63. (1) The Uttar Pradesh Jagadguru Rambhadracharya Divyang University Act, 2001 (Act no. 32 of 2001) and the Uttar Pradesh Jagadguru Rambhadracharya Divyang State University Ordinance, 2023 are hereby repealed.
(2) Notwithstanding such repeal all appointment made, orders issued, degrees and other academic distinctions conferred, diplomas and certificates awarded, privileges granted, or other things done (including the registration of graduates) under the Uttar Pradesh Jagadguru Rambhadracharya Divyang University Act, 2001 (U.P. Act no. 32 of 2001) shall be deemed to have been respectively made, issued, conferred, awarded, granted or done under the corresponding provisions of this Ordinance and, except as otherwise provided by this Ordinance or the Statutes, continue in force unless and until they are superseded by any order made under this Ordinance or the Statutes.
(3) Notwithstanding such repeal anything done or any action taken. Under the Uttar Pradesh Jagadguru Rambhadracharya Divyang State University Ordinance, 2023 shall be deemed to have been done or taken under the corresponding provision of this Act.
The Uttar Pradesh Jagadguru Rambhadracharya Divyang University Act, 2001 (U.P. Act no. 32 of 2001) has been enacted to establish and incorporate a University sponsored by Jagadguru Rambhadracharya Divyang Siksha Sansthan, Chitrakoot Dham in the State.
Due to his inability to operate the University owing to his old age and limited financial resources, the Chancellor of Jagadguru Rambhadracharya Divyang University requested the State Government to incorporate it as a State University.
In view of the above, the memorandum of understanding between the State Government and the Chancellor Raghviyo Jagadguru Swami Rambhadracharya to incorporate and establish the aforesaid University as a State University was approved by the Cabinot on 31.01.2023. On the basis of the said memorandum of Understanding, it was decided to establish Jagadguru Rambhadracharya Divyang Vishwavidyalaya as a State University.
Since the State Legislature was not in session and immediate legislative action was necessary to implement the aforesaid decision, the Uttar Pradesh Jagadguru Rambhadracharya Divyang Vishwavidyalaya Ordinance, 2023 (Uttar Pradesh Ordinance no. 13 of 2023) was promulgated by the Governor on July 18, 2023.
The Uttar Pradesh Jagadguru Rambhadracharya Divyang State University, Bill 2023 is introduced to replace the aforesaid Ordinance.
