No. 13/2023/380/ LXXX-1-2023-600(20)-1994 Dated Lucknow, September 19,2023 IN exercise of the powers under sub-clause (b) of clause (iii) of section 17 of the Uttar Pradesh Krishi Utapadan Mandi Adhiniyam, 1964 (U.P. Act no. XXV of 1964), the Governor is pleased to make the following order:- THE UTTAR PRADESH KRISHI UTPADAN MANDI (CRUSHER UNITS GUR AND KHANDSARICOMPOUNDING OF MARKET FEE) ORDER, 2023
1. (1) This order may be called the Uttar Pradesh Krishi Utpadan Mandi Short title and (Crusher Units Gur and Khandsari) (Compounding of Market Fee) Order, 2023. commencement
(2) It shall be deemed to have come into force with effect from the beginning of ;t'l:;c sugar year dated 1* October, 2022 and shall be effective up to 30" September,
2023.
2. In this order- Defenitions
(a) "Act" nieans the Uttar Pradesh Krishi Utpadan Mandi Adhiniyam, 1964 (U.P. Act no. XXV of 1964) ;
(b) "Agricultural Ycar" means a Period of twelve months commencing from the first day of july of a calendar year;
(<) "Form" means a form appended to this order;
(d) "Sugar Year" refers to a period of twelve months commencing from the first day of October of a calendar year;
(€) "Crusher Unit" means a unit producing or processing on¢ o more of the specified agricultural produce mentioned in the schedule and Ticensed as such by the Market Committee.
3.Subject to the provisions of this order, any trader who has a valid licence of market committee, as a crusher unit, may exercise his option for payment of lump-sum amount ir lieu of such an amount of ‘market fee which may be due against him in the sugar year 2022-2023:
Provided that this scheme shall be implemented by any Market Committee where at least thirtypercent units situated in the market area opt for the scheme.
4.Any trader licenced as crusher unit, who opts to pay the Tump-sum amount shall submit his application in Form no.1 to the market committee within 30 days from the date of publication of this order in the Gazette.
5.As soon as the application mentioned in clause 4 is received, the market committee shall assess the Tump-sum amount of the due market fee and development cess payabic in the manner prescribed herein.

7. 1f the crusher unit is turbine-equipped, then the compounding amount will be 10 percent morc than the previous amount mentioned for each size for the year 2022-2023,
8. If any crusher unit licencee trader has paid any amount of market fee in respect of sugar year 2022-2023 and he opts to pay 2 lump-sum amount in fieu of market fee that may be payable by him, then the amount of market fee paid shall be deducted from the amount of lump-sum determined as per this notification.
9. After deduction, if any amount remains i balance then that will be adjusted in the next year, and after that if any amount remains in balance then its adjustment will be made in forthcoming years. It will not be given by the market committee. °
10.The crusher unit shall get the gate pass of its production online from the market committee. On online application of crusher unit, the market committec shall issue the gate pass within maximum two hours.
11. After exercising the option for the scheme, no market fee except the lump-sum amount shall be payable till the end of the sugar year 2022-2023. If any trader induiges in the salé and purchase of the specified agricultural produce mentioned.in the schedule, apart from the quantity produced or processed in his crusher unit, he shall have to pay market fee and development cess at the prevailing rate on each transaction of sale and purchase of that quantity. This amount shall be in addition to the lump-sum amount.
12. (1) At the end of the year, the Market Committee shall determine that the trader has issued gate passes according to the production capacity of his unit. For this purpose, the crusher unit shall have to furnish the monthly stock position to the respective committee every month.
(2) For the aforesaid purpose, traders shall be bound to submit the records, required by the Market Committee. Market committee is authorized to inspect crusher unit at any reasonable time.
13. (i) If any dispute arises in respect of payment of any amount of lump-sum, it shall be decided by the concerned market committee, by a speaking order, after giving the parties reasonable opportunity of being heard.
(ii) A revision under section 32 of the Act may be filed within 30 days or within such time as may be extended in appropriate cases by the Director against the decision of the market Committee.
14. The trader who has opted for this scheme, shall pay the required lump-sum amount of the year in two equal instailments. First installment shall be deposited at the time of application and second installment shall be deposited within 30 days.
15. If any amount of lump-sum remains unpaid afer it becomes due, it shall be recovered in accordance with section 20 of the Act.
