour for grant of licence and forfeit the application fee and processing fee deposited by him. (2) Where it is brought to the notice of the Excise Commissioner:—

(a) that the applicant suffers from any of the disqualifications mentioned under the Rules;

(b) that the sanction for grant of licence has been fraudulently obtained by the applicant, hiding the material facts, the Excise Commissioner shall afler giving a reasonable opportunity of being heard to the applicant, cancel the sanction issued for grant of licence and forfeit the fees and security amount paid by him;

(c) that the conditions of the license and the directions issued by the Excise Commissioner from time to time have been violated.

13- Powers to reject application- Not with standing anything contained in these rules, the Excise Commissioner shall be competent to reject any application for licence without assigning any reason whatsoever.

14- Appeals and Revisions-

(1) Any decision taken by the District Level Bar Committee shall be appealable to the Divisional Commissioner: Provided that no appeal shall be entertained under this rule unless it is preferred by the aggrieved applicant within 30 days from the date of communication of such decision.

(2) Any applicant aggrieved by an order of the Excise Commissioner passed under Rule 9 (i) (d) & (iii) (c) or an order by the Divisional Commissioner under Rule 14(i) may make an application to the State Government for revision of such order.

(3) The State Government may either suo motu or on an application by an aggrieved applicant call for and examine the records relating to any order passed in any proceedings under this rule, for the purposes of satisfying itself ~as to the correctness, legality or propriety of any such orders or as to the regularity of such proceedings; and, if in any case it appears to the State Government that such order or proceedings should be modified, annulled, reversed or remitted for reconsideration, it may pass orders accordingly: Provided that no order adversely affecting any party shall be passed under this rule unless he has been given a reasonable opportunity of making his representation: Provided further that no application under this rule shall be entertained unless it is preferred within thirty days from the date of the order of the Excise Commissioner.

151. Renewal of license-

(1) A licence granted under thesc Rules shall expire after the 31st day of March every year:

Provided that if any adverse facts regarding the operation of the said licence come into light, then the decision taken by the Excise Commissioner in relation to the renewal will be final and binding.

(2) A person possessing a licence under these rules and seeking renewal of the same except in case of liense in PH-1, shall agply one month before the expiry of 'financial year in accordance with the existing rules and such applicaion shall be accompanied by the licence fee payable under these rules, as'may be fixed by the Excise Commissioner Uttar Pradesh with the consultation of the State Government from time to time.

(3) The licensee shall be eligible for renewal of hisw licence, subject to submission of a notarised affidavit that there are no cases pending against the licensee for violation/ contravention of licence conditions or rules.

(4) The license in Ferm PH-1 may Form . be renewed for the next year on an application of the licence holder submitted before 31st March "along with the prescribed licence ‘fee and difference of security amount, if any.

16-Accounts to be maintained by all licensees-

(1) Every licensee shall maintain a correct account of all his daily transactions of liquor in a register in form F.L.25.

The licensee shall ensure use of registers duly authenticated by the District Excise Officer. The register is divided into four parts:- Part I-for inspecting officers to record the result of their inspections. Part [I-for recording of all stock receipts by the licensee Entries should invariably be made on the date on which supplies are received. A separate line should be given to each consignment and if the consignment consists of liquors of various kinds a separate line should be given to each kind of liquor also. Part IIl-for recording total sales during the day each item of sales should be shown separately. Part-IV-for recording the total receipt of each kind of liquor during the day and the total sales the figures of receipt will be obtained from part-II and those for sales will be obtained by totalling the entries for the day as shown in part-IIL.

(2) (Account register shall be uploaded on online and produced for inspection whenever asked by the competent inspecting authority. The licensee shall furnish account of sales etc. and facilitate and provide the material, documents and F.L.-36 passes as required by the inspecting authority.

(3) He shall also maintain such other returns as may be prescribed by the Excise Commissioner.

(4) Person holding an Event Bar license shall maintain a correct account of all his daily transactions of liquor in the form prescribed in the license F.L.11.

17- On death of a licensee(s) - 17. If a bar licence is held by an individual or is jointly held by two or more partners, in the event of death of licensee or one of partners, on an application made to the Excise Commissioner, license may be mutated in the name of the survivors along with the legal heir(s) of deceased, subject to fulfilment of eligibility conditions. Provided they are not found otherwise ineligible after considering the application made for the mutation of license. No distinction will be made between the legal liabilities of the partners who will be jointly and severally responsible.

18. Sale-purchase of hotel and restaurant - In case, an application is made to the Excise Commissioner in the respect of sale-purchase of hotel and restaurant or in the change of its management and ownership, license may be mutated in the name of new owner/manager subject to fulfilment of eligibility conditions. Provided they are not found otherwise ineligible after considering the application made for the mutation of license.

19. Licensee not to declare any person to be or not to be his partner- 19. No licensee shall, except with the prior permission of the Excise Commissioner get any other person, who is not ineligible under Rules, be included as partner to his business, or get an existing partner excluded so long as the partnership nature of the business does not change: Provided that the Excise Commissioner may, after such enquiry as he may deem fit, permit the licensee at his request, to get any person(s) included as partner(s) or excluded any existing partner(s), so long as the partnership nature of the business does not change, on payment of a fee of 10% of the annual license fee: Provided further that where there is dissolution of partnership it shall be notified to the Excise Commissioner.

20- Shifting of bar licences from one premises to another premises- Shifting of the licensed premises may be permitted once during the license period from one location to another by the Excise Commissioner, subject to recommendation of district level bar committee that the new premises conforms to the conditions laid down under the Rules on payment of a fee of 10% of the annual licerise fee.

21- Geo-tagging of bar- 21. Every hotel/restaurant/club shall be geo-tagged in order to ensure location of bar.

22. Rule to have overriding effect - In case there is any conflict between provisions of The Uttar Pradesh Excise (Grant of Bar Licence) Rules,2020 and rules relating to the Uttar Pradesh Licensing under the Surcharge Fee System Rules, 1968 published vide nctification No. 36/11-619-B, dated April 2,1968 and Retail Vend of Foreign Liquor other than Denatured Spirit framed under the U.P. Excise Act, 1910 (as amended time to time) published vide notification no. 9473/XH1-2-213, dated March 25, 1926 as well as Uttar Pradesh Cluh (Possession of Foreign Liquor Permit) Rules, 1980 published vide notification no. 6144-E/X111-637-77 dated November 10, 1980 the Uttar Pradesh Excise (Grant of Bar Licence) Rules,2020 shall prevail.

231.- Status of Bar licences issued before commencement of these rules-

(i) Any Bar licence issued for retail sale of foreign and Indian made foreign liquor to.any hotel or restaurant or club for the financial year 2020-2021 under the Uttar Pradesh Excise Act, 1910 or the rules framed- there under or under any corresponding law before the commencement of these rules, shall remain valid and continue till publication of Uttar Pradesh Excise (Grant of Bar Licenses) Rules, 2020 in the Gazette: Provided that all the bar-licences existing before the commencement of these shall be entitled for renewal. ) rules

(ii) All beer bar licences granted under earlier rules may be deemed to operate in the following manner:

(a) Hotel beer bar licence F.L.-7B shall stand mutated into Form FL.-6 bar licence.

(b) Restaurant beer bar licence F.L.-7B shall stand mutated into Form F.L-7 restaurant bar licence.

1- UTTAR PRADESH EXCISE (GRANT OF BAR LICENSES) RULES, 2022 10 241-Amendment of rule:- Hours of Business:- The Licensee shall transact business from 10.00 AM to 12.00 PM:

Provided that the Excise Commissioner with the approval of the Government may bring about any change during the course of licence period in the hours of business and the licensee shall observe such changed timings accordingly.

The duration of the event bar license will be decided by the applicant and will be mentioned in the application form, but this duration will be maximum 12 hours only and will be till 12 midnight only. Serving time of liquor for F.L.8 licenses shall be granted for duration of journey in the state subject to condition imposed by the district administration:

Provided that the serving and consuming time of liquor for a category of licences situated within a geographical location may be extended on the payment of additional annual license fee as may be fixed by the Excise Commissioner with previous approval of the state government.

25- Dry day- The licensed premises shall be closed and no business transacted on the following days declared as dry days:- ()26 January - Republic day (b) 14th April - Ambedkar Jayanti © ]5"l August - Independence day (d) 279 October - Gandhi Jayanti and (€) up to 3 more days as notified for closure by the Licensing Authority Licensing Authority may also order for closure of bar on account of law and order or General Election related activity under the provisions of relevant laws: Provided that the licensee shall not be entitled to any compensation whatsoever for the closure of the licensed premises.

26. Disposal of unsold / remainder stock at the expiry of financial year- Any balance stock of foreign liquor found outstanding and unsold at the - expiry of the financial year, shall be declared by licensee to the licensing authority on next day of expiry of financial year. The disposal of such stock shall be made as per directions of the Excise Commissioner in this regard.

27. Disposal of stocks on cancellation or non-renewal or surrender of licence - In case the licence is cancelled or surrendered during the currency of the period of licence or is not renewed on its expiry, the licensee shall forthwith intimate the stock of foreign liquor held in balance at the licensed premises to the Licensing Authority and dispose the balance stock only under directions given by the Excise Commissioner.

281-. Imposition of special fee- Special fee shall be leviable on the consumption of every bottle of foreign liquor and beer at the rate as may be prescribed by the State Government from time to time. License holder shall deposit entire special fee in advance. FL-36 passes issued by wholesale licensee of FL-2,FL-2B and BIO-1/ BIO-1A shall bear the description of amount of special fee paid.

29. Foreign Liquor shall not be given or sold to certain persons - No foreign liquor shall be sold or given to the following persons namely:-

(a) Lunatics;

(b) Persons known or believed to be in a state of drunkenness;

(c) Persons about whom it is known or suspected that they are likely to participate in the commission of sedition, insurrection, breach of peace or any other similar offence threatening public peace and tranquillity;

(d) Persons below (21) years of age.

301. Sale of only duty paid foreign liquor-

(1) The licensee shall sell only duty paid foreign liquor, as the case may be, to the customers in sealed bottles or pegs for consumption within the licensed premises only but not for removing it out of the licensed premises.

(2) The licensee shall purchase foreign liquor from license holder of FL-2, FL-2B, BIO-1/BIO-1A or from any licensee authorised by the Excise Commissioner.

(3) The licensee may sell drought beer manufactured in a Micro brewery for which he possesses valid licence in Form MB-1

(4) The licensee shall not stock or sell in the licensed premises foreign liquor except those stocks purchased from the 1- UTTAR PRADESH EXCISE (GRANT OF BAR LICENSES) RULES, 2025 11 permitted wholesalers/ BIO-1/ BIO-1A importing unit having custom bond or allocation of space in custom bonds, of any kind which he is authorized to buy, stock or sell under the provisions of Act or Rules, Regulations or Orders made there under.

(5) The licensee shall not stock foreign liquor in any place other than the licensed premises. The licensee shall be held responsible for any foreign liquor unauthorizedly kept outside or nearby the licensed premises.

(6) The licensee shall transport foreign liquor to the license premises through transport passes issued under relevant rules.

(7) Every bottle of foreign liquor in a bar shall carry labels prescribed by Excise Commissioner on the cap of the bottle in addition to the manufacturer’s label and security code.

31. Foreign liquor not to be. Adulterated

(1) The foreign liquor offered for sale or stored in.the licensed premises shall not be of substandard, deteriorated, spurious or adulterated and the licensee shall not tamper with the Indian Made Forgign Liquor and Foreign Liquor in any manner so as to alter their quality, strength, nature orquantity.

(2) If in an inspection of any officer competent for the inspection, on finding any foreign liquor unfit for use, substandard, adulterated or spurious or in respect of which it is believed that some substance has been admixed so as to make it unfit for consumption by any process or manner, inspecting authority may stop it from being sold and seize the same forthwith and take necessary further action as per the provisions of the Act.

32. Notwithstanding any permit/license granted by any authority, gambling, dancing, any other acts of disorderliness or obscenity within the licensed premises shall be strictly prohibited.

33. A licensee may surrender his license afier giving at least one month's notice in writing to the licensing authority and on receipt of such notice the licensing authority will take steps for recovering all outstanding excise dues from. his security deposit and refund the balance amount after obtaining orders of the Excise Commissioner.

34. The licensee shall use only standard measures, as may be prescribed by the Excise Commissioner from time to time.

The measures should be got duly stamped by the Department of Weights and Measures. 35. Persons, who are known or believed to have been convicted of any nonbailable offences, who are prostitutes and habitual offenders, shall not be employed nor shall they be allowed to assemble or remain in the licensed premises, and if such persons visit licensed premises the matter shall be forthwith reported to the nearest Police Station by the licensee.

36. Matter of compoundable breaches pertaining to bar licenses such as set out below shall be imposed with minimum compounding fee :- The licensing authority may compound the offences committed and punishable under the Act mentioned in column-2 with the amounts specified in column 3,4 and 5 of the schedule below.

(1) Licensing Authority may suspend or cancel the licence:- (a ) If any bottle is found in licensed premises on which m consideration fee has not been paid and which does not carry security code duly approved by the Excise Department.

(b) If any other kind of liquor or intoxicating drug (for which licence is not granted) is found in the licensed premises or if any other business is found to be carried on.

(c) If any liquor of intoxicating drug is found in the possession of the licensee against the provisions of the Act or Rules.

(d) If the Affidavit submitted by the licensee at the time of application is found incorrect and assertions made therein are found to be false.

(e) If the licensee is convicted of any offence punishable under the Act or of any cognizable and non-bailable offence, or any offence punishable under Narcotics Drugs and psychotropic substance Act, 1985.

(f) If any bottle / container is found in the licensed premises on which maximum retail price is not printed: or .

(g) if it is found that the licence has been obtained in a false Me and the licensee is holding the licence on behalf of some other person.

(h) If any adulteration or dilution of liquor or mixing of low category liquor with high category liquor is found in the licensed premises.

(2) The Licensing Authority shall immediately suspend the license and also serve a show cause notice for cancellation of licence and for forfeiture of security deposit. The licensee shall submit his explanation within 7 days of the receipt of notice. Thereafter, the licensing authority shall pass suitable order after giving due opportunity of hearing to the licensee, if he so desires.

(3) In case the license is cancelled for any violation of the rules and the conditions of license, the license fee and security deposited by him shall stand forfeited in favour of the Government and the licensee shall not be entitled to claim any compensation or refund for suspension or caricellation of license under this rule. Such licensee may also be blacklisted and debarred from holding any other excise licence.

38- If there is any doubt or dispute regarding the application or iitsrpretation of any of these rules, the decision of the Excise Commissioner thereon shall be final.

SPECIAL CONDITIONS

3. Sales shall be made from 10:00 am to 12 :00 night or such other extended time on the payment of additional fee as may be fixed by the Excise Commissioner.

4. At the entrance to the licensed premises a signboard shall be affixed on which name of the licence-holder and designation " Licensed F.L. 6 Hotel Bar" shall be painted.

5. The licence-holder shall display the following warning at a prominent place on the above premises.

"Drinking is injurious to health".

6. Liquor may be sold only in sealed bottles/can or pegs (one peg equal to 60 ml. and half peg equal to 30 ml) except beer. Beer obtained In kegs of 20 litre ,30 litre or 50 litre may be sold in pegs.

7. Every bottle of liquor meant for serving and consumption must carry labels prescribed by Excise Commissioner.

8. Licence holder shall be entitled to get supplies of liquor in standard bottle from wholesale licensee holding licence in form F.L.-2, F.L.2 B & BIO-1./ BIO-1A.

9. Any addition of deleterious or noxious substance in the liquor shall be punishable under Relevant Section of U.P.Excise Act.1910.

10. It shall be strictly prohibited to carry arms in the licensed premises.

11. Signboard shall essentially display the following information inter alia other things;

(I) To carry the arms inside the premises is strictly prohibited,

(ii) Don’t drink and drive. Drunken driving is fatal to the life.

12.The licensed premises shall remain open for serving and consumption of liquor on all days except on 14th April (Ambedkar Jayanti), 15th August (Independence Day), 2nd October (Gandhi Jayanti), 26th January (Republic Day), and up to 3 more days as notified for closure by the Licensing Authority. Licensing Authority may also order for closure of bar on account of law and order or General Election related activity under the provisions of relevant laws.

No compensation shall be given for the closure of bar on above grounds.

13. The licence -holder shall be bound to observe all rules incorporated from time to time in the Excise Manual Volume I and directions passed by the Excise Commissioner, Uttar Pradesh from time to time.

5. The licence-holder shall display the following warning at a prominent place on the above premises.

"Drinking is injurious to health".

6. Liquor may be sold in sealed bottle /can or pegs (one peg equal to 60 ml. and half peg equal to 30ml) except beer. Beer obtained in kegs of 20 litre, 30 litre or 50 litre may be sold in pegs.

4. Sales shall be made from 10:00 am to 12 :00 night or such other extended time on the payment of additional fee as may be fixed by the Excise Commissioner. The licence-holder shall display the following warning at a prominent place on the above premises.

22 SPECIAL CONDITIONS

(1) Liquor shall be served only at the licensed premises and the liquor shall be consumed on the premises.

(2) Liquor shall be brought to the licensed premises on the very day of organising function after purchasing from nearby retail shop of foreign liquor/ beer as adverted by the applicant in his application.

(3) Details of liquor sold by the salesman of retails shop of foreign liquor and beer shall be printed on the back page of this form of licence.

(4) Liquor shall not be served by any minor or any woman.

(5) Person employed for serving liquor should not suffer from any infectious or contagious disease.

(6) The liquor purchased for the specific organisation/event shall be consumed during the sanctioned period and shall not be consumed on another function. Failing which, licensee shall be liable to punishment under Relevant Section of U.P.

Excise Act.1910.

(7) Consumption of liquor other than obtained through this license shall be punishable under the Relevant Section of U.P.

Excise Act.1910. For this organiser of function and manager/owner of venue of organisation shall be jointly and severally responsible.

(8) Any sort of non-cooperation, incivility or indecorous treatment with the inspecting authority shall be punishable under Relevant Section of U.P. Excise Act.1910.

(9) Any addition of deleterious or noxious substance in the liquor shall be punishable under Relevant Section of U.P.Excise Act.1910.

(10) The duration of operation of event bar/function bar license will be decided by the applicant and will be mentioned in the application form, but this duration will be maximum of 12 hours only and will be till 12 midnight only.

(11)Licensee shall be responsible for any misdemeanour and boorish treatment meted out to any guest specially women present in the function.

(12)Licensee can get supply of foreign liquor in standard bottle and beer in standard bottle/can of any capacity.

(13)Every bottle of liquor meant for serving and consumption must carry labels prescribed by Excise Commissioner.

(14)It shall be strictly prohibited to carry arms at the venue of organising event/function.

(15)This licence shall remain inoperative on 14 April (Ambedkar Jayanti), 15 August (Independence Day), 2 October (Gandhi Jayanti), 26 January (Republic Day) and on other dry days declared by the licensing authority.

(16) The licence-holder shall maintain regular and accurate accounts in the following form. and shall produce the same for inspection on the requisition of any officer authorised by Government to demand their production and shall furnish to the District Collector a full account of sales made under the authority of this licence on its expiry:
