NOTIFICATION No.07/2017/545/XXIX-7-2017-Writ-07/2017 Lucknow :Dated: October 12 , 2017 The Uttar Pradesh Kerosene Control (Fourteenth Amendment) Order, 1994 which was issued on April 19, 1994 with Notification No.584/XXIX-7-69(PP)/91 but could not be published in the Gazette is hereby published as follows with such modification as is necessary to regulate the things done and actions taken in pursuance of the provisions of the Uttar Pradesh Kerosene Control Order, 1962 as amended by the said amending order of 1994:- "NOTIFICATION No.584/XXIX-7-69(PP)/91 Dated: Lucknow : April 19,1994 In exercise of the powers under section-3 of the Essential Commodities Act,1955 (Act No. X of 1955) read with the Government of India, Ministry of Industry and Civil Supplies (Department of Civil Supplies and Co-operation) Order No. S.O. 681 (E) dated November 30, 1974 and Section 21 of the General Clauses Act, 1897(Act no.10 of 1897), the Governor is pleased to make the following order with a view to amending the Uttar Pradesh Kerosene Control Order, 1962.
THE UTTAR PRADESH KEROSENE CONTROL (FOURTEENTH AMENDMENT) ORDER, 1994 Short title, extent and commencement
1. (1) This order may be called the Uttar Pradesh Kerosene Control (Fourteenth Amendment) Order, 1994
(2) It shall extend to the whole of Uttar Pradesh .
(3) It shall come into force with effect from the date of issuance of this notification i.e. April 19, 1994.
Amendment of clause-2
2. In the Uttar Pradesh Kerosene Control Order, 1962, hereinafter referred to as the said Order, in clause 2 for subclause(e) the following sub-clause shall be substituted, namely:- "(e) 'Licencing Authority' means the District Magistrates of the district and includes the Additional District Magistrate (Civil Supplies) or the District Supply Officer of the district authorised by him to perform any of the functions of Licencing Authority under this order."
Amendment of clause-6
3. In the said order, in clause 6 in sub-clause (IV) the words "or renewed" shall be omitted.
Substitution of clause 8
4. For clause 8 of the said order, following clause shall be substituted, namely:- "One time licence
8. A licence granted under this order shall be one time licence and shall be valid unless cancelled by the licensing authority under this order:
Provided that a licence granted before the commencement of the Uttar Pradesh Kerosene Control (Fourteenth Amendment) Order, 1994 shall be valid for a period for which it is granted and if the licencee at his option applies for one time licence before the expiry of period of validity of the existing licence, in that case, the proportionate fee of the remaining period of the existing licence shall be adjusted towards the fee prescribed for one time licence."
Amendment of clause-10
5. In the said Order, in clause 10
(a) for sub-clause (i) the following sub-clause shall be substituted namely:- "(i) The fees prescribed below shall be chargeable for issue of licence :
(A) Licence in Form III
(a) for issue of licence Rs. 5,000.00
(b) for issue of duplicate licence Rs. 500.00 (B) Licence in Form III A
(a) for issue of licence Rs.1,050.00
(b) for issue of duplicate licence Rs 200.00 (C) Licence in form IV
(a) for issue of licence Rs. 250.00
(b) for issue of duplicate licence Rs. 100.00
(b) (b) in sub-clause (ii) the words "for renewal of licence or" appearing after the words " licence fee" and the words "renewal or "appering after the word "application" shall be omitted."
Amendment of clause-11
6. In clause 11 of the said order,
(a) in the marginal heading the words "and refusal to renew a licence "shall be omitted;
(b) the words "or refuse to renew a licence" and in the first proviso the words "or its renewal" shall be omitted.
Amendment of clause-12
7. In clause 12 of the said order, for sub-clause(i) the following sub-clause shall be substituted, namely:- "(1) any person aggrieved by the cancellation of his licence may within thirty days of the communication of the order prefer as appeal to the concerned Divisional commissioner or to such other Officer as nominated by the State Government in this behalf."
Amendment of schedule
8. In the Schedule to the said Order,
(a) in Form I, in the heading, the words "or for renewal of such licence "shall be omitted;
(b) in form I-A, in the heading, the words "or for renewal of such licence "shall be omitted;
(c) in form II, the heading, the words "or for renewal of such licence "shall be omitted;
(d) in each of the Form III Form IIIA and Form IV, the following shall omitted:- "Renewal Endorsement Date of renewal Date of expiry Signature of Lincencing Authority Remarks" 1 2 3 4 By Order, Shitla Prasad Special Secretery.

(1) यह आ�ा उ� तर �देश �म�ी का तेल �नयं�ण (चौदहवा ं सशंोधन) आ�ा, 1994 कहा जायेगा।
(2) इसका �व� तार स� पणू� उ� तर �देश म� होगा।
(3) यह इस अ�धसूचना के जार� �कये जाने के �दनाकं अथा�त 19 अ�लै, 1994 से �व�ृ त होगा। ख� ड 2 का संशोधन 2 यह उ� तर �देश �म�ी का तले �नयं�ण आ�ा, 1962, िजसे आगे उ� त आ�ा कहा गया है, म� ख� ड-2 म�, उप ख� ड (ड) के � थान पर �न� न�ल�खत उप ख� ड रख �दया जायेगा, अथा�त, (ड) '' लाईस�स �ा�धकार� का ता� पय� िजले के िजला मिज� �ेट से है और इसके अ� तग�त अपर िजला मिज� �ेट (नाग�रक आपू�त�) या िजले का िजला पू�त � अ�धकार� भी है िजसे उसके �वारा इस आदेश के अधीन लाइस�स �ा�धकार� के �क� ह�ं कृ� य� का स� पादन करने के �लए �ा�धकृत �कया जाय। ख� ड 6 का संशोधन 3 उ� त आ�ा म�, ख� ड-6 म�, उप ख� ड (4) म� श� द ''न नवीनीकरण �कया जायेगा'' �नकाल �दये जाय�गे। ख� ड 8 का ��त� थापन 4 उ� त आ�ा के ख� ड-8 के � थान पर �न� न�ल�खत ख� ड रख �दया जायेगा, अथा�त:- ''एक बार का लाइस�स 8- इस आ�ा के अधीन � वीकृत लाइस�स एक बार का लाइस�स होगा और तब तक �व��यमा� य होगा जब तक इस आ�ा के अधीन लाइस�स �ा�धकार� �वारा �नर� त न कर �दया जाय। ��तब� ध यह है �क उ� तर �देश �म�ी का तले �नयं�ण (चौदहवां सशंोधन) आ�ा, 1994 के �ार� भ होने के पूव� � वीकृत कोई लाइस�स उस अव�ध के �लए िजसके �लए वह � वीकृत �कया जाए �व��यमा� य होगा और य�द लाइस�सधार� अपन े�वक� प पर वत�मान लाइस�स क� �व��यमा� यता अव�ध के अवसान के पवू� एक बार का लाइस�स के �लए आवेदन करता है तो उस ि�थ�त म� �व�यमान लाइस�स क� अवशषे अव�ध क� आनुपा�तक फ�स एक बार का लाइस�स के �लए �व�हत फ�स के ��त समा योिजत �कया जायेगा।'' ख� ड 10 का संशोधन 5 उ� त आ�ा म�, ख� ड 10 म� :- (क) उप ख� ड (एक) के � थान पर �न� न�ल�खत उप ख� ड रख �दया जायेगा, अथा�त:- ''(एक) लाइस�स जार� करन ेके �लए नीच े�नयत �कये गये शु� क �लये जाय�गे:- (क) �प� 3 म� लाइस�स (क) लाइस�स जार� 5,000.00 �पये करन ेके �लए (ख) लाइस�स क� दसूर� ��त 500.00 �पये जार� करन ेके �लए (ख) �प� 3 क म� लाइस�स (क) लाइस�स जार� 1,050.00 �पये करन ेके �लए (ख) लाइस�स क� दसूर� ��त 200.00 �पये जार� करन ेके �लए (ग) �प� 4 म� लाइस�स- (क) लाइस�स जार� 250.00 �पये करन ेके �लए (ख) लाइस�स क� दसूर� ��त 100.00 �पये जार� करन ेके �लए (ख) उप ख� ड (दो) म� श� द ''लाइस�स के नवीनीकरण के �लए'' या और श� द ''यथाि�थ�त नवीकरण या'' �नकाल �दये जाय�गे। ख� ड 11 का संशोधन 6 उ� त आदेश के ख� ड 11 म�:- (क) (ख) पा� व� शीष�क म�, श� द ''और लाइस�स नवीकरण करन े से इ� कार करना'' �नकाल �दये जायेग�, श� द ''या �कसी लाइस�स का नवीकरण करन ेसे इ� कार कर सकता है'' और �थम पर� तकु म� श� द ''या उसका नवीनीकरण करन ेसे इ� कार करने'' �नकाल �दये जायेग�। ख� ड 12 का संशोधन 7 उ� त आदेश के ख� ड 12 म�, उप ख� ड (एक) के � थान पर �न� न�ल�खत उप ख� ड रख �दया जायेगा, अथा�त:- ''(एक) कोई � यि�त जो अपन ेलाइस�स के �नर� त �कये जाने से � य�थत हो, आ�ा को सू�चत �कये जान े के �दनाकं से तीस �दन के भीतर स� बि�धत मडंल�य आयु� त या ऐसे अ� य अ�धकार� को िजसे रा� य सरकार �वारा इस �न�म� त नाम�न�द�� ट �कया जाय, अपील कर सकता है।'' अनसुचूी का संशोधन 8 उ� त आ�ा क� अनुसूची म� :- (क) �प� 1 म�, शीष�क म�, श� द ''अथवा ऐसे लाइस�स के नवीकरण के �लए'' �नकाल �दये जायेग�, (ख) �प� 1-क म�, शीष�क म�, श� द ''अथवा ऐसे लाइस�स के नवीकरण के �लए'' �नकाल �दये जायेग�, (ग) �प� 2 म�, शीष�क म�, श� द ''अथवा ऐसे लाइस�स के नवीनीकरण के �लये'' �नकाल �दये जायेग�, (घ) �प� 3, �प� 3-क और �प� 4 म� �� येक स े�न� न�ल�खत को �नकाल �दया जायेगा:
